REZONING APPLICANT'S RESPONSE STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER
PURSUANT TO REQUIREMENTS OF THE UNIFIED DEVELOPMENT ORDINANCE, THE BOARD OF COMMISSIONERS FINDS THAT THE FOLLOWING STANDARDS ARE RELEVANT IN BALANCING THE INTEREST IN PROMOTING THE PUBLIC HEAL TH, SAFETY, MORALITY OR GENERAL WELFARE AGAINST THE RIGHT TO THE UNRESTRICTED USE OF PROPERTY AND SHALL GOVERN THE EXERCISE OF THE ZONING POWER.
PLEASE RESPOND TO THE FOLLOWING STANDARDS IN THE SPACE PROVIDED OR USE AN ATTACHMENT AS NECESSARY:
(A) WHETHER A PROPOSED REZONING WILL PERMIT A USE THAT IS SUITABLE IN VIEW OF THE USE AND DEVELOPMENT OF ADJACENT AND NEARBY PROPERTY:

(B) WHETHER A PROPOSED REZONING WILL ADVERSELY AFFECT THE EXISTING USE OR USABILITY OF ADJACENT OR NEARBY PROPERTY: No, There will be no adverse affect. The proposal is consistent with zoning across Rosebud Road and compatible with nearby Commercial uses.
(C) WHETHER THE PROPERTY TO BE AFFECTED BY A PROPOSED REZONING HAS REASONABLE ECONOMIC USE AS CURRENTLY ZONED: The econimic use of the property is greatly diminished as currently zoned.
(D) WHETHER THE PROPOSED REZONING WILL RESULT IN A USE WHICH WILL OR COULD CAUSE AN EXCESSIVE OR BURDENSOME USE OF EXISTING STREETS, TRANSPORTATION FACILITIES, UTILITIES, OR SCHOOLS: Current infrastructure and services are adequate to serve to community .
. (E) WHETHER THE PROPOSED REZONING IS IN CONFORMITY WITH THE POLICY AND INTENT OF THE LAND USE PLAN: Yes, The proposed development will add to the existing surrounding development to create a Community Mixed-use character as proposed in
the 2040 Unified Plan.
(F) WHETHER THERE ARE OTHER EXISTING OR CHANGING CONDITIONS AFFECTING THE USE AND DEVELOPMENT OF THE PROPERTY WHICH GIVE SUPPORTING GROUNDS FOR EITHER APPROVAL OR DISAPPROVAL OF THE P ONING: The 2040 Unified Plan designates the area as a Community Mixed-Use character area. Ridgeline Land Planning, Inc. is requesting to rezone 25.368 acres located at 2882 Rosebud Road from R-100 to RM-13. The proposed rezoning is to allow development of a 258-unit multi-family development. The proposed net density is 12.967 units per acre. The community will consist of 3 story garden style apartments with active and passive amenity areas. Common areas consisting of 5.5 acres of active and passive recreation areas will be provided throughout the community. The active portion of the common areas will include a leasing center and clubhouse, pool, and playground. These areas will be connected by a trail system linking the community to the internal amenities and to external pedestrian pathways.
The proposed community lies within one thousand feet of the intersection of Rosebud Road and Hwy 78. This intersection in the center of a Community Mixed-Use area identified in the 2040 Unified plan. The addition of residential units close to the existing commercial developments at the intersection mentioned above will help to create the mixed-use character designated for the area. Having Brushy Fork Creek along the Eastern Boundary also provides opportunity to connect to Gwinnett's Greenway and Open Space Master Plan. We feel the proposed project will benefit the existing and future growth to this Mixed-Use node along the Hwy 78 corridor.
