W h ile in the militaryhe carried secu rity clearances that are av ailable only after an extensiv e background check . Itis ou r position that M r. M oore is gu ilty of no crim e, and should not be indicted for th is offense.If the you ng lady w as peering in Mr. M oore's w indow , and saw him in a state of undress, thenat worst , this is a case of indecent exposu re u nder Section 21.08 T exas P enal C ode w hich says,"a person com m its an offense if he exposes any part of h is genitals w ith in ten t to arou se orgratify the sexu al desire of any person, and he is reckless abou t w hether another is p resent whowill he offended or alarm ed by his act." If there is no in ten t to arou se or gratify anyone'ssexu al desire , then reck less exposu re of genitals w ou ld v io late the disorderly condu ct law u nderSection 42 .0 1(a)(12) or the Texas Penal Code. R eference to these other offenses is not intendedto be nn admission ' of wrongdoing on Mr. Moore's part, bu t are memloned a s s ug ge ste dalternativ es in the ev ent the grand ju ry believ es there is p robable cau se to find that M r.     This action effec tiv ely ends the case against Mr. M oore . The re aso n s ta te d for thedismissal w as th at thes .Q!!1plain ing witness re fu se d to a pp ear in court in Texas to testify. W h ileM r. M oore w ou ld hav e lik ed to hav e been vindicated in court by a v erdict of not guilty from ajury, th e S ta te 's M o tio n to D ism iss p rev ented a ju ry from hearing the case. W e had no doubt thatthe ju ry w ou ld hav e acqu itted Mr. Moore when they heard the ev idence. It is our position thatthe com p la inin g w itness em b ellished a story that continu ed to get larg er as it was repeated. H erreluctance to appear in cou rt a nd testify is to u s a c oncessio n that the story bad gotten ou t of handan d that she did no t w ant to repeat, w hat she knew not to be tru e in c ou rt u n de r oath.
