DO YOU HAVE THE RIGHT TO COMPEL THE HEAD OF YOUR FAMILY TO ACCOUNT FOR

PROCEEDS OF FAMILY PROPERTY? PART THREE (3) - COURT AS A CHANNEL FOR REDRESS

The law gives family members the right to seek accountability from the head of family is called Head of Accountability Law, 1985 (PNDCL 114).

The law states as follows '' any head of family or any person who is in possession or control of or has in his custody, any family property is to be accountable for the property to the family, and is required to '' cause to be taken and filed'' an inventory of the property.

Furthermore, ''any member of the family who has or claims to have any beneficial interest in the property'' may apply to a court for an order enforcing the duty of the family head to account. However the individual family member/applicant seeking such relief must satisfy the court that he had taken all reasonable steps to settle the matter within the family, and that all such attempts had failed.

In short, the law in Ghana empowers individual members of the family to compel the head of family to account for family property in his custody through using family grievance channels and using legal remedies under PNDCL 114.
