Because I’ve coveredthe foreclosure crisis aslong as I have, even aquick read of the latestproposed rules affecting
mortgage servicing high-lights all the abuses bor-rowers have mentionedover the last few years.

abuse that the latest rulesfrom the Consumer Fi-nancial Protection Bu-reau address is “double-tracking,” in which a ser-vicer simultaneouslypur-
sues foreclosure and of-fers alternatives to loss ofthe home.
Fromwhat I have beentold, this is carried out byservicer employeesworking in different de-partments, often separat-
ed by hundreds of miles.They never talk. They
rarely listen. They readfrom printed sheets.They seem incapable ofindependent thought.They never seem to bearound for followup.
They are not as hei-nous as those who urgedborrowers to default ontheir mortgages ratherthan offer advice abouttheir ability to continuemaking full mortgagepayments on time or infull. There is a rule to stopthat, too.
As we learned in themess created by theHomeAffordableModifi-cation Program and theHome Affordable Refi-nance Program, if rulesare made, lenders andservicerswill always finda way to break them.
Even three years afterthe Obama administra-tion launched HAMP, de-signed to reduce the fore-closure rate from recordlevels, mortgage servic-ers were still disqualify-ing qualified applicants.Under the new rules, aservicer must wait 120days after a missed pay-ment before beginningthe foreclosure process.
“This window of op-portunity provides ahealthy amount of timefor struggling homeown-ers to adjust their loanswithout having to worrythat their foreclosure isalready being proc-essed,” says Lot Diaz, oftheNationalCouncil ofLaRaza.
Servicers must reachout to troubled borrowersfrom the get-go, not onDay119. The extendedpe-riod should allow enoughtime for everyone to seewhether an alternative toforeclosure can be found—which should eliminateunnecessary costs, aswell as increase the likeli-hood that borrowers can
stay in their homes.The rules include pro-
tections for those who ap-ply for foreclosure alter-natives after the processhas started. A borrowermust complete an appli-cation for alternative toforeclosure at least 37days before a house is tobe sold.
Servicers will be pre-vented from seekingforeclosure judgments orselling houses until re-views of applications arecomplete.
These are importantprotections, but it wouldhave been better to re-quire that foreclosureproceedings be pausedduring reviews.
A borrower’s ability toappeal will be limitedwhen a request for an al-ternative to foreclosureis denied. Critics say thatwill prevent some bor-rowers from having im-proper denials corrected.They also wonder wheth-er servicers will heed therules.
“We’ve already seenservicers ignore the callsto end dual tracking,”Diaz says. “Strong en-forcement is key.”

The United States Post Office is offering a new online service called Click2Mail.This service offers users the ability to upload or create a document online andmail it online. Users can send the document certified mail without leaving theircomputer. Since the mail is certified, it fulfills the statutory requirement of certifiedmail for notices of claims against security deposits.
Mail date and costs
The mailing date is the next business day for entries before 2pm EST. For those ofus who wait until the last day of the thirty-day notice period, it’s too late to use theonline service. Off we go to the post office. The cost is the postage plus a servicecharge (the “production cost”) with a $2.00 minimum. Until the May 11th postageincrease, the cost for one certified letter was $5.07 ($3.07 postage plus $2.00minimum service charge).
How does it work?
I just couldn’t resist driving it around to see how it worked. I start by creating anaccount. Unlike many online vendors, no payment information is needed at sign-up. This is great. I can go through the entire process, and if I find it doesn’t work forme, I leave behind an unused account without my credit card information.
Build the template and enter the information.
Next I choose a layout or upload my own form. The system will upload Wordand Adobe documents with relative ease. Other file formats can be uploadedby following special instructions. I upload the Notice of Intent to Impose Claimon Security Deposit in Word format. Unfortunately, the USPS online editor is nota word processing program. I have to add text boxes to the Notice to prepareit for entry of the information: tenant name, address, security deposit amount,deductions, etc. That’s a lot of text boxes. Once the form is complete, I save it asa template, and it is available in my account for future use.
Enter the tenant information, deposit and deduction information, etc. Preview theinformation. Enter the recipient’s name and address into the address book, whichsaves them for future use. Since it is unlikely that I will ever need this tenant’s name
and address again for certified mail, saving the name/address in an address bookserves no purpose, but is required to use them for mailing. For volume mailersthere is an upload mailing list and mail merge option.
Check, confirm, charge, return receipts
Check off that I have proofed everything, and the payment screen is next. Selecta return address. The payment address and return address default to the accountaddress. Payment options are prepaid credit account or credit card. Review thecharges and the mail date. Confirm my order, and I’m done. My receipt is saved inmy account, and a hard copy can be printed out. I can track delivery online.
If I desire a return receipt, two types are available: electronic and the standardgreen card for additional postage charges of $1 and $2.20 respectively. Note thata return receipt isn’t required by Florida Statutes for the Notice of Claim.
Help
There’s an online knowledgebase, program specific help menus and phonesupport. The phone help line was a pleasant surprise. I called it twice forassistance, pressed 2 (support), pressed 3 (documents), and real people answeredimmediately. When was the last time that ever happened?
Summary
My review of the service indicates that the lack of a word processing editor makesthe online entry of data difficult. It was quicker to complete the Notice on mycomputer and upload the completed form each time then to complete the savedtemplate online each time. However, I can see that a template saved on the USPSwebsite, which can be accessed anywhere anytime, could be useful in a pinch.The saving of addresses is unnecessary.
This service is targeted toward mass mailers who will upload a brochure or letter,or design a mail-out postcard online, and mail merge their customer list. That’sfood for thought for the marketing people who are tired of lugging mail to the postoffice. For the rest of us, if we don’t have immediate access to a printer, envelopes,certified stickers or postage, sometimes it’s worth $2.00 to finish that Notice andget it mailed. TD

But, hesays, “when done right, acombination of layeredwhites, blue-grays andtouches of metallic canadd a wintry look that’schic, inviting, surprising-ly warm and totally time-less.”

Get reflective
Start with the reflec-tive sheen of ice as yourmain inspiration, saysFlynn. “Use a plethora ofreflective surfaces andmetallic touches,” hesays, including mirroredaccent tables and night-stands, as well as mir-rored lamps.
Flynn and Schunemanboth recommendmetallicwallpaper. “One bedroomI designed in Californiawas completely inspiredby Candice Olsen’s birchbarkwallpaper fromYorkWallcovering,” Flynnsays.
“The paper is madefrom white-toned birchbark, and has a metallic
backing which justscreams ‘winter chic.’”
If you’d prefer paintedwalls, Schuneman sug-gests choosing a shade of
pale gray or icy blue andbuying it in two differentfinishes—onewith a highsheen that almost looksmetallic and the other
matte. Paint the wallswith alternating stripes ofeach finish.
This use of just a fewmetallic or mirroreditems is a great way tobring in some icy glam-our, Schuneman says,“without it becoming theice princess’ dungeon.”
Use range of colors
“The biggest trick todoing a wintry paletteright is to layer, layer, lay-er,” Flynn says. “I like tostickwithanoverallwhitepalette, but bring in ultra-white, off-white, cream,blue-white and then addtouches of blue-gray. Thismakes a space soothingand sophisticated, whileadding depth.”
Burnham’s favoritewintry wall color rightnow is a shade called “Sil-ver Spoon” by Dunn-Ed-wards. “It’s a really, reallypale gray-blue, and I can-not tell you how manyrooms I’ve used it in,” shesays. It contrasts wellwith white for a modernlook or with warm shadesof brown for a more “or-ganic and earthy” feel.
Schuneman loves mix-ing wintry whites, silversand grays accented withshades of purple. Or hesometimes pairs “a graythat has blue as its base,and a blue that has gray inits base” and brings in“hard edges, like crystallamps” for a chic, “wintryfeeling.”

In the early1980s, a To-ronto-based builderplanned a handful of con-dominium projects alongthe South Florida coast,but first wanted the opi-nion of local researcherLewis Goodkin.
On Goodkin’s advice,the company killed thedeals just before amarketmeltdown.
When he suggested toanother builder that a pro-posed project wouldn’twork, Goodkin remem-bers the builder tellinghim he would “make amonkey out ofme.”
The developmentfailed.
“The biggest criticismI ever had—andwhat I’mso proud of — is peoplesaying, ‘He’s so nega-tive,’” Goodkin said. “Thepride factor is that wewere right.”
Goodkin, 77, celebrateshis golden anniversary asa housing analyst thisyear.Apioneer inconsum-er research for homebuil-ders, he remains a go-tosource for banks, WallStreet investment firms,the national media andotherstryingtodeterminewhich way the housingwinds are blowing.
Goodkin advised thecompanies that developedWeston and Coral Springsand hundreds of gatedcommunities in SouthFlorida and across thecountry.
Although much ofsouthwestern BrowardCounty didn’t sprout untilafter Hurricane Andrewin 1992, Goodkin wastrumpeting that area forgrowth as far back as thelate1970s.
“He doesn’t have aPh.D, but hemight as wellhave one,” said ChuckCobb, former head of Bo-ca Raton-based ArvidaCorp.,Weston’sdeveloper.
Goodkin began work-ing full time as a housingresearcher in 1963, theyear Florida passed a lawallowing condos as a form
ofownership.By theearly1970s, condo developmentwas booming, mostlyalong Collins Avenue inMiami Beach and GaltOcean Mile in Fort Lau-derdale.
Thousands of unitswere built on speculation,just as the nation washeading intoarecession in1974. In Miami-DadeCounty alone, there were5,000 unsold units, andbuildings were left par-tially complete.
“It was just a royalmess,” Goodkin recalled.
But it would be just arelative hiccup to thehousing debacle that fol-lowed three decades later.In 2004, two years beforethe bust, Goodkin warnedabout awave of easy lend-ing, speculative buyingand soaring prices thatthreatened to create abubble, particularly inSouth Florida.
The housing marketpeaked in 2005, then col-lapsed, devastating devel-opers, buyersandexistinghomeowners. Goodkinsaid the crash, easily theworst of his career, waspredictable becausebuilders ignored marketfundamentals.
He initially was basedin California, workingwith his brother, Sanford.They offered some of thefirst real estate research,helping West Coast build-ers capitalize on markettrends.Builders inFloridatook notice and were ea-ger to use that analysis toachieve the same level ofsuccess, said Jack Win-ston, Lew Goodkin’s long-time senior associate.
Goodkin met his sec-ond wife, Joie, at a Christ-mas party inBroward andeventually relocated tothe Sunshine State, writ-ingreportsoutofanapart-ment office above aFrench bakery in FortLauderdale. He latermoved Goodkin Consult-ing toMiami.
He said his was one ofthe first research firms torecommend to clientswhat kind of homes to
build and drill down tosuchdetails as floor plans,appliance brands androofingmaterials.
Goodkin told develop-ers what types of golfcourses would be best fortheir markets — fromcourse design to themem-bership structure.
“I always took pride inthe fact that we not onlyunderstood the market,but also how to cater to it
properly,” he said.Deerfield Beach ana-
lyst Jack McCabe saidGoodkin isn’t afraid to beblunt, even if it costs himbusiness.
“He would not pull anypunches to keep the gravytraingoing,”McCabesaid.
Still, Goodkin is knownfor his homespun humorand expressions, oftensaying “you have to countthe mice before you can
build the traps.”“We had clients who
wouldn’t letus leavemeet-ings without Lew tellingus one of his stories,” saidHarry Posin, a Fort Lau-derdale-based builderwho started his career un-der Goodkin in1976.
“Lew is one of themostrespected individuals inthe real estate industry,and one of the best loved,”addedWinston.

ANSWER: Flipping refers tobuying a home at a discountwith the intention of quicklyselling for a profit. During thehousing boom, investorsflipped properties in amatterof days, taking advantage ofthe huge run-up in prices. To-day’s investors aremore likelyto buy and fix up the homesbefore selling a fewmonthslater.
Flipping is a perfectly legiti-mate business – as long as youaren’t lying to a lender aboutyour intentions or otherwisescamming the system.
Despite what those infomer-cials and radio spotsmay leadyou to believe, investing in realestate is risky. If it were aseasy as the gurus say it is, theywould be too busy investing toteach somany seminars.
Be leery of the potentialpitfalls. Selling the propertymay not be as easy as youthink. A prospective buyer’slendermay have requirementsthat the investor (you) own theproperty for a certain period oftime or that the increase in theresale price not exceed a cer-tain ratio.
For these reasons, most flipsinvolve an end buyer payingcash. And cash buyers usuallyare experienced, so you couldbe stuckwith the home for along time if you don’t purchaseit at the right price.
The best way to become asuccessful investor is by learn-ing themarketplace –maybe asa real estate agent, contractoror appraiser. That will give youexperience you need in identi-fying undervalued propertieswith profit potential.
