(6) Support Coordination Group

The TG 8.5, Coordination Group, under the rupcr- .

vision of an AEC representative is responrible for:

(a) Providing for the control, coordination, and authorization of construction, modificationr, fabrication of items, and rehabilitation and modification of shore facilities, in support of the AEC Scientific Task Units.

(b) Receiving m d coordinating conrtruction, fabrication, modification and rehabilitation requirements for EQ JTF-8 facilities aohore.

(c) Providing for continuing liairon with the Scientific Deputy, and the Commander, TC 8.5 and his &puty, regarding the support contractor's work status in executing authorized tasks.

(d) Providing for the coordination of engineering and construction cost estimates.

(7) Pacific Operationn Branch

(a) General

Under the direction of an Area Project Engineer arsigned by the Atomic Energy Coemirrion, the Pacific Operations Branch is responsible for:

) Supervising the execution of construction and logistical functions authorized by the CTG 8.5 or hfs designee.

(2) Prwiding for on-rite super~ision and necessary action to arsure accomplirhnent of AEC func tionr including conrtruction, administration, logir tical support, security, tad-safe ty, communications, real estate, vehicle control, utilization of administrative and warehouse space, utilization of manpower, and other actions directed by the Command Section TG 8.5, CTG 8.6 at Johnston Island, and CTG 8.7 at Chris-8 Inland.

The funding of the integrated contractors , Eolmer & Narver and Edgerton, Germeshaurm & Grier w i l l be handled between these con- t r ac to r s and the Nevada Operations O f f i ce , Las Vegas, Nevada.

FOR - NUCLEAR TEST OPERATIONS AT OFF-CONTINENT TEST SITES

A. PUBPOSE

1. The purpose of t h i s agreement is t o provide a mutually sa t i s fac tory , general framework within which the Atomic Energy Coarnission (AEC) and the Department of Defense (DOD) may, on an equitable basis, de l ineate primary respons ib i l i t i e s of each agency, and budget and fund cos ts fo r j o i n t AEC-DOD nuclear t e s t operations a t the off-continent t e s t s i t e s . The concept of j o i n t AEC-DOD operations a t the off-continent t e s t sites encompasses buildup, operations, and rollup.

B. GENERAL

1. Except as modified by epaci f ic paragraphs below, the coets of the various test projecta connected w i t h the operation s h a l l be borne by the agency es tabl i sh ing the spec i f i c project .

2. The cos t s of projec ts of mutual i n t e r e s t t o both agencies w i l l be prorated i n proportion t o the degree of in te res t.

Such equipment as is reasonably avai lable from the stocks of e i t h e r agency w i l l , upon request, be furnished t o the other agency on a loan basis a t no cos t except tha t of operating, safeguarding, and maintaining the equipment. The AEC w i l l not, i n general, reques t through mi l i t a ry channels equipment avai lable from c o m ~ r c i a l sources. The borrowing agency w i l l not be held responsible f o r normal wear and tear but w i l l exercise adequate control and care of the equipment. Equipment on loan which is l o s t , des- troyed, o r damaged beyond economical repai r w i l l be accounted

The borrowing agency w i l l not be responsible fo r payment fo r any equipment on loan which is loe t , destroyed, o r damaged beyond economical repai r , except where s u j z lose, des t ruct ion, o r damage r e s u l t s from w i l l f u l misconduct, gross negligence, o r f a i l u r e to exercise good f a i t h on the p a r t of an employee of the borrowing agency, o r on the p a r t of a corporate o f f i c e r o r the pereon having e n t i r e supervision of the work a t the off-continent t e s t s i t e of a contracting firm of the borrowing agency.

4. The loan of marine c r a f t is a specia l case and is governed by a jo in t AgC-Department of Navy agreement quoted below:

"Effective this date, the following terms and conditions w i l l apply t o any loans of c r a f t made i n the fu ture by the Navy Department t o the Atomic Energy Commission. I n addition, these t e r m and conditions w i l l be applicable to Navy c r a f t i n the custody of the Atomic Energy C o d s o i o n as of t h i s date, insofar as applicable.

"1. The Navy Department, upon request of the Atomic Energy Commission w i l l lend to the AEC such c r a f t as can be made available and as a r e r e q u h d i n the prosecution of projec ts which a r e the responsib i l i ty of the ARC. Loan of such c r a f t s h a l l be made on custody rece ip t without charge for the c a p i t a l value of the c r a f t .

"2. The AEC w i l l provide funds on request by the Navy for act ivat ion, i f required, and f o r preparing f o r opera- t ion and t o w , i f necessary, any c r a f t made available t o the AEC, including funds t o procure addi t ional spare pa r t s and accessories required fo r operation of the c ra f t . Normal overhead w i l l be charged for this work.

"3. Delivery of c r a f t tha t a r e loaned t o the AEC under this agreement w i l l be on a "where i n " basis . Where pract icable, avai lable Navy transport w i l l be used t o redeploy c r a f t . However, any expenses beyond normal Navy operating expenses, incurred i n redeployment of c r a f t , w i l l be borne by AEC. Return del ivery of these c r a f t w i l l be a t the point of o r ig ina l t ransfer o r a t a point mutually agreed upon.

To assure t h a t c r a f t i n the custody of the Atomic Energy Conmtiseion under the t e r m of t h i s qreement a re maintained a t sa t i s fac tory Navy standards, they w i l l be subject to the routine material inspection normally conducted by the Navy f o r naval c r a f t , The scheduling of these inspections w i l l be mutually agreed upon by representat ives of the Navy and AEC i n the f i e l d

"5. a , Upon tranefer of Naval c r a f t from the Navy to the ABC and re turn of such c r a f t to the .Navy by the AEC, j o in t inspections of c r a f t so transferred o r returned w i l l be conducted. Such inspections w i l l be conducted by an appropriate board appointed jo in t ly by the Connnander i n Chief, U. S. Paci f ic F l e e t and the Manqer, Albuquer- que Operations Office, AEC and composed of both Navy and AEC members, The repor ts of the above board w i l l be ircmizid i n s u f f i c i e n t d e t a i l to enable alloca- t ions t o be made, upon re tu rn of c r a f t to the Navy, of repai r cos ts properly chargeable t o each party i n con- formance with t h i s agreement. These reports w i l l be forwarded to the Bureau of Shipe v i a the Naval command f r a n which the c r a f t a re obtained and the Commcmder i n Chief, U. S, Paci f ic F lee t with copies of the or ig ina l and a l l endorsements to the Chief of Naval Operatione, AEC Washington, other AEC agencies and Naval material bureaus aa appropriate. The work t o be performed i n re- pair ing c r a f t and a l locat ion of costa properly charge- able to each par ty for.. t h a t work w i l l , b e resolved by the above boards i n the f i e l d , and only such i t e m d l which cannot be reaolved sat isfact&ly by them w i l l be referred to the Chief of Naval Operations and the Atomfc Energy Comission. The United Kingdom has retained primary juriediction over t r i v i a l o r minor offenses against UK laws by both U.S. mil i tary personnel and U. S. c iv i l ians on the Island.

(2) 'Phe United Kingdom has waived i n advance her claim of criminal jurisdict ion aver members of the United States b e d Forces on the Island fo r all offenses except t r i v i a l offenses. Members of the U .S .
