Manager’s Message

We will include a list in the next newsletter about new laws

passed by the board this summer. We wouldn’t want you to feel left

out.

The refinished pool looks great, just like new. It took longer than

expected to get started due to the wait for the county permit which

took about 6 weeks.

We still have mailbox key packets for 11 units. Please see Presi-

dent Fred if you are one of those unit owners without new keys.

Fifth street and half of sixth street did not have boxes to change, so

no new keys.

As the hot water tanks for the laundry room break down break

down, we are replacing them with the tank-less variety.

The list for rear door frame repairs is nearly completed. There

are still several residents we have not been able to contact.

On-going repairs: as the community ages the necessity for

maintenance increases. Much of what we are doing now is deferred

maintenance from the past years. You can expect the Board to ad-

dress past and current maintenance problems in a swift yet thrifty

manner.

The Budget Committee has been work-ing on the 2016 budget in concert with our accountant service “Summit”. It is also time to think about running for a po-sition on the board. New member are a key to new ideas and vitality in the run-ning of the association. Suggestions ra-ther than complaints and gossip go a long way in getting things done. The pool has been resurfaced, the deack sealed and the concrete areas have gotten a fresh coat of paint. 23 units have been turned over so far this year, so you will see some new faces. In the past 2 1/2 years, there has been 87 units which have changed ownership. This shows that this is a good place to live. We will be looking for volunteers to help with a few projects we would like to take on this winter season. Doing some cos-metic touches to the grounds will im-prove the aesthetics. We have the ideas, we just need some help implementing them. I would like to thank the Board Mem-bers for the help they have given me this year. I have tried to make this a joint ef-fort keeping everyone involved and in-formed in the day to day operation. Lis-tening to various opinions makes deci-sions making easier. Along with our property manager’s input, we have a smooth working group. Fred Gutowski, President

Meeting called to order at 10:04 P.M. Roll call:, The following were present Fred Gutowski, Anthony Murphy, Ruth VIvenzio Joe Galvin, Sylvia Russo and Don Campbell, Manager Meeting Minutes: 1. Motion by Fred Gutowski to waive May 20th Minutes until the next meeting. Tony Murphy se-conded the motion. All approved. 2. Motion by Fred Gutowski to waive Treasurer’s Report. Joe Galvin seconded the motion. All ap-proved 3. A vote to install Sam Zarcone to one of the Director’s position was held. Sam was unani-mously approved. There is still one position to be filled. 4. Fred Gutowski addressed the very few at-tending members with a request for volunteers, other than the Board members to be on the Budget Committee. There were two volunteers, Jim Gerrish and Rise Sztulwark. Jim and Rise will be working with the Board to develop next years budget.

5. The meeting was opened to the floor for com-ments. It was noted by residents that some own-ers were not preparing their grounds for the Hur-ricane season. Owners should be closing their awnings, removing planters and unauthorized items when they are not residing in their condos. 6. Motion by Ruth Vivenzio to adjourn the meet-ing. Seconded by Tony Murphy. The meeting was adjourned at 10:37 a.m. All approved. Good and welfare followed.

UPDATED BY-LAWS This is an on-going process to inform and edu-cate our unit owners on the legality of mecha-nisms as they pertain to the operation of our condominium, the by-laws and the member-ship. Changes to the Florida statutes when they occur, will also be reported via this publi-cation when space allows. In this issue Fines are covered as a 2 part is-sue. Under “obligations of owners and occu-pants; Remedies; Each unit owner, each tenant and other in-vitee, and each association is governed by, and must comply with the provisions of, this chapter, the declaration, the documents creat-ing the association. And the association by-laws which shall be deemed expressly incor-porated into any lease of a unit. Actions for damages or for injunctive relief, or both, failure to comply with these provisions may be brought by the association or by a unit owner Against: (a) The association

(b) A unit owner (c) Any director who willfully and knowingly fails to comply with these provisions. (d) N/A (e) Any tenant leasing a unit, and any other

invitee occupying a unit. The prevailing party in any such action or in any action in which the purchaser claims a right of void ability based upon contractual pro-visions as required in s.718.503(1)(a) is enti-tled to recover reasonable attorney’s fees. A unit owner prevailing in an action between the association and the unit owner under this sec-tion in addition to recovering his or her reason-able attorney’s fees, may recover additional amounts as determined by the court to be nec-essary to reimburse the unit owner for his or her share of assessments by the association to fund its expenses of the obligation. This relief does not exclude other remedies provided by law. Actions arising under this subsection may not be deemed to be actions for specific per-formance. Written by Tony Murphy, V.P.
