GILLETTE, WYOMING S GILLETTE NEWS RECORD S SATURDAY, MAY 9, 2020 PAGE C3 Availability of an Environmental Assessment for Public Review and Comment Antelope Mine Federal Mining Plan Modification In accordance with the Council on Environmental Quality (CEQ) regulations and the Department of the Interior (DOI) procedures for implementing the Nation- al Environmental Policy Act of 1969 (NEPA) 42 U.S.C. 43332(2) (C), the Office of Surface Mining Re- clamation and Enforcement (OSMRE), Western Re- gion has prepared an Environmental Assessment (EA) to evaluate the environmental effects of the proposed mining plan modification for the Antelope Mine lease by modification (LBM) to federal coal lease WYW- 177903 (West Antelope II South Modification Tract). OSMRE is responsible for reviewing plans to conduct coal mining and reclamation operations on lands con- taining leased Federal coal. Pursuant to 30 CFR 746, OSMRE must prepare and submit to the Assistant Sec- retary for Land and Minerals Management (ASLM), a decision document recommending approval, condition- al approval, or disapproval of the proposed mining plan modification. ASLM approval of a mining plan modi- fication would authorize mining activities to produce an estimated 15.8 million tons (Mt) of coal at an estimated rate of 30 Mt per year from federal coal lease WYW- 177903. Antelope Coal, LLC owns and operates the Antelope Mine, which is located in Campbell and Con- verse counties, Wyoming, approximately 20 miles south of Wright, Wyoming, east of Wyoming Stat e Highway 59. OSMRE invites the public to comment on the EA and unsigned Finding of No Significant Impacts (FONSI) available for public review. The EA and unsigned FONSI will be available for review as of May 8, 2020. All comments must be post marked by June 8, 2020 for consideration. The Commission’s interim approval i s subject to notice, protest, intervention, refund, change, further investigation, opportunity for hearing and further order of the Commission. On March 4, 2020, BHWG filed its Application to re- vise tariff terms related to the assessment of late fees. After the conclusion of the Company’s General Rate Case, BHGW discovered that language regarding the late payment fee assessment time in the proposed tariff was not that intended by the Company. The unintended language created billing issues for BHWG customers. The current tariff retained a combination of the two variations previously used. The language implemented a due date 20 days after issuance of the bill with a 10- day grace period before the assessment of late payment penalties. This is a total of 30 days for payment prior to the assessment of late fees. The Company explains this mistake in the proposed tariff extends assessment of late payment charges into a customer’s next billing cycle. The mistake potentially causes assessment of a late payment penalty after an on-time payment, creat- ing unintended confusion for customers. BHWG states that it has suspended late fee charges until it is corrects tariff. BHWG intends to standardize the bill due date and grace period by mirroring the then current terms of three of the four consolidated utilities. Specifically, BHWG is requesting to revise its tariff to state that bills are due 20 days after issuance, with a grace period of 7 days prior to the assessment of late fees. This would change the practice only for the legacy BHGD-WY customers, extending their due date by 5 days for a total extension of days without penalties by 2 days. Interested persons may inspect the Application at BH- WG's Wyoming business office and at the Commis- sion’s offices in Cheyenne.
