1. INTRODUCTION

Clay bricks are produced in Rajasthan in small or cottage scale brick

kilns and clamps which operate seasonally. The raw materials in the

brick kilns include topsoil, coal, paddy husk, fly ash, wood & locally

available agro wastes to some extent. Brick manufacturing process

generates emissions discharged from the brick kilns. Brick kiln

emissions consists of mainly coal fines and dust particles. There are

other activities like mining/quarrying of clay, handling &

transportation of raw material/bricks which also contribute to air

pollution.

The process involved in the brick kilns is such that if appropriate

measures are not taken, it may lead to pollute air and besides impact

on land, soil, flora and fauna, hence it has been categorized as ‘RED’

category industry by the Board. It is, therefore, mandatory that brick

kiln units must adopt appropriate measures to prevent/control

discharge of pollutants in the air and must also have adequate

arrangement to control the particulate matter in the premises of the

unit itself.

Any project proponent intending to establish a brick kiln unit must

seek prior consent to establish under the Air (Prevention and Control

of Pollution) Act, 1981 before taking any step for establishing the

industry. Likewise, after establishing the brick kiln, the project

proponent must seek prior consent to operate before commissioning

the plant.

2. COMPETENT AUTHORITY

The State Board has delegated powers to Regional Officers of the

Board to grant or refuse applications for consent to establish and

consent to operate submitted under the provisions of Air (Prevention

& Control of Pollution) Act, 1981 (Air Act) for the brick kilns.

However, when a consent application is refused by Regional Officer,

the decision on the application submitted subsequently is taken by the

Head Office.

Therefore any person who intends to establish/operate a brick kiln

may submit application for consent to establish/operate at the

concerning Regional Office of the Board.

3. LOCATION OF LAND

A Brick Kiln unit can be established on a land owned by the promoter

(this also includes land taken on lease or agreement for at least 10

years) provided that:-

3.1 The land is not located within a radius of 1.5 km (aerial

distance) from abadi area of any revenue village as defined

under the provisions of Land Revenue Act.

Explanation – Revenue village is the village or Dhani notified

as such by Revenue Department of the State Government and

the distance is to be verified by concerned revenue officer not

below the rank of Tehsildar in the model format enclosed as

annexure -1.

3.2 The distance (aerial) of the nearest point of boundary of the

land from the State/ National Highway must be at least 100

meters, and from other roads at least 50 meters.

Explanation – Distance is to be measured from the boundary of

the road, to be verified by concerned revenue officer not below

the rank of Tehsildar in the model format enclosed as

annexure-1.

3.3 The distance (aerial) of the nearest point of boundary of the

land must be at least 500 m from National Park & Sanctuaries,

and 100 meters from Reserve Forest/Protected Forest.

Explanation- In cases where the claimed distance is equal or

marginally more than the above limit, the distance is to be

verified by the concerned Forest Officer not below the rank of

Range Officer in the model format enclosed as annexure –2

and/or annexure –3 as the case may be.

3.4 The distance (aerial) of the nearest point of boundary of the

land must be at least 500 meters from any Prominent Public

Sensitive places/ Prominent Places of Worship/ School/

Hospital/ Community Parks/ Notified Archaeological

Monuments.

Explanation- To be verified by concerned revenue officer not

below the rank of Tehsildar in the model format enclosed as

annexure -1.

3.5 The distance (aerial) of the nearest point of the land must be

atleast 1500 meters from the water body located in the down-

stream side. However, if brick kiln unit is likely to have

adverse effect on catchment area of the water body or is likely

to obstruct the flow path of a natural stream, drain, nullah, river

etc. even if the land is located beyond 1500 metre from such

water body, permission shall not be granted to establish the unit

on such land.

Explanation - The distance from water body must be verified by

concerned Assistant Engineer, Water Resources Department

(Irrigation) in the format enclosed as annexure –4.

Provided further that the above mentioned distance criteria shall

not be applicable for the existing brick kiln units which have been

established after obtaining valid consent from the State Board

prior to issuance of these guidelines and do not intend to expand

capacity.

Provided also that in case of units established after seeking

consent from the State Board, the consent shall not be renewed if

it is found that:-

(i) The local community has been experiencing the air pollution

from the emissions of the brick kiln, and/ or

(ii) The water flow to the water body in the downstream is

getting obstructed, and/ or

(iii) The project proponent has failed to comply with conditions

laid down in the consent.

4. LOCATION OF PLANT & MACHINARY

The minimum area of land for establishing a brick kiln unit should be

such that after establishing plant and machinery and leaving sufficient

space for material stock and movement of vehicles, enough space is

available all around for planting at least two rows of trees and shrubs

along the periphery as mentioned at para 12.

5. RESTRICTIONS VIDE FLY ASH, TAJ TRAPEZIUM, MOUNT

ABU ECO-SENSITIVE ZONE AND ARAVALI NOTIFICATIONS.

(A) Notification for utilisation of fly ash from coal or lignite based

thermal power plants issued by Ministry of Environment and

Forests(MoEF) under Environment (Protection) Act, 1986.

Any brick kiln, located within a radius of 100 km from coal or

lignite based thermal power plants, must use at least 25 percent of

ash (fly ash, bottom ash or pond ash) with soil on weight to weight

basis.

(B) Taj Trapezium Notification

Vide notification no. S.O. 489(E) dated 30/04/2003 issued by

Ministry of Environment and Forest, GOI, geographical limits of

the Taj Trapezium Zone have been defined in the shape of a

trapezoid between 260 45’ N & 770 15' E to 270 45’ N & 770 15’ E

in the West of the Taj Mahal and in the East of Taj Mahal between

270 00' N & 780 30’ E to 270 30' N & 780 30’ E, lying in the Agra

Division of Uttar Pradesh and in the Bharatpur Division of

Rajasthan. (Refer MoEF website i.e. www.moef.nic.in.).

As per Hon’ble Supreme Court directions issued on 10/05/1996 in

the case of M.C. Mehta v/s Union of India & ors:-

No brick kiln shall be allowed to be established or operated within

20 km radial distance of the Taj Mahal and other significant

monuments in the Taj Trapezium Zone and Bharatpur Bird

Sanctuary.

(C) Mount Abu Eco Sensitive Zone

No new brick kiln unit can be established within Mount Abu

Eco Sensitive Zone.

Boundaries of the eco-sensitive zone

a. The said eco-sensitive zone is situated in the southern area of Rajasthan in Sirohi District between 240 33’42’’ and 240 39’ 00’’ North latitude and between 720 41’ 36’’ and 720 48’ 06’’ East longitude and the configuration of land is hilly and rugged with high altitudinal variation ranging from 300 meter to 1727 meter. Gurushikar, the highest peak of the Aravalli, is the highest peak between the Himalayas and the Nilgiris. The boundaries of the said eco-sensitive zone comprise North - Southern boundary of Abu Forest Block No.3 South - Northern Boundary of Abu Forest Block No. 1 East - Western and Southern Boundary of Abu Forest Block No.2 West - Eastern boundary of Abu Forest Block No. 3

b. The Eco-sensitive zone covers the entire area of Notified Urban Area Limit, including Mount Abu Municipal Limits adjoining Forest Block Areas c. The list of the villages in the eco-sensitive zone – Sanigaon, Machgaon, Goagaon, Delwara, Oriya, Jawal, Achalgarh, Salgaon, Torna, Dudhai, Hetamji and Ama

(D) Restrictions - Aravali Range

Any new industry proposed to be established or intending to undergo

expansion, in the Alwar district must seek prior environmental

clearance as prescribed under the Aravali Notification or submit copy

of Jamabandi having mention of land classification, if the project

proponent claims that such land does not fall under said notification.

6. REQUIREMENT FOR GROUND WATER EXTRACTION

Keeping in view the requirements stated in the Policy guidelines for

clearance of ground water abstraction for various uses issued by the

Central Ground Water Authority, Ministry of Water Resources,

Government of India vide letter dated 14.10.2009, the guidelines

regarding the requirement of NOC from CGWA for abstraction of

ground water by any industry/ infrastructure project/ mine

(proposed/existing) should be followed.

7. REQUIREMENT UNDER WATER (PREVENTION AND CONTROL OF POLLUTION) CESS ACT – 1977

If the industry consumes water for different applications including

domestic more than 10 KLD, it shall file water cess returns in the

prescribed format as per provisions of Water Cess Act-1977and cess

amount to be payable shall be calculated as per the rates prescribed in

the Notification dated 6/5/2003 issued by Ministry of Environment &

Forest, Government of India.

RSPCB has simplified the cess assessment procedure for certain

category of units. The scheme is applicable to small assessees whose

cess liability at the existing rates does not exceed Rs. 6,000/- Per

annum Under this scheme the eligible assessees are required to submit

a self assessment before 31st May of every year, for the ensuing year

as a whole, based on earlier year’s data and as per the latest rates

applicable. The amount payable is to be remitted through Demand

Draft drawn in favour of Member Secretary, Rajasthan State Pollution

Control Board and submitted to the Member Secretary, Rajasthan

State Pollution Control Board, Jaipur with a copy to the concerned

Regional Officer of the Board.

8. STANDARDS TO BE ACHIEVED

Stack height to be provided with different type of brick kilns and

emission standards have been notified by Ministry of Environment

and Forest (MoEF), Govt. of India under Schedule I at S.No. 74 of

Environment (Protection) Rules, 1986 (as amended time to time) vide

G.S.R. 543 (E)dated 22/7/2009 (Annexure 5).

There are other activities in brick manufacturing process like

mining/quarrying of clay, handling & transportation of raw

material/bricks which contribute to ambient air pollution. MoEF has

also Notified National Ambient Air Quality Standards dated 16th

November 2009 (Annexure 6).

These standards are mandatory to be achieved by the Brick Kiln units.

9. POLLUTION CONTROL MEASURES REQUIRED

Following measures must be taken by brick kiln owners for

abatment of pollution:-

i. Approach road within the premises of brick kiln area should be

pucca / stabilized with brick bats etc.

ii. They should use crushed coal for better burning efficiency.

iii. Bricks should be laid in such a staggered manner for baking to

entrap maximum particulate matter at the source itself.

iv. They should use a properly designed gravity chamber.

v. Permanent stack should be provided at the brick kiln and height

of chimney / stack should be at least 30m. No moving chimney

shall be allowed.

vi. Water sprayers shall be installed and operated at strategic

locations.

vii. The approach road to site of brick kiln (including the storage

site if it is at different place) from the nearest public road for

the transportation of raw material/ final products must be paved

or hard surfaced.

viii. Active haul roads inside the works should be adequately wetted

with water (preferably recycled and treated wastewater).

ix. Exhausts of trucks for transportation of materials within the site

should be directed upward.

x. Wheel cleaning facilities should be provided, for delivery trucks

leaving the works, for the removal of mud.

10. OPERATION AND MAINTENANCE

i. Wetting agents should preferably be added in the water used in

the spraying systems so that water consumption is reduced.

ii. Water storage facility (minimum 3000 liters) must be provided at

the brick kiln site.

iii. A high standard of housekeeping should be maintained.

iv. Malfunctioning or breakdown of any equipment/machinery

leading to abnormal emissions should be dealt with promptly.

11. GENERAL CONDITIONS

a. A Sign Board showing the name, address and capacity of the

brick kiln as well as validity of the consents should be displayed

at the entrance of the site.

b. Brick kiln industry must have valid source for raw material either

in self ownership or with proper legal arrangement. An affidavit

to this effect shall be submitted by the Project Proponent. Clay

mining area should be reclaimed after utilization.

c. In case brick kiln industry is intending to use ground water more

than 25 KLD, the industry must obtain prior permission from the

competent authority (CGWA) for withdrawal of ground water.

d. The application for consent and reply to notices etc. must be

furnished by owner (including lawfully empowered attorney for

such purpose) of the unit. Where the owner of the brick kiln is a

Juristic person (Company, Firm, Association etc.), the

applications must be filed/ information must be furnished under

the seal and signature of a person authorized for such purpose

and the document confirming the authorization must be attached.

12. PLANTATION FOR ENVIRONMENTAL CARE

For conserving environment from adverse effect of emissions, the

industry must ensure that:-

I. Minimum 33% of the land on which industry is established or

proposed to be established is covered by plantation.

II. At least two rows of tall trees of suitable species are planted

along the boundary on all the sides and such plantation should be

carried out within a minimum width of 10 meter. An additional

row of shrubs shall also be preferable.

III. If the soil is not fit for plantation, the project proponent will

import soil and ensure that saplings with minimum height of 5

feet are planted.

IV. The plantation is carried out as per guidelines issued by the

Board vide circular dated 15.7.04 (Annexure-9).

13. PROCEDURE TO APPLY FOR CONSENT TO ESTABLISH

The prescribed application form for Consent to Establish can be

downloaded from RSPCB website (www.rpcb.nic.in).

The application for consent to establish before establishing a new

brick kiln unit or expansion of an existing unit must be submitted in

the prescribed form along with following documents failing which

additional consent fees will be payable as per provisions of the rules:-

I. Requisite Consent fee as per the Department of Environment,

Govt. of Rajasthan, Gazette Notification dated 10th December,

2010. Refer Board’s website (www.rpcb.nic.in).

II. Declaration on Rs. 10/- non judicial stamp paper duly attested

by notary public (As per Annexure 7).

III. Certificate regarding distances issued by Tehsildar/SDO and

others as per para 3 in the prescribed formats (Annexure 2 to 5).

IV. Details of valid source of raw material.

V. Project report of proposed plant including all costs duly attested

by Chartered Accountant.

VI. Details of various sources of air pollution and proposal for

pollution control measures.

VII. Ownership documents for land/ lease deed.

VIII. Land conversion letter/ land allotment letter for brick kiln

issued by the competent authority.

IX. Layout plan showing the location of plant and machinery and

the green belt giving to the scale dimensions and also

specifying the width of green belt.

X. Location plan of proposed site showing distance from road and

nearest abadi.

XI. Copy of Partnership deed/ MOU & Article of Association as the

case may be.

XII. Permission of CGWA, in case brick kiln unit is consuming

water more than 25 kilo liter per day (kld).

XIII. Document confirming the authorization of signatory of the

application form and enclosures.

14. PROCEDURE TO APPLY FOR FIRST CONSENT TO

OPERATE

The application for consent to operate must be filed after establishing

the unit and at least four months before the date of expiry of period of

consent to establish failing which additional consent fees will be

payable as per provisions of the rules.

The prescribed application form for Consent to operate can be

downloaded from RSPCB website (www.rpcb.nic.in).

The application form for consent to operate must be submitted

alongwith following documents:-

(a) Requisite Consent fee as per the Department of Environment,

Govt. of Rajasthan, Gazette Notification dated 10th December,

2010. Refer Board’s website (www.rpcb.nic.in).

(b) Declaration on Rs. 10/- non judicial stamp paper (Annexure 7).

(c) Investment certificate issued by Chartered Accountant (As per

annexure 8).

(d) Report of compliance of all the conditions of consent to establish.

(e) Status of implementation of the action plan for green belt

development, i.e., the number of plants planted, area covered by

plantation, area yet to be covered by plantation etc.

(f) Document confirming the authorization of signatory of the

application form and enclosures.

(g) Copy of documents required with consent to establish as per

para 13, if not submitted earlier.

15. PROCEDURE TO APPLY FOR RENEWAL OF CONSENT TO

OPERATE

The application for renewal of consent to operate must be filed atleast

four months before the date of expiry of period of consent to operate

failing which additional consent fees will be payable as per provisions

of the rules.

The application for renewal of consent to operate must be preferred in

prescribed form alongwith following documents:-

15.1 Requisite consent fee as per the Gazette Notification dated 10th

December, 2010.

15.2 Requisite Declaration on Rs. 10/- non judicial stamp paper (as

per annexure 7).

15.3 Investment certificate issued by Chartered Accountant (As per

annexure 8)

15.4 Report of compliance of conditions of consent to operate.

15.5 Status of implementation of the action plan for green belt

development i.e. the number of plants planted, number of plants

surviving, area already covered by plantation etc.

15.6 Copy of periodical reports submitted (As per Para 16).

15.7 Document confirming the authorization of signatory of the

application form and enclosures.

15.8 Status of payment of Water Cess, as applicable.

16. PERIODICAL REPORTS REQUIRED TO BE SUBMITTED TO

THE STATE BOARD

Following periodical reports must be submitted to the Board. Failure

to submit these reports shall be treated as non-compliance for the

purpose of future consents.

(a) Annual compliance report of consent conditions to the competent

authority.

(b) Annual stack emission and Ambient Air Quality Monitoring

Report to the competent authority.

(c) Annual Environment Statement in the prescribed format as under

EP Act-1986 (Annexure 9) to the competent authority.

(d) Annual production and dispatch details of bricks.

17. CONSEQUENCE OF DEFAULTING COMPLIANCE OF

GUIDELINES

If any non-compliance is observed during the operations, notice under

section 31(A) of the Air Act, 1981 will be issued and proponent will

be directed to rectify the non-compliance within specified period. If

non compliances are found to be continuing even after show cause

notice, the consent will be revoked/ refused and closure directions will

be issued under section 31(A) of the Air Act, 1981 forthwith. The

owner will also be liable for criminal prosecution.

18. CONDITIONS FOR REVOCATION OF CONSENT

The consent granted will be revoked if it is found that:-

18.1 It has been obtained by misrepresentation of facts.

18.2 The industry defaults in Pollution Control Measures.

18.3 If found that the raw material is procured from illegal sources

18.4 The industry defaults in furnishing of annual information even

after expiry of 30 days from the prescribed period.

Further, in case of a brick kiln unit established after obtaining consent

from the Board, the consent may not be renewed without appropriate

legal action if it is found that:-

a. The local community has been experiencing air pollution from the

emissions of the brick kiln unit.

b. The project proponent has failed in compliance of the conditions

laid down in the consent.

The annexure referred in the guidelines are enclosed.

All concerned are directed to ensure strict compliance of the

guidelines while dealing with the issues related with the brick kiln

industry.

These guidelines are meant to serve as a guide. In case of

interpretation of any question related to law, the provisions of the

original law and the rules made thereunder with various government

directions/resolutions will have to be read and followed. In case of

amendment to the original Act/Rules/Notifications made thereunder,

the provisions as amended from time to time shall be applicable.

These guidelines are being issued in supersession to all previous

guidelines.

2. One chimney per shaft in Vertical Shaft Kiln shall be provided. The two chimneys emanating from a shaft shall either be joined (at the loading platform in case of brick chimney or at appropriate level in case of metal chimney) to form a single chimney. 3. CIRCULAR

Entry no. 37 of schedule-I of Environment (Protection) Rules, 1986 has stipulated that in

respect of stone crushing units, the concerned unit would be required to grow a green belt

along the periphery. The Board has also incorporated a condition of 33% of the unit’s area as

being required to be covered by plantation, while granting consent to these units to operate

under the Air (Prevention & Control of Pollution) Act, 1981. However the numbers of trees,

species etc. and the manner of their plantation have not been specified by either the Board or

the Environment (Protection) Rules, 1986. In view of the difficulty being experienced in

implementing this requirement, following clarification is hereby issued:-

1. Trees shall necessarily be planted along the periphery of the area in rows. The unit

may also take up additional plantation in other available open areas such as along

the road, on unused land etc.

2. The computation of the area under plantation shall be done on the basis of the

following norms:-

i. Tree species like Neem, Pipal, Jamun, Gulmohar etc. shall be deemed to

cover 25 M2 areas on maturity.

ii. Shrubs like Guava, Pomegranate, Jungle Jalebi etc. shall be deemed to cover

an area of 9 M2 on maturity.

The area likely to be covered by the plants mentioned above shall be computed accordingly.

The herbs which require continuous watering for their maintenance shall not be counted to

meet the norms though the can be planted by the management as per their need.

Illustration: In case of 10 no. of trees like Sehtoot, Siris, Shisham, Babool; 5 no. of

Shrubs like Eucalyptus, Ashok, Ber Kair and 20 no of Herbs like Rose, Mehandi,

Duranta, Merigold are planted the total area under plantation shall be computed as

follows:

Area covered by trees = 10 x 25 = 250 m2 Area covered by shrubs = 05 x 09 = 045 m2 Area covered by herbs = 20 x 00 = 000 m2 Total Area 295 m2
