2. The Overview of the e-tender:

The Office of the Commissioner, Commercial Taxes, West Bengal wants to procure 09 (nine) UV

based Water Purifiers-cum-Coolers, from bidders dealing in the products of Eureka Forbes Ltd. /

Blue Star Ltd. / KENT RO Systems Ltd. only, for use in its office. The present e-tender is floated to

invite rates of UV based Water Purifiers-cum-Coolers along with pre-attachment (Bag Filter and

Iron Remover) and Comprehensive Annual Maintenance Contract (CAMC) / Warranty Coverage

of Water Purifiers-cum-Coolers and their parts and attachments for 03 (Three) years (1 + 2) as

per specifications and requirements of the same as appended in Annexure - A of this document.

For Comprehensive Annual Maintenance Contract (CAMC) / Warranty Coverage clauses please

refer to Point No. 8.

3. Scope of Work:

The selected bidder(s) shall remain responsible for supplying, installation, testing &

commissioning of 09 (nine) UV based Water Purifiers-cum-Coolers along with pre-attachment

(Bag Filter and Iron Remover) as may be directed by the Office of the Commissioner, Commercial

Taxes, West Bengal. Supply, installation, testing & commissioning of materials / articles shall have

to be made within 30 days from the receipt of Work Order / Purchase Order from the Office of

the Commissioner, Commercial Taxes, West Bengal. The selected bidder(s) shall also remain

responsible for providing Comprehensive Annual Maintenance Contract (CAMC) / Warranty

Coverage of Water Purifiers-cum-Coolers and their parts and attachments for 03 (Three) years (1

+ 2).

4. Eligibility Criteria:

11. Authorized Signatory of the Bidder. Power of Attorney in the name of person

signing the Bid, authorizing him to

submit / execute this as a binding

document.

Joint Venture / consortium of companies are not allowed for bidding in this RFP / tender.

� Even though the bidders meet the above qualifying criteria, they are subject to be

disqualified if they have: (i) Made misleading or false representations of any nature in any

document submitted as proof of the qualification / requirements; (ii) Record of poor

performance such as abandoning the works, not properly abiding by the contract,

inordinate delays in completion, financial failures, etc.

5. Technical Bid:

1. Technical Bid should contain self-attested copies of all the documents in support of the

eligibility criteria spelt out at Point No. 4 above maintaining the sequence in which they

are sought for, along with a Top-sheet mentioning the documents submitted. However,

intending bidders should specifically note that uploading of any extra non-related

document is strictly discouraged.

2. The Tender Committee constituted by the Commissioner, Commercial Taxes, West Bengal

shall evaluate the responses to the NIT and supporting documents / documentary

evidences. In case of inability to submit requisite supporting documents / documentary

evidences, the Bid shall not be considered for evaluation and will be summarily rejected.

3. Only one set of tender document duly signed & stamped on each page by authorized

representative of the bidder shall be electronically submitted. Bidders should note

specifically that all pages of tender document are to be electronically submitted by them

as a part of their offer. Price should not be mentioned by them anywhere in the

Technical Bid portion of offer.

4. Each bidder should submit single bid for a single brand / company. In case of submission

of multiple Bids by any individual bidder for a single brand / company or for different

brand / company, all such bids shall not be considered for evaluation and will be

summarily rejected.

5. On the date of opening of tender, Technical Bid shall be opened first to select the eligible

Bidders. Financial Bid will be opened on the scheduled date only in respect of those

Bidders, whose bids are found technically acceptable.

6. Each of the responses shall be evaluated as per the criteria and requirements specified in

this NIT.

7. The Tender Committee reserves the right to reject any or all proposals on the basis of any

deviation and the decision of the Committee in the matter of evaluation of the bids shall

be final and abiding.

6. Financial Bid:

1. Price should be mentioned only in the "Bill of Quantities (BOQ)" by quoting the rates

online as specified in the ‘Price Schedule’ format.

2. The rates should be quoted taking into account the price of Water Purifiers-cum-Coolers,

their pre-attachments and cost of Comprehensive Annual Maintenance Contract (CAMC) /

Warranty Coverage (including all Spares, Accessories and Labour) of the Water Purifiers-

cum-Coolers and their parts and attachments for a period of 03 (Three) years (1 + 2). First

year’s Warranty should be free of cost. The cost for subsequent 02 (Two) years shall have

to be quoted separately. Bidders are requested to quote the rates as per specifications

and requirements of the same as appended in Annexure - A of this document.

3. Basic rate (unit price) and amount of all applicable taxes, cess, carriage and incidental

charges of any nature, complete with material and labour, for single unit should be

quoted in separate columns respectively.

4. The total rate (unit price) will thus include basic rate (unit price) and amount of all

applicable taxes, cess, carriage and incidental charges of any nature, complete with

material and labour, for single unit.

5. The Financial offer of the prospective bidder will be considered only if the Technical Bid of

the bidder is found qualified by the Tender Committee constituted by the Commissioner,

Commercial Taxes, West Bengal. The decision of the Tender Committee will be final and

absolute in this respect.

6. Where there is a discrepancy between the unit rate and the line item total resulting from

multiplying the unit rate by the quantity, the unit rate quoted shall govern. Moreover,

where there is a difference between the rate quoted in figures and words, the amount

quoted in words shall prevail.

7. Financial bid should also contain a “COMPANY & MODEL INFORMATION FORM” in .pdf

format. The bidder or its authorized representative is required to fill it up with proper

company and model name only, of the products being offered and upload with proper

stamp and signature. Rates should not be quoted in this Form in .pdf format.

7. Validity

1. The quoted rates must be valid for a period of 120 days from the date of opening of the

tender. The overall offer for the assignment and bidder(s) quoted price shall remain

unchanged during the period of validity. If any bidder quotes rates for validity shorter

than the required period, the same will be treated as unresponsive and will be summarily

rejected.

2. In case the bidder withdraws, modifies or changes his offer during the validity period, bid

is liable to be rejected and the earnest money deposit (E.M.D.) shall be forfeited without

assigning any reason thereof. The bidder should also be ready to extend the validity, if

required, without changing any terms, conditions etc. of their original offer.

8. Warranty/Comprehensive Annual Maintenance Contract

1. The bidder participating in the tender will have to undertake Comprehensive Annual

Maintenance Contract (CAMC) / Warranty Coverage (including all Spares, Accessories and

Labour) of the Water Purifiers-cum-Coolers and their parts and attachments for a period

of 03 (Three) years (1 + 2). The equipments will be covered under warranty for a period

of 01 (one) year after successful installation and commissioning (free of cost). The cost

for subsequent 02 (Two) years shall have to be quoted separately. No extra amount on

any account shall be payable over and above the quoted rate. CAMC / Warranty Coverage

charges for 02 (Two) years will be taken into account for financial bid evaluation purpose.

2. Scheduled Preventive Maintenance is to be carried out every six months interval.

3. The breakdown of the equipments is to be attended throughout the year and within 2-3

hours of breakdown call registration. All the materials required for repair / replacement of

any of the components / systems shall be arranged by the supplier.

9. Delivery and Installation

1. All goods ordered shall have to be supplied, installed, tested and commissioned within 30

days from the date of receipt of Work Order / Purchase Order. All the aspects of safe

delivery, installation, testing and commissioning shall be the exclusive responsibility of the

supplier.

10. Taxes and Duties:

1. All payments will be subjected to tax deduction at source as applicable / required as per

existing provisions of law.

11. Earnest Money:

1. The Bidder shall be required to deposit Earnest Money of Rs.25,000.00 (Rupees Twenty

Five Thousand only) in Online Mode only (as per Finance Department Memo No: 3975

F(Y) dated 28th

July 2016). Regarding EMD the notifications issued by Government from

time to time are applicable. By selecting ICICI Bank Mode bidder have to pay the EMD

amount through net banking and in case of ICICI NEFT / RTGS a challan will generate

online, in that case Bidder have to pay the EMD at their concerned bank branch through

NEFT or RTGS mode. The Earnest Money may be converted to Security Deposit in case of

successful Bidder who is not Exempted from EMD Payment. This may be released after

completion of successful bidder’s performance obligation including Comprehensive

Annual Maintenance Contract (CAMC) / Warranty period. The same may be forfeited in

the event of any breach or negligence or un-satisfactory performance. If the successful

bidder is exempted from payment of EMD in that case such successful bidder may be required

to submit a security deposit of Rs.25,000/- (Rupees Twenty Five Thousand only).

12. Mode of submission of Bids:

All documents and corresponding information are to be obtained, shared and submitted

only through e-tender process. No manual submission of documents, etc. will be

entertained. Canvassing in any form by any bidder will be treated as disqualification and

may result into rejection of the Bid.

13. Terms and Conditions:

a. There will be no sub-letting of the Contract.

b. Conditional / incomplete offers will not be entertained in any case.

c. Each bidder should submit bid for products of a single brand / company. Multiple

bids for a single brand / company or for different brand / company by a single

bidder will not be entertained.

d. Under no circumstances escalation in prices will be entertained.

e. The rates tendered shall remain valid for the period of 120 days from the date of

opening of the tender.

f. The lowest bidder shall have to submit hard copies of the documents to the Tender

Inviting Authority along with acceptance letter. Failure to submit the hard copy with

the acceptance letter within the time period prescribed for the purpose may be

construed as an attempt to disturb the tendering process and will be dealt with

accordingly as per provisions of law including blacklisting of the bidder.

g. Before issuance of WORK ORDER / PURCHASE ORDER, the credential and / or other

documents of the lowest bidder may be verified. After verification, if it is found that

the document(s) submitted by such bidder is incorrect / false / fabricated /

manufactured, WORK ORDER / PURCHASE ORDER will not be issued in favour of such

bidder under any circumstances

h. After selection, ordered items should be delivered within 30 days from the receipt of

Work Order / Purchase Order. Supply of items should be made as per specifications

and requirements of the same appended in Annexure - A of this document. No

deviation in specifications and requirements during supply will be accepted.

i. The Office of the Commissioner, Commercial Taxes, West Bengal reserves the right

not to procure any of the items as mentioned in Annexure - A even after selection of

the successful bidder for those items.

j. The selected bidder should give warranty against each item supplied and replace the

items found defective subsequently at its own cost during the warranty period.

k. In the event of breach / violation or contravention of any terms and conditions

contained herein by the selected agency, the firm / agency may be blacklisted in

addition to termination of contract.

l. Payment will be made after successful supply, installation, testing & commissioning of

the ordered items / materials to the satisfaction of the Office of the Commissioner,

Commercial Taxes, West Bengal. The Tax invoice needs to be issued mentioning full

particulars of the items supplied and showing separately the tax charged in

accordance with the provisions of GST Act, 2017. No advance payment will be made.

m. Payment of Comprehensive Annual Maintenance Contract (CAMC) / Warranty

Coverage (including all Spares, Accessories and Labour) of the Water Purifiers-cum-

Coolers and their parts and attachments for subsequent 02 (two) years will be made

after the expiry of free warranty period of 01 (one) year on raising Tax invoice at the

accepted rate.

n. Purified water shall have to be tested at any recognized lab and the report of the

same shall have to be submitted as a proof of successful commissioning of Water

Purifiers-cum-Coolers.

14. Instruction To Bidders:

a. Registration of Contractor: Any agency / firm / entity etc. and or its authorized

representative willing to take part in the process of E-Tendering will have to be enrolled

& registered with the Government e-procurement system, through logging on to

https://wbtenders.gov.in.

b. Digital Signature Certificate (DSC): Each agency / firm / entity etc. and or its authorized

representative is required to obtain a Class-II or Class-III Digital Signature Certificate

(DSC) for submission of tenders from the approved service provider of the National

Informatics Centre (NIC) on payment of requisite amount. Details are available at the

web site https://wbtenders.gov.in. DSC is given as a USB e-Token.

c. Each agency / firm / entity etc. and or its authorized representative can search and

download the NIT and Tender Document(s) electronically from computer once he logs

on to the website https://wbtenders.gov.in using the Digital Signature Certificate. This is

the only mode of collection of Tender Documents.

d. Submission of Tenders: Tenders are to be submitted through online to the web site

https://wbtenders.gov.in in two folders at a time for each work, one in Technical

Proposal & the other is Financial Proposal before the prescribed date & time using the

Digital Signature Certificate (DSC). Virus scanned and digitally signed copies of the

documents are to be uploaded. The documents will get encrypted (transformed into

non readable formats).

e. Technical Proposal: The Technical Proposal should contain scanned copies of the

following two covers (folders):

i. Statutory Cover Containing the following documents – NIT.

ii. Non-Statutory Cover Containing the following documents – All documents as stated

in the Eligibility Criteria in Point No. 4.

f. Financial Proposal:

1. BOQ: The Financial Proposal should contain Bill of Quantities (BOQ) in one cover

(folder). The agency / firm / entity etc. and or its authorized representative is to

quote the rates online through computer in the space marked for quoting rates in

the BOQ after downloading the prescribed format from the web site.

2. The Financial cover should also contain a “COMPANY & MODEL INFORMATION

FORM” in .pdf format. The agency / firm / entity etc. and or its authorized

representative is required to fill it up with proper company and model name only ,

of the products being offered and upload with proper stamp and signature of the

bidder.

3. The agency / firm / entity etc. and or its authorized representative should

specifically note that rates should not be quoted in the above-mentioned

“COMPANY & MODEL INFORMATION FORM” in .pdf format. If any deviation in this

Form is found, such as disclosure of rates or any other information apart from

company & model name of the products, the bid shall not be considered for

evaluation and will be summarily rejected.

4. The rates shall be quoted by the bidder entirely in Indian Rupees.

5. Each bidder should submit single bid for products of a single brand / company.

Multiple bids for same brand / company or for different brand / company by a

single bidder will not be considered for evaluation. In such case, all such bids by a

single bidder will be summarily rejected.

g. Opening & Evaluation of Tender:

i. The Tender Committee, formed by the Commissioner, Commercial Taxes, West

Bengal will evaluate the bids of the tender.

ii. The online tenders will be received up to the time and date mentioned in the Bid

Schedule and will be opened on the date and time mentioned therein. In the event of

the specified date of bid opening being declared holiday or in case of exigent

circumstances or conditions of force majeure, the bid shall be opened at the specified

time and location on the next working day. The Tender Inviting Authority also

reserves the right to defer the date of opening of either Technical or Financial

Proposal or both, if required.

iii. Cover (folder) for Statutory Documents will be opened first and if found in order,

cover (folder) for Non-Statutory Documents will be opened. If there is any

deficiency in the Statutory / Non-statutory Documents the tender will summarily be

rejected.

iv. Decrypted (transformed into readable formats) documents of the Non-Statutory

cover will be downloaded and handed over to the Tender Committee.

v. Summary list of technically qualified bidders will be uploaded online.

vi. During evaluation, the Tender Committee may summon the bidders and seek

clarification / information or additional documents or original hard copy of any of

the documents already submitted electronically and if these are not produced

within the stipulated time frame, their bids will be liable for rejection.

h. Rejection of Bid: The Office of the Commissioner, Commercial Taxes, Govt. of West

Bengal reserves the right to reject any / or all the bid(s) prior to the issuance of Work

Order / Purchase Order without assigning any reason thereof and / or not to place any

Work Order / Purchase Order even after selection, without thereby incurring any

liability to the affected bidder or bidders and / or any obligation to inform the affected

bidder or bidders of the ground for its action. The Office of the Commissioner,

Commercial Taxes, Govt. of West Bengal reserves the right to divide the contract

amongst any number of bidders, if required so. Tenders with incomplete / incorrect

information, subjective and conditional offers as well as partial offers will be liable for

rejection. Tenders with variance / contradiction between Technical Bid and Financial Bid

will also be liable for rejection. Further, Tenders submitted without any of the mandatory

statements/ documents of the bidders are liable for rejection. The Office of the

Commissioner, Commercial Taxes, Govt. of West Bengal does not bind itself to accept

the lowest rate.

Annexure-A TECHNICAL SPECIFICATION

1) UV based Water Purifiers-cum-Coolers with multi-stage purification (minimum 03 stages).

2) Body material should be full stainless steel (SS304).

3) Purification process should be last point to ensure purity of water both for normal and cold

water option.

20. The bidder participating in the tender will have to undertake Comprehensive Annual

Maintenance Contract (CAMC) / Warranty Coverage (including all Spares, Accessories and

Labour) of the Water Purifiers-cum-Coolers and their parts and attachments for a period

of 03 (Three) years (1 + 2). The equipments will be covered under warranty for a period

of 01 (one) year after successful installation and commissioning (free of cost). The cost

for subsequent 02 (Two) years shall have to be quoted separately.
