GSAR and CNYIS Visioning and Beyond....As the real estate market starts to bloom this Spring, the leadership of GSAR and CNYIS is focusing on the vision for the organizations today and beyond. National Communications specialist Melynn Sight from NSight Marketing met with both orga-nizations and staff to come up with bright ideas to enhance membership services. The groups looked at internal strengths and weaknesses along with external op-portunities to assist members in the demands of the changing economy and legisla-tion. A communication plan will be developed to start. Many of you may have signed up for the latest communication endeavor, texting to “90210”, which is an opt-in to GSAR and CNYIS text alerts. Members and Brokers will be communicated with, only by their request, with what is “hot”, “need to know now”, education and meeting reminders. See page 5 for more information on how to sign up. Another initiative that the group will be focusing on is more technical education to help members keep up with the demands of the consumer. There are many useful features to the MLS service that many members don’t use...because they don’t know about them. CNYIS will be focusing on developing classes that will elevate product awareness. The plan is to assist members in becoming more efficient.

Fair Housing Month 2011To kick off Fair Housing Month in April, GSAR’s Equal Opportunity Committee hosted an informational seminar. Our special guests were Merrilee Witherell, Executive Director of the Fair Housing Council of CNY, and Robert DeMore, Director of Onondaga County’s Division of Community Development. The event began with Mr. DeMore issuing a proclamation officially designating April as Fair Housing Month. Merrilee Witherell presented fair housing bloopers and then answered questions from the group.

The seminar ended with Merrilee’s smart phone scavenger hunt.

Thanks to all who attended and especially to the Equal Opportunity Committee, for making this fun and educational event a success.

Lobby Day – May 24thThe Legislative Committee will once again be participating in NYSAR’s annual Lobby Day on May 24th. We will be travel-ling to Albany to educate our local representatives about issues important to the real estate industry. Meetings with Senators DeFrancisco and Valesky and Assemblymen Magnarelli, Barclay, Miller and Roberts are planned.

Lobby Day is a great opportunity for REALTORS® to have their voices heard. About 300 REALTORS® gathered in Albany for last year’s Lobby Day - the largest turnout ever! Professional Standards Case Interpretations

As a new feature of our weekly e-mailed HotNews, we have start-ed to feature one article of the Code of Ethics each week, just to keep them all fresh in our minds! On the same note, we would like to start running case interpretations in this newsletter.

These Interpretations of the Code of Ethics have been devel-oped by the Professional Standards Committee of the National Association of REALTORS® to help REALTORS® and REAL-TOR-ASSOCIATE®s understand the ethical obligations created by the Code of Ethics, and as a reference work for Grievance Committees, ethics and arbitration Hearing Panels, and Boards of Directors.

Interpretations of the Code of Ethics presents specific situations involving charges of alleged unethical conduct by REALTORS® and/or REALTOR-ASSOCIATE®s, which are reviewed by a peer panel of Board Members and in which decisions as to ethical conduct are reached. Each case provides the Hearing Panel’s decision based on the facts and the rationale for the decision, but does not specify a specific sanction or discipline to be imposed. There are two reasons for this. First, any sanction imposed must always fit the offense and must involve every consideration of justice, equity, and propriety. Second, a Hearing Panel may base its recommendation for discipline on a Member’s past record of ethics violations.

Case #1-13: Obligation to Present Subsequent Offers After an Offer to Purchase Has Been Accepted by the Seller (Adopted November, 1987 as Case #7-17. Transferred to Article 1 November, 1994.)

REALTOR® A had a 90-day exclusive listing on Seller X’s prop-erty. Seller X instructed REALTOR® A to list the property at $150,000 based upon the sales price of a neighbor’s house, which had sold a month earlier.

REALTOR® A aggressively marketed the property, filing the list-ing with the Board’s MLS, running a series of advertisements in

the local newspaper, holding several “Open Houses,” and dis-tributing flyers on the property at local supermarkets. REALTOR® A, whose listing contract was nearing expiration, held another “Open House” on the property, which resulted in an offer to pur-chase from Buyer Y at $15,000 less than the listed price. RE-ALTOR® A, convinced that this was the best offer Seller X was likely to obtain, persuaded Seller X to accept the offer. Seller X expressed dissatisfaction with REALTOR® A’s failure to obtain a full price offer, but signed the purchase agreement nonetheless.

The next day, REALTOR® B, a cooperating broker, delivered to REALTOR® A a full price offer on Seller X’s property from Buyer Z. Buyer Z had attended an earlier “Open House” and was very enthusiastic about the home’s location, stating that it would be perfect for his mother.

REALTOR® A advised REALTOR® B and Buyer Z that an offer had already been accepted by Seller X and that he, REALTOR® A, would not present Buyer Z’s offer. REALTOR® B and Buyer Z then promptly filed a complaint with the Board charging REAL-TOR® A with a violation of Article 1, as interpreted by Standard of Practice 1-7.

At the hearing, REALTOR® A stated that he felt he was under no obligation to present Buyer Z’s offer, since the listing agreement did not specifically provide that subsequent offers would be pre-sented to the seller. Further, REALTOR® A felt that such a prac-tice could only lead to controversy between buyers and sellers, as well as result in breached contracts. “Why get everyone in an uproar,” said REALTOR® A, “by presenting offers after one has been accepted? And what would I do if Seller X wanted to back out of the first purchase contract and accept Buyer Z’s offer?”

The Hearing Panel found REALTOR® A in violation of Article 1. In their “Findings of Fact and Conclusions,” the Hearing Panel cited REALTOR® A’s lack of understanding of the requirements of Article 1, as interpreted by Standard of Practice 1-7. The panel noted that state law did not prohibit the presentation of offers af-ter an offer had been accepted by the seller; that the fact that the listing contract was silent on whether subsequent offers would be presented did not relieve REALTOR® A from the obligation to present such offers; that as the agent of the seller, REALTOR® A must always act in the seller’s best interest and advise the seller of all offers submitted; and that should the seller wish to consider accepting a subsequent offer, REALTOR® A must advise the seller to seek the advice of legal counsel.

Standard of Practice 1-7When acting as listing brokers, REALTORS® shall continue to submit to the seller/landlord all offers and counter-offers until clos-ing or execution of a lease unless the seller/landlord has waived this obligation in writing. REALTORS® shall not be obligated to continue to market the property after an offer has been accepted by the seller/landlord. REALTORS® shall recommend that sellers/landlords obtain the advice of legal counsel prior to acceptance of a subsequent offer except where the acceptance is contingent on the termination of the pre-existing purchase contract or lease. (Amended 1/93)

Pathways to ProfessionalismWhile the Code of Ethics and Standards of Practice of the National Association establishes objective, enforceable ethical standards governing the professional conduct of REALTORS®, it does not address issues of courtesy or etiquette. Based on input from many sources, the Professional Conduct Working Group of the Professional Standards Committee developed the following list of profes-sional courtesies for use by REALTORS® on a voluntary basis.

Respect for the PublicFollow the “Golden Rule”—Do unto others as you would have them do unto you.Respond promptly to inquiries and requests for information.Schedule appointments and showings as far in advance as pos-sible.Call if you are delayed or must cancel an appointment or showing.If a prospective buyer decides not to view an occupied home, promptly explain the situation to the listing broker or the occupant.Communicate with all parties in a timely fashion.When entering a property, ensure that unexpected situations, such as pets, are handled appropriately.Leave your business card if not prohibited by local rules.Never criticize property in the presence of the occupant.Inform occupants that you are leaving after showings.When showing an occupied home, always ring the doorbell or knock—and announce yourself loudly—before entering. Knock and announce yourself loudly before entering any closed room.Present a professional appearance at all times; dress appropri-ately and drive a clean car.If occupants are home during showings, ask their permission be-fore using the telephone or bathroom.Encourage the clients of other brokers to direct questions to their agent or representative.Communicate clearly; don’t use jargon or slang that may not be readily understood.Be aware of and respect cultural differences.Show courtesy and respect to everyone.Be aware of—and meet—all deadlines.Promise only what you can deliver—and keep your promises.Identify your REALTOR® and your professional status in con-tacts with the public.Do not tell people what you think—tell them what you know.

Respect for PropertyBe responsible for everyone you allow to enter listed property.Never allow buyers to enter listed property unaccompanied.When showing property, keep all members of the group together.Never allow unaccompanied access to property without permission.Enter property only with permission even if you have a lockbox key or combination.When the occupant is absent, leave the property as you found it (lights, heating, cooling, drapes, etc). If you think something is amiss (e.g. vandalism) contact the listing broker immediately.Be considerate of the seller’s property. Do not allow anyone to eat, drink, smoke, dispose of trash, use bathing or sleeping fa-cilities, or bring pets. Leave the house as you found it unless instructed otherwise.Use sidewalks; if weather is bad, take off shoes and boots inside property.

Respect for PeersIdentify your REALTOR® and professional status in all contacts with other REALTORS®.Respond to other agents’ calls, faxes, and e-mails promptly and courteously.Be aware that large electronic files with attachments or lengthy faxes may be a burden on recipients.Notify the listing broker if there appears to be inaccurate informa-tion on the listing.Share important information about a property, including the pres-ence of pets, security systems, and whether sellers will be pres-ent during the showing.Show courtesy, trust, and respect to other real estate professionals.Avoid the inappropriate use of endearments or other denigrating language.Do not prospect at other REALTORS®’ open houses or similar events.Return keys promptly.Carefully replace keys in the lockbox after showings.To be successful in the business, mutual respect is essential.

Real estate is a reputation business. What you do today may affect your reputation—and business—for years to come.

REALTOR Party Political Survival InitiativeBackground: In March 2011, NAR launched the REALTOR® Par-ty Political Survival Initiative. The initiative is a bold and powerful proposal to make the Voice of Real Estate one of the most influ-ential advocacy groups in America.

SRI/NYSAR: New York State consumers sense im-proved housing market, optimistic about future

According to the Siena Research Institute and New York State Association of REALTORS Consumer Real Estate Sentiment Scores for the first quarter of 2011, consumers in the Empire State see now as a poor time to sell with a score significantly be-low breakeven at -36.7 but as a very good time to buy with a high positive score of 31.4. Still, both the current sell and buy have moved in the direction of a thriving market. Looking forward, the overall future Real Estate Sentiment score is 15.9 (relatively un-changed from 16.0 last quarter) indicating that New Yorkers ex-pect the overall real estate market and the value of property to increase over the next year.

“REALTORS are reporting increased market interest, which seems to support the poll’s finding that New Yorkers are more optimistic about the housing market,” said Duncan R. MacK-enzie, NYSAR’s CEO. “We expect second quarter numbers to be even better and it will reflect positive public reaction to the on-time budget approved by lawmakers and Governor Cuomo. NYSAR expects an even more positive outlook if the Governor’s two-percent property tax cap is enacted, which we believe will bring homeownership within the reach of more first-time home-buyers.”

According to SRI director Dr. Don Levy, not since the federal homebuyer tax credit have all three current market indicators moved toward, what he calls “real estate health.” The report also shows New York City residents to be most optimistic, followed by its suburbs with upstate finishing last.

Existing-Home Sales Rise in Most States in First Quarter; Metro Area Prices Mixed

Existing-home sales continued to recover in the first quarter with gains recorded in 49 states and the District of Columbia, while 22 percent of the available metropolitan areas saw prices rise from a year ago, according to the latest survey by the National Association of Realtors®.

Total state existing-home sales, including single-family and con-do, rose 8.3 percent to a seasonally adjusted annual rate of 5.14 million in the first quarter from 4.75 million in the fourth quarter, and are only 0.8 percent below a 5.18 million pace during the same period in 2010.

Also in the first quarter, the median existing single-family home price rose in 34 out of 153 metropolitan statistical areas (MSAs) from the first quarter of 2010, including four with double-digit in-creases; one was unchanged and 118 areas showed price de-clines.

Lawrence Yun, NAR chief economist, said home prices are all over the map. “The reading of quarterly price data can be vola-tile because they are based on the types of homes that are sold during the quarter. When buyers principally purchase distressed properties in a given market, the recorded prices will be very low, which is what we’re seeing now in much of the country,” he said. “Annual price data provides a better guide about the direction of the market in those areas.”

The national median existing single-family home price was $158,700 in the first quarter, down 4.6 percent from $166,400 in the first quarter of 2010. The median is where half sold for more and half sold for less. Distressed homes, typically sold at a discount of about 20 percent, accounted for 39 percent of first quarter sales, up from 36 percent a year earlier.

To clarify, Yun said lower priced homes have seen the best sales performance. “The biggest sales increase has been in the lower price ranges, which are popular with investors and cash buyers,” he said. “The preponderance of sales activity at the lower end is bringing down the median price, so what we’re seeing is the result of a change in the composition of home sales.”

Although sales are slightly below a year ago, the volume of homes sold for $100,000 or less in the first quarter was 8.9 per-cent higher than the first quarter of 2010, creating a downward skew on the overall median price. The share of all-cash home purchases rose to 33 percent in the first quarter from 27 percent in the first quarter of 2010.

Investors accounted for 21 percent of first quarter transactions, up from 18 percent a year ago, while first-time buyers purchased 32 percent of homes, down from 42 percent in the first quarter of 2010 when a tax credit was in place. Repeat buyers accounted for a 47 percent market share in the first quarter, up from 40 percent a year earlier.

“The rising sales trend in nearly all states is a part of the healing process to clear off inventory. Sales need to rise be-fore prices can firm up,” Yun added.

NAR President Ron Phipps, broker-president of Phipps Re-alty in Warwick, R.I., said strong sales of distressed homes are exactly what the market needs. “The good news is foreclosures, which account for two-thirds of all distressed homes sold, are selling very quickly,” he said. “Short sales still take far too long to get lender approval, but it appears the inventory of distressed property is peaking and will be gradually declining next year. This means the market should slowly return to balance. We are encouraged that recent home buyers are having exceptionally low default rates.”

According to Freddie Mac, the national commitment rate on a 30-year conventional fixed-rate mortgage averaged 4.85 percent in the first quarter, up from a record low 4.41 percent in the fourth quarter, but below the 5.00 percent average in the first quarter of 2010.

Regionally, existing-home sales in the Northeast increased 0.8 percent in the first quarter to a level of 800,000 but are 7.3 percent below the first quarter of 2010. The median ex-isting single-family home price in the Northeast declined 5.0 percent to $234,100 in the first quarter from a year ago.
