Before considering the different work types, we need

to firstly define work with asbestos.

‘Work with asbestos’ includes:

• work which removes, repairs or disturbs asbestos;

• work which is ancillary to such work (ancillary

work);

• supervising the work referred to in the two bullet

points above (supervisory work).

There are two distinct work types undertaken with

asbestos, these are best known as:

• Licensable Work

• Non-Licensable Work (Inc Notifiable Non-

Licensable Work)

Licensable work

That is work:

• where worker exposure to asbestos is not sporadic

and of low intensity or

• where the risk assessment cannot clearly

demonstrate that the control limit (0.1 f/cm3

airborne fibres averaged over a four-hour period)

will not be exceeded; or

Licensable work

• on asbestos coating (surface coatings which

contain asbestos for fire protection, heat insulation

or sound insulation but not including textured

decorative coatings); or

• on asbestos insulation or AIB where the risk

assessment demonstrates that the work is not

sporadic and of low intensity, the control limit will

be exceeded and it is not short duration work.

Materials in which the asbestos fibres are firmly

linked in a matrix

• asbestos cement;

• textured decorative coatings (artex);

• bitumen products;

• roofing felts;

• thermo plastic/vinyl floor tiles

• linoleum flooring

• composite products/ toilet cisterns etc

With the introduction of the CAR 2012, two further

definitions have been given to determine if NNLW

applies.

Maintenance Work – this is defined as drilling holes

or painting ACM’s, it also includes the removal of

ACM’s where the removal work is ancillary to the

main task.

Removal – this is defined as refurbishment or

demolition works where the ACM’s have to be

removed.

Regulation 10: Training of Employees

There are three main types of information, instruction

and training.

These are:

(a) Asbestos awareness training.

(b) Training for non-licensable asbestos work.

(c) Training for licensable work with asbestos.

There are four practices that require a licence issued

by the HSE:

• Asbestos Removal, where regulation 3 (2) cannot

be satisfied

• The construction of a Scaffold where access is

required to remove licensable asbestos materials,

where it is foreseeable that asbestos will be

disturbed (Reg 3(2).

• Supervisory Licence holder

• A company maintaining NPUs and Vac’s

Regulation 9: Notification of work

If a contractor undertakes licensable work they have

to notify the appropriate enforcing authority with

details of the proposed work.

This gives the enforcing Authority the opportunity to

assess the proposals for carrying out work with the

asbestos containing materials and to inspect the site

either before or during the work.

They will normally be required to notify the relevant

enforcing authority office 14 days before any work

begins, but the enforcing authority may allow a

shorter period, e.g. in an emergency where there is a

serious risk to the health and safety of any person.

This shorter period is known as a ‘waiver’ or

dispensation.

*The waiver.....it has become increasingly more

difficult to successfully request a waiver, the waiver

must include a formal request from the client as well

as the contractor.

contractor or sub-contractor

holds current and valid Health

& Safety Executive (HSE)

the contractor/sub-contractor has had any

prohibitions or improvement notices for breaches of

health and safety regulations within the last three

years.

appointment of contractors:

• Employers liability certificates

• Current valid licence

• Up to date worker training records (12 month max)

• Management training records

• Health & Safety Policy document

• Company Risk Assessments

• Asbestos standard operating procedures

• Medical records for employees

• Face fit certificates for all RPE

• References from previous works (if available)

What to expect prior to work commencing;

• Pre-site meeting

• Pre-site setup visit to assess the site

• Pre-clean (where identified debris or contamination)

• Installation on site of the DCU

• Installation on site of waste storage (where applicable)

• Issue of the notification pack including POW (at the same

time as the HSE receive their copy of the ASB5)

• An agreement of the scope of the clearance, handover and

designation of transit routes.

• Agreement of any site specific emergency procedures.

Plan of Work (POW)

In accordance with CAR 2012, Regulation 6 & 7, the

contractor will be required to assess and produce a

suitable and sufficient POW (aka Method Statement).

This MUST be prepared before the work is notified to

the Enforcing Authority

This needs to be job and site specific.

The plan of work must include the following

information:

• the nature and probable duration of the work;

• the number of people involved in the work;

• the address and location where the work is to be carried out;

• the methods to be used to prevent or reduce exposure to asbestos,

eg prevention and control measures, arrangements for keeping

premises and plant clean and arrangements for the handling and

disposal of asbestos waste;

• the type of equipment, including PPE and RPE, used for:

– protecting and decontaminating those carrying out the work;

– protecting other people present at or near the worksite.

There are a number of methods which can be used

when removing asbestos, all of which should ensure

that fibre release is minimised.

Methods available:

• Wrap and cut

• Spray wetting

• Shadow vacuuming

• Wet injection

Enclosures

HSE Guidance note for enclosure construction

provided for work with asbestos – HSG 247.

Enclosures may either make use of the fabric of the

building or may be self supporting built around the

work area.

The enclosure should be constructed with the view to

avoid the spread of asbestos from the work area.

After asbestos removal works have

been carried out, the enclosure

should be tested in accordance with

HSG 248 (The Analysts Guide), CAR

2012, L143

CAR states that the independent

laboratory carrying out the clearance

test should conform to ISO 17025

It is recommended that the Client

Certificate of Reoccupation (CORO)

There are four stages to the site

certification for reoccupation procedure:

• Stage 1: Preliminary check of site condition

and job completeness;

• Stage 2: A thorough visual inspection inside

the enclosure/work area;

• Stage 3: Air monitoring;

• Stage 4: Final assessment post-

enclosure/work area dismantling.
