3. The women in LOreals advertisements can be described as
beautiful, flawless, and perfect.
But beautiful is an opinion right?
Attractiveness can be positive in everyday life, socializing,
dating, etc. But what about work? Isnt it discrimination to fire a
promising employee because of their physical appearance?

Yanowitzwas directed by a top executive of LOreal to fire an
unnatractive saleswoman for not being sexy enough. After not firing
the salewoman and taking sick leave Yanowitzreturns to find she has
been fired.
5. Legal BattleYanowitz v. LOreal USA
LOreal contends that Yanowitzs firing was not related to her
refusal to fire the saleswoman.Rather they claim it is a result of
her falling work performance, though she had been recognized as one
of the best LOreal managers the prior year.
In a 4 year court Yanowitz is asserting that the executive was
practicing sexual discrimination by demanding a prettier saleswoman
and ignoring work performance.
6. Sex Discrimination
The California Appeals Court agreed with Yanowitz that her actions
were ethical and fair, while the executive was discriminating based
on his own sexual preferences.
An example of a similar instance of sex discrimination was listed
on page 259 it is illegal for airlines to require women working on
fights to adhere to harsher bodily restrictions in regards to
weight.This prevents rules that require female flight attendants to
be more aesthetically pleasing than male attendants.
Appearance may be a factor in hiring or firing employees as long as
it applies to both genders.
7. Appearance is everything?
There are certain standards set for job interviews requiring both
males and females to look professional.
First impressions are crucial to landing a big job and there are
companies out there with a certain look they are going for.
For example the restaurant Hooters isnt going to hire an overweight
male to prance around in little orange booty shorts.
8. 9. There are times when a job may be better suited for a
particular gender, there is also a line between what is
discrimination and what is not.
While a woman may be best suited for selling cosmetics a man may
prefer a job in construction requiring great strength and strong
deodorant.
If appearance prevents the company from accomplishing its goals to
sell make-up then it is in their best interest to replace the
employee regardless of how unjust it may be.

was created to provide women with the same rights as men

equal severity on both man and woman.
