Demolition drives: NHRC sends notices to Delhi govt, rly board |

Acting on reports that several people were rendered homeless due to demolition drives in New

Delhi, the national rights watchdog has sent notices to the Delhi chief secretary and the railway

board chairman even as a row rages over the death of an infant at a slum cluster that was razed by

railways.

The National Human Rights Commission (NHRC) has also decided to conduct an on-the-spot inquiry

in this regard.

NHRC said it had sent the notices after taking suo motu cognisance of media reports regarding the

demolition of slum dwellings at two places in the city -- Shakurbasti in west Delhi and Belagaon area

in old Delhi.

“The contents of the news reports, if true, raise a serious issue of violation of the right to life, right to

shelter and right to dignity of the people, including women and children, who have been rendered

homeless due to demolition of their slum dwellings,” the commission observed.

Media reports said that following the demolition drive carried out by railway authorities in

Shakurbasti, nearly 500 people were rendered homeless.

Accordingly, NHRC has issued notices to the Delhi Chief Secretary and Chairman of the Railway

Board seeking reports on the matter within two weeks.

The demolition of shanties in the Belagaon area was reportedly carried out by Delhi Development

Authority. Several affected people are stated to have held out Aadhaar and voter identity cards and

other documents about land and land holdings in the Belagaon area.

A woman showed papers that she was promised an alternative plot in 2006 for which Rs 500 were

paid to the authorities. The Commission has issued a notice to the Chief Secretary of Delhi

government calling for a report within two weeks in the matter.

NHRC has also decided to send a team of its officers to conduct on-the-spot inquiry at the two spots

where demolition drives were undertaken and submit reports within one week.

A case of death due to negligence has been lodged by police over the loss of life of the baby girl in

the Shakurbasti slum cluster even as the political slugfest over it intensified with Chief Minister

Arvind Kejriwal asserting that no such razing will be allowed without rehabilitation.

Meanwhile, stepping into the demolition row, Delhi High Court came down heavily on the rail ministry

and police for razing the slum cluster and directed the authorities to immediately rehabilitate over

5,000 people rendered homeless in this biting cold.

The National Human Rights Commission (NHRC) has issued conditional summons to the Delhi Chief Secretary, Police Commissioner and Union Home Secretary after they failed to send requisite reports on the impending release of the juvenile involved in the December 16, 2012 rape and murder case of 'Nirbhaya'.

The Commission has now asked them to submit the report by December 21 or personally appear before it to explain the reasons, the NHRC said in a statement. After taking cognizance of a complaint from the parents of 'Nirbhaya', the NHRC had issued a notice to the Secretary of Delhi Government, Police Commissioner and Secretary of Union Home Ministry on November 20 calling for reports, within two weeks on impending release of the juvenile in Nirbhaya rape and murder case, the statement said.

In their complaint to NHRC, the parents of 'Nirbhaya' had stated that the juvenile, who was largely responsible for the death of their daughter and was the most brutal amongst all the offenders, was supposed to be released sometime in December.

They had submitted that such persons are threat to the life and liberty of the common man. There

should be a mechanism to keep a strict check on them so that people are not subjected to any risk of

being harmed.

The National Human Rights Commission (NHRC) has issued notices to the Indian Railways Board and

Delhi Government on demolition of slums in Shakur Basti and Belagaon in the national capital.

More than 500 slums were demolished in an anti-encroachment drive conducted by the Indian Railways

in Shakur Basti on Saturday.

“The Commission has observed that the contents of the news reports, if true, raise a serious issue of

violation of the right to life, right to shelter and right to dignity of the people, including women and

children, who have been rendered homeless due to demolition of their slum dwellings,” a NHRC press

release stated.

The NHRC has further said that several affected people held out Aadhar and Voter Identity Cards and

other documents, indicating old correspondence about land and land holdings in the Belagaon area.

The slum residents in Shakur Basti raised an uproar after a child was found dead. They alleged that the

child had died in the anti-encroachment drive.

The Commission has also decided to send a team of its officers to visit both the places of demolition and

conduct an on-the-spot enquiry and submit reports within one week.

According to reports, the DDA had demolished several jhuggis to free the Belagaon area in Old Delhi as

part of their demolition drive last week.

The DDA had reportedly said that they were carrying out the demolition drive on the orders of the

National Green Tribunal.

Call money: NHRC to issue notices to CS, DGP

The National Human Rights Commission has taken a serious note of the call money racket that was busted in

Vijayawada recently.

NHRC Chairman Justice Cyriac Joseph termed the issue as “serious” and said notices would be sent to the Chief

Secretary and the Director General of Police in this regard.

“We are issuing notices asking them to send a report on the incident,” Justice Joseph said.

The notices would be sent in a day or two calling for a comprehensive report on the incident within a stipulated

period.

“Let us see what further action can be taken after we receive the report,” he said.

The NHRC is contemplating to depute its representatives for first hand information on the development once

the report is received from the State Government.

The NHRC chairman responded to a complaint lodged by a delegation of senior Congress leaders headed by

APCC president N. Raghuveera Reddy which called on him on Tuesday.

The APCC said, in its complaint, that the call money racket busted in Vijayawada, the administrative capital of

Andhra Pradesh, not only involved call money, but was also a racket exploiting women who opt for call money

sexually.

The racket had exposed the nexus between the financiers, politicians and bureaucrats. It is not just an

economic/financial scam, but threatens the human rights of the people, especially women.

The call money lenders gave loans to women and these gullible women were tortured and sexually abused even

after the repayment of the loan.

Expressing apprehension that the involvement of few MLAs and bureaucrats in the racket could influence the

probe, the APCC president urged the Commission to protect the victims’ human rights in the interest of justice.

The APCC delegation also called on the representatives of the National Commission for Women and submitted

a memorandum explaining the modus operandi of the call money racket.

NEW DELHI: The National Human Rights Commission on Tuesday issued summons to the Delhi chief

secretary, police commissioner and the Union home Secretary following their failure to produce reports on the

release of the juvenile convict in the 2012 Nirbhaya gang-rape and murder case.

The Commission had issued a notice to them on November 20, giving them two weeks to respond after taking

cognisance of the apprehensions of the victim’s parents.

The NHRC has now asked the city and state authorities to submit the reports by December 21 or personally

appear before it.

Nirbhaya’s parents had requested the Commission to recommend to the government to prepare a plan to

protect citizens from such delinquent juveniles as the convict, post their release and also to strengthen existing

laws on the subject.

The National Human Rights Commission had asked the Delhi chief secretary to apprise it of any pre-release or

post-release plan prepared for the juvenile and also sought information on whether the juvenile had been

recently subjected to psychological or psychiatric assessment.

It had also asked the Union home secretary whether any action was taken based on the representation

submitted by the parents of the victim to the Home Minister. The Commission had observed that “there is no

doubt that the complainants have undergone extreme agony and pain after the incident of rape and murder of

their daughter. The fears expressed by them need to be looked into.”

On Monday, the Centre asked the Delhi High Court to extend the observation home stay of the juvenile convict,

who is scheduled to be released on Sunday, arguing that several mandatory aspects were missing from the

post-release rehabilitation plan which needed to be considered before setting him free.

The court was hearing its stand on BJP leader Subramanian Swamy’s PIL seeking a stay on the juvenile’s

release and reserved its verdict on it.

Three Years 'Nirbhaya' Rape, Govt To Help Juvenile Convict Set Up Tailoring Shop

Three years after a young woman was brutally raped and murdered in the national capital on a moving

bus, one of the accused, who was a juvenile at the time of the crime, is set to walk free but the parents of

the victim say they feel no sense of closure.

According to the Times of India, as part of a rehabilitation plan by the Delhi government's department of

women and child development (WCD), the rapist will be given a one-time financial grant of Rs 10,000

and a sewing machine so that he can set up a tailoring shop.

The Intelligence Bureau had earlier said that the rapist had allegedly been radicalised inside the

correction home.

"We have failed. Now there is no hope for justice," the distraught parents of the December 16, 2012

gangarape victim told PTI and appealed to the government to not release the convict.

"With each passing day her memories get more intense. But we are not even able to face the memories as

we have failed to secure justice for her. And now there is no hope for justice!," the 50-year-old father of

the victim said. The juvenile convict, allegedly the most brutal of the six accused, is scheduled to be

released on December 20 because his term at the minor observation home ends.

The parents have submitted representations to the Home Ministry and National Human Rights

Commission (NHRC).

"For us he is the killer of our daughter who is being set free despite his heinous crime. We demand that he

should not be released," the father said.

The Centre had asked Delhi High Court to extend the observation home stay of the juvenile convict,

Today the parents, in collaboration with women's and citizens groups, will mark the day as 'Nirbhaya
