A BILL TO BE ENTITLEDAN ACT

appropriating money for the support of the Judicial, Executive and Legislative Branches of the Stategovernment, for the construction of State buildings, and for State aid to public junior colleges, for theperiod beginning September 1, 2003 and ending August 31, 2005, authorizing and prescribingconditions, limitations, rules and procedures for allocating and expending the appropriated funds; anddeclaring an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

ARTICLE I

GENERAL GOVERNMENT

Sec. 1. The several sums of money herein specified, or so much thereby as may be necessary, areappropriated out of any funds in the State Treasury not otherwise appropriated, or out of special fundsas indicated, for the support, maintenance, or improvement of the designated agencies of generalgovernment.

The amounts shown below shall be expended only for the purposes shown and are notavailable for expenditure for other purposes. Amounts appropriated above and identified in thisprovision as appropriations either for "Lease Payments to the Master Lease Purchase Program"or for items with an "(MLPP)" notation shall be expended only for the purpose of making lease-purchase payments to the Texas Public Finance Authority pursuant to the provisions of§ 1232.103, Government Code.

2. Transfer Authority. The State Aircraft Pooling Board is hereby authorized to transfer suchamounts as may be necessary between appropriation Strategies A.1.1, Fleet Operations, andB.1.1, Aircraft Maintenance. Appropriations made in Strategy B.1.1, Aircraft Maintenance,include funding for aircraft replacement and aircraft acquisition.

3. Revolving Fund Appropriation. It is the intent of the Legislature that the Comptroller ofPublic Accounts maintain the State Aircraft Pooling Board’s “Revolving Fund” to account forthe expenditures, revenues and balances related to revenues from the sale of aircraft

appropriated to the State Aircraft Pooling Board for the purpose of maintenance, acquisition,repair or replacement. The expenditures, revenues and balances shall be maintained separatelyby the State Aircraft Pooling Board within its accounting system.

4. Limitation of Expenditures for Aircraft Insurance. Included in amounts above, unexpendedbalances consisting solely of appropriated receipts and interagency contracts and not to exceed$80,000, in the appropriation made to the Aircraft Pooling Board remaining as ofAugust 31, 2003, are included in Strategy A.1.1. for the biennium beginning September 1, 2003,for the sole purpose of acquiring aircraft insurance for aircraft owned or leased by the AircraftPooling Board. Any liability insurance to protect the officers and employees of other stateagencies from losses arising from the operation of state-owned aircraft owned or leased by thatstate agency shall be financed by appropriations to those state agencies. Any unexpendedbalances remaining as of August 31, 2004 are hereby appropriated to the agency for the samepurpose in fiscal year 2005.

5. Capital Budget Expenditure. Notwithstanding the limitations on capital budgets contained inRider 1, page I-2 of this Act, for the State Aircraft Pooling Board, the agency may utilize fundsappropriated for capital budget purposes for expenditures on salaries and wages and contractsfor fuel for the first two months of each fiscal year of the biennium beginning September 1,2003. Any expenditure made pursuant to this section shall be repaid by appropriated receiptsand interagency contracts when such funds become available and not later than August 31,2005.
