Example

Assume:20,000 discharges; 50,000 Part A & Part C days; 100,000 total days; charity care charges are 20% of total chargesYear 1 of implementation is 2012

Base amount = $2 million + (20,000 x $200) = $2 million + $4 Million = $6 million

Medicare Share = 50,000 / (100,000 x 80%) = 50,000 / 80,000 = .625

Transition Factor = 1Total = $6 million x .625 x 1 = $3.75 million in Year 1

Meaningful Use

Comments to Draft Definition of “Meaningful Use”

• Medicare Payment Advisory Commission (“MedPac”)

• American Hospital Association (“AHA”) • Healthcare Information and Management

Systems Society (“HIMSS”)

Page 37: HITECH Act Incentives for Electronic Health Records: Show Us the Money!! Georgia Healthcare Financial Management Association Richard D. Sanders rsanders@balch.com.

37

Meaningful Use (cont.)

• Strong public and industry endorsement of outcomes-focused framework for meaningful use

• Although a clear stretch, meaningful use of HIT is critical to president’s and congress’s agenda for health reform, which drives the urgency of the timelines

• Achieving the aggressive timelines will require more than financial incentives (e.g., education, regional extension centers, increased informatics workforce, product improvements, accelerated technical standards adoption)

• While extremely ambitious, with robust alignment of incentives, the vision is achievable

Page 38: HITECH Act Incentives for Electronic Health Records: Show Us the Money!! Georgia Healthcare Financial Management Association Richard D. Sanders rsanders@balch.com.

38

Meaningful Use (cont.)

General Themes• Majority concurred that the focus of meaningful use must be on

objectively measurable improvement of health outcomes and actual effective use, not simply to promote the adoption of technology for its own sake.

• Commenters generally applauded the emphasis on quality. • More than a third of commenters expressed general support for the

initial guidance. • Some suggested more aggressive timeline; some suggested less

aggressive timeline.• Many asked for clarification of terms.

adopting an initial set of standards, implementation specifications, and certification criteria

43

Some Things We Still Don't Know About the Rulemaking Process:

A. ONC vs. CMS - which details decided by whom?

B. When will CMS issue a proposed rule? A final rule?

Page 44: HITECH Act Incentives for Electronic Health Records: Show Us the Money!! Georgia Healthcare Financial Management Association Richard D. Sanders rsanders@balch.com.

44

“To Do” List

A. Get involved in the regulatory process.1. Keep track of committee meetings and read

minutes.a. http:llaamc.org/members/gir/hitlstarthtm

b. http:l/rossmartinmd.comlf/blog.htm (for an HIT laugh)

2. Voice your opinion, either directly or through your trade associations.

3. Do a "gap analysis" when proposed standards are issued and submit comments if the standards are over-reaching.

Page 45: HITECH Act Incentives for Electronic Health Records: Show Us the Money!! Georgia Healthcare Financial Management Association Richard D. Sanders rsanders@balch.com.

45

“To Do” List (cont.)

B. Choose your EHR vendor wisely.1. 1 Is the prospective vendor an active participant in the

regulatory process?2. What is their action plan for acting on new developments?3. Will they indemnify you for failure to furnish a "certified

EHR technology?“

C. Keep checking for other funding.1. Check Grants.gov and hhs.gov/recovery periodically.2. Monitor opportunities in the Federal Register.3. Be creative and proactive - take the initiative to present

DHHS agencies with funding ideas.
