Jim Church called the meeting to order at 5:30 p.m

A motion was made by Josh Lydon and seconded by Kevin Brueggeman to approve the consentagenda consisting of the minutes of the March 5, 2018 meeting and the Police Department's monthlyreport for February and bills. Motion carried 5-0.

Upon proper payment of any fees, the following new or renewal bartenders licenses were approvedon a motion byJosh Lydon and seconded by Alli Karrels, Motion carried 5-0.

A motion was made by Josh Lydon and seconded by Kevin Brueggeman to approve the TemporaryClass "B" Beer License request for Butterfest in Memorial Park for June 7th through June 10, 2018.Motion carried 5-0.

Chris Haas, our Code Enforcement Officer, wanted to show the committee pictures of some of thecomplaints she is dealing with and to get some clarification of our ordinances pertaining to junk/non-motarized vehicles. She went over the process on how she handles the complaints she receives and thetimeline. This was a discussion item only and may have to be revisited is anything in our ordinancesneeds to be changed.

There were no items mentioned for future consideration

A motion was made by Josh Lydon and seconded by Kevin Brueggeman to adjourn at 5:54 p.m.Motion carried 5-0.

The area that we intend to occupy within Evan-Bossard Park will be enclosed by "hard fenced"- french barricades / bike racks. We prefer to use this type of fencing to eliminate groundpenetration and resolve any need to secure approval to dig/drive stakes in the park.

We intend to serve beer during our post-ride gathering. Although we expect that anyalcoholic beverages will be secured through brewery sponsorship, it will be processedthrough an authorized regional distributor (as required by Wisconsin State law).

Based upon current registration numbers and our registration trends, we anticipate betweenlT5and250ridersforthisyear'sevent.Currentlythereisonlyl registeredriderundertheage of 21 (and he is accompanied by a parent). lncluding this individual... there are only 2

registered pafticipants under the age of 30.

All underage participants will be issued, and be required to wear, a unique wristband colortorecognize them as under the legal drinking age, and ineligible for alcohol service. Thisprotocol is utilized due to our ease of process and the fact that very few bicyclists carry lD.

All alcohol distribution will be limited to registered,legal-aged participants of Tour deCoulee. Furthermore, there will be no additional charge to participants for event alcoholservice.

Below is a detailed description of ouroperating logistics pertaining tothe site area locatedwithin Evan-Bossard Park:

Beer Garden Size: Triangular area 70' deep by 70' wide

Security & Duties: All site staff and service volunteers will be monitoring alcohol distribution

and consumption. They will ensure only those participants with wristbands are allowed inside

the Beer garden and will attend to (and reportto Sparta PD)any inappropriate consumption

issues immediately.

r Service personnel atthe beverage station, located inside the fenced area, will be

responsible for checking lD's of any individuals of questionable age, regardless of

wristband status.

. Responsible to check the lD of each person - adhere beer wristband to those over

21 yrs of age.

Entrance/Exit Gate

fenced area with an event wristband or event credential.

RE: Application for Extension of Class "8" License Beyond Building Premises

Mr. Fa hning:

I am applying for the consideration of the City of Sparta in the matter of extending my Class "8" licensebeyond the building premises. Specifically, lwould like them extended to a proposed deck behind thepremises as detailed in the attached response to the ordnance as well as the drawings I have enclosed.

The project is a cooperative arrangement between the building owners, Kevin and Deborah Moore, TheCork and Barrel, and the Downtown Cooperative. The interestsofeach stakeholderare summarizedbelow:

The Moore's are interested in improving their property to provide handicap accessibility to theirbuilding immediately to the north. They would also like to improve the property for tenantssuch as the Cork & Barrel and those that may venture in the future.The Cork & Barrel would benefit from outdoor seating in the Spring, Summer, and Fall, and feelsthe addition of an outdoor venue would create interest in the Downtown and in the business.

The Downtown Cooperative would benefit from the additional space for the Farmer's Market, as

their hours do not coincide with those of the Cork & Barrel. Additionally, the Kriskindlmarktwould benefit during the three weekends of the market during which the Cork and Barrel wouldnot be using the outdoor venue.

I have responded to the key points of the ordnance in the attached, and have also provided a drawing ofthe proposed structure.

Please consider my request for expanding my license beyond the current building premises in

accordance with the requirements of the ordnance.

Stats. ch. 125 to thebuilding prernises so defined on the liquor license application unless, prior to the application ofaliquor license or renewal thereof, approval has been obtained frorn the plan commission for anoutdoor facility.

(b)

Upon making application to the plan commission, the person shall subrnit a site and landscapeplan of the entire parcel showing the outdoor facility designating its location with respect to themain premises and other buildings on the site, designating entrances and exits ofboth the mainstructure and outdoor facility and the location of the outdoor facility with respect to buildings onadjoining sites and such other information as the plan commission rnay require to ensurecompliance with this Code.

(c)

The plan commission shall consider the following guidelines when reviewing an application foran outdoor facility:

(1)

Location. The outdoor area may not be within a 150-foot setback fiom properlies zonedresidential

The outdoor area is not located within a 150 ft setback from properties zoned residential.

(2)

Fencing. The outdoor area should be enclosed with a fence. The height and style of fencing willdepend on location.

The outdoor area will receive a railing system that is constructed of lx4 vertically placedrails, spaced 5 inches between each edge, The railing will be topped with a 5/4 x 6 flat rail.Thc enfire svstem shall he incornorafcd with fhp nncfs fhaf alco sunnorf fhe rlccl< andcontinue on to the underside of the top rail for maximum strength. The top of the rail willbe 42 inches from the height of the deck.

Overall appearance. The overall appearance rnust be attractive.

In our opinion, the proposed structure offers intrigue with the partially covered area. Theramp access provides patrons from the market area a place to wander and to explore asatellite location of the market. It will present a stong appearance, and with the improvedmasonry backdrop, will provide a very trendy warehouse district appearance,

Exits. The nonnal entry and exit should be from inside the building. However, an emergency exitmust be available fiom the outdoor facility. The fire departrnent will review the emergency exitsystems.

There will be secondary egress from the outdoor area to the handicap ramp. This accesswill be controlled during hours where intoxicating beverages are served by means of a gate.

Tables, chairs and trash receptacles. A seating plan should be subrnitted and reviewed by the firedepafiment to establish occupancy load. Seating capacity should be clearly posted. Trashreceptacles will be required.

Tables and chairs will be unsecured to the deck below, Seating capacity will be postedbased on the recommendations of the fire department.

Trash. The outdoor area must be patrolled for trash and cleaned on a daily basis

Trash will be controlled daily during the outdoor business season, and as needed off-season.

(7)

Liquor availability. The availability ofliquor shall be consistent with the liquor license of theapplicant. The approved liquor license must include the outdoor area as part of the premises.

The liquor license will be amended as necessary for inclusion of the outdoor area,

Use ofright-of-way. No outdoor area shall be located on a dedicated public right-of-way.

The outdoor area is located within the property boundaries ofthe landlord.

(e)

Size lirritation. An outdoor area shall not be larger than the inside area of its parent building.

The parent facility is 800 square feet. The outdoor facility less the handicap ramp has a netarea of 500 square feet,

Setback liom public right-of-way. A minimurn 20 foot setback from the public right-of-way.Exceptions may be requested for those lots not able to accornmodate 20 feet.

The lot continucs to the back to the center of Beaver Creek. Mueller Square abuts theoutdoor area, as Mueller Square sits atop an area that was a platted as zero lot lines

Hours ofoperation. Outdoor facility hours rnay only occur during open hours under Wis. Stats. $12s.32(3).

The Cork & Barrel will comply with the State Statute

Music allowed. As a general rule, music should not be allowed; however, applicants may make aspecial request.

Music will only be featured by special request.

( 13)

Bartender required. Whenever the outdoor facility is open to customers and intoxicating liquor orfennented malt beverages are sold, at least one licensed bartender must be staffrng the area.

The Cork & Barrel acknowledges the regulation on bartenders.

(d)

The plan commission shall conduci a public hearing and make a recommendation to the citycouncil. Notice sliall be given by ordinary mail of the proposed establishment of an outdoorfacility to the owners ofpropefty immediately adjacent to the area to be considered for the newuse extending 200 feet therefrom and to the owners ofproperties extending 200 feet frorn thestreet frontage of the opposite property and also by a Class I publication in the offrcialnewspaper. The recomrnendation shall be one of the following:

(1)

Approve without special conditions;

(2)

Approve with special conditions taking into consideration the above guidelines; or

(3)

Deny.

(e)

Upon recommendation from the plan commission, the city council shall considel the applicationand any special conditions recommended by the plan commission. Iffinal approval is granted bythe city council, a special use permit shall be issued with any restrictions stated thereon. Anyviolation of the stated restrictions shall subject the special use permit to automatic revocationwithout further notice or public hearing.
