Commissioner Kokoski also said the new 911 center and reason we have desks that rise up and down so you can stand at your desk not always sit, is because Melody brought that to her attention. So all dispatchers need to thank Melody. Melody thanked the Commissioners, she said this is just part of the job there are a lot of things to do, been doing it 20 years and yes some calls do stay with you for a while and you go home with that. Commissioner Lundy said this job is challenging and the county does go through a lot of dispatchers. Mr. Cordes said yes, it’s not as easy as it looks on tv or in the movies, it is very multi tasks and now we have a state of the art facility. She thanked the taxpayers for their support of 911 and the new facility is great as well as the staff Commissioner Sweda said this is a tough job and heard some people don’t come back after lunch and it takes a special person to do this. __________________(discussion was held on the above) JOURNAL ENTRY 9:45 a.m. Lauren Burgess, Executive Director – Office on Aging Update on Services Laruen thanked the Commissioners and thanked 911 and the dispatchers they do a wonderful and she can speak from experience when she had to call them and they walked her through giving CPR to her mother. Lauren said there’s need for older adults in our county and many services that are offered by Office on Aging but funds are needed Homemaker serves 95-105/month, 2 hours every other week and there are 289 on the waiting list. This provides residents 60 and older to maintain a healthy and cleaning living environment. More adults are staying in their homes and living longer. Homemaker provides light housekeeping to heavy chore jobs Transportation which is a door to door service using volunteer’s cars and provides 300 rides/year which is only about 1.2 rides/day but this is only for 60 and older with no other means to get to appointments, first come first served advance notice and there is about 8-10 people waiting Nutrition provides a meal because we have food insecurity here especially if there is a lack of reliable transportation.

9:40 a.m. Recognizing Melody Perkins, 911 Communications System OperatorCommissioners presented and took picture with Melody on her recognition of her outstanding performance on November 25, 2018.

Melody’s professionalism made a direct contribution ensuring the safety of our law enforcement officers on a shooting incident in Camden Township. Your actions, skills and calm demeanor that day demonstrated your compassion and dedication to your career and Community. Your professionalism was also recognized by an Ohio Gold Star Award from Ohio Chapters of Association of Public-Safety Communications Officials International and National Emergency Number Association. Commissioner Kokoski also said the new 911 center and reason we have desks that rise up and down so you can stand at your desk not always sit, is because Melody brought that to her attention. So all dispatchers need to thank Melody.

she had to call them and they walked her through giving CPR to her mother.Lauren said there’s need for older adults in our county and many services that are offered by Office on Aging but funds are neededHomemaker serves 95-105/month, 2 hours every other week and there are 289 on the waiting list. Nutrition provides a meal because we have food insecurity here especially if there is a lack of reliable transportation.Home Delivered Meals – A hot, nutritious meal is delivered Monday through Friday at lunchtime by a dedicated group of volunteers. 

Currently, residents reside in the cities of Avon, Avon Lake, Sheffield Lake, Village of Sheffield and the Townships of Brighton, Huntington, Penfield, Pittsfield and Wellington. The communities all support this by some financial need given and Avon Lake Mayor Zilka delivers every Thursday. There is a waiting list in the Lorain and Elyria of around 450 that is provided by another entity. Mr. Cordes said the county gave Title 20 money from JFS to Office on Aging. Lauren said no but would like to have discussions with the agencies to see how all can level funds.

Restaurant Voucher Program – Clients can receive up to twelve (12) vouchers a month to be used at the Blue Sky Restaurant locations in Amherst or Elyria.  Program participants select a meal from a pre-approved special menu designed by a registered dietitian while having the opportunity to socialize with one another. Tipping the server is the only required cost for clients. There are 600 vouchers distributed per month and 90 people are on the waiting list. There are around 6,730 vouchers per year and it is a dietician specialized menu but it gets them out to continue to be socialized.

Senior Food Box Program – This program funded by Second Harvest Food Bank provides a once-a-month box of nutritious, shelf-stable items to eligible Lorain County residents and is a 40 lb box that has 160 delivered per month and 9 on waiting list. And the bags are about 86 per month with 29 on waiting list.

Emergency Food Pantry – Located at both the Main and Northeast locations, please call ahead for hours and eligibility requirements.The programs listed above have little to no cost requirements for the clients receiving these benefits, however, donations are always

appreciated.Commissioner Sweda asked how much does it cost per meal. Lauren said southern part of the county is around $5.40 which is purchased

from a local nursing home $3 with $2.40 mileage. Other parts of the county it cost around $4.70-4.95 through Western Reserve. Lauren said she would like to collaborate with other agencies in the county to see how this service as well as other can be collaborate and be more efficient.

Lauren said without the volunteers this work could not be done, she appreciates them all and older adults are staying in their homes at least 90%. Mr. Cordes said even Medicare is supporting visiting nurses since nursing homes are expense.Aging and Disability Resource Center

An initiative of the Western Reserve Area Agency on Aging. Assistance is available to older adults (60 and over), adults with disabilities and their families/caregivers to address their needs in a community setting and there is no waiting list and work with JFS and APS

Benefits Assistance – Our case managers assist the client and/or their family members in identifying public benefits they are eligible to receive.  Further, we help with the application, enrollment, and follow-up processes to troubleshoot common issues.  Benefit examples include; Medicare/Medicaid, Supplemental Nutrition Assistance Program (SNAP), Home Energy Assistance Program (HEAP), Homestead Exemption, and potential assistance with Medicare costs.

Specialized Information and Assistance – This phone-based service acts as a gatekeeper to all LCOOA services in addition to linking callers to other appropriate resources in the community.

Options Counseling – This community-based, client-driven voluntary service pairs an Options Counselor with clients and their families/caregivers.  The Counselors help to identify needs, build on strengths, educate about available programs and services, ultimately facilitating entry into the services or programs the client selects.

Kinship CaregiverKinship placements with both relatives and non-relatives is on the rise and this program is designed to provide the following services to

support the placements and families:Kinship Legal Assistance provides funding to cover costs associated with custody and guardianship.  Funding is limited and is

offered on a first-come, first-serve basis. Clients of all ages are served.Our Food Pantry is available specifically for kinship families. Please call for more detailed information.Case Management services are provided to kinship caregivers to assist in addressing their unique needs.Kinship Caregiver Support Groups are offered throughout the year to assist the caregiver in adjusting to their new role and

navigating multiple systems, including the school system.Lauren said Miami University did a statistic on older adults and in 2020 the population of 60+ will be 25%; 2030 it will be 23.6% and in

2050 it will double to from 2%-4.2% with 60/65 and 80 year old adults and that is because of the baby boomers and people living longer.Commissioners thanked her for the update and will review the resources that are available.

In the matter of a decision on 46.240 acres muni owned )land annexation in accordance with ORC 709.14 & 16 to) May 29, 2019Grafton Village from Eaton and Grafton Townships )

Commissioner Lundy moved, seconded by Kokoski. Clerk called for discussion.Eaton Township Trustee Monschein said he spoke about this last week and he has not received anything from the Engineers office.

Trustee Monschein said last week he spoke of the paperwork, map and also here today is the last serving former Trustee Walker that has knowledge of the agreement he spoke of. He distributed the consent to creed he would speak about, unless there has been some change or they have an appendix that he does not have. As he referred to last Wednesday, page 4 E, per the agreement the signatures of the judge, county commissioners, trustees of both townships; Grafton and Eaton signed that the territory would be annexed and reduced by 100 feet around the perimeter. There is a map of the 2nd to last page of the packet notice on the court order of the 1,805 acres; the map placed in was then 1,715 acres. If there was an argument from the other signed, he would assume that something about being contiguous and the property owners but no matter who owns the territory, the whole perimeter has an agreement because they wanted the income tax off the prisons and agreed and to be reduced 100 feet off that annexation. At the time they were contiguous, 900+ feet, is highlighted on the map, 2nd to last page. This does not mean if there is other annexations, they were contiguous then and that is the part they are referring to contiguous not only the property. If you think about it the other way, day one of this agreement would have been void and why would they have every signed it because if you see the black line around your map they would have been contiguous on day one it was annexed. Trustee Monschein said that small portion is highlighted where there was no buffer zone placed and go into both townships, majority of Eaton Township. He knows what the county commissioners handbook on annexation states shall and no one down in Columbus was planning on a court order being around properties and don’t’ believe this decision was made here because the Commissioners would be in violation of the court order. His understanding and he is not an attorney but if he is in violation of a court order he would be arrested, perhaps. Perhaps is a crime asking for this and asking other elected officials to be part of this court order and this is how he sees it.

Al Schrader, Attorney representing Eaton Township normally tells township if the city owns the property it is in the statue to annex. Unique things with this case and the only reason we are here, is because there is a court order, there is a court case signed by Judge Cirigliano from 1988 a consent judgment order that means all parties accepted and they agreed on the buffer zone. And today, without ever going to the court to the court first to get a modification or argue why it is to be modified, Grafton Village walks in here asking to annex exactly the same land at least to that buffer zone that the court and they have agreed not to annex before and we checked with the clerk of courts and this order has never been appealed, abandoned, revered or otherwise changed, it is still a court order. What is kind of scary, granted it might be a 31 year old court order, it is still a court order. It is not invalid because it is 31, he is 65 he would be long invalid. But he has practiced law for 40 years and the first thing before coming here under 709.14 and 70.16 and asking the commissioners to pretty much automatically approve the annexation, they should have first went to the court to see if the court wants procumbent, not sure if they would. The judgment entry does not say they won’t annex until they decide otherwise and certainly the township would address the needs which they were party to that and signed it. If you look at the signature page it has over a dozen signatures from county commissioners everyone in office at the time, all the Eaton township trustees that were in office at the time, all the Grafton township trustless that were in office at the time, proper representatives from the village of Grafton and some folks from the state of Ohio. Commissioner Kokoski said the Judge did not sign. Attorney Schrader said yes he did, and presented. The difficulty with the courts office and this being around the holiday when he found out about this, 1 is readable with other and the other one not produced well but has the Judge’s signature. Eaton Trustee Monschein said Grafton was around 770 acres at the time and approved and being unreasonably largeAttorney Schrader said the point is he does not think the commissioners have the authority to overrule the court and so what he is asking either deny or hold it in abadance until, and if the Village wants to change they have the right to ask the court to change and they have the right to come in and say no you shouldn’t and then the judge can make a decision. Right now, what they are inviting you to do is ignore a court order and possibly be in contempt of court and while it is not technically a crime, he would not want to take a chance and he is not going to ask that this be done but what he is asking and what would be wise, in his practice of law for 40 years and don’t ever advise anyone to ignore a court order, his advice is if you don’t like it try to modify it but don’t ignore, it is not a good idea. He has a pretty good idea what Judge Cirigliano would do if you tried to violate one of his courts order. He stated he thinks this is all they have.

Trustee Monschein said on the record there is no way to this recommendation that the township would agree. Attorney Schrader said the township would oppose this in court, they not only have the right to get this thing changed if they can before they come here asking to violate a court order.

County Administrator Cordes asked who was providing all the sewer service around that property, LORCO. Trustee Monschein said no it is the Village of Grafton. $400,000 check presented to the Mayor Tom Smith at the time at the ribbon cutting. Mr. Cordes so all that sewer service around prison. Trustee Monschein said there is no sewer there, theoretically out where they are putting solar panels or anything there. Attorney Schrader said as part of the court order covers provision of, Mr. Cordes said he was just looking at the percentage and talks of county sewers. Trustee Monschein said speaking of county sewers and LORCO that is why, when it was signed the buffer zone was established so that they are locked in right there; it is the joint LORCO, County sewer system on south Island Road going west. Mr. Cordes said this is interesting and be careful of what you want to enforce and not enforce in that consent decree. Trustee Monschein said everything else is honored in there. Mr. Cordes said be careful because certainly speaks about a county sewer in that whole area around there in Grafton. Trustee Monschein said it speaks of different agreements and don’t believe, he is sure that the Estates where in question at that time. Commissioner Lundy said no one wants to be in violation of the court order. Mr. Cordes said conversations should be had, Trustee Monschein said maybe we should all get together. Mr. Cordes said you can’t enforce or pick and choose. Trustee Monschein said he would have not brought this up if this did not come up. Attorney Schrader said if there are no other questions he would rest.

Assistant County Prosecutor Innes said the law states the prosecuting attorney represents the Commissioners and not the Village but usually with annexation maters he interprets and tells the statue of the law. He stated Attorney Schrader is correct, there is an outside judgment entry and involves interpretation and have spoken with Attorney Schrader and Eaton Township, Grafton Township and Law Director Holderman, Grafton Village and everyone has a different opinion. So this puts him in an odd situation and struggles with not represent the township, because he represents both townships Eaton and Grafton and trying to look at this objectively and he will ask the commissioners to table for a week so he can seek outside council. He said he is going to do one of two things; favor the township or be too hard on them, so he would like to get some outside view. Assistant Prosecutor Innes asked Attorney Schrader and Law Director Holderman to think about this, while the Commissioners signed the judgment, but they are not named as a party, so what authority does the Board of Commissioners now have to interpret what judgment entry is. Not asking for an answer right now, but this is one of the things he is looking at. Where do, obviously this decision involves interpretation on judgment entry, but where do they get they the authority to interpret what the judgment entry is since they were not a party too. So does this need to go back to the court, should there not be some injunctive act. Attorney Schrader said that is going to be his answer, the fact is the court and the parties and all who signed consented and so he thinks it’s the court has to tell us what it means, other than kind of figuring it out and court needs to make that decision. What he suspect happens although the parties where different it was an annexation back then of the prison property. So the parties where only interested in the township and state who was the petitioner and village of accepted and this where the technically parties and he knows enough about Judge Cirigliano and realized issues what Mr. Cordes mentioned the land, sewer and water and all those other services but all signed and it’s kind of like what Commissioner Lundy said earlier trying to get everyone together. Sometimes we all need to get together to get on board and nothing wrong with the commissioners signing it and don’t think the other parties where a problem to signing it.

Trustee Monschein said the sewer he understands the talk but it is ridiculous outside fees and you understand why there would be no annexation down there because of the buffer zone. Sewers can be spread. Mr. Cordes said he knew nothing about it.

Journal entry cont. annexation May 29, 2019

Assistant County Prosecutor Innes said he spoke with Peter Zwick, Deputy County Engineer and there was some mention of amending this. Mr. Zwick said the county engineer letter was submitted yesterday and the report indicated legal description accurate but recommends not only this annexation but all annexation, he would like to see on petition that in this particular one the petition proposes to annexation to the right of way line of Island Road which causing problem later on and these had to be corrected last year in an annexation on Chestnut Ridge Road. The way to correct is to annex to the centerline instead and then enter into an agreement for the maintenance of the road with the Village. The main reason for the road maintenance agreement is it distributes the responsibility for normal maintenance and future capital improvements. For example, if the Village where to establish an industrial park, they would need access for construction vehicles on the road, entity occupies land might generate industrial truck traffic and diminishes age the road pavement and should not be the county’s responsibly to foot 100% of the road that is benefiting the adjacent development. He said there are other technical things for instance; if you only annex the right of way, side of road, technically the Village could not even control curb cuts, designate road signs, widening, paving, turn lane, etc and Village would be at the mercy of the county and the county could say we are not cooperating because there are no funds. These are the reasons why for this case and others and is completely separate comment and recommendation for annexation.Assistant County Prosecutor Innes said he wanted Engineer to explain this first and did know how the Village feels about that. Mr. Zwick said he knows how they feel. Mr. Innes said make a subsequent annexation, don’t think we can amend; we would have to start over to include this.

Law Director Gretchen Holderman, Village of Grafton and also stated Joe Price, Village Administrator would like to address the Board.Mr. Price said Mr. Zwick mentioned how the Village felt and yes because he was in his office on Friday and expressed all these concerns

along with Mr. Klaiber and yes the Village of Grafton would have no objections.Law Director Holderman said the annexation was in 1988 and there is an injunctive case with consent decree and reduce 100 feet

perimeter and it’s a different annexation from what we are here today for. She stated the consent decree 4E, she notes there is no language perpetuity and no mention in this section of the reduction of the annexation back then would be binding upon successor interest or future owners, contrary to other provisions; such as 4 c & d, the language specially says binding on all parties so there is discretion there. She also submits that it was this board that determines the annexation back then proposed back then was lawful, by agreement of parties that it was reduced and the consent decree dealt with that annexation. She is sure that circumstances are different today in that now, Grafton owns the land, the law changed in ORC 709.16 which enables the Commissioners to grant petitions such as this one, the perimeter of property because the Village owns the property. She is sure that the Village did not envision back in 1988 that they would ever buy this property from the prison, State of Ohio but they have. The fact the parties contemplated perpetuity language for other provisions and those provisions finding upon the township are significant and if the parties wanted to agree that nobody could annex this property again they would have said so and furthermore, the Village of Grafton was not the owner of the property at that time. So the Village of Grafton could have not agreed to annex property since they were not the owner. She would request, and Village is in agreement with the Engineers suggestion and if they have to request again a new petition annexation and personally thought the commissioners would accept grant annexation subject to changing the map, but she agrees with Mr. Innes that it should all be submitted new. She would ask the board to grant request for annexation noting that the full integrity of the consent decree the fact the 100 feet perimeter was agreed by all parties with original annexation and note circumstances are different today and the Village owns the property and lawfully request commissioners grant their request for annexation.

Assistant Prosecutor Innes said the Commissioners have a deadline of 30 days which would be next week to decide.Eaton Trustee Monschein said he understand the budget the county assigns for engineer office and there are different circumstances

throughout the county and understand why Mr. Zwick said that but Chestnut Ridge where we incorporate that established into the city of Elyria. Island road we have people in the 1400 block that they are trying to annex a part of the buffer zone but all of a sudden you come over the tracks to a 35 MPH speed trap because Village now owns the road way, former county road and where he would just put up no truck signs and make them keep their truck down there on an access road off SR83. Also another reason for the buffer zone is that there is a rural water tower in front of the prison nothing changes accept the ownership of the property there is still no different intentions, there is a reason why Eaton agreed, they agreed to block them in with the buffer zone. You are talking about 100 feet of land, 100 feet wide land, 46 acres of property, just annexing the strip, much like last time which was a scam last time he believes they are taking advantage of a code that was set down at the state of Ohio and this is the second annexation for a strip of land just like last time going north to midveiw.Law Direction Holderman said Grafton did not agree to not annex that property. Commissioner Lundy said please direct your comments to the chair there is no debate. She apologized and said that Grafton owns the land. Trustee Monschein said Tom Smith, the attorney, Tom Smith; the Mayor of Grafton would not agree that it would be annexed.

WHEREAS, Ohio counties have experienced a collective $351 million annual revenue loss due to reductions in the Local Government Fund, Medicaid Managed Care sales tax elimination, and tangible personal property tax; and

WHEREAS, Ohio counties are anticipating a $50 million collective sales tax revenue loss by State Fiscal Year 2021 due to the implementation of the prescription eyewear sales tax exemption and the expiration of Ohio’s grandfather clause to the federal Internet Tax Freedom Act of 1998; and

WHEREAS, county budgets have been strained for decades by the state passing down to counties its constitutionally-mandated requirement under the U.S. Supreme Court decision Gideon v. Wainright (1963) that the state provide legal counsel to indigent defendants; and

WHEREAS, the state reimbursement rate to counties for indigent defense costs has only averaged 35 percent from SFY 07 to SFY 16, leaving counties to collectively spend tens of millions in county general revenue funds to fulfill this state mandate; and

WHEREAS, Governor Mike DeWine provided counties an additional $60 million each fiscal year of his introduced state budget to provide counties with much needed budgetary relief of this state mandate; and

WHEREAS, the Ohio House of Representatives provided an additional $35 million in SFY 21 to the state budget bill to reimburse counties for indigent defense costs and alleviate counties of this growing state mandate;

NOW, THEREFORE BE IT RESOLVED, by the Lorain County Board of Commissioners;THAT, this Board applauds and sincerely thanks Governor DeWine for listening to county budgetary concerns and addressing indigent

defense costs with his historic and impactful investment included in his introduced budget; andTHAT, this Board deeply appreciates and sincerely thanks the Ohio House of Representatives for further increasing the indigent defense

appropriation by $35 million in SFY21 which should fully reimburse counties for their indigent defense costs, assuming current conditions; andTHAT, this Board calls upon the Ohio Senate to maintain the House of Representatives’ appropriation for indigent defense

County Administrator Cordes said the parking deck has been an ongoing discussion and continues to deteriorate and will cost millions of dollars. He met with the Engineers last week and we are going to bid this out 2 ways; on an accelerate schedule finish by this November or wait until next Spring to start but still have to move out 340 vehicles and park elsewhere while this is being done. Last time it was done it was worked around vehicles and in order to do correctly the whole garage needs to be emptied. He will also look at shoring up the back end structure Commissioner Lundy said it cost around 25,000 per space. Mr. Cordes said around $25 million but would add additional 200 spaces to get around 700 spaces at that cost is a lot. Commissioner Lundy said usually employees pay for parking and there are county vehicles and children services vehicles located here. He said so are case workers, guardian ad litem ad mobility people. There will be an inconvenience for all and will make many people unhappy, but it needs to be done.

BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby approve the extension of an interagency agreement between the Lorain County Workforce Development Agency (LCWDA) and the Lorain County Port Authority (LCPA) to serve as the employer of record for participants assigned to the work experience element of the Comprehensive Case Management and Employment Program (CCMEP).

FURTHER BE IT RESOLVED, said resolution is to authorize LCWDA to reimburse LCPA for payments made to CCMEP participants for wages paid and all other payroll related expenses, in addition to a five percent (5%) administrative fee in a total amount not to exceed $626,583.60.

Said agreement is considered a part hereof to this resolution by reference thereto and can be found on file in the Commissioners/Purchasing and Workforce Development Agency, effective July 1, 2019 – June 30, 2020.

WHEREAS, the Workforce Innovation & Opportunity Act (WIOA) Policy Letter No. 15-18.1 (Local Workforce Development Area Governance), issued by the Ohio Department of Job & Family Services identifies the requirement to establish a Local Governance Agreement;

WHEREAS, the purpose of the local governance agreement is to delineate the roles and responsibilities between the Chief Elected Official’s, local Workforce Development Board and the fiscal agent;

WHEREAS, the Lorain County Board of Commissioners has been designated as the recipient of WIOA funds for Area 4;

WHEREAS, the Lorain County Workforce Development Board has been appointed be the Lorain County Board of Commissioners to provide guidance and support in the development and implementation of policies and programs designed to accomplish the goals of WIOA;

WHEREAS, the Workforce Institute of Lorain County has been designated by the Lorain County Board of Commissioners to serve as the staff to the Lorain County Workforce Development Board;

WHEREAS, the Lorain County Workforce Development Agency has been designated by the Lorain County Board of Commissioners as the Fiscal Agent to be responsible for disbursement of the WIOA funds in Area 4;

WHEREAS, the Lorain County Workforce Development Agency also serves as the OhioMeansJobs Center Operator, provider of Career Services and provider of Youth services to meet the objectives of WIOA;

NOW THEREFORE BE IT RESOLVED, that this Board of Lorain County Commissioners does hereby approve the Local Governance Agreement that shall commence immediately and continue in force until June 30, 2020. This agreement shall automatically be renewed for two-year periods unless any party gives written notice as outlined in the termination clause of the agreement.

In the matter of amending Res# 18-804, adopted )December 12, 2018 approving contract with D&M ) May 23, 2019Earth Moving, LTD., Wakeman to provide )construction services for the Clinton Ave Ditch )Management Facility )

WHEREAS, Board of Commissioners approved Res. 18-804 awarding a contract in the total amount of $272,342.92 which includes a 10% contingency for unforeseen site conditions to D&M Earth Moving, LTD. Wakeman; and

WHEREAS, in the course of excavating the contractor encountered significant debris, requiring disposal in a construction & demolition debris landfill and other minor site conditions, resulting in a total change order request of $45,199.63; and

WHEREAS, Lorain County Storm Water Management District is requesting to amend its contract with D&M Earth Moving, LTD. to provide construction services for the Clinton Ave Ditch Management Facility in the amount of $45,199.63 which will preserve the contingency if other issues are encountered; and

WHEREAS, D&M performed earthmoving and disposal of construction debris and fence repair and experienced nearly 30 documented rain days; and

WHEREAS, D&M will invoice Lorain County for services provided and those invoices will be paid from storm water account 7100.7118.300.304.11.6200.0000.

NOW THEREFORE BE IT RESOLVED, based upon the above information, the Lorain County Board of Commissioners hereby amends Res#18-804, adopted December 12, 2018 approving contract with D&M Earth Moving, LTD. 12709 State Route 113 Wakeman, OH 44889, to provide consulting services for the Clinton Ave Ditch Management Facility, and extended the term of the contract by 30 calendar days..
