Project Summary:
Project Summary:
The rising incidence and severity of natural disasters in recent years has prompted
Caribbean governments to take a hard look at how it should be responding to these
situations. The pressure from the community to become involved is significant. What
should be done to provide positive support in the relief or recovery phase of a
disaster? The unintended consequences of providing support to people who have been
affected by disaster can have a significant negative impact if done improperly. Good
intentions are not enough. Many factors are involved including global standards,
societal and cultural norms, economic and environmental impact, support to recovery,
logistics and cost in ensuring the adequacy of the response. Advance planning and
proactive and straightforward communication can reduce fears and begin the
rebuilding and healing process.e3-6

Project Description:
A. Consultant’s experience
Environmental Advisors Inc. (EAI) is an environmental management firm that has been providing the highest quality consulting services in the Caribbean for nearly two decades. The Company is incorporated in Trinidad and Tobago. The firm works with its Caribbean and international expert associates to provide advice on all aspects of sustainable development management. Legal, policy and institutional issues are among the key focus areas of EAI. Other action areas include integrated water resources and natural resources management, sustainable energy, climate, engineering, natural resources economics, development planning and capacity-building. Judy Daniel is the President of the firm and its senior legal, institutional and international law expert.

B. Description of Approach, Methodology and Work Plan for Performing the Assignment
a. Technical Approach and Methodology
Technical Approach
The Scope of Work section of the Terms of Reference adequately summarises the
various sub-tasks that will be required of the Consultant. The following is our
preliminary assessment, based on the understanding of the project, of the work
required of each of the sub-tasks, as well as an indication of how we would staff the
effort. We have included in Form 1 attached to this proposal, a Work Schedule which
provides an indication of the time frame in which this work will be performed. The
Work Schedule is also presented in a bar chart. In addition, a Financial proposal
which provides a detailed cost breakdown is attached at Form 2 to this proposal.
1. Start of Assignment
1.1 Finalisation of Workplan & Timetable Inception
The EAI Team and OAS Project Secretariat will hold an inception meeting via
teleconference. The EAI Team leader will prepare an agenda for this meeting that
will include a discussion on the draft project schedule and timetable.
2. Preparation of Draft Report Identifying Best Practices
This exercise will include –
(a) a review of national policies in each of the participating countries regarding
“Declarations of State of Emergency”

A comprehensive policy towards state of emergency requires a full understanding of
the character and effects of the circumstances requiring state of emergency, the
existing and potential vulnerabilities and the context for response. It provides a sound
basis for developing a responsive programme when circumstances that require a state
of emergency arise.1 This review will enquire into the peculiarities and concerns that
exist in each of the participating countries (PCs) that underlie the decisions to declare
a state of emergency.
(b) a review of Eastern/Western Caribbean Donor Group Operations Procedure for
Disaster
The procedure has been used when several hurricanes struck in the PCs. This review
will identify any improvements as regards responsiveness/appropriateness of the
procedures and make appropriate recommendations.
(c) a review of CDERA policies for emergencies
CDERA is the key agency that is responsible for disaster management in the
Caribbean region including Haiti and Dominican Republic. CDERA has recently put
in place a Comprehensive Disaster Management (CDM) strategy as a new approach to
tackling disasters. This review will consider the administrative and programming
changes that have resulted.
(d) consultations with CARICOM/CDERA and other relevant government officials
regarding the issuance of declarations of emergency.
With new approach in place it will be necessary to hold consultations with
CARICOM & CDERA as regards policy changes to national and regional
programmes for tackling disasters.
(e) consideration of Cayman Islands Government decision.
The Cayman government did not declare impacts of the recent hurricane disaster for
fear of losing offshore/tourism advantages. The local population however suffered
initially under this policy. The time of intervention is a key factor to consider in
determining intervention as regards disaster relief.
The team will enquire into the circumstances surrounding the Cayman situation in
developing best practices as regards prioritizing mitigation interventions, which is
critical in a time of tight budgets and high demands on governments and the private
sector.
(f) based on findings prepare a draft report identifying best practices the use of state
of emergency and disaster declarations in disaster response. The report will be
presented in the form of guidelines/operating methods to best alleviate the effects of
such an event specific to different types of disasters e.g. hurricanes, floods,
earthquakes and various sectors in society e.g. women, children, youth.

3. Preparation of draft assessment report
The Team will-
(a) analyse the proposed solutions proposed in the Draft Report at Activity 2 (f) to determine their applicability on a national
and regional basis;
(b) review and analyse model legislation in the context of the
ability of key agencies to mobilise executive powers in the
aftermath of a disaster. The focus will be on identifying gaps
in the model that may impede the actions that are required to
be undertaken.
(c) In an assessment report, make recommendations to improve
the model legislation to be responsive in the aftermath of a
disaster.
4. Preparation of Draft Final Report A draft final report will be prepared taking into account output 2 and 3 and contain
recommendations and best practices. It will be submitted to OAS/DSD for comments.
5. Revision of Draft Final Report
The Team Leader will -
(a) revise the Draft Final Report to take account of any comments or revisions
proposed by the OAS/DSD;
(b) prepare and finalise an Executive Summary for the Draft Final Report. The
Executive Summary will contain, inter alia, recommendations at the national
level, identify regional trends, similarities and differences between the PCs;
regional recommendations.
(c) submit Final Draft Report to OAS/DSD.
Methodology
The proposal is structured such that Environmental Advisors Inc. is the tendering
consultant. Project outputs will be delivered by a four man team of associate consultants
comprising Team Leader Judy Daniel, Dr. Jean Andre Victor, John Wilson and Dr.
Judi Gobin.
John and Judi have specialised expertise on the management of natural disasters. Dr.
Victor and Judy Daniel are legal, policy and institutional capacity building experts
with Dr. Victor having specialised knowledge about the French and Spanish legal and

institutional frameworks and their operations. The preparation of the
Executive Summary to the Report, the Report and recommendations will be a team
effort.
The project will be conducted as a desktop study as the resources that are available
will not cover field trips, save and except in the country in which the consultant is
resident. In light of this, our team members were selected because they have a well-
established network of key policy makers and stakeholders in the participating
countries. This makes it possible to hold teleconferences and group meetings with
them in order to obtain information. The team consultants have agreed to be
accessible throughout project delivery.

c. Organization and Staffing Project
The tasks will be performed by a Consultant Team comprising Team Leader Judy Daniel, Dr. Jean Andre Victor, John Wilson and Dr. Judi
Gobin. The cv’s of the consultants are attached at the Annex to this proposal.

Main disciplines of the assignment, key experts and proposed technical and support staff The Consultant Team members will comprise - Judy Daniel – Team Leader
Judy Daniel is an environmental lawyer. Judy received her law degree, with honours, from University of the West Indies and was admitted to practice
law in Trinidad and Tobago in 1983. She completed her post-graduate studies in environmental law and management at Tufts University, Boston
USA. Ms. Daniel has extensive experience working on environmental regulations, policy and institutions in the Caribbean and has held fulltime
positions of International Legal Consultant to the International Maritime Organisation/World Bank, Legal Advisor to the Ministries of Planning,
Environment and Agriculture, Lands and Marine Resources of Trinidad & Tobago.
Judy Daniel, Senior Consultant, Environmental Advisors Inc., is an attorney-at-law with over twenty years’ experience as a proven leader
and team-focused specialist in all areas of, international, regional and domestic environmental law, policy and institutional development,
planning law, negotiations and legislative drafting. Judy has held long-term positions of Environmental Advisor to the City of Macon, Georgia,
International Legal and Policy Consultant to the World Bank/International Maritime Organisation WCISW Project and Senior Legal and Policy
Advisor to the Ministries of Planning and Development, Agriculture and the Environment.
As Senior Legal and Policy Advisor to the several government Ministries, Judy led the Caribbean legal and policy team for the for the United
Nations Conference on Sustainable Development, the UN Conventions on Biodiversity and Climate Change and the Global Conference on the

Sustainable Development of Small Island Developing States. Judy was also responsible for the development of international environmental
policy and in that regard has followed the negotiations on several international instruments that include the Basel Convention on the
Transboundary Movement of Hazardous Waste, Rottedam and Stockholm Conventions.
Judy Daniel is highly regarded as a key advisor by senior managers with a unique combination of strong legal and technical skills in a broad
range of areas and the ability to produce workable solutions. She has a strong working knowledge of the legal and institutional frameworks,
politics, society, key actors and civic groups in the Caribbean and a proven ability to work effectively in cross-cultural situations with
multidisciplinary teams of experts. Judy has a working knowledge of Spanish.
Through her consulting experience, Judy has acquired broad-based experience in complementing international and Caribbean multidisciplinary
teams, and in advising regional governments on key policy. She is specially skilled in report writing and team management. Judy has professional
ties throughout the Caribbean and possesses a keen sensitivity and understanding of the legal, institutional and administrative operations of Caribbean
countries and culture.
John Ricky Wilson
Mr. Wilson is a highly motivated professional of proven ability with notable technical and programmatic experience in post disaster project
management and environmental management. He brings to the Team over 15 years negotiating experience in regional and international fora,
sound international development assistance experience, policy formulation, familiarity of sustainable development matters as it relates to Small
Island States and multi-island project management capacity. As an IDB Consultant Mr Wilson
• Oversaw the post hurricane recovery/rehabilitation work in Grenada, Tobago, Bahamas, Antigua, St Lucia and Dominica following the
passage of Hurricane Ivan in the amount of USD20 Million. The activities were diversified: Grenada (11 medical clinics,250+ house
repairs, 5 biodiversity projects and 6 schools repairs); Tobago (3 road stabilisations and community emergency capacity building of 45
residents ); Antigua (Safer building techniques) and in St Lucia and Dominica (community land stabilisation and flooding/landslide
mitigation work in two communities) and in the Bahamas 20 new homes. All works were delivered on time and within budget despite
programmatic issues including a late start, the additional impacts of hurricanes and shortages of materials;
• Coordinated the development of a disaster risk reduction strategy (benchmarking tool) in partnership with the OECS Secretariat;

He has also provided Project Management for ICT/Disaster Project (CDERA).
Dr. Jean Andre Victor
Among his many career accomplishments Dr. Victor is a Law Professor of Law at the University of Haiti. He earned his Msc. Degree form the
University of Costa Rica and pursued his Ph.D. in International Law at the University of Limoges in France (2000-2002). He has been involved
in several project activities for USAID, the Government of Canada and IICA. His responsibilities included project evaluation and budget
allocations. His work assignments include (1967 – 1991) the Ministry of Agriculture, Natural Resources and Rural Development before joining
the University in 1987. Dr. Vicor has also led many project activities as an international law consultant. A full description of his capabilities is
attached in the Annex to this proposal.
Dr. Judi Gobin
Dr. Judith Gobin attained a Ph.D from the University of Exeter and the Plymouth Marine Laboratory, U.K. in the field of Marine Benthic
Ecology (1994). Dr. Gobin previously worked as a team member in the Environmental Quality Research (EQR) Group at the Institute of Marine
Affairs (IMA), Trinidad for 16 years (between 1982 and 1998); during this time she also supervised the team (EQR) for approximately 3 years.
She is presently a Lecturer (since Sept. 2002) at the University of the West Indies, St. Augustine in the Dept. of Life Sciences, Faculty of
Agriculture and Natural Sciences (Oceanography and Marine Biology, Coastal Ecosystems Management) and in the Faculty of Engineering
(Land use and Natural Resources, Coastal Zone Planning, Environmental Impact Assessments).
She has tremendous environmental and ecological experience in the marine, coastal and terrestrial areas of Trinidad and Tobago having
developed this both at the IMA and as a private consultant (1998 to 2002). She has worked extensively on Environmental Impact Assessments
(EIAs) for coastal and land based operations of petrochemical and other industries (see attached cv). She has generated numerous reports in
addition to administering advice on the effects of Infrastructural Development and hazards in both coastal, offshore and terrestrial areas. She has
also co-ordinated numerous Environmental Management Plans (EMPs) for industries and other agencies, towards management and conservation
of natural resources* in Trinidad and Tobago.

While her primary research interests are in Coastal and Marine Ecology; she has been recently working on a number of environmental
management projects which extend to and include other disciplines of study (eg. coastal zone management, land use/planning, environmental
economics and water resources management).

Ms. Paul is a recent graduate of Mercer University with a Bachelor of Arts in English and Women and Gender Studies. At EAI, Ms. Paul

Legislation to implement MARPOL. This legislation considered and promoted action by Caribbean countries compliance with the Basel

and present a cooperation strategy for the instruments. The proposals were based on the Synergies Decision taken at the Basel COP in June
2008.

Together with a multidisciplinary team of Caribbean and international experts the project delivered national reports on the legal, institutional
and policy framework for watershed and coastal and marine areas, assessed water quality gaps and proposed recommendations for policy review.
As Team Leader Judy drafted model legislation modules to implement, the Land based Sources of Marine Pollution Protocol to the Cartagena
Convention and a Guideline document for implementation by 13 Caribbean countries. The Guidelines examined the synergistic relationship
between the Convention on Biodiversity, Framework Convention on Climate Change and the United Nations Convention on the Law of the Sea
with the objective of avoiding duplication and conflict in the implementation of these instruments. Judy provided project management support to
the 15-member consulting team and reports to the IWCAM Regional Project Coordinator.
World Bank/Government of Grenada, project to prepare Biomedical Waste Policy, Technical Guidelines, and Regulations, (final report
submitted), 2007.
As Lead Consultant, Judy was responsible for coordinating multidisciplinary and multi-sector team of experts including water-related institutions,
prepared draft Biomedical Policy and Regulations. The provisions of the Rotterdam and Stockholm Conventions were considered in the exercise
to draft legislation that was consistent with international policy for the management of waste.
UNEP, Draft Model Biodiversity Act for OECS countries, 2006 A key element of the drafting process involved an examination of the various concepts for reforming international environmental governance for 6
related MEAs. The objective of this approach was to assist Caribbean countries that are already challenged due to limits on their human,
financial and technical resources to implement MEAs. By clustering related MEAs and their governance structure countries would be better
positioned to effectively implement several instruments and meet their treaty obligations. The merits of the various options and proposals for
clustering between elements of multilateral environmental agreements (MEAs) were therefore analysed. The recommendations were reviewed
and agreed upon by the Client and the result was the Draft Model Biodiversity Act proposing a legal and institutional framework to implement 6
biodiversity conventions. The Draft Model was reviewed by UNEP (Nairobi), OECS and academia and met with their approval.

As Lead Legal Consultant prepared a raft Act. A combined review was conducted by the Chief Legal Reform Commissioner, a multi-stakeholder
Committee and the Lead Legal Consultant. The draft is being prepared for submission to Cabinet.

UNEP, Project to prepare Draft Environmental Management Policy, Act & Regulations for Grenada, 2006. The drafting exercise required a rationalisation of other relevant legislation including the implementation of international pollution control
instruments, physical planning, conservation and national parks legislation. The final draft is awaiting Cabinet approval and enactment.
IADB/Gov’t of Guyana, Draft Physical Planning and Development Act & Regulations, July 2006 Worked with development planning officials to modernise physical planning laws and rules; coordinating them with EIA requirements contained
in the Environmental Protection Act. The draft Act has been reviewed and finalised by the Chief Parliamentary Draftsman’s Office.
UNECLAC, Proposal to Declare the Caribbean Sea a Special Area in the context of Sustainable Development, 2004
This project included a review of institutional arrangements for several sustainable development agreements to propose recommendations for
useful mechanisms and activities that would promote the Declaration.
PAHO/Gov’t of BVI, Prepare Draft Water Quality Standards Regulations, 2005 These draft regulations have been reviewed by the Attorney General’s Chambers and are awaiting enactment.
Environmental Management Plan, Policy, and regulations Guyana, 1997-2004 This Consultant led team activities for the preparation of Environmental Policy and Plans, Pollution Control Policy, Enforcement Policy,
Conservation Policy and an Integrated Waste Management Policy. This long term project involved the drafting of air, noise, water pollution
regulations. The Consultant also prepared compliance Manuals and delivered training seminars and workshops to a wide range of public, private,
quasi-government and non-governmental organizations.
Global Water Partnership, Integrated Water Resources Management (IWRM), Dec. 2006. The Consultant provided technical training and support to Caribbean water managers towards the development of IWRM capacity. The activity
engaged a review of water resources law and policy for participating Caribbean countries with the aim of assisting these territories in developing
comprehensive policy documents for government approval.
