PREAMBLE

WHEREAS, the parties hereto have main-tained a mutually satisfactory bargainingrelationship in the work area covered bycollective agreements between them whichhave been in effect over a substantial periodof years; and

WHEREAS, the International Brotherhoodof Boilermakers, Iron Ship Builders,Blacksmiths, Forgers, and Helpers and/orsubordinate subdivisions thereof embracewithin their membership large numbers ofqualified journeymen who have constitutedin the past, and continue to do so, a majori-ty of the employees employed by theEmployer herein:

ART. 1(d) The use of the masculine orfeminine gender or titles in thisAgreement shall be construed as includingboth genders and not as sex limitationsunless the Agreement clearly requires adifferent construction.

ARTICLE 2RECOGNITION

The Employer recognizes the Union asthe sole and exclusive bargaining represen-tative for all Boilermaker and Blacksmithjourneymen, apprentices, and constructionBoilermaker helpers in the employ of theEmployer with respect to wages, hours, andother terms and conditions of employmentherein expressed in the performance of allwork coming within the terms of thisAgreement subject to the provisions ofexisting laws. The Employer agrees that,upon the Union’s presentation of appropri-ate evidence of majority status among itsemployees in the bargaining unit of theEmployer covered by this collective bar-gaining agreement, the Union shall be vol-untarily recognized as the exclusive collec-tive bargaining agent under Section 9(a) ofthe NLRA for all employees within the bar-gaining unit of the Employer on all job siteswithin the jurisdiction of this Agreement. Inthe event of such a showing, the Employerexpressly waives any right to condition vol-untary recognition on the Union’s certifica-

NOW, THEREFORE, the undersignedEmployer and Union, in consideration ofthe mutual promises and covenants con-tained herein, agree as follows:

ARTICLE 1SCOPE AND PURPOSE OF AGREEMENT

ART. 1(a) This Agreement shall applyexclusively to field construction, mainte-nance and repair work within the territoryherein referred to as the Great Lakes Areanow under the jurisdiction of:

Lodge 107, Milwaukee, Wisconsin;Lodge 374, Hammond, Indiana;Lodge 647, Minneapolis, Minnesota; and,Lodge 744, Cleveland, Ohio.

ART. 1(b) The parties to this Agreementrecognize that stability in wages and work-ing conditions and competency of work-men are essential to the best interests of theindustry and the public, and they agree tostrive to eliminate all factors which tendtoward destabilizing these conditions.

ART. 1(c) It is hereby agreed by all partiesthat, in keeping with the intent of increasingproductivity and placing both parties on abetter competitive basis, that the NCA-BTDWork Rules dated June 1, 1973 shall beincorporated as an integral part of thisAgreement as expressed in Appendix “A”.

Blacksmiths, apprentices, and constructionBoilermaker helpers employed in the boiler-making, blacksmithing, welding, acetyleneburning, riveting, chipping, caulking, rig-ging, fitting-up, grinding, reaming, impactmachine operating, unloading and han-dling of Boilermaker material and equip-ment, and such other work that comesunder the trade jurisdiction of theBoilermakers and Blacksmiths.

ART. 4(b) Journeymen Boilermakers andBlacksmiths may be required to performany work coming within the scope of thisAgreement.

ART. 4(c) In recognition of the work juris-dictional claims, it is understood that theassignment of work and the settlement ofjurisdictional disputes with other BuildingTrades organizations shall be handled inaccordance with the procedures estab-lished by the Impartial JurisdictionalDisputes Board and Appeals Board or anysuccessor agency.

ART. 4(d) When an Employer’s majorcraft on a job is Boilermakers and theEmployer determines a tool room man isnecessary, then the tool room man shall be aBoilermaker.

ART. 4(e) When an Employer determinesit is necessary that work be performed that

tion by the NLRB following an NLRB elec-tion, unless a representation petition hasbeen filed by a Petitioner other than theEmployer prior to the Employer’s volun-tary 9(a) recognition. The Employerexpressly waives the right to seek an NLRBelection during the term of this contract, orany right to abrogate or repudiate this con-tract during its effective term.

ARTICLE 3UNION SECURITY

As of the effective date of this Agreement,all employees under the terms of thisAgreement must be or become members ofthe Union thirty (30) days thereafter; theemployees hired after the effective date ofthis Agreement shall be or become andremain members of the Union thirty (30)days after their date of employment inaccordance with the provisions of theNational Labor Relations Act. (This clauseshall be effective only in those states permit-ting Union Security.)

ARTICLE 4TRADE JURISDICTION AND WORK

CLASSIFICATION

ART. 4(a) This Agreement, except as oth-erwise provided for herein, covers theworking rules and conditions of employ-ment for all journeymen Boilermakers and

ARTICLE 5JOB SITE CONTRACTING

ART. 5(a) No Employer shall subcontractor assign any of the field construction workdescribed herein which is to be performedat a job site to any contractor, subcontractor,or other person or party who does not com-ply with all of the terms of this Agreement,or a field construction agreement in effect inthe area where the work is erected, whichhas been approved by the InternationalBrotherhood and does not stipulate, in writ-ing, compliance to the applicable fringebenefits funds and the Trust Agreement oragreements covering same.

ART. 5(b) It has been agreed that theInternational Brotherhood will not enterinto any written or oral agreement with anyContractor on terms and conditions moreadvantageous than those contained in thisAgreement. Should the InternationalBrotherhood, for any reason, enter into anagreement with any other Contractor onterms and conditions more advantageous tosuch Contractor than those contained in thisAgreement, then such advantageous termsand conditions shall be made available toall contractors signatory hereto. Speciallocal, area, or national agreements negotiat-ed to cover specific projects or classes ofwork shall not be considered as “the local orarea agreement” as referred to elsewhere in

comes under the jurisdiction of Boilermakerduring the testing or starting up ofBoilermaker equipment, there shall be aminimum of two (2) men employed, one (1)shall be the foreman and the other shall be asteward, both of whom shall perform workas assigned.

ART. 4(f) When the Employer determinesmanual assistance is required for stressrelieving, Gamma Ray, X ray, or other non-destructive testing by technicians in theexamination of Boilermaker work,Boilermakers will be assigned to performthe manual work that is not directly relatedto the technicians examination. TheEmployer shall determine the number ofBoilermakers required.

ART. 4(g) There shall be no work stop-page because of jurisdictional disputes,except in the case of non-compliance withImpartial Jurisdictional Dispute Board andAppeals Board Rules. In such instance orinstances, specifically the InternationalPresident of the Union must approve anyenforcement action taken. It is understoodhowever, an Employer will not be consid-ered as in noncompliance in the eventanother trade or trades claims jurisdictionover work, in which case it shall be consid-ered a bona fide jurisdictional dispute.

within two business days prior to theemployees’ required start date, theEmployer may employ applicants fromany other available source. Any Employerwho brings in applicants under the forty-eight (48) hour rule must notify the localunion within forty-eight (48) hours theapplicants’ name, address, and SocialSecurity number.

ART. 6(d) Selectivity. The first two employ-ees on a job shall be the foreman, selected bythe Employer, and the steward, selected bythe business manager, regardless of theirpositions on the out-of-work list. For a jobunder the terms of this Agreement, theEmployer may select a maximum of seven (7)additional Boilermaker employees by namefrom among the top fifty percent of regis-trants on the appropriate out-of-work list ofthe local lodge having jurisdiction. Theseseven (7) additional Boilermaker employeesmay be selected from any one or combinationof Boilermaker classifications under the termsof this Agreement (i.e., journeyman, appren-tice, and other applicable classifications),except that the choice may not exceed oneapprentice and one other classification or twoapprentices. Additional employees requiredfor the job will be obtained in accordancewith the Referral Rules.

ART. 6(e)(1) Transfer of Employees. TheEmployer may transfer Boilermaker

this Agreement, and the overtime provi-sions will apply.

ARTICLE 6REFERRAL OF MEN

ART. 6(a) The referral system shall complywith the National Uniform ReferralStandards and any revisions thereto.

ART. 6(b) The Employer shall, under theterms of this Agreement, request the Unionto furnish all competent, drug screened, andqualified Field Construction Boilermakers,Boilermaker apprentices and other applica-ble classifications in the area agreement.The Employer, in requesting the Union tofurnish such applicants, shall notify theUnion either in writing or by telephone,stating the location, starting time, approxi-mate duration of the job, the type of work tobe performed and the number of workmenrequired. The Employer shall have the rightto reject any job applicant referred by theUnion who has not satisfactorily completeda MOST ten (10) hour safety training classor equivalent, provided the Employer stipu-lates this as a condition of employment.This stipulation should be reduced to writ-ing as soon as practical by the Employerand provided to the Union for their records.

ART. 6(c) In the event the Union knows itis unable to fill a requisition for applicants

ability, but he shall not be allowed to exceedthe eight (8) employee limit for any one job.

ART. 6(e)(3) A transferred employee willbe allowed to be transferred back to the jobhe was transferred from, provided the jobhe was transferred to has been completed.

ART. 6(e)(4) Modification as to the selec-tivity and transfer of men beyond the limi-tations set forth in this Article may be madeby mutual consent of the parties.

ART. 6(e)(5) The Employer shall deter-mine the competency of all employees. TheEmployer shall determine the number ofmen required on a project and shall selectany employee or employees working underthe terms of this Agreement to be laid offregardless of membership or non-member-ship in the Union.

ARTICLE 7HOURS OF WORK

ART. 7(a) Eight (8) consecutive hours perday (exclusive of lunch period) shall consti-tute a day’s work between the hours of 7:00a.m. and 5:00 p.m. Forty (40) hours perweek, Monday through Friday inclusive,shall constitute a week’s work.

ART. 7(b)(1) The Employer has theoption of establishing a four (4) ten-hour

employees on his payroll working underthe terms of this Agreement from one job toanother job being worked under the termsof this Agreement within the jurisdiction ofthe same local lodge, provided that thenumber transferred shall not exceed a totalof eight (8), consisting of a foreman andseven (7) additional Boilermaker employeesfrom any one classification or combinationof classifications under the terms of thisAgreement (i.e., journeyman, apprentice, orother applicable classifications), and provid-ed that the number transferred shall includenot more than one apprentice and one otherclassification, or two apprentices. TheEmployer desiring to utilize this transferprovision shall promptly notify the businessmanager of the local lodge having jurisdic-tion giving the name, classification, andSocial Security number of each employee tobe transferred. The steward shall be selectedby the business manager from the lodge’sout-of-work list, or he may elect to transferthe steward from a job which the sameEmployer is working under the terms ofthis Agreement. After the foreman and thesteward have been selected, the Employermay transfer the remaining employees notto exceed seven (7). Additional employeesfor the job will be obtained in accordancewith the Referral Rules.

ART. 6(e)(2) The Employer may utilize theprovisions for selectivity and/or transfer-

of the Employer, then Friday may, at theoption of the Employer, be worked as amake-up day at the straight time wage rate.Straight time is not to exceed ten hours aday or forty hours per week.

This provision requires mutual agreementbetween the Union and Employer represen-tatives for jobs lasting two (2) weeks or less.

ART. 7(b)(3) Employees, who inform theirEmployer on Thursday that they do notwish to work a Friday make-up day, willnot be penalized.

ART. 7(b)(4) An employee who receivesless than forty (40) hours of work (from thedate of hire to date of termination), throughno fault of his own, shall receive overtimepay for all hours worked in excess of eight(8) hours per day.

ART. 7(c) If any other craft employed bythe same Employer or its subcontractor isreceiving double-time wages in lieu of timeand one-half wage rate as set forth in thisAgreement, the Boilermaker employeeswill automatically be entitled to the double-time rate of pay during the period that theaforementioned crafts are employed. TheChairmen of the Agreement, in accordancewith Article 30(c) determined on March 16,2004, that … during the period that theaforementioned crafts are employed… is

shift exclusive of the thirty-minute unpaidlunch period at the straight time wage rate.The starting time shall be between 7:00a.m. and 8:00 a.m. Forty hours per weekshall constitute a week’s work, Mondaythrough Thursday. In the event a job isdown due to weather conditions, holiday,or other conditions beyond the control ofthe Employer, then Friday may, at theoption of the Employer, be worked as amake-up day at the straight time wagerate. If Friday is scheduled as a make-upday, a minimum of eight hours will bescheduled and worked, weather permit-ting. Straight time is not to exceed tenhours a day or forty hours per week. TheEmployer will designate starting time; theUnion will be advised of the starting time.

This provision requires mutual agreementbetween the Union and Employer represen-tatives for jobs lasting two (2) weeks or less.

ART. 7(b)(2) An Employer may establishtwo four-day, ten-hour shifts at the straighttime wage rate, Monday through Thursday.These shifts are exclusive of the thirty-minute lunch period. The day shift shallwork four days at ten hours for ten hourspay per day. The second shift shall workfour days at nine-and-one-half hours for tenhours pay per day. In the event the job isdown due to weather conditions, or a holi-day, or other conditions beyond the control

shall receive a minimum of eight (8) hoursat the overtime rate.

ART. 8(b) Overtime is not to be demand-ed of any Employer by any employee orapplicant for employment as a condition foremployment.

ARTICLE 9HOLIDAYS

ART. 9(a) The following holidays shall beobserved: New Year’s Day, Decoration Day,Independence Day, Labor Day,Thanksgiving, the day after Thanksgiving,and Christmas. No work shall be per-formed on Labor Day and Christmas exceptfor the preservation of life and property.When a holiday falls on Sunday, the dayobserved by the Nation shall be observed.

ART. 9(b) The contractor shall notify theunion at the pre-job whether a holiday willbe worked excluding emergencies.

ARTICLE 10SHIFTS

ART. 10(a) The starting time of the first orday shift shall be between 7:00 a.m. and 8:00a.m.; the starting times of the second shiftand third shift shall be adjusted accordingly.The foregoing starting times may bechanged when mutually agreed to between

very specific in that, Boilermaker employ-ees would only be entitled to double-timeduring the period of time that other craft orcrafts were receiving double-time. Anexample of this would be, if another craftreceived double-time on the day shift of atwo (2) day job for one (1) day of eight (8)hours, then the Boilermakers would beentitled to double-time for one (1) day ofeight (8) hours for that shift only. TheChairmen of the Agreement drew theessence of their determination from theNational Maintenance Agreement, ArticleXV-6 interpretation.

ART. 7(d) Emergency ServiceMaintenance Agreement within Locals 107& 647. A mutually-signed letter of assentregarding emergency services may supple-ment this Agreement.

ARTICLE 8OVERTIME

ART. 8(a) Time-and-one-half (one-and-one-half hours for one) shall be paid fortime worked before or after regular estab-lished shift hours in any twenty-four (24)hour period, Monday to Friday inclusive,and all time worked on Saturdays. All timeworked on Sundays and holidays set forthin Article 9 shall be paid at double time(two hours for one). Any employee calledfor work on Labor Day and/or Christmas

been given an eight-hour (8) break, if a manis called in more than four (4) hours prior toregular starting time of his shift, he will bepaid at the applicable overtime rate inaccordance with Article 8, paragraph (a),until sent home.

ART. 10(e) Employees, employed duringtheir regular lunch period, will be paid theovertime rate and allowed sufficient time toconsume their lunch on Employer’s timeafter completing such emergency work.

ART. 10(f) When an employee is continu-ously employed for more than two (2)hours beyond the quitting time of his regu-lar shift and/or for each additional continu-ously-worked period in excess of four (4)hours, he will be allowed thirty (30) min-utes to obtain a meal without loss of pay.

Art. 10(g) Shift Schedule. The Employermay establish shift work on the followingbasis (see next page for schedule):

ART. 10(b) When two (2) or three (3) shiftsare worked, the first or day shift shall beestablished on an eight-hour (8) basis; thesecond shift shall be established on a seven-and-one-half (7 1/2) hour basis; and thethird shift shall be established on a seven-hour (7) basis. The pay for the secondand/or third shift for full time shall be theequivalent of eight (8) times the employee’sregular hourly rate. The shift rate differen-tial for the second shift will be twenty-fivecents ($0.25) per hour worked. The shift ratedifferential for the third shift will be fiftycents ($0.50) per hour worked.

ART. 10(c) Any employee called to workat any time other than his regular shift shallbe paid at the applicable overtime rate forall such time worked within any one twen-ty-four (24) hour period.

ART. 10(d) No employee shall be requiredto work more than eight (8) hours in anytwenty-four (24) hour period for straighttime. Beginning of the twenty-four (24)hour period for such purpose shall be theregular starting time of the shift uponwhich the employee is regularly employed.The overtime rate will be paid to employeesworking beyond eight (8) hours until theyreceive an eight-hour (8) break. ARTICLE 11MINIMUM PAY AND REPORTING TIME

ART. 11(a) Any employee starting to workor called to work after the starting timeMonday through Sunday, inclusive, shallreceive at the applicable rate, not less thantwo-hours (2) pay, and if the employee isrequired to continue on the second periodof the shift he shall receive not less than afull-day’s pay.

ART. 11(b) When an employee reports forwork at starting time, and weather does notpermit him to go to work that day, afterreporting he shall receive two (2) hoursshow-up time. This two (2) hours show-uptime is flexible to be used either at the begin-ning of the shift or during the first four (4)hours of the shift. All remaining time of theshift is to be paid for actual time worked.

ART. 11(c) The foregoing requirements shallnot be applicable where the employee is laidoff by reason of bad weather, breakdown ofmachinery, or any other cause beyond thedirect control of the Employer, in which eventhe shall be paid, (1) not less than two hourspay, (2) for the time actually worked, or (3) thetime required to remain on the job, whicheveris greater. Where the employee quits or is laidoff, payment will be made for actual timeworked. In order to qualify for the pay pro-vided for in this Article, the employee must

(1) must remain at work at least ten (10)working days or (2) in case of jobs of lessthan ten (10) working days, they mustremain on the job for the duration there-of. An exception to the foregoing wouldbe an employee who quits a job shall notbe entitled to return transportationexpense. Any dispute arising as to theproper application of this provision shallbe considered as a grievance subject tohandling under the grievance machineryherein provided.

ARTICLE 13WAGES

remain on the job, available for work, duringthe period of time for which he receives pay,unless released sooner by the Employer’sprincipal supervisor.

ART. 11(d) The Employer’s representa-tive shall determine when weather condi-tions on the job are such that the men shallor shall not work. Employees not reportingfor work because of inclement weatherwill not be discriminated against.

Art. 11(e) All one-day jobs on first shiftshall require a minimum of eight hourspay at the applicable rate.

ARTICLE 12TRANSPORTATION EXPENSE AND SUBSISTENCE

ART. 12(a) Local Lodges 374 and 744TRAVEL EXPENSE. At the beginning andconclusion of their employment, where ajob is located outside of the 30 mile zoneof each Lodge dispatch office, allBoilermaker employees shall be paid thepublished amount allowable by the IRSper mile transportation expense, from theLodge dispatch office to the job, over themost direct main traveled route, plus anytolls. In order to qualify for transporta-tion in accordance with the provisions ofthis Article, it is understood that allemployees, unless transferred or releasedsooner (at the option of the Employer),

ART. 13(e) Savings Plan

ART. 13(e)(1) LODGE 107 AND LODGE 647SAVINGS PLAN. Effective July 1, 2004, theEmployer agrees to deduct from theemployee’s hourly taxable wage the sum ofone dollar and five cents ($1.05) per hourfor all hours worked. The Employer agreesto and shall be bound by the TrustAgreement creating the BoilermakerVacation Trust and all amendments now orhereafter approved by the Board ofTrustees. Said Agreement and amendmentsare incorporated by reference and made apart of this Agreement as if affixed hereto.

ART. 13(e)(2) LODGE 744 VACATION FUND.The Employer shall deduct from theemployee’s gross hourly taxable wages thesum of one dollar ($1.00) for each regular

proper and timely payment of the fringebenefit contributions and other deductionsas required by this Agreement. The bondshall provide for immediate payment to theappropriate Fund upon receipt of evidenceof a delinquency from the Fund offices. Inlieu of a payment bond, an escrow accountwith the same payment provisions may beestablished at a bank satisfactory to theInternational. The bond or escrow accountshall be in an amount equal to one hundredtwenty-five percent (125%) of theEmployer’s highest quarterly fringe contri-butions, and other deductions in the previ-ous calendar year, but not less than $25,000.Evidence, satisfactory to the International, ofsuch bonding or escrow account must bepresented prior to start of the job in question.The bond or escrow account cannot be can-celed without approval of the International.Disputes resulting from this provision shallbe resolved in an expedited fashion consis-tent with Fund requirements.

ART. 13(g)(1) Effective July 1, 2000,Boilermaker helpers who are referred asapplicants and employed, who are not jour-neymen in any building trades metal-work-ing craft, shall be paid sixty percent (60%) ofthe journeyman Boilermaker basic rate ofpay and one hundred percent (100%) offringe benefit contributions.

hour paid, one dollar and fifty cents ($1.50)for each time-and-one-half hour paid, andtwo dollars ($2.00) for each double-timehour paid. This amount shall be deductedweekly and shall be made payable to theBoilermakers Local 744 Vacation Fund.

The total amount due to the VacationFund is made payable to the BoilermakersLocal 744 Vacation Fund and sent on amonthly basis, no later than fifteen (15)days after the end of the month, to theBoilermakers Union Local 744, 1435 E. 13thStreet, Cleveland, Ohio 44114.

Payment of the Vacation Fund shall bemade monthly, and if any payment is notmade within fifteen (15) days from the lastday of the month for which hours arereportable, the local union shall have theright to take whatever steps are necessary tosecure compliance with this Article, anyprovision of this Agreement to the contrarynotwithstanding, and the Employer shall beliable for all costs for collecting the pay-ments due, together with attorneys’ fees.The Employer’s liability for payment here-under shall not be subject to the grievanceprocedure or arbitration provided underthis Agreement.

ART. 13(f) BOND OR ESCROWREQUIREMENTS. All Employers are requiredto furnish or post a payment bond to assure

ART. 14(b) Every employee workingunder this Agreement will be furnished onthe stub of his paycheck or pay envelope, arecord of all hours worked, showing alldeductions separately and indicate clearlywhat they are for (excluding Boilermaker-Blacksmith Pension, Boilermaker Healthand Welfare, Annuity Program, andApprentice contributions). Employers willinclude their name and address on checkstubs after present stock is exhausted.

ART. 14(c) When it becomes necessary tolayoff men, the foreman and steward shallbe notified of the men to be laid off at leastone (1) hour prior to regular quitting time.

ART. 14(d) Employees who are laid off ordischarged from the service of theEmployer shall receive their wages andtransportation expense (to which anemployee is entitled) and personal propertyimmediately thereafter. By prior mutualagreement with the Business Manager,when it becomes necessary to terminate ajob or a portion of the employees during thenight, early morning, or over the weekend,all such employees may be paid on the nextscheduled workday either personally, or viaU.S. mail in an envelope bearing theemployee’s name and address. The post-mark on such envelope shall determine thedate of such mailing. Should an Employerfail to transmit the checks as required by

ART. 13(g)(2) Any Employer who fails orrefuses to hire Field Construction BoilermakerApprentices when available in accordancewith the agreed upon ratio of apprentices tojourneymen, will not be allowed to employBoilermaker helpers.

ART. 13(g)(3) When qualified Boilermakersand/or apprentices are on the local out-of-work list and are willing and available toaccept the referral offer, Boilermaker helpersshall not be referred to the job until the out-of-work list is exhausted. However, bymutual consent, apprentices and helpersmay comprise thirty percent (30%) of thework force on certain work.

ARTICLE 14PAY DAY

ART. 14(a) Employees shall be paid week-ly on a designated day during workinghours and in no case shall more than three(3) days be held back in any one-payrollperiod. Failure to pay wages during work-ing hours on specified day, employees shallreceive overtime for waiting.

ART. 14(a)(1) The Employer may offer adirect deposit option through BrotherhoodBank & Trust, or any other financial institu-tion of the employee’s choice, that is volun-tary to the employee.

tion of the job who shall, in addition to hiswork as a journeyman, be permitted to per-form during working hours such of hisUnion duties as cannot be performed atother times. The Union agrees that suchduties shall be performed as expeditiouslyas possible and the Employer agrees toallow the steward a reasonable amount oftime for the performance of such duties.Stewards shall receive the regular journey-man’s rate of pay.

ART. 15(c) It is understood and agreed thatthe steward’s duties shall not include anymatters relating to referral, hiring, or layingoff of employees.

ART. 15(d) Stewards shall not be discrimi-nated against for the discharge of their duties.

ART. 15(e) Upon presentation of a signedauthorization card, the obtaining of whichshall be the responsibility of the Union, theEmployer shall withhold field dues anddues to affiliated organizations if applicable,and submit same to the local union officehaving jurisdiction no later than thirty (30)days after the end of the month in whichthe dues accrued. The Union holds theEmployer harmless and agrees to defendthe Employer fully in any litigation result-ing from this activity that is deemed to be aservice to the Union by the Employer.

ART. 14(e) When there is a reduction offorce, it is understood that the intent is togive preference of employment to qualifiedemployees of the local area, consistent withthe efficient operation of the job.

ART. 14(f) Employees terminated shall befurnished a separation slip showing theemployee’s name, the date of termination,and any and all reasons for the separation.Copies of all separation slips for cause orquits will be forwarded to the local unionoffice within twenty-four (24) hours.

ARTICLE 15UNION REPRESENTATION AND ACCESS TO

JOBS

ART. 15(a) Authorized representatives ofthe Union shall have access to jobs whereemployees covered by this Agreement areemployed, provided they do not unnecessar-ily interfere with the employees or causethem to neglect their work, and further pro-vided such Union representative complieswith customer rules and regulations.

ART. 15(b) A steward shall be a workingjourneyman appointed by the BusinessManager of the local union having jurisdic-

after. Only the foremen will give instruc-tion to the men on the job.

ART. 16(d) Where a total of nine (9) orless men are employed, one (1) shall be aforeman who shall work with the tools ifrequired by the Employer. Where a total often (10) or more men are employed, one (1)shall be a foreman who shall not work withthe tools.

ART. 16(e) All classifications of foremenshall accept instructions from theEmployer’s superintendent(s). However,the superintendent(s) shall not give directinstructions to the other employees coveredby the terms of this Agreement.

ART. 16(f) Foremen shall not apply, in anyrespect, any regulations, rules, by-laws, orprovisions of the Union Constitution on theEmployer’s job site.

ART. 16(g) Except in a broken work-week at the beginning or conclusion of ajob, when a general foreman or foremanworks three (3) or more days in any work-week, he shall receive a minimum offorty-hours (40) pay, provided he reportsto the job daily during said workweek ifrequested. The intervention of any holi-day referred to in this Agreement duringany workweek shall not be construed ascreating a broken workweek. The forego-

ART. 15(f) In order to expedite the dis-patching of applicants as provided underArticle 6, the Union office, when practical,will be notified at least four (4) hours inadvance of the names of the employees tobe laid off and the reason for the lay off.

ART. 15(g) When layoffs occur, the stew-ard will be the last employee laid off pro-viding he is capable of performing theremaining work.

ARTICLE 16SUPERVISION

ART. 16(a) The selection and number offoremen and general foremen shall beentirely the responsibility of theEmployer. It is understood that in theselection of foremen and general foremen,the Employer will give first considerationto the qualified men available in the localarea without persuading any employeesto leave one Employer for another. TheEmployer shall have the right to sendgeneral foremen into any local territorywhere work is being performed.

ART. 16(b) All foremen shall be practicalmechanics of the trade.

ART. 16(c) There shall be a foreman onevery job and as many additional foremenas the Employer deems necessary there-

ARTICLE 17PIECE WORK, LIMITATION, ANDCURTAILMENT OF PRODUCTION

There shall be no contract, bonus, bit, ortask work, nor shall there be any limitationor curtailment of production. Further, theparties to this Agreement recognize theirresponsibility, mandated by its spirit andintent to encourage the elimination ofrestrictive, inefficient, and cost intensivework practices. To this end, the employee isexpected to extend willing cooperation andapply himself to work with a reasonabledegree of effort and activity in performingthe work of his trade.

ARTICLE 18FUNCTIONS OF MANAGEMENT

The Employer shall have full right todirect the progress of the work and to exer-cise all functions and control, including, butnot limited to, the selection of the kind ofmaterials, supplies, or equipment used inthe execution of the work, the determina-tion of the competency and qualifications ofhis employees, and the right to dischargeany employee for any just and sufficientcause, provided, however, that no employeeshall be discriminated against.

This Agreement may, upon thirty (30)days prior written notice, be reopened todiscuss any change in the hourly contribu-tion to the Great Lakes Apprenticeship Fundif the Great Lakes Area ApprenticeshipCommittee requests such reopening. TheEmployer agrees to and shall be bound bythe Agreement and Declaration of Trustestablishing the Boilermakers AreaApprenticeship Funds and all amendmentsnow or hereafter approved by the Board ofTrustees. Said Agreement and amendmentsare incorporated by reference and made apart of this Agreement as if affixed hereto.

ART. 21(b) The ratio of apprentices shall bedetermined by the local union ratio ofapprentices to journeymen, but not less thanone (1) to five (5). In the event apprenticesare not available in sufficient number tocomply with the ratio, the area JointApprenticeship Committee and theInternational will be notified and necessary

ARTICLE 21APPRENTICESHIP PROGRAM

ART. 21(a) The Employer, for all employ-ees covered by this Agreement, shall pay, foreach hour worked, the following contribu-

Building and Training Fund. It is understoodthat this payroll deduction is subject to acheck-off authorization from each employeeworking in that local lodge jurisdiction. Allpayroll deductions shall be forwarded bycheck to the appropriate local union officeand shall be made payable to the appropriateLocal Building and Training Fund withinthirty (30) days following the last day of eachmonth or at the conclusion of a job, whichev-er is sooner. A list of all employees, hoursworked, and individual deductions shallaccompany such payments.

ARTICLE 22ANNUITY PROGRAM

The Employer shall pay, for each hourpaid, the following contributions to theBoilermaker National Annuity Trust foreach Boilermaker employee working in thegeographical jurisdiction of the local unionslisted below. The hourly contributions arebased on hours paid.

ART. 21(c) It is the understanding of theparties to this Agreement that the funds con-tributed by signatory Employers to theApprenticeship Fund will not be used totrain apprentices or journeymen who will beemployed by employers in the BoilermakersField Construction and Repair Industry notsignatory to a collective bargaining agree-ment providing for contributions to theFund. Therefore, the Trustees of the Fundare empowered to adopt and implement ascholarship loan agreement program whichwill require apprentices and journeymenwho receive training benefits from the Fundand who are employed by signatoryEmployers to repay the costs of training,either by service with such Employers fol-lowing training, or by actual repayment ofthe costs of training if the individual goes towork for a non-signatory Employer in theBoilermaker Field Construction and RepairIndustry. The costs of training at theNational Training Center may include thereasonable value of all Fund materials, facili-ties, and personnel utilized in training at theNational Training Center.

ART. 21(d) It is agreed that each of the par-ticipating local unions covered under thisAgreement may choose a ten-cents ($0.10)per hour paid payroll deduction for a Local

ART. 23(b) Any increases or decreasesafter July 1, 2000 shall be implemented onthe first day of the month following notifi-cation from MOST to the Co-Chairmen ofthe Great Lakes Articles of Agreement.

ART. 23(c) The Great Lakes Employersand the Union each recognize the need topromote construction job site safety and tocontribute to the reduction or elimination ofindustrial accidents and unhealthy environ-mental conditions at work sites on a day-to-day basis. In recognition of this need, theparties adopt a Joint Safety and TrainingProgram which also encompasses annualdrug screening program. This programshall be funded by a contribution to MOSTof twelve cents ($0.12) per hour worked aspresently included in Section (a) above. TheSafety and Training Program shall be car-ried out in keeping with the Trust docu-ments and the policies and proceduresmanual adopted for this program.

ART. 23(c)(1) The parties to this programwill cooperate to accomplish a drug freeenvironment and a safe work place.Effective July 19, 1995, in the Great Lakesarea, drug screening will be mandatory.

ARTICLE 23MOST

ART. 23(a) Effective July 1, 2000 theEmployer agrees to contribute the appren-ticeship contribution rate established inArticle 21 plus twenty-four cents ($0.24) perhour worked to the Mobilization,Optimization, Stabilization, and Training(MOST) Program. ART. 24(b) Each Fund shall be jointlytrusteed with three (3) Trustees from thelocal union and three (3) Trustees from localemployers. ART. 23(c)(4) A subcommittee from eacharea will be formed to keep abreast of thelatest developments, changes, and technolo-gy pertaining to drug screening programs.The subcommittee will report any suggest-ed changes to the safety oversight commit-tee appointed by MOST.

ART. 23(c)(5) All contractors will berequired to perform on-site specific randomdrug testing, in accordance with MOSTDrug Screening Policy and Procedures(revised March 1, 2004), and all amend-ments now or hereafter approved by theBoard of Trustees.

ARTICLE 24DEVELOPMENT AND TRAINING FUNDS

ART. 24(a) In order to continue to improvethe knowledge and skill of Boilermakers andto assure a high quality of workmanship,each local union may establish aDevelopment and Training Fund. TheEmployer shall contribute the following con-tributions for each hour paid to the respec-tive Local Development and Training Fund:

ARTICLE 26GRIEVANCE AND ARBITRATION PROCEDURE

ART. 26(a) All grievances, other thanthose pertaining to general wage rates orjurisdictional disputes, that may arise onany job covered by this Agreement shall behandled in the following manner withoutpermitting the grievance to interfere withthe progress and execution of work in theprocess of adjustment.

ART. 26(b) Representatives of the localunion and the Employer shall first considerany such grievance, and if not settled with-in seven (7) working days, it will bereduced to writing and submitted to;

(CAF). The Employer shall submit the col-lected Campaign Assistance Funds to theInternational Secretary-Treasurer’s office nolater than thirty (30) days after the end ofthe month in which the deduction accrued.Obtaining the signed authorizations shallbe the responsibility of the Union. TheUnion shall hold the Employer harmlessand agrees to defend the Employer fully inany litigation resulting from this activitythat is deemed to be a service to the Unionby the Employer. The signed authorizationshall remain in force and effect until can-celed in writing by the employee.

ART. 25(b) The Employer shall with-hold five cents ($0.05) per hour paid forthe appropriate Boilermaker Local’s Stateand Local Political Action Fund (PAC),and ten cents ($0.10) per hour paid forthe Local Lodge 744 Sick and DistressedFund. The Employer shall submit the col-lected Political Action Funds to the localunion’s office, in care of the local union’sSecretary-Treasurer, no later than thirty(30) days after the end of the month inwhich the deduction accrued. Obtainingthe signed authorizations and maintain-ing of records shall be the responsibilityof the Union. The Union shall hold theEmployer harmless and agrees to defend

ART. 26(f) The expense of the third mem-ber of the Arbitration Committee shall beborne equally by the Union and theEmployer. All other expenses of the arbitra-tion procedure will be borne by the partyincurring them.

ART. 26(g) Any grievance must be sub-mitted in writing to the other party withinfifteen (15) working days of occurrence or itwill be considered closed.

ART. 26(h) Should the NationalAssociation of Construction BoilermakerEmployers (NACBE) and the InternationalBrotherhood adopt an alternate grievanceand arbitration procedure, then that proce-dure will be substituted herein after reviewand mutual agreement by both parties.

ARTICLE 27SAFETY MEASURES

ART. 27(a) All work of the Employer shallbe performed under mutually approvedsafety conditions which must conform toState and Federal regulations. However, asrequired by law, it is the Employer ’sresponsibility to provide a safe and healthywork place.

ART. 27(b) A warm, clean, dry place,shielded from dust, shall be provided foremployees to change their clothes and eat

ART. 26(c) The International Representativeof the Union and the Employer or Employersinvolved, and if not settled within seven (7)working days;

ART. 26(d) Then the grievance shall be sub-mitted in writing within seven (7) workingdays to an Arbitration Committee consistingof a representative of the Union, a representa-tive of the Employer, and a third member tobe chosen by those two (2) jointly. The deci-sion of the majority of the ArbitrationCommittee shall be final and binding on theparties involved. Such decisions shall be with-in the scope and terms of this Agreement, butshall not change such scope and terms, shallbe rendered within ten (10) working daysfrom the time of reference to the ArbitrationCommittee, and shall specify whether or notit is retroactive and the effective date thereof.

ART. 26(e) If the two members of theArbitration Committee fail to select a neu-tral member within five (5) working days,the two members already appointed shallwithin five (5) working days call upon theFederal Mediation and Conciliation Serviceto make the third selection. In the eventeither the Employer or the Union represen-tative fails to cooperate in calling upon theFederal Mediation and Conciliation Servicewithin the said five (5) working days, theother representative shall have the authori-ty to make such request.

not restrict his movements. Suitable leatherswill be made available on the job forwelders’ use when, at the discretion of thesuperintendent and foreman, they are nec-essary for welders’ safety and protection.Such suitable leathers shall be the propertyof the Employer.

ARTICLE 28MEDICAL TREATMENT AND EXAMINATION

ART. 28(a) Employees actually at workand who are required to take time off fromtheir employment during working hours tosecure treatment because of injuries or sick-ness arising out of and in the course of theiremployment shall receive pay for such timeplus necessary travel expenses incurredproviding he has a doctor’s certificate fromEmployer’s designated doctor showingtime he reported for treatment and length oftime required for such treatment. Should anemployee become ill or injured on a job, thejob superintendent shall designate a man toaccompany the man to his local residence,hospital, or for necessary treatment. In theevent an employee chooses to select hisown doctor for medical attention after thefirst day of injury and such visits are sched-uled during working hours, he shall be paidonly for actual hours worked.

ART. 28(b) Employees shall not berequired to take a physical examination,

lunches. Properly cooled drinking water andreasonable sanitary facilities, properly main-tained, will be made available. Attempts willbe made to obtain the use of the customer’stoilet and wash facilities. Upon failure togain the use of the customer’s facilities,when practical, the Employer shall, whereaccess to running water and a sewer is possi-ble, provide a means of wash up. Hand soapor similar cleansing agents shall be provided,including paper hand towels or sectionsthereof. Where pre-bid meetings are heldwith the customer, the use of owner facilitiesshall be requested.

ART. 27(c) Scaffolding, staging, walks, lad-ders, gangplanks, and other safety equipmentshall be provided where necessary and shallbe constructed in a safe and proper mannerby competent mechanics. No reinforcing rodof any size or type shall be used in any of theabove safety equipment.

ART. 27(d) In addition to the Employerbeing required to furnish adequate safetymeasures and equipment, it shall be arequirement of the employees to conform tosafety regulations and measures as provided.

ART. 27(e) Welders shall be furnishedsuitable replacement of welding gloveswhen employed as a welder. When awelder is required to use heliarc equipment,he shall be furnished a light glove that does

be unlawful or void by any tribunal havingthe right to so hold, the remainder of theAgreement shall remain in full force andeffect, unless the parts so found to be voidare wholly inseparable from the remainingportions of this Agreement.

ART. 30(b) It is further understood thatthis Agreement was negotiated with theUnion on an area-wide basis by theEmployers engaged in the field constructionindustry in the area. Should this Agreement,by notice given as herein provided bereopened for further negotiations, suchnegotiations shall be conducted on an area-wide basis by the Employers who have exe-cuted this Agreement and/or Employerssignatory to the National Agreement.

ART. 30(c) By agreement between a signa-tory Employer and the Union, a disputeregarding the application of any provisionsof this Agreement shall be submitted to thetwo Chairmen for their opinion. Failure tomutually agree to submit the dispute to thetwo (2) Chairmen, then either party may, inwriting, submit the dispute to the two (2)Chairmen for an opinion.

ART. 30(d) Any article or articles of thisAgreement, for a particular job or project,may be modified by mutual agreementbetween the Business Manager and theEmployer. Any such agreement shall be

unless required by governmental agencies,and there shall be no age limit except asprovided by law.

ARTICLE 29JOB NOTICE

ART. 29(a) In order to insure the satisfac-tory progress of each job, the Employer willfurnish the local Business Manager andInternational headquarters with the follow-ing job information as soon as possible andpractical:

(1) Location of job site (2) Approximate starting date and duration (3) Type of job (4) Approximate manpower requirements

ART. 29(b) Upon written request by theConstruction Division of the International,the home office representative of theEmployer shall, on letterhead stationery, des-ignate specific assignments of work on a job.

ARTICLE 30AGREEMENT QUALIFICATIONS

ART. 30(a) It is not the intent of eitherparty hereto to violate any laws or any rul-ings or regulations of any governmentalauthority or agency having jurisdiction ofthe subject matter of this Agreement, andthe parties hereto agree that, in the eventany provision of this Agreement is held to

Employer to stop work covered by thisAgreement for the duration of the strike.The Employer is required to give notifica-tion to the Union a minimum of five (5)working days prior to taking such action. Inthe event of an area strike over contractnegotiations, it will not be considered a vio-lation of this Agreement for the Union torefuse to furnish employees to theEmployer for the duration of the strike. TheUnion is required to give notification of theEmployer a minimum of five (5) workingdays prior to taking such action.

ART. 31(d) The Employer may dischargean employee for taking part in an unautho-rized strike.

ART. 31(e) Not withstanding any provisionof this Article, it shall not be a violation of thisAgreement for employees covered by thisAgreement to refuse to cross a picket lineestablished by any union or the local BuildingTrades Council representing employees at thejob if such employees are engaged in a strikewhich is properly sanctioned by theBoilermakers International Union.

ARTICLE 32WELDER CERTIFICATION

ART. 32(a) Any welder who is required totake a test on a job site shall be paid for thetime required to take the test.

reduced to written form, signed by both par-ties and in the hands of the Chairman ofboth Union and Employer committees,when practical to do so, before the com-mencement of any work at the job or project.

ARTICLE 31NO STRIKE, NO LOCKOUT

ART. 31(a) During the term of thisAgreement, there shall be no authorizedstrike by the Union or lockout by theEmployer, provided the Union and theEmployer abide by the provisions of thegrievance machinery.

ART. 31(b) In the event a strike occurswhich is unauthorized by the Union, theEmployer agrees that there shall be no lia-bility on the part of the Union, its officers oragents, provided the Union shall, as soon aspossible after notification by the Employerof a work stoppage, post notice at the jobthat such action is unauthorized by theUnion, and promptly take steps to return itsmembers to work.

ART. 31(c) In the event of an area strikeover contract negotiations between theInternational Brotherhood of Boilermakers,Iron Ship Builders, Blacksmiths, Forgers,and Helpers, AFL-CIO, and the Great LakesBoilermaker Employers, it will not be con-sidered a violation of this Agreement for the

ART. 32(b) If an Employer participates inthe Common Arc Program, no compensa-tion shall be paid to welders testing orupgrading under the program.

ARTICLE 33DURATION OF AGREEMENT

This Agreement shall become effectiveJuly 1, 2007, and shall remain in full forceand effect through June 30, 2010, and shallremain in force and effect from year to yearthereafter unless either party shall, at leastsixty (60) days prior thereto, notify the otherparty in writing of desire to modify or termi-nate this Agreement. In the event suchnotice is given, the parties in accordancewith the provisions of Article 30, Section (b),shall meet not later than fifteen (15) daysafter receipt of such notice. Should anunderstanding not be reached within thirty(30) days from the date such notice wasfiled, the procedure outlined in Section 8 ofthe Labor Management Relations Act, 1947,will be followed.

The foregoing Agreement and Appendix“A” were negotiated at a general conferenceof the Employers and the Union.

APDX. A(e) Practices not a part of termsand conditions of collective bargainingagreements will not be recognized.

APDX. A(g) A steward shall be a qualifiedworkman performing work of his craft andshall exercise no supervisory functions.There shall be no nonworking stewards.

APDX. A(h) There shall be no illegalstrikes, work stoppages, or lockouts.

APDX. A(i) When a local union does notfurnish qualified workmen within forty-eight (48) hours (Saturdays, Sundays, andholidays excluded), the contractor shall befree to obtain workmen from any source.

APDX. A(j) It is agreed that overtime isundesirable and not in the best interests ofthe industry or the craftsmen. Therefore,except in unusual circumstances, overtimewill not be worked. Where unusual circum-stances demand overtime, such overtimewill be kept at a minimum.

APPENDIX “A”NCA WORK RULES

APDX. A(a) The selection of craft fore-men and general foremen shall be entirelythe responsibility of the Employer, it beingunderstood that in the selection of suchforemen the Employer will give primaryconsideration to the qualified men avail-able in the local area. After giving suchconsideration the Employer may selectsuch men from other areas. Foremen andgeneral foremen shall take orders fromindividuals designated by the Employer.

APDX. A(b) There shall be no limit on pro-duction by workmen nor restrictions on thefull use of tools or equipment. Craftsmenusing tools shall perform any of the work ofthe trade and shall work under the supervi-sion of the craft foremen. There shall be norestrictions on efficient use of manpowerother than as may be required by safety reg-ulations, provided, however, legitimatemanning practices that are a part of nationalor local agreements shall be followed.

APDX. A(c) Security procedures for con-trol of tools, equipment, and materials aresolely the responsibility of the Employer.

APDX. A(d) Workmen shall be at theirplace of work at the starting time and shallremain at their place of work performing

for all of its Field Small Boiler and Repairemployees in the performance of all workcoming within the terms of this Agreementsubject to the provisions of existing laws.

APDX. B(b) Scope and Purpose ofAgreement.

APDX. B(b)(1) This Agreement shall applyto all Employer’s work traditionally knownas Small Boiler (all heating boilers andprocess boilers, 25,000 lbs. per hour or less)work and shall encompass all minor repairwork done in the field including installa-tion, maintenance, repair, and renovation.

Maintenance work shall be any work per-formed within the limits of a plant propertyinvolving renovation, repair, or preventivemaintenance to plant facilities. The termrepair as used herein is work required torestore by replacements of parts, or othermeans, any existing facilities to efficientoperating conditions. The word “renova-tion” as used herein is work required torestore by replacement, overhauling, orrevision of parts to existing facilities, to effi-cient operating condition.

This Addendum shall not apply to workof any nature performed in or about SteelMills, Oil Refineries, Chemical Plants, GasPlants, Ore Processing Plants, or UtilityPlants. This, however, does not preclude

APDX. A(k) If the contractor so elects, hemay work shift work at a rate negotiated inthe applicable agreements. If the agree-ments do not contain rates pertaining toshift work, the parties shall negotiate suchshift rates at the pre-job conference. TheEmployer shall determine the crafts andnumber of men to be assigned to each of theshifts as established.

APPENDIX “B”SMALL BOILER AND REPAIR ADDENDUM

APDX. B(a) Preamble.

WHEREAS, the parties hereto have main-tained a mutually satisfactory bargainingrelationship in the work area covered bycollective bargaining agreements betweenthem which have been in effect over a sub-stantial number of years; and

WHEREAS, the International Brotherhoodof Boilermakers, Iron Ship Builders,Blacksmiths, Forgers, and Helpers, and/orsubordinate subdivisions thereof, embracewithin its membership large numbers ofqualified journeymen who have constitutedin the past, and continue to do so, a majori-ty of the employees employed by theEmployers herein;

NOW, THEREFORE, the Employer recog-nizes the Union as the sole bargaining agent

The Union agrees that the Employer maybring one (1) foreman and three (3) boiler-makers to each job. All additional classifica-tions of qualified boilermakers shall bereferred from the Local where the work isbeing performed. If no qualified boilermak-ers are available, the contractor will beallowed to bring additional manpower.

APDX. B(b)(4) This article or other articlesof this Addendum may be modified bymutual agreement between the BusinessManager and the Employer. All such agree-ments shall be reduced to written form,signed by both parties and submitted to theChairman of the Employers Committee andUnion Committee for final approval, whenpractical to do so, before the commencementof any work at the job or project.

APDX. B(b)(5) All other major repair jobs,including all Federal, State, County, andCity work of any nature shall be performedat the construction rate of pay set forth inthe Great Lakes Articles of Agreementbetween Employers and the Union.However, where no prevailing wage isestablished for this work, the Small BoilerRepair rate of pay may be used with priorapproval of the Business Manager.

APDX. B(b)(6) This Great Lakes Articles ofAgreement Addendum shall apply to theknown or established territory, now under the

This rider covers the emergency repair ofnon-utility, completed, shop assembled,package boilers and shall pertain to all suchwork within the geographical jurisdiction ofthe Great Lakes Articles of Agreement, TheMissouri Basin Articles of Agreement, andany other additional territory that may beapproved by the International Brotherhoodof Boilermakers.

The Employer agrees to notify the appro-priate Local, within twenty-four (24) hours ofarriving on the job site, of where work isbeing performed, the description of work, theapproximate duration, and the manpowerrequirements for each job.
