1.0 INTRODUCTION

1.1 Background

Hillhouse Quarry Group Limited (Hillhouse) intends to submit an application for planning permission to South Ayrshire Council under Section 42 of the Town and Country Planning (Scotland) Act 1997, as amended, to operate Hillhouse Quarry ‘without complying with conditions subject to which a previous planning permission was granted’.

The Quarry is located on the outskirts of Dundonald, approximately 4km north-east of Troon. The site location is shown on Drawing HQ1.

Hillhouse has appointed SLR Consulting Limited (SLR) to undertake a screening/scoping study and prepare this report to accompany a request to South Ayrshire Council to adopt a Screening and/or Scoping Opinion as to the required form and content of the planning application and if appropriate an Environmental Statement (ES).

1.2 Development History and the Intended Planning Application

Hillhouse Quarry has been operational since 1907. The extent of development permitted at the quarry is that contained in planning permission reference 5431, dated 2nd July 1948.

Planning permission reference 5431 was subject to a review under Schedule 9 of the Town and Country Planning (Scotland) Act 1997, which imposed a revised set of conditions on the operations at the quarry. The revised set of conditions is set out in the notice of determination reference CE/5/2 dated 29th January 1999 (The 1999 Decision). The progressive development of Hillhouse Quarry continues to be undertaken in accordance with The 1999 Decision.

The efficient development of the quarry is currently constrained until the 28th January 2014 by Condition 6 of The 1999 Decision that currently requires:

That the limit of excavations for the 15 year period from the date of the conditions being approved shall be restricted to the area outlined in blue and yellow on the submitted plans.

The combined extent of the blue and yellow areas that are referred to in Condition 6 is shown delineated purple on Drawing HQ2.

The intended planning application aims to remove the constraints imposed by condition 6 in order to allow development outwith the restricted area to commence during late 2010 rather than wait until January 2014, as the current condition 6 requires.

1.3 Fallback Position

The intended application is fundamentally different from many other forms of planning application as it wholly relates to a development that is already authorised and being undertaken. The planning application will not contain any proposal for new or extended quarrying operations. The purpose is instead to vary a planning condition and remove a time limited restriction on the lateral extent of workings.

The areas within which it is proposed to work by removing the restriction placed by Condition 6 of The 1999 Decision would be worked on lapse of the time limit i.e. 28th January 2014.

The fallback position therefore would see extraction within the constrained area of the quarry commence in 2014 (rather than late 2010) irrespective of the outcome of the intended planning application.

1.4 Purpose of this Report

This report is intended to engage South Ayrshire Council in pre-application consultation in respect of the intended planning application and in this regard the report looks to set out a description of the proposed development and outline the format of the planning application that is intended to be made.

The report is also intended to provide South Ayrshire Council with the necessary information to ‘screen’ the proposal and to issue a Screening Opinion as to the requirement to undertake a formal Environmental Impact Assessment (EIA). Furthermore, should the development be deemed to be EIA development, then the report provides the necessary information to enable the council to adopt a Scoping Opinion under the provisions of the Environmental Impact Assessment (Scotland) Regulations 1999, as amended (‘EIA Regulations’).

1.5 Hillhouse Quarry Group Limited

The Hillhouse Quarry Group Limited is South Ayrshire based and is one of Scotland’s largest privately owned heavy building materials businesses. The company supplies drystone, coated stone and concrete products to markets throughout Central and Southern Scotland, particularly Ayrshire and Glasgow

Hillhouse Quarry has been producing crushed aggregate since 1907 and continues to produce crushed rock aggregates, coated stone and concrete products. The operations at Hillhouse Quarry form the base of a complementary portfolio of operations comprising two hardstone quarries, three asphalt plants, a surfacing division, four ready-mixed concrete plants and a concrete blocks business, all in Ayrshire. The company also operates precast concrete businesses in Beith and in Inverness.

1.6 SLR Consulting Limited

SLR is a multi-disciplinary environmental consultancy with significant experience in preparing planning applications.

2.0 HILLHOUSE QUARRY SITE

2.1 Location

Drawing HQ1 illustrates the location of Hillhouse Quarry. The quarry is located on the outskirts of Dundonald in South Ayrshire, approximately 4km north-east of Troon, 9km north of Prestwick and 6km south of Irvine. The quarry is centred on national grid reference NS351340.

The quarry is accessed off the A759 that is located to the north-west. The Glasgow South Western Railway (Stranraer Branch) runs north-east to south-west approximately 200m from the north western boundary of the quarry.

Collenan Reservoir is located approximately 400m south of the Quarry.

The nearest residential properties are isolated dwellings located approximately 800m to the south and west of the quarry. The nearest settlements are Dundonald to the east, and Barassie and Loans to the west.

Core footpath SA7 runs through Dundonald Woodland to the south and west of the quarry.

2.2 Quarry Land Uses

The Quarry can be described in the following key compartments:

• Active quarrying areas comprising areas of extraction by drilling and blasting, and loading of blasted material for transportation to the plant site.

• Plant and stocking area: plant, buildings and stocking areas including coating plants. • Undeveloped area: eastern area of the Quarry into which the working face will

progress following soil stripping and other enabling works. • Periphery lands: undeveloped areas to the south-west and north of the current

operations.

Approximately 6.5ha of the currently undeveloped areas into which it is intended to progress the quarry workings comprises parts of the Dundonald Wood SSSI. Dundonald Wood is a mixed predominantly deciduous woodland extending to 31ha in total. The intended working in the areas of the SSSI would be subject to Mitigation and Management works that are provided for by condition 16 of The 1999 Decision.

The majority of the other undeveloped areas comprise enclosed pasture which is currently utilised for the grazing of livestock (cattle and sheep).

3.0 DESCRIPTION OF THE OPERATIONS

3.1 Method of Extraction, Processing and Despatch

The existing methods of extraction, processing and despatch have been established over a number of years and are summarised below for information.

Rock is dislodged from quarry faces by blasting whereby a series of holes are drilled in a development bench, filled with explosives and thereafter blasted to release rock.

The blasted rock is loaded by a face shovel into dump trucks and hauled from the blast location to the plant area for processing. The processing operation involves preparing the blasted rock into saleable products. This is achieved by feeding the blasted rock via a primary feed hopper through a series of crushers and screens that shape and sort the stone into the required range of products.

From the processing plant, the largest portion of the resultant aggregate products is stocked in their respective sizes before being hauled from the plant area to the stockyard for final stocking and subsequent sale. A smaller proportion of the aggregates are fed to the asphalt plant for use in the manufacture of a range of surfacing (coated stone) materials.

The asphalt plant blends the quarried aggregates with sand and a filler (such as stone dust) in the correct proportions and then heats the materials to a temperature suitable for coating with a bitumen binder.

The aggregates and asphalts are ultimately dispatched from the stockyard, or from the asphalt plant, by way of road going lorries that typically carry 20 tonnes per load. Unladen vehicles arriving at the quarry for loading are weighed in at the weighbridge upon arrival, before progressing to the stockyard where they are loaded by a wheel shovel loader before being weighed back out at the weighbridge, passing through a wheel wash and then being sheeted before leaving the quarry.

All vehicles enter and leave the quarry using the established access road running from the A759 road.

3.2 Operating Hours

Extractive operations are regulated by Condition 5 of 1999 Decision that restricts excavation working to between the hours of 6.45am to 6pm Monday to Friday, from 7am to 1pm on Saturdays and from 7am to 3pm on Sundays.

Works outwith the periods regulated by Condition 5 are restricted to servicing and repairs and the operation of the coating, crushing and concrete plants.

3.3 Quarry Development

The final extent of the quarry development envisaged is delineated by a dashed green line on Drawing HQ2.

As the working face progresses into areas of previously undeveloped land, the vegetation would be cleared in advance of soil stripping. The stripped soils would be used in restoring other exhausted areas of the quarry. The existing quarry faces will then progress over time until approaching their final face positions at the limit of the intended operations.

3.4 Restoration Concept

Condition 21 of planning permission CE/5/2 makes provision for the submission of a restoration scheme for approval by the local planning authority 12 months prior to completion of extractive operations at the Quarry.

4.0 SCREENING THE DEVELOPMENT FOR EIA

4.1 Introduction

A preliminary EIA screening and scoping study has been carried out by SLR, following the practice described in Planning Circular 8/20071 and taking account of best practice guidelines from the Institute of Environmental Management and Assessment2, from the SNH handbook on EIA3 and from PAN 584.

The remainder of this section sets out the screening assessment of the proposed development in order to assist South Ayrshire Council adopt a ‘screening opinion’ and if appropriate a ‘scoping opinion’ as prescribed in the EIA Regulations.

4.2 Approach to Screening and Scoping Study

The existing operations at Hillhouse Quarry are well established and already form an integral part of the environmental baseline for the area. The proposed development would not materially alter the nature of land use currently employed.

This screening and scoping study has initially comprised a desk based appraisal that considered datasets from a variety of sources including the existing operating features of the Quarry, Ordnance Survey mapping and Development Plans.

4.3 Considering Schedule 1 and Schedule 2 of EIA Regulations

In considering the requirement for EIA it is necessary to firstly determine whether the proposed development is listed in either Schedule 1 or Schedule 2 of the EIA Regulations. Figure 1 of Planning Circular 8/2007 outlines a process diagram for applying Schedule 1 and Schedule 2 of the EIA Regulations as a way of establishing whether a development requires EIA.

The already consented operations at Hillhouse Quarry are over an area “where the surface of the site exceeds 25 hectares” as described at paragraph 19 of Schedule 1 to the EIA Regulations. It is therefore considered that the already consented operations at Hillhouse Quarry are of a type listed in Schedule 1 of the EIA Regulations.

Paragraphs 21 of Schedule 1 and Paragraph 13 of column 1 to Schedule 1 of the EIA Regulations provides that changes or extensions to already implemented EIA developments can themselves require EIA, where such a change or extension in itself meets the thresholds, if any, or description of development set out in Schedule 1 or Schedule 2 as appropriate.

It is acknowledged that the intended planning application relates to a quarry development over an area exceeding 25 hectares and in that regard the intended planning application might be considered capable of falling within Schedule 1 of the EIA Regulations. As described above however, the intended planning application relates to quarrying development that is already authorised and being undertaken and will not itself contain any

proposal for new or extended quarrying operations. The physical extent of those consented operations would not alter in any way as a result of the intended planning application. It is not therefore considered that the relevant thresholds of Schedule 1 are necessarily exceeded.

The intended planning application would involve development within the Dundonald Wood SSSI. SSSIs are identified in the EIA Regulations as being ‘sensitive areas’ and the EIA Regulations in turn require that all developments within or adjacent to sensitive areas are Schedule 2 developments, requiring to be screened for the need for EIA.

The following discussion provides relevant information on the intended planning application to inform a systematic assessment as to whether the proposed development is likely to be EIA development. The checklist provided at Annex B to Circular 8/2007 has been completed and applied to the planning application to highlight potential areas of environmental impact arising from the proposed facility. The checklist is reproduced at Appendix A.

The checklist provides the opportunity to consider the characteristics of the proposed development in combination with its proposed location in order to identify the potential for interactions between the development and its environment and to therefore determine whether there are likely to be environmental effects.

5.0 ENVIRONMENTAL TOPICS CONSIDERED IN THE SCOPING STUDY

5.1 Ecology and Biodiversity

The currently undeveloped parts of Hillhouse Quarry largely comprise an area of pasture which is currently utilised for the grazing of livestock (cattle and sheep). This area is considered to be of limited ecological value.

The undeveloped part also comprises part of the Dundonald Wood SSSI. At present the Dundonald Wood SSSI has an unfavourable nature conservation status.

Mineral extraction throughout the SSSI is already consented by the extant planning permission at the quarry, albeit not before 2014. However the intended planning application would rationalise the extent of SSSI to be occupied by quarrying and envisage developing within only 6.5ha of the 31ha designated site.

An ecological appraisal including site visit by an experienced ecologist has been carried out in order to inform the preparation of a Mitigation and Management Plan for the Dundonald Wood SSSI. The Mitigation and Management Plan has been funded by Hillhouse and has been developed in consultation with SNH.

The Mitigation and Management Plan is to be submitted to South Ayrshire Council for approval as envisaged by Condition 16 of The 1999 Decision. The implementation of the measures contained within the plan would be funded by Hillhouse and would bring about the positive management of the SSSI and the adjacent woodland so as to significantly improve the conservation of the SSSI in the longer term.

It is considered that potential impacts on the Dundonald Wood SSSI can be effectively regulated and mitigated through the existing planning controls contained in The 1999 Decision.

The only direct effect of the intended planning application on the Dundonald Wood SSSI would be to see parts of it being removed from late 2010 onwards as opposed to those works being put off until early 2014. Those effects are not considered to be significant.

5.2 Landscape and Visual Amenity

Quarrying at Hillhouse and at other localised operations is a long established feature in the local landscape. Hillhouse Quarry is in general terms relatively well screened from the local area by virtue of retained topography and established woodland around the flanks of the quarry.

The intended planning application would not alter the planned lateral extent of quarrying. The intended planning application will propose areas of currently undeveloped land being removed from late 2010 onwards as opposed to those works being put off until early 2014. Those effects are not considered to be significant.

5.3 Hydrology and Hydrogeology

The main interface between Hillhouse Quarry and the water environment currently is the management of collected rain and surface from the quarry.

The depth of the extraction is limited to the current floor level by Condition 7. There will therefore be no change in the hydrological and hydrogeological regime at the quarry as a result of the intended planning application.

5.4 Noise

The aspects of development which could potentially give rise to noise impacts are:

• site preparation works, including soil stripping; • mineral extraction operations and transportation within the site; • mineral processing operations; and • transportation of minerals from the site by heavy goods vehicles.

All of the potential sources of noise impact listed above already take place at Hillhouse Quarry and are already accommodated within the environmental baseline for the local area.

In so far as the mineral processing operations and the transportation of minerals by HGV’s are concerned, there is no proposal to alter the characteristics of those existing activities.

The scope for any change to the environmental baseline from those operations is therefore limited and can reasonably be disregarded from further consideration.

Noise limits will continue to be regulated by Condition 9 of the extant planning permission.

5.5 Blasting

Blasting is used at Hillhouse Quarry to break and dislodge rock from quarry faces.

The potential environmental impacts of blasting include ground vibration, air overpressure, noise and dust at adjacent premises. Conditions 10 and 13 of the existing planning permission regulate blast events at the quarry in order to manage any potential impact.

Routine monitoring of quarry blasts demonstrates compliance with the limits set out in Condition 10 of the existing permission. The intended planning application will not present any variation to the nature of blasting undertaken at the quarry.

5.6 Traffic and Transportation

Hillhouse Quarry is accessed via a well laid out and formed junction from the A759. Condition 19 of the extant permission requires that the visibility splays at the junction are suitably maintained.

The intended planning application will not contain any proposal for a new quarry access or any proposal to alter the volume or nature of distribution of traffic that has been established for some considerable period of time.

5.7 Air Quality (Dust)

The primary potential impact on air quality from the continued working of Hillhouse Quarry is the risk of deterioration in local air quality as a result of wind blown dust.

The main sources of dust within the quarry are from the haulage of materials and from the processing and subsequent stocking of aggregates. There is also a limited potential for dust to be generated during the drilling of blast holes and the subsequent detonation of blasts.

Each of the dust sources mentioned above are currently in operation at the Quarry and have not caused any significant levels of dust that have given rise to outstanding complaints. Generation and control of dust are regulated by Conditions 2, 3, 4, and 18 which make provisions for reducing dust generated by the movement of vehicles, and Condition 8 which controls dust emissions from plant.

There will be no additional dust sources from the haulage, processing or stocking of aggregates as all of those activities will continue on site in the same manner and employing the same mitigation measures as the existing operations.

5.8 Public Access

Core Path SA7 runs to the south and west of the Quarry boundary within the Dundonald Wood. A number of other footpaths have been created by Hillhouse in partnership with South Ayrshire Council that run through the wooded area.

The Mitigation and Management Plan proposed for Dundonald Wood SSSI will contain measures for the ongoing maintenance of footpaths and access to the woodland. It is not considered that there will be any significant impact to public access as a result of the intended application.

6.0 CONCLUSION

Hillhouse Quarry Group intend to progress the extraction of minerals at Hillhouse Quarry without compliance with the time limit envisaged by Condition 6 of planning decision CE/5/2.

The intended planning application would provide for extractive operations to progress into currently undeveloped parts ahead of the current permissible start date of 28th January 2014. The company do not however intend to extend the quarry workings beyond that already permitted at the site

This report describes the nature of the intended planning application and the site setting with a view to establishing whether the proposed development constitutes EIA development. It is acknowledged that the intended planning application would be for a change to an existing Schedule 1 EIA development. It is not considered that the intended planning would necessarily be Schedule 1 EIA development in itself.

The intended planning application would be Schedule 2 development as defined in the EIA Regulations. A screening checklist has considered the potential for significant environmental impacts to occur through the intended planning application. Through that screening, it is not considered that the development requires the undertaking of an EIA.

Potential effects on the Dundonald Wood SSSI would be effectively managed through a Mitigation and Management Plan to be funded by Hillhouse as a requirement of the existing planning permission for the quarrying activities at the site.

The intended removal of Condition 6 of Planning Permission CE/5/2 will not introduce any new development to the existing environment.

The Quarry will continue to operate as it does currently and will utilise the access roads and other plant currently in use.

(b) Cumulation with other development

Are there potential cumulative impacts with other existing development or development not yet begun but for which planning permission exists?

No

The existing quarry operations at Hillhouse Quarry already coexists with Hallyards Quarry.

The planning application will not itself result in any new development.

Should the application for this development be regarded as an integral part of a more substantial project? If so, can related developments which are subject to separate applications proceed independently?

Yes

The quarry development is permitted under planning permission CE/5/2 – there are no other related developments proposed.

Residential properties are located within approximately 800m of the Quarry. The intended application does not constitute a new proposal and therefore the effects of the development on surrounding land uses are small.

Approximately 6.5ha of the 31ha Dundonald Wood SSSI would be lost through the proposed quarrying operations in the eastern area of the site.

Planning consent CE/5/2 permits mineral extraction within the whole of the Dundonald Wood SSSI.

A Mitigation and Management Plan has been produced in consultation with SNH and as envisaged by Condition 16 of the extant planning consent reference CE/5/2.

Potential effects on the SSSI can be effectively managed through the Mitigation and Management Plan.

CHECKLIST OF CRITERIA FOR EVALUATING THE SIGNIFICANCE OF ENVIRONMENTAL EFFECTS

The checklist below is for use in conjunction with the Screening Checklist in the first part of this Annex.
