Availability of an EnvironmentalAssessment for Public Review and Comment
Antelope Mine Federal Mining Plan Modification In accordance with the Council on EnvironmentalQuality (CEQ) regulations and the Department of theInterior (DOI) procedures for implementing the Nation-al Environmental Policy Act of 1969 (NEPA) 42U.S.C. 43332(2) (C), the Office of Surface Mining Re-clamation and Enforcement (OSMRE), Western Re-gion has prepared an Environmental Assessment (EA)to evaluate the environmental effects of the proposedmining plan modification for the Antelope Mine leaseby modification (LBM) to federal coal lease WYW-177903 (West Antelope II South Modification Tract).OSMRE is responsible for reviewing plans to conductcoal mining and reclamation operations on lands con-taining leased Federal coal. Pursuant to 30 CFR 746,OSMRE must prepare and submit to the Assistant Sec-retary for Land and Minerals Management (ASLM), adecision document recommending approval, condition-al approval, or disapproval of the proposed mining planmodification. ASLM approval of a mining plan modi-fication would authorize mining activities to produce anestimated 15.8 million tons (Mt) of coal at an estimatedrate of 30 Mt per year from federal coal lease WYW-177903. Antelope Coal, LLC owns and operates theAntelope Mine, which is located in Campbell and Con-verse counties, Wyoming, approximately 20 milessouth of Wright, Wyoming, east of Wyoming StateHighway 59. OSMRE invites the public to comment on the EA andunsigned Finding of No Significant Impacts (FONSI)available for public review. The EA and unsignedFONSI will be available for review as of May 8, 2020.All comments must be post marked by June 8, 2020 forconsideration. PUBLIC NOTICE The Wyoming Public Service Commission (Commis-sion) approved the Application of Black Hills Wyom-ing Gas, LLC, d/b/a Black Hills Energy (BHGW or theCompany), to revise tariff terms related to the assess-ment of late fees. The Commission’s interim approvalis subject to notice, protest, intervention, refund,change, further investigation, opportunity for hearingand further order of the Commission. On March 4, 2020, BHWG filed its Application to re-vise tariff terms related to the assessment of late fees.After the conclusion of the Company’s General RateCase, BHGW discovered that language regarding thelate payment fee assessment time in the proposed tariffwas not that intended by the Company. The unintendedlanguage created billing issues for BHWG customers.The current tariff retained a combination of the twovariations previously used. The language implementeda due date 20 days after issuance of the bill with a 10-day grace period before the assessment of late paymentpenalties. This is a total of 30 days for payment prior tothe assessment of late fees. The Company explains thismistake in the proposed tariff extends assessment oflate payment charges into a customer’s next billingcycle. The mistake potentially causes assessment of alate payment penalty after an on-time payment, creat-ing unintended confusion for customers. BHWG statesthat it has suspended late fee charges until it is correctstariff. BHWG intends to standardize the bill due date andgrace period by mirroring the then current terms ofthree of the four consolidated utilities. Specifically,BHWG is requesting to revise its tariff to state that billsare due 20 days after issuance, with a grace period of 7days prior to the assessment of late fees. This wouldchange the practice only for the legacy BHGD-WYcustomers, extending their due date by 5 days for a totalextension of days without penalties by 2 days. Interested persons may inspect the Application at BH-WG's Wyoming business office and at the Commis-sion’s offices in Cheyenne. The Application is avail-able for inspection by any interested person during reg-ular business hours or online at: http://psc.wyo.gov/.
