NOTICE OF PUBLIC MEETING

Notice is hereby given to all interested parties that the Board of Directors of the captioned District will hold a public meeting by telephone conference call. Members of the public may access and participate in the meeting by following the instructions listed at the bottom of this notice.

Instructions for accessing telephone conference call:

On March 16, 2020, in accordance with section 418.016 of the Texas Government Code, Governor Abbott has suspended various provisions of the Texas Open Meetings Act that require government officials and members of the public to be physically present at a specified meeting location (the “Order”). In accordance with the Order, the District has implemented procedures to allow members of the public to participate and address the Board of Directors during the telephone conference meeting. To participate in the telephone conference meeting:

1. Please call 1-866-773-8424 and use access Code 633101# to access the meeting and announce your name to the meeting host.

2. The agenda packet will be available at the following web site: http://www.hcmud49.org/meetings.

3. The audio of the meeting will be recorded and will be made available to the public.

DIRECTOR AND AGENT QUESTIONNAIRE FOR CONFLICTS DISCLOSURE STATEMENT

In 2005, the Texas Legislature approved changes in disclosure requirements for public officials in Texas. The requirements became effective on January 1, 2006 and were clarified and amended by the legislature in 2007 and in 2015. Many public officials, including water district directors, agents, and employees, will not need to file a report or take any action under the act. This questionnaire will assist you in determining if you need to fill out a Texas Ethics Commission Form CIS, Local Government Officer Conflicts Disclosure Statement, for filing with the District. Please complete and sign this questionnaire and return it to the attorney for the District.

LOCAL GOVERNMENT OFFICER CONFLICTS DISCLOSURE STATEMENT

Section 176.003 of the Local Government Code requires certain local government officers to file this form. A "local government officer" is

defined as a member of the governing body of a local governmental entity; a director, superintendent, administrator, president, or other

person designated as the executive officer of a local governmental entity; or an agent of a local governmental entity who exercises discretion

in the planning, recommending, selecting, or contracting of a vendor. This form is required to be filed with the records administrator of the

local governmental entity not later than 5 p.m. on the seventh business day after the date on which the officer becomes aware of the facts

that require the filing of this statement.

A local government officer commits an offense if the officer knowingly violates Section 176.003, Local Government Code. An

offense under this section is a misdemeanor.

Refer to chapter 176 of the Local Government Code for detailed information regarding the requirement to file this form.

(ii) the local governmental entity is considering entering into a contract with the vendor.

The plat was recorded and the construction of the utility & paving improvements are complete. A Harris County inspection was held on February 13, 2020 with minor comments. The

contractor has addressed the comments approved by the County. BEC will be preparing all the closing documents for the project for in the next couple of months.

Sunset Ridge Section 7 and Sunset Ridge Commercial Access – Clearwater Utilities (No Board Action This Month)

The construction of Section 7 and the Sunset Ridge Commercial Access Road are complete. The contractor is complete with addressing the County’s comments, and BEC is rescheduling a

county inspection.

Earth Movement, Phase 5 serving Sunset Ridge – Double Oak Construction (No Board Action this Month)

This project is complete. Contractor addressed all the punch list items, and BEC will submit the final pay estimate upon inspection completion.

BEC is waiting for the inspection date to be scheduled by the County. The inspection is being delayed due to a fiber optic line that is being scheduled to be relocated.

Eagle Creek Detention Pond Outfall Repair - (No Board Action this Month)

BEC previously received a proposal from KKS Environmental in the amount of $7,660.00 for the addition of 54 tons of rip rap & related items to the existing Fall Creek Detention Pond outfall into Garners Bayou and related items. The contractor is working on getting this addressed.

Potential FEMA Projects

Eagle Creek Detention Pond Repair – NBM Development, Inc. (Board Action this Month)

BEC is continuing to hold weekly construction meetings, and the contractor is nearing

completion. Besides the remaining 15% of fill required, they still have to install the backslope interceptor and turf establishment.

BEC received Pay Estimate No. 5 in the amount of $37,341.54 and request board approval for payment.

BEC received an invoice from Ninyo and Moore in the amount of $2,328.75 for related geotechnical services. On behalf of Ninyo and Moore, BEC requests board approval of this invoice.

The location of the failure was located deeper than the water surface elevation. BEC and the geotech engineer were unable to observe the location of the failure until the water surface elevation was pumped down. As a result, the quantities of excavation and fill increased. BEC prepared a proposal for Change Order No. 2 in the amount of $32,666.71 and request board approval.

In addition, the geotechnical engineer Ninyo & Moore has been onsite more often than originally expected when they created the proposal for this project. On behalf of Ninyo & Moore, BEC requests board approval of Change Order No. 1 in the amount of $14,700.00 for a total contract amount of $29,200.00 for their extra effort on this project.

BEC has submitted reimbursable items to FEMA and will include the invoice and change orders as well.

Sunset Ridge West Retaining Wall along HCFCD ditch located east of the Wastewater Treatment Plant – A&M Contractors (No Board Action this Month)

The contractual bonds and insurance information has been prepared and finalized. BEC plans to

circulate the contracts for board signature. BEC requires the contracts to be signed to issue the notice to proceed. BEC plans to draft a letter to the affected residents informing them of the work to be performed to replace the wall once the contracts are signed. Contractor is expected to be released to begin construction in early July.

BEC received a proposal for Change Order No. 1 in the amount of $182,132.09 for the installation of tie-backs that may be installed from the HCFCD drainage ditch rather than entering the backyards of the residents. The current design is adequate and suitable by utilizing a concrete wall with steel tie-backs to concrete drilled shafts. Although structurally sound, this will be invasive within the residents’ properties. The proposed change order will allow the contractor to drill steel tie-backs through the wall without being so invasive within the backyards.

BEC requests board approval of Change Order No. 1 in the amount of $182,132.09. The total contract amount would increase from $759,567.32 to $941,669.41.

BEC will continue investigating the conditions of the remainder of the wall.

As per our discussion, this transmittal is to provide written authorization associated with additional fees related to the above referenced project. Based on our review of reports, schedule and dispatch log, the Contractor took longer than estimated to perform site construction activities. We estimated about 15 days for the testing during construction. We have been requested by the Contractor for 36 site visits to date. There have been two trips which resulted in onsite cancellations. The majority of the additional fee is due to the contractor taking longer than estimated. We have estimated the fee to complete the testing for the project as summarized below.

We appreciate the opportunity to be of service to you on this project.

Attached is the plat of Eagle Creek Sec. 3 showing Eagle Landing Dr. (later renamed to Fall Creek Preserve Dr.) right-of-way crossing the HCMUD 49 drainage ditch. Per the aerial image attached, the pavement never crossed the ditch even though the right-of-way was dedicated. I'm assuming the landings of the pedestrian bridge would be located within the right-of-way of Fall Creek Preserve Dr.; therefore, Harris County's public infrastructure department would be the regulatory agency to give direction on the installation of a bridge. Although the MUD maintains that segment of the ditch, the land is not owned by the MUD.https://www.eng.hctx.net/permits

HCMUD 49 would want to review the related construction plans to determine if there are any proposed alterations or potential interferences to the drainage ditch.

Good morning!

I’ve messaged andrias Lowe on Nextdoor but wanted to submit an inquiry here as well. As the humble iSD district is setting boundaries for the new elementary school (elementary school 30) several of us that live in Fall Creek On Fall Creek Preserve Dr have been curious as to how we could go about proposing a pedestrian bridge be built to to cross the easement on Fall Creek View Preserve drive. I believe the land is owned by the MUD. Is there any way you could guide us in how we couple propose something- it would allow many of the young students have a MUCH shorter walk to school (and connect that side of the neighborhood to the Fall Creek sports complex). It would cut down on vehicle traffic as well - as I think we will find ourselves on this side too close to have a bus route- but too far to walk all the way around.
