Getting a mortgage today is vastly different than 10, five, three, even one year ago. In anattempt to protect consumers, the government has implemented steps that lenders arerequired to go through. Mortgage backed securities are not desirable commodities dueto the number of foreclosures and short sales. The impact of reps and warranties hastrickled down from investors to the originating lenders, whereby lenders are document-ing files so thoroughly as to ensure no stone has been left unturned.

With all of the challenges mentioned above, there are still a lot of positives.Rates are low! Housing prices are affordable! Banks are lending money! Here are a few

things to help you navigate a successful course in obtaining a mortgage:Have the following documents readily available for your lender: last two years’ tax returns—

complete copy (if self-employed, include business returns & current P&L), last two years’ W-2s, mostrecent year-to-date paystub, last two months’ bank statements—all pages, even if blank. If you area recent graduate—your transcripts, offer and acceptance letter from your employer, and make sureyou are not still on probation! If you have had a divorce, then your divorce decree, property settlementagreement, and (if applicable) child support agreement will be required documents. Most of all, be COM-PLETELY honest with your lender. There are a host of “behind the scenes” search tools that are usedtoday to fully research all borrowers, and your lender will uncover undisclosed items.

Please be patient and understanding. Once you have furnished requested documents, your lend-er will do a thorough review. If there are deposits on your bank statements that are not related to youremployment, you may be required to explain and document these. Inquiries on your credit report notrelated to the lender you are getting your loan through will need to be explained as well. Tax returns canalso generate a host of questions that need to be addressed. The more forthcoming with information youare, the smoother your transaction will be.

And as a daily reminder: focus on the end goal. You are purchasing the place you will call your home!

A: I don’t believe thatwater has to appear in agush to cause this kind ofproblem. Our summersare increasingly warmand humid, and the closetmight just have becomedampandlackedtheprop-er ventilation to dry outcompletely.

Cedar needs to be re-newed periodically to doits primary job, deterringmoths and bugs fromfeasting on fabric.

The experts recom-mend that the cedar besanded using fine-gradesandpaper at the end ofeach season. This will ex-pose a new layer of thewood to the air, and allowthe natural oils in thatfresh layer to evaporateand release their aroma.

Q: I have a 22-year-oldhouse. In thegarage in thepast two years, the dry-wall tape is falling off theceiling.

We keep the garagedoor open about 6 inchesso the cat can go to andfrom.

The walls are sheet-rock andboth thewall andceiling only have primerpaint/sealer on them.

Why is the tape comingoff, will thewall start fall-ing apart, and could thisbe stopped?

A: We had the same is-sue in our master bed-room, which gets mistywhen we take showers,and discovered that thereason for it was that thetaping had not been doneproperly.

I tore off the tape andredid it. No problem.

It appears that thereisn’t an excessive amountof moisture, but when pa-per tape gets damp anddries out a couple oftimes, it tends to comeaway from the joint.

I used fiberglass tapethat sticks to the joint, andthis ended my problem.

The federal fair housing law bars discrimination based on anindividual’s race, color, religion, sex, familial status, nationalorigin, and handicap. Florida law bars discrimination onthe same bases. Although these seven “protected classes”are fairly well known by housing providers, what manypeople don’t realize is that local laws can create additionalcategories of protection.

A county or city can enact its own fair housing law bypassing an ordinance or resolution. Sometimes, when thisis done, the local law mimics what the federal and state lawsrequire. However, many opt to create additional restrictions.

For instance, under the federal and state law, it is okay todiscriminate on the basis of marital status. Not so in MartinCounty! In Martin County, a landlord cannot refuse to rentto an unmarried couple just because they lack a marriagelicense. The same is true of Palm Beach County, PinellasCounty, and the city of Sarasota (to mention just a few).

InBrowardCounty, in addition to the sevenprotected classesof the federal law, it is unlawful to discriminate againsttenants and applicants on the basis of sexual orientation,

age, marital status, and political affiliation. Martin Countyadds ancestry to the list and the city of Sarasota addsveterans.

Sometimes, the difference between legality and illegalityis the city line. A gay couple in Orange County has no fairhousing protection unless they are within the city limits ofOrlando. There, if they are refused housing because of theirsexual orientation, they can contact city government tomake an administrative complaint.

ANSWER: Probably

not. Generally, contractscan be either written orverbal, but the “StatuteofFrauds” is a rule of lawthat requires certaintypes of contracts to be inwriting to prevent injuryfrom fraudulent conductor just the uncertainty ofmemory. For example,contracts related to thetransferofrealestate, forthepurchaseofgoodsval-ued at more than $500,guaranteeing anotherperson’s debt, and con-tracts that can’t be com-pletedinoneyearmustallbe in writing to be valid.

In your case, the lease

contract is for more thanayearandthereforemustbe in writing. Further,most contracts contain aclause that states that theentire agreement is inwriting and that any pre-vious verbal agreementsare not valid.

Sometimes when awritten agreement isvague, verbal commentsmade about the lease canbe used to help the judgeinterpret what wasagreed to, but when thewritten agreement isclear, as in your situation,oral evidence can’t beusedregardingtheagree-

ment. Because youragreement falls into thecategory that must be inwriting and is clear aboutthe 5-percent annual in-crease, it appears you arestuck with what wasagreed to in the contract.

Even if the agreementwas not required to be inwriting, a written agree-ment will hold muchmore weight with thecourt than conflictingmemories of what wassaid years ago.

Still, you may want tospeak with your landlordand see if you can worksomething out. You can

move your mobile home,and the landlord may de-cidethatatenantpayingalittle less is better thananempty lot.

The Board of Supervi-sors onTuesday approvedlegislation allowing con-struction of up to 375 mi-cro units as small as 220-square feet. Buildingcodes previously had re-quired that apartment liv-ing rooms alone be thatsize.

Several city lawmak-ers said they were wor-ried that sanctioningapartments so smallwould exacerbate, ratherthan help, San Francisco’sshortage of affordablehousing by driving uprents for bigger places.

The itsy-bitsy studiosare expected to fetch$1,300 to $1,500 a month.The average studio apart-ment in the city now goesfor more than $2,000 amonth.

The board voted 10-1 toallowthemasa limitedex-periment, ordering cityplanners to come back af-ter 325 of the efficiencyapartments have been ap-proved with a report out-lining what they rentedfor and their impact onconstruction of biggerunits.

Tallahassee Area Ranks High in Housing AffordabilityThe evidence continues to mount that

Tallahassee home shoppers are enjoying a“buyer’smarket.”Actually, it’s a trend beingseen across the country as historically lowmortgage interest rates are helping makehomesmore affordable to median-incomefamilies even as house prices continued toinch up in many metro areas.

According to the National Associationof Home Builders/Wells Fargo HousingOpportunity Index (HOI), 74.1 percent ofall homes sold in this year’s third quarterwere affordable to families earning theU.S. median income of $65,000. This wasup slightly from the 73.8 percent of homessold that were affordable tomedian-incomeearners in the second quarter.

In the Tallahassee area, the median-priced home of $146,000 is affordableto 85 percent of households earning themedian income of $64,300… making thecapital city region the 80thmost affordablehousing market in the nation.

“The latest housing affordability datais good news on two fronts, because itshows that the share of homes affordableto median-income earners has risen evenas home prices have continued to graduallyrecover from their recession lows,” saidNAHBChairman Barry Rutenberg, a homebuilder from Gainesville.

“This is primarily due to the fact thatmortgage rates are now lower than we’veseen them since the HOI was initiatedmorethan a decade ago,” added Rutenberg.

“That said, given today’s overly tight lendingconditions, we know that it remains verydifficult for potential buyers to qualify forand obtain those great rates.”

Nationwide, the median price of all newand existing homes sold in the third quarterwas $189,000, whichwas up from$176,000in last year’s third quarter, according toNAHB Chief Economist David Crowe.

The NAHB/Wel ls Fargo HousingOpportunity Index is a measure of thepercentage of homes sold in a given areathat are affordable to families earning thatarea’s median income during a specificquarter. Prices of new and existinghomes sold are collected from actualcourt records by CoreLogic, a data andanalytics company. Mortgage financingconditions incorporate interest rates onfixed- and adjustable-rate loans reportedby the Federal Housing Finance Agency.

COLUMBUS, GA. –Looking out my officewindow, I can see threebaldcypress trees thatap-pearonfirewithablazeofred.

Ever since I made myfirst trip to the Frio Riverin Garner State Park, Ihave been completelysoldout to thisnative tree.

Along the Frio, they givesense of having beenthere since Texas historybegan.

After more than a doz-en years at the Columbus,Ga., Botanical Garden,they are among the mostpicturesque in the land-scape. Ours are part of agreat conifer display fea-turing the evergreen Jap-anese cryptomeria andthe dawn redwood, which

was once thought extinct,though the cypress is notevergreen.

Down below, close tothe buttressing trunk,there is another dazzlingshow on the forest floor.Lacy fern-like leaves thathave dropped yield a car-pet of red,with themyste-rious cypress kneesemerging all around. Allwho see it try to capture itwith a camera.

The opposite color ofthis fiery red fall color isgreen and the leaves ofadjacent sweet bay mag-nolias prove to be a per-fect foil.

Many of youmay thinkTexas or Florida when itcomes to thebaldcypress,known botanically as Tax-odium distichum. Incred-ibly it has a huge nativerange of 21 states, as farnorth as New York. Don’t

think of it as a swampytrash tree either becauseit isn’t. It is a superiorlandscape tree that willgrowonalmost any soil. Itcommonly reaches 50 to70 feet high and 20 to 30feet wide.

It can grow beautifullyfrom the Gulf Coast toSyracuse, N.Y. The fo-liage is gorgeous, turningfrom green to a fiery or-ange in the fall. The barkis an attractive reddish-brown and is especiallynoteworthy when itreaches a stage of but-tressing. The seeds feedseveral species of birds,including wild ducks.

The cypress knees,which people see in theswamps and fear will de-velop in the landscape,aremuchmoreprominentin the presence of reallymoist conditions.

Bald cypress trees al-most always are sold ge-nerically, but one varietythat is simply incredibleis called Sentinel. Thesetall trees were narroweror more conical in shape.Even in the winter theystood out in the gardenlikemassivepiecesof finestatuary.

NEWPORT NEWS – It’s fall foliage timein the tiny town of Sugarland.

“I love gardening andmy husband, Char-lie, and I like model railroads, so I’ve com-bined the two,” says Patricia, who lives inYorktown, Va.

“All buildings have candy or sugary-likenames, and most reside on Lemon DropLane.”

Patricia’s railroad garden – 200 feet of G-scale track winding through a 40-by-12-footspace – started in 1997, when she first laidthe track on concrete blocks. When moleskept disrupting soil under the blocks, Char-lie rebuilt the track on treated lumber sup-ported with plastic PVC pipe.

More than 50 colorful cookie jars in theshapes of houses and businesses make upmost ofSugarland’sbuildings.Patricia findsthem in antique and thrift stores, and manyare gifts from friends and family.

“I never knew that cookie jars came in somany wonderful shapes and colors,” saysDavid Taylor, a member of the HamptonRoadsHorticultural Society,which recentlyvisited the railroad garden.

“Charlie and Patsy have created a jewelright in their back yard,” he added.

While trains and buildings form Sugar-land’s energy, plants give the town MotherNature’s special ambiance. Such trees suchas pines, sweet gums and crapemyrtles arepruned to staysmall; nandina is anatural be-cause its tall, stalk-like presence naturallylooks like a clump of close-growing trees.CreepingJennyandmossareusedforgreenspaces.

“I covered concrete block with outdoorcarpet to set the cookie jars on and a beauti-fulmoss started growing there – perfect formy lawn in front of the houses,” Patriciasays.

dina, Mexican heather, sedum, dusty millerand pencil trees are used tomake a realisticlook of a miniature town.

As winter nears, Patricia takes the build-ings indoors where she cleans and storesthem. The trains are never left outdoors,

even during warmweather. When the moodstrikesher, she’llbring themout torunwhileshe hasmorning coffee or at night when thetrain lights can illuminate the darkness.

“It’s like an expanded playhouse,” shesays.

“It’s also a tribute to my father, who diedwhenhewas 59 andwas stillworking for therailroad.My father was a pipe fitter, my un-cle an engineer andbothgrandfathersmadetheir bread and butter from the SouthernRailway.

“Forme, it’s displaying life inminiature.”
