REALTOR® A was the listing broker for 25 acres of land owned by Client B. Shortly after REALTOR® A’s sign was placed upon the property, Customer C called REALTOR® A and expressed interest in purchasing the property. After inspecting the property, Customer C made a full price offer. Surprised, Client B prepared a counter-offer at a higher price. REALTOR® A realized that he might have a legal claim for commission from Client B, but not wishing to jeopardize their relationship, agreed that he would go back to Customer C and attempt to negotiate a higher price.
Upon being informed of the property owner’s change of mind and his requested higher price for the property, Customer C became upset and indicated his intent to consult his attorney to determine if he could force the seller to go through with the sales transaction at the price for which it had been originally offered. At this point REALTOR® A advised Customer C that, in his opinion, litigation would be lengthy and expensive and that in the final analysis the sale could not be enforced. On the basis of REALTOR® A’s advice Customer C agreed to the higher price, and the transaction was consummated. Shortly after, Customer C complained to the Board of REALTORS® that REALTOR® A had provided bad advice to him. The Secretary referred the complaint to the Grievance Committee which determined that a hearing should be held and referred the matter back to the Secretary to arrange such a hearing.
At the hearing, Customer C outlined his complaint to the Hearing Panel of the Professional Standards Committee. He indicated that he had intended to consult his attorney, however, because of the persuasive personality of REALTOR® A and REALTOR® A’s assurance that legal action would be an exercise in futility, he had not done so. REALTOR® A advised the panel that he had told Customer C that he could consult his attorney, but that, in his opinion, it would be a waste of time. He defended what he had told Customer C stating that it was only his opinion, not intended as a conclusive statement of law, and, in fact, was a correct statement under the law of the state.
The panel concluded that REALTOR® A, in pointing out the fact that legal action was likely to be time consuming and expensive, was stating a practical circumstance which Customer C should consider and was proper. The panel further concluded that the expression of an opinion as to the probable outcome of the case was not an “unauthorized practice of law” within the meaning of Article 13.
However, the panel noted that a REALTOR® is obligated to “recommend that legal counsel be obtained when the interest of any party to the transaction requires it.” In this case, REALTOR® A was aware that the interest of Customer C required a legal opinion as to whether Customer C could compel Client B to convey title to the property and did not intend his personal opinion to represent a “statement of law” upon which Customer C could rely. Accordingly, REALTOR® A was obligated to affirmatively recommend that Customer C consult his attorney to definitively establish the legal rights in question. Having failed to make such a recommendation, REALTOR® A was in violation of Article 13.

MLS Statistics
Statistics developed by the REALTORS Association of Indian River County through its Multiple Listing Service and in conjunction with Florida REALTORS reflect the
following for November 2016/2015. The Residential closed sales of single family detached homes totaled 216 units for November 2016. This compares to a total of 175 units in
November 2015. The median price of single family detached homes sold by members of the REALTORS
Association of Indian River County MLS for November 2016 was $219,450. This compares to a median price of
$190,000 for November 2015. Current active inventory of residential single family detached homes total 1266 for
November 2016. This compares to the active inventory of 1222 for November 2015.
The Residential closed sales of condominium homes
totaled 57 units for November 2016. This compares to a total of 49 units in November 2015. The median price of
condominium homes sold by members of the REALTORS
Association of Indian River County MLS for November 2016 was $110,000. This compares to a median price of
$117,500 for November 2015. Current active inventory of condominium homes total 348 for November 2016. This compares to the active inventory of 332 for November
2015.

Government Affairs Update
Homeownership to Be in Hill Spotlight
Homeownership will be at the center of attention in Washington next year as lawmakers examine federal taxes and discuss Fannie Mae and Freddie Mac, Reps. Frank Lucas (R-Ok) and Brad Sherman (D-Ca) said during a recent forum on the future of the U.S. housing market hosted by NAR and S&P Global at NAR’s Washington office.
FHA Loan Limits to Increase in 2017
The federal government will raise the FHA national loan limit "ceiling" to $636,150 in 2017, from $625,500 this year, and will increase its "floor" to $275,665 from $271,050. The ceiling is set at 150 percent of the conforming loan limit, which represents the limit for conventional loans backed by Fannie Mae and Freddie Mac, and the floor is set at 65 percent of that limit. The higher loan limits reflect rising home prices around the country and the subsequent increase in the conforming limit, which in November was increased for the first time since 2016. It is now at $424,100, up from 417,000.
NAR Asks HUD to Modify Condo Rules
In a letter to HUD about the federal government’s proposed new rules for FHA condo financing, NAR is calling on the agency to either change the owner-occupancy threshold for FHA-certification to 35 percent or eliminate the threshold requirement entirely. NAR is also asking HUD to remove the existing 50 percent cap on the proportion of units in a condo project that may have FHA mortgages.

Data Protection Bill Falls Short
Legislation in the House to curb data breaches needs to go back to the drawing board, NAR says in a letter it submitted with several other organizations. The legislation falls short on protections while burdening businesses unnecessarily, the groups say. HAMP Debt Tax Relief Clarified
REALTORS® can alert homeowners to instructions from the IRS on how end-of-year tax issues will be handled if they’re participating in the federal government’s mortgage modification programs. The Principal Reduction Modification Program (PRMP) and the Home Affordable Modification Program (HAMP) provide incentives to lenders to modify troubled mortgages. The modifications can raise tax issues on a portion of any loans forgiven. The IRS instructions will be useful to homeowners facing a tax issue this year or next.

MLS Computer Training Monday, January 9th
Basic 10-Noon Using MLS resource links, adding, editing, searching for property, using the speed bar, hotsheets, field related controls, viewing, sorting and filtering a list and tack related controls. Advanced and CMA 1:30-3:30pm. Searching, creating custom hot sheets to suit your needs. This functionality keeps agents up to date on the latest market conditions. Using the listing cart functionality for listing managements into any clients cart fron virually anywhere into the program with multiple clients while navigating the MLS. Using the CMA wizard, you can customize your reports, branding, adjusting price to comparables. You can save incomplete CMA and print or email final reports directly to your clients.
“Sellers Waiver of Entry in MLS” The “Sellers Waiver of Entry” form is an agreement signed by the sellers and listing agent//broker to waive RAIRC MLS entry of a listing. When you notice that a property located in IRC appears in other websites or see a sign on a property, but do not see it listed in the RAIRC MLS, contact the Association. Staff will check to see if a “Sellers Waiver of Entry” form along with the listing agreement was submitted indicating that the listing is being waived from input by the sellers temporarily until a certain date or even for the entire listing period. This is a broker’s business decision. Sellers Waiver of Entry form can be found in FormSimplicity under Board Realtors Association Form.
“Variable Rate Commission in MLS”
Disclosing a specified or a different commission rate must be disclosed by the listing broker in the Listing Sub Type field of a listing as Variable Rate (VA). Refer to Section 5.3 of the MLS Rules and Regs.
“Public Open Houses” Open house are scheduled in MLS by location. Tuesdays the main land, Wednesdays Sebastian and the beach area is usually on Thursdays.
“GoMLS “MLSofIRC” App” On your Android or iPhone search for MLSofIRC or
CoreLogic and look for the Association icon and download the App. To access the app as a Realtor, press Agent login and use your MLS user ID and password, the same as you do in Matrix. To use app as a consumer, create a login using an email address and password.
“Reporting NON-MLS Property as Sold for Comps”
A $30 fee for listing entry by Association staff applies to and includes Non-MLS property when entered and reported as sold in the MLS for comparable purposes. A sold property will be allowed to be entered when sold by an MLS Participant firm when the following criteria is met and documentation is provided by mailing to RAIRC MLS Staff for entry into the MLS. The following are required: 1. Completed MLS data input sheet with all required fields describing the property for input and fill out the sold data on the change form 2. Exterior photo of the property emailed to MLS in jpg format and 3. One of the following to support that MLS Participant participated in the sell of the property; a. Signed Buyers Brokers Agreement with Buyer of Property. b. Copy of HUD showing participating brokerage firms to the transaction. or c. Copy of the commission check form Seller/closing Agent (FSBO) or Brokerage (Non-MLS Participant) showing the requesting office participated in the transaction. 4. Payment of $30 by Visa or Master Card .
“Matrix New and Enhanced Features” Some of the new features released Matrix 6.14.12 are: 1. Auto-emails that display multiple listings can now include direct links to the individual listing detail report on the customer portal. The links can be incorporated into simple text hyperlinks to the ML#, photo or more details. 2. A Data Checker widget is now added to the home page that will indicate if a current user has any current outstanding violations. 3, You can now edit contact information directly from send email screen without having to exit the send email process. 4. The auto-email disclaimer and unsubscribe text and link font size has been reduced to 8 pixels in auto e-mails. 5. New “Back to Results” link on full view on Portal. A new feature when viewing a full property display in the client portal the x button in the top right corner could easily be overlooked, so it has been replaced by a much more prominent “Back to Results” link in the left side of that same top bar. 6. Improved “Share Listing for interneet sites can now configure certain listing fields on the shared listing to be populated into social media as the title and description. The image that is used in social media displays is automatically set as the primary image for that listing. Next Basic and Advanced Matrix training is January 9th.

When having difficulties, please call Sentrilock (877-736-8745). They can easily
troubleshoot any issues as the APP does not always have sig-nal. In some cases, the lock-box needs to be woken up by having a card stuck into the
box then it works.
Message from SentriLock: RAD Connectivity
As of December 31, 2016, subscribers using the SentriLock Remote Access Device (RAD) may no longer be able to renew active SentriCards® using this device. This is due to AT&T deprecat-ing their 2G cell towers, which is out of our control. We do not anticipate that a subscriber will
experience a service outage as the RAD is designed to connect to other 2G networks, provided ser-vice is available in your area.
In the event that a subscriber experiences service failure, please have the subscriber contact Sentri-Lock support at (513) 618-5800 so that we can work with the subscriber on a resolution. In the
meantime, any subscriber can download and use the free SentriSmart™ app, which provides ac-cess to lockboxes, access reporting, ability to release shackle (if feature is turned on at the Associ-ation level), and allows the ability to renew a SentriCard® at a lockbox without cell service. In ad-
dition, SentriSmart™ features do not require physical renewal of the SentriCard® as SentriSmart™ automatically renews the users credentials daily.

All students registered for an RAIRC CEU course or event will receive an email confirmation 2 days prior to the scheduled course. If you have not received a confirmation email by this time, contact the Association to confirm you’re registered. If you register after this time, you will not receive an email confirmation. If you are not on the registration roster the day of class, you will be required to pay a Late Registry fee (see below for fee information).

Pre-Registration - FREE Late Registration - $5 per CE hour
AFFILIATE MEMBERS & *FL REALTORS® Pre-Registration - $10 per CE hour Late Registration - $15 per CE hour
*NON-MEMBERS Pre-Registration - $20 per CE hour Late Registration - $25 per CE hour
*Payment MUST be received prior to RSVP *NO REFUNDS for cancellation / No-Show
NO SHOWS: Anyone registered for a course or event that is a NO SHOW or fails to cancel his/her registration PRIOR to the registration deadline will be billed $10.00.
CANCELLTIAONS: Cancellations must be called into the Association office or emailed to [email protected] PRIOR to the registration deadline or it will be considered late & a $10.00 Fee will be assessed.
