4. A minimum rear yard of 5.8 metres shall be permitted instead of the minimum required front yard of 7.5 metres;
5. The front yard shall comprise no landscaped area instead of the required minimum landscaped area of not less than 50% of the gross area of the front yard;
6. One (1) parking space shall be permitted instead of two (2) parking spaces for a single detached dwelling; and,
7. No manoeuvering spaces shall be provided for a required parking space instead of the requirement that a manoeuvering space abutting to each required parking space shall be provided and maintained on the lot.
NOTES:
1. A demolition permit shall be required for the removal of the existing dwelling to accommodate the new construction.

2. Lot width and lot area are legally existing, non-conforming.
3. The existing single detached dwelling does not have a driveway and any required parking spaces.
4. No eaves and gutters were identified on the drawings for the proposed single detached dwelling. Projections for eaves and gutters shall comply with Section 18(3)(iv(b)(i) of Zoning By-law No. 6593 or alternatively further variances shall be required.

4. The accessibility to the rear parking space may be obstructed by another vehicle whereas the By-law requires an unobstructed access driveway to the parking space.
5. The front yard landscaped area shall be a minimum of 45.0% the gross area of the front yard instead of the minimum 50.0% required front yard landscaped area.
6. The existing appearance of the building will be altered by the enlargement of the living room window whereas the By-Law states that the external appearance and character of the dwelling shall be preserved.
Notes: The Zoning By-law requires a minimum floor area of 65.0m2. The applicant shall ensure that the minimum is achieved; otherwise, further variances will be required.
The submitted plan does not clearly show the location of the access driveway for the front parking space. If additional driveway area is intended, a revised plan with further details shall be submitted as this will affect the total front yard landscaped area and other parkinq provisions.
A minimum unobstructed parking space size of 2.7m x 6.0m shall be maintained for eachof the parking spaces. No details were provided to confirm compliance; as such, further variances may be required.

1. A minimum front yard depth of 8.5m shall be provided instead of the minimum required front yard depth of 12.0m.
Variances required to pursuant to Hamilton Zoning By-law No. 05-200
1. A Motor Vehicle Dealership shall be permitted notwithstanding that a motor vehicle dealership is not permitted within the “C5” zone and is also a prohibited use within this zone even as an accessory use;
2. A maximum building setback of 9.3m shall be provided from the Upper James Street street line instead of the maximum building setback of 4.5m from a street line;
3. Parking spaces and aisles shall be permitted between the building fagade and the front lot line instead of the requirement that no parking, stacking lanes, or aisles shall be located between the required building fagade and the front lot line;
4. No direct access from a public sidewalk shall be provided to the principal entrance instead of the requirement that a minimum of one principal entrance shall be accessible from the building fagade with direct access from the public sidewalk;
5. A minimum parking space width of 2.8m shall be provided instead of the minimum required parking space width of 3.0m as required by Section 5.2 of By-law 17-240 which amends Hamilton Zoning By-law No. 05-200;

6 The parking spaces and aisles shall be a minimum of 1.4m from the Upper James Street street line and a minimum 1.4m wide landscaped area shall be provided between the parking spaces and aisles and Upper James Street street line, excluding driveways and walkways extending directly from the street, instead of the requirement that parking spaces and aisles, giving direct access to abutting parking spaces, excluding driveways extending directly from the street shall not be located within 3.0 metres of a street line and a 3.0m wide planting strip shall be required and permanently maintained between the street line and the said parking spaces or aisles; and,
7. No short term bicycle parking spaces shall be provided instead of the minimum required five (5) short term bicycle parking spaces.
i. The subject lands are presently zoned “HH” according to Hamilton Zoning By-law No. 6593. Be advised that By-law No. 17-240 was passed on November 8, 2017 which changed the zoning of this property from “HH” to “C5” under Hamilton Zoning By-law 05- 200. However, By-law No. 17-240 has been appealed to the Ontario Municipal Board and is therefore not yet final. At present, all proposed development is reviewed under both the existing and proposed Zoning By-laws with the more restrictive zoning regulations of both Zoning By-laws being applied, with the exception of building permits, which are reviewed under the former existing zoning until such time that By-law No. 17-240 comes into force. If By-law No. 17-240 is approved at the Ontario Municipal Board, the zoning under this Bylaw will be applicable.
ii. The variances are necessary to facilitate Site Plan Control Application File # DA-17- 191.
iii. The Agent has advised that one (1) service bay will be utilized as an accessory car washing establishment (car detailing).

2. A minimum 3.0m wide landscaped area shall be provided and maintained abutting a street (except for points of ingress and egress) instead of the minimum required 6.0m wide landscaped area.
3. A hydro vault shall be provided within a required landscaped area whereas the definition of landscaped area does not include such mechanical equipment.
4. A maximum combined gross floor area for accessory retail and showroom areas shall be 687.6m2 instead of the maximum permitted floor area of 500.0m2.
5. 51 parking spaces shall be provided instead of the minimum required 56 parkingspaces.
6. Loading facilities shall be provided without a visual barrier in the flankage side yard whereas the by-law requires loading spaces to be screened from view of the street by a visual barrier.
7. A minimum parking space size of 2.6m x 5.5m shall be provided instead of the minimum required parking space size of 3.0m x 5.8m.
NOTES:
i. A maximum combined gross floor area permitted for accessory retail and showroom areas are limited to 25% of the total floor area or 500.0m2, whichever is the lesser. Variance #4 is requesting a total retail and showroom area of 687.6m2 which is 25%.

Floor plan drawings have not been submitted to confirm the total retail/showroom floor area, as such this variance has been written as requested by the applicant.
ii. These variances are necessary to facilitate site plan control application SPA-17-015.
iii. Be advised that By-law 17-240 was passed on November 8, 2017 which changed a number of zoning provisions under Hamilton Zoning By-law 05-200. However, By-law 17-240 has been appealed to the Ontario Municipal Board and is therefore not yet final. At present, all proposed development is reviewed under both the existing and proposed Zoning By-law regulations with the more restrictive zoning regulations of both Zoning By-laws being applied, with the exception of building permits, which are reviewed under the former existing requirements until such time that By-law 17-240 comes into force. If By-law 17-240 is approved at the Ontario Municipal Board, the zoning under this By-law will be applicable. As such, Variance #7 has been included to address the new parking space size requirement under By-law 17-240.
