QUESTION: Mom is having troubleliving independently but would like tolive in her home for as long as possible. Isthere any problem with Mom paying arelative to provide care in her home?
ANSWER: Yes, there can be very nega-tive results for Mom. The governmentassumes that family members will providein home care because of “love and affec-tion”, not for monetary gain. If Mom everapplies for Medicaid to help pay for longterm care services, the payments to relativeswill be treated as “gifts.” Medicaid willpenalize Mom for making these gifts,prohibiting Mom from benefits she mightotherwise be entitled.
To avoid penalties, a “care contract”should be executed between Mom and therelative caregiver. Also, because the pay-
ments are income to the relative caregiver,he/she should be prepared to report theincome on their income taxes.
Only an attorney well versed in Medicaidand long term care issues can provide prop-er assistance in creating a care contract thatcan avoid costly penalties.
