    Access to and copies of the district's policy on teacher conduct; The policy for reporting and investigating claims of misconduct; The status of any and all investigations into teacher misconductdating back to the 2006-07 school year; Copies of any forms sent to the state requesting revocation ofteacher credentials due to misconduct dating back to the 2006-07school year.

    A determination has been made that, to the extent records responsive toyour request exist, the request in part seeks disclosable public records. We will adviseyou of the basis for withholding any otherwise responsive records.As part of this initial response, we note that one of your requests lacks sufficient specificity forus to determine the existence of the records you seek. To assist you in identifying records andinformation that are responsive to your purpose, insofar as those records exist and aredisclosable, we ask your cooperation in clarifying the scope of the remaining request for "thestatus of any and all investigations into teacher misconduct dating back to the 2006-07 schoolyear."This request does not seek an identifiable public record. The District investigates complaintsand allegations of misconduct regarding its employees, as appropriate and as required by lawand Board policy. However, the Public Records Act does not require the District to create arecord identifying the status of such investigations.Additionally, we are uncertain as to your intended meaning of the phrase "teacher misconduct."There is no legal definition of "teacher misconduct," and even the state credentialing bodyrecognizes that not every complaint or allegation against a certificated individual constitutes anallegation of "misconduct." Depending on one's definition of "misconduct," any determination of

    the existence or status of investigations regarding District teachers within the time period youspecify is extremely uncertain.Therefore, without clarification of these terms, we are unable to respond to your request for "thestatus of any investigation into those complaints." Please specify what constitutes "teachermisconduct" in the context of your request. We enclose for your information a copy ofEducation Code section 44932, which describes the specific grounds for disciplining a teacherin California, in the hope it may assist you in refining the request to describe "misconduct."We also ask that you consider the fact that a teacher may not be disciplined for any conduct thatoccurred more than four years prior to the teacher's receipt of a formal notice of disciplinaryaction. (Education Code section 44944(a)(5).) Accordingly, the scope of your request, "datingback to the 2006-07 school year," could result in an extensive and expensive search for dateddocuments which, if they exist, could not lawfully lead to the discipline of any teacher. Werespectfullyrequest that you consider narrowing the scope of your request to a more recent timeperiod.Additionally, you requested "Copies of any forms sent to the state requesting revocation ofteacher credentials due to misconduct dating back to the 2006-07 school year." The Districtdoes not possess any documents responsive to this request. The District reports to theCalifornia Commission on Teacher Credentialing (CTC) teachers' separation from service as aresult of allegations of misconduct, pursuant to Title 5, California Code of Regulations, section80303 (copy attached). However, the District does not "request revocation of teachercredentials." The CTC is responsible for determining whether a teacher's credential should besubject to disciplinary action such as suspension or revocation.Insofar as teachers are identified in these reports, if any, we believe the teachers' names areexempt from disclosure under the Public Records Act, pursuant to the "personnel" exception ofGovernment Code section 6254(c). Please note that all investigative processes of the CTC areclosed to the public and remain confidential until "final action" is taken, pursuant to EducationCode section 44245. In fact, unauthorized disclosure of such information is a misdemeanor.(EducationCode section 44248.)We will review our files for the existence of any such reports in an effort to provide you with theinformation requested. We will redact the names of the individual teachers involved and of anyother persons identified in the records, as appropriate. We anticipate having copies of thereports prepared for you no later than April 3, 2012. The copying cost of 15 cents per page willapply.We are happy to speak or meet with you to ensure disclosure of nonexempt records that meetyour objectives.     44932. Grounds for dismissal of permanent employees; suspension of employees(a) No permanent employee shall be dismissed except for one or more of the following causes:(1) Immoral or unprofessional conduct.(2) Commission, aiding, or advocating the commission of acts of criminal syndicalism, asprohibited by Chapter 188 of the Statutes of 1919, [FN 11or in any amendment thereof.(3) Dishonesty.(4) Unsatisfactory performance.(5) Evident unfitness for service.(6) Physical or mental condition unfitting him or her to instruct or associate with children.(7) Persistent violation of or refusal to obey the school laws of the state or reasonableregulations prescribed for the government of the public schools by the State Board of Educationor by the governing board of the school district employing him or her.(8) Conviction of a felony or of any crime involving moral turpitude.(9) Violation of Section 51530 or conduct specified in Section 1028 of the Government Code,added by Chapter 1418 of the Statutes of 1947.(10) Knowing membership by the employee in the Communist Party.(11) Alcoholism or other drug abuse which makes the employee unfit to instruct or associatewith children.(b) The governing board of a school district may suspend without pay for a specific period oftime on grounds of unprofessional conduct a permanent certificated employee or, in a schooldistrict with an average daily attendance of less than 250 pupils, a probationary employee,pursuant to the procedures specified in Sections 44933, 44934, 44935, 44936, 44937, 44943,and 44944. This authorization shall not apply to any school district which has adopted acollective bargaining agreement pursuant to subdivision (b) of Section 3543.2 of theGovernment Code.CREDIT(S)(Stats.1976, c. 1010, 2, operative April 30, 1977.     California Code of RegulationsTitle 5. EducationDivision 8. Commission on Teacher CredentialingChapter 3. Committee of CredentialsArticle 1. General Provisions 80303. Reports of Change lnEmployment Status.(a) Whenever a credential holder, working in a position requiring a credential:

    (1) is dismissed or nonreelected;(2) resigns;(3) is suspended or placed on unpaid administrative leave as a final adverse employmentaction for more than 10 days.;(4) retires; or(5) is otherwise terminated by a decisi.on not to employ or re-employ; as a result of anallegation of misconduct or while an allegation of misconduct is pending, the superintendentof the employing school district shall report the change in employment status to theCommission not later than 30 days after the employment action.

    (b) The report shall contain all known lnformaticn about each alleged act of misconduct.(c) The report shall be made to the Commission regardless of any proposed or actualagreement, settlement, or stipulation not to make such a report. The report shall also be made ifallegations served on the holder are withdrawn in consideration of the holder'S resignation,retirement or other failure to contest the truth of the allegations.(d) Failure to make a report required under this section constitutes unprofessional conduct. TheCommittee may investigate any superintendent who holds a credential who fails to file reportsrequired by this section.(e) The superintendent of an empl'oying school direct shall, in writing, inform a credential holderof the content of this regulation whenever that credential holder, working in a position requiring acredential, is dismissed, nonreelected, resigns, is suspended or placed on unpaid administrativereave as a final adverse employment action for more than ten days, retires or is otherwiseterminated by a decision not to employ or re-employ as a result of an allegation of misconductor while an allegation of misconduct is pending. Failure to comply with this subdivision by asuperintendent of schools constitutes unprofessional conduct which shall be investigated by theCommittee of Credentials.
