BUILDER PARTICIPATION CONTRACT
This contract is entered into between __________________________________________
(List name as it appears under HBA membership listing.) (the “builder”), and the Housing &
Building Association of Western Colorado (the “Association” heron out known as HBA),
collectively referred to herein as “the Parties,” whereby the builder may participate in the 2019
HBA of Western Colorado Parade of Homes, organized, sponsored, and governed by the
Association. Any exception to this contract will be voted on and approved by the 2019 HBA of
Western Colorado board of directors.
I. Dates and Times of the 2019 Parade of Homes:
October 4-6; 11-13th Friday/Saturday homes are open from 10:00 AM-6:00 PM
Sunday 10:00 AM – 4:00 PM
*See Exhibit A for Realtor Tour/Judging dates and times and other deadlines.
II. Entry Fees:
All builders in the Parade of Homes MUST be members of the Housing & Building
Association of Western Colorado. (Contact HBA for builder dues amount and other
membership info if you wish to participate in the Parade/Join HBA)
Entry fee is payable in full when contract is submitted to the HBA:
Entry Fee: $2,200.00 for your first home
$1,700.00 each additional home entered
Payment types accepted: Check, Visa, MasterCard, Discover, AMEX
Builders: Your HBA membership must remain current from the date you sign up for the
parade through the last day of the event. Any builder not complying will not be able to
show their home during the event until membership dues are paid in full. Builder will not
be permitted to enter if there are any outstanding dues/fees owed to the HBA.

o You will receive instructions on how to submit items to The Sentinel
o Late fee of $50/day will be charged for any items not submitted by end of
day on August 22, 2019. Failure to supply the information required on pages 8 & 9 of this contract results in the
information NOT being printed in the program. Information must be provided in the type of file
requested.

III. House Sponsors: NEW to 2019: Oct. 3rd Only
1. On Thursday, October 3rd, each home in the Parade will require a house sponsor to
greet Realtors during the tour. See Sponsorship info attached for more information.
2. House Sponsorship is $500/home for HBA Members,
3. Non HBA Members are $1,000 (which includes their membership to the HBA)
4. We encourage each builder to identify your own house sponsor from your preferred
vendors/lenders/etc.
5. Let the HBA know by August 22 if you have found a sponsor for your home.
6. HBA will contact and invoice each home sponsor.
7. Builders having more than one home in the Parade will need a sponsor for each
home.
8. If you are unable to find a sponsor for your home, the HBA will find one for you.
9. House Sponsors are the exclusive host for the house for the Realtor Tour. No
other vendors etc. are allowed to help at the house (only on October 3). Any
builder who allows vendors other than the House Sponsor at the house that
day will be eliminated from all judging including People’s Choice Award.
IV. Refunding of Fees:
NO REFUNDS of entry fees will be given after August 22, 2019. The Builder
will forfeit all monies paid to the HBA.
V. Association Obligations
1. The Association will provide multi-media advertising, builder signs, and
exposure on Parade website.
2. The Association will coordinate ALL marketing and promotion for the
Parade to ensure a successful event.
3. The Association owns all rights to advertising in house and on property
during the entire course of the Parade.
4. HBA will have one MANDATORY informational meeting for all Parade
Builders/House Managers.
o Meeting will be on Thursday, September 26 at 10:00 AM
VI. Builder Obligations
1. Agrees to meet all Deadlines as described in exhibit A
2. Parade home must be constructed by the Builder Member (defined by
name on permit),
3. Responsible for providing a site located in a properly approved
subdivision within a county in the HBA jurisdiction.
4. All improvements to the lot will be furnished by the Builder.
5. Agrees home will comply with all zoning and building codes and
regulations in effect for the area in which the Parade home is built. The
builder also agrees the home will be built in a professional manner which
reflects the standards of the Association.

6. All Subcontractors providing materials and/or labor on the Parade home
will possess a valid license as required for the area.
7. INSURANCE: Prior to the beginning of the Parade through the end, the
builder agrees to maintain in full force and effect worker’s compensation
insurance, and public liability insurance in coverage amounts of at least
$250,00 per each occurrence and $500,000 general aggregate.
8. The Builder agrees and acknowledges that he/she is responsible and liable
to the Association for any violation of the terms of this contract committed
by the Builder’s employees, subcontractors, suppliers, and others
performing services/materials to the Parade home. Violation of any of
these terms shall be deemed a violation of the Builder.
9. Builder is responsible for the security of the Parade Home and for the
protection of every person on the home site prior to the conclusion of the
Parade.
a. Builder Hereby agrees to indemnify, defend (with legal
counsel approved by the Association) and hold harmless
the Association, its officers, partners, designers,
predecessors, successors, assigns, agents, representatives,
employees, attorneys, and each of them from and against
any and all claims, demands, causes of action, liabilities,
judgments, settlements, losses, costs, inspection, re-
inspections, damages and/or expenses in law or equity,
contract or tort or otherwise, (including without limitation,
attorneys’ fees an any and all other costs and expenses) of
every kind or nature whatsoever that in any way arise out
of or relate to the Builder’s participation in the Parade of
Homes, the Parade Home, or the real property on which it
is located.
10. WIFI Requirement
a. Builder is responsible for having WIFI at their Parade
Home(s) all the days of the Parade event.
b. WIFI is required for our ticketing app and credit card ticket
sales
c. Contact HBA prior to September 1st is this is an issue
for your parade home.
VII. Home Completion Definition & Deadlines
1. Home must be completed on or before Wednesday, October 2, 2019 by
12:00 NOON as per all terms in this contract. The home will be inspected
on Wednesday, October 2 by the Executive Officer of the HBA and or
by persons selected by the HBA board of directors. If the home is not
compliant the builder will be fined $250.00 and will be disqualified from
all judging, including the People’s Choice Award. Builder will have until
7:00 am on Thursday, October 3 to complete. If during this inspection the
home is still in violation it will be posted as “Closed” for the Realtor Tour

and the Parade of Homes until it is completed and re-inspected. No
refunds of entry fees due to closure for non-completion.
2. Certificate of Occupancy must be pulled within 6 months of the date of
the Parade (no earlier than March 2019). This document MUST be
submitted to the HBA by the deadline stated within this contract or home
will not be open to the public during the event.
3. Remodels will be allowed into the Parade on a case by case basis and
must be approved by the HBA of Western Colorado’s Executive
Committee and Board of Directors.
4. Homes must be site built. No modular homes will be allowed in the
Parade.
5. Judging:
o Judging is divided into different price points (TBD by the HBA
board of directors once all contracts are received by the HBA)
o Will take place on Thursday, October 3. HBA will provide
judges with transportation and lunch.
o Categories: Best Master Suite, Kitchen, Landscaping,
Layout/Design, Technology, Interior Décor, Craftsmanship. HBA
Executive Committee will also award the builder who used the
most HBA members as subcontractors with an award.
o People Choice Award is voted on by the public during the Parade.
6. Realtor Tour – Thursday, October 3. Homes will be open from 8:00-
3:00 pm. *Please see Item III for information about House Sponsors and
who can be at your home on Thursday, October 3rd.
VIII. Occupancy Restrictions
1. The Parade home must be unoccupied during the Parade of Homes event.
2. If the home is sold prior to the Parade, the owner must acknowledge their
consent to the terms of this contract by signing Exhibit B. This document
MUST be delivered to the HBA on or before August 22.
° The owners may live in the home up until Wednesday,
October 3 at 12:00 NOON. After that time, the Parade home
must be vacated and presented in an unoccupied state.
Occupants must locate to another domicile for the duration of
the Parade. All closets, kitchen/bathroom cabinets,
countertops, etc. must be cleared of all personal belongings and
no room shall be locked/closed off to the public.
3. If the owners wish to not have their home shown during the Parade, or if
they don’t comply with the terms in this agreement, the home will be
closed to public viewing, and the builder shall be required to withdraw
from the Parade and forfeit the entry fee.

IX. Interior Decorating & Landscaping
1. All homes must have a minimum of three primary rooms decorated (i.e.
living room, dining area, and master bedroom.)
2. The degree of decorating these rooms is at the discretion of the builder.
3. All arrangements and contracts between interior designers and builders
will remain the responsibility of the builder.
4. Full landscaping must be completed in front of the home, defined as what
can be viewed from the street. (Front yard, and possibly the side yard.)
5. All event marketing has set the expectation of the customer to feel they are
entering a finished home with staging and furnishings.
6. Garages: Builders, invite your subcontractors to display their products
and services inside your parade home’s garage. Real Estate agents may
NOT display their other properties for sale. Only properties of the builder
whose home is entered in the parade may be displayed!
o To honor our title sponsor, no vehicles other than those provided
by the dealership Grand Junction Subaru/Volkswagen will be
allowed to be parked in the driveways or garages during the Parade
of Homes.
o Builder will allow for Grand Junction Subaru/Volkswagen to park
a new vehicle of title sponsors choice in the driveway during the
Parade.
X. Signage Policy
1. Homes will be free of interior and exterior signage except where approved
by the Association. No sign in violation of the Association’s signage
specifications will be allowed in the Parade home.
2. Interior signage: You may purchase business card holders for your
subcontractors. These will allow your subcontractors to distribute their
business cards in a uniform and attractive manner at each Parade home.
a. The builder is encouraged to place interior signs close to products
used in the Parade Home.
b. Garages may be used at the builder’s discretion. Builder may use
the garage for displays to showcase their subcontractors, etc. No
vehicles will be allowed in driveways or garages during the Parade
hours except as approved in advance by the association
3. Exterior signage: limited to ONE sign for each of the businesses. (I.e.
builder, landscaper, realtor, decorator.)
a. October 3rd: The House Sponsor will be allowed one exterior sign
during the Realtor Tour. (Thursday Only).
4. A business MUST have product in the Parade home to place their signs in
or outside of the home.
5. The builder may limit the number of signs or exclude any sign he feels
inappropriate for his home.
6. Parade Builders will be allowed to distribute brochures for other projects
and specs in the home. The builder brochure will contain no advertising

(paid for or otherwise) other than the builder or marketing agent as it
pertains to home or subject property.
7. Directional signs: The builder understands that all directional signs are
the responsibility of the builder once checked out and until checked back
in with the Association. Any damaged signs should be immediately
reported to the Association office and the builder will be charged for the
damaged/missing signs at the rate of $75.00/sign.
8. This signage policy will be enforced during the Parade by the Association
and the Builder.
XI. Admission Policy
The Parade of Homes is a major fundraiser for the HBA of Western Colorado, a
not-for profit organization. Builders MUST adhere to this policy!
1. The Association will charge admission fees for public entry to the homes
featured in the Parade of Homes. The Association has the sole right to the
proceeds of the ticket sales.
2. Tickets allow for attendee to visit each home one (1) time. They will be
allowed to have a single re-entry into ONE home of their choice. This
prevents ticket sharing.
3. Tickets are $15 each. Children 3 and under are free and MUST be
supervised by their parent or guardian at all times.
4. All attendees require a ticket to enter the parade home.
5. Builder agrees to prevent persons not holding valid tickets from entering
the home.
6. The builder agrees that during the Parade, no person will be admitted
between the hours of 6:30 pm and 9:30 am. Builder may have parties
associated with parade at the discretion of the Association (i.e.
Subcontractor Appreciation/Celebration, etc. Parties will not interfere
with any Association sponsored event, such as the Realtor Tour.)
7. Builder may permit access to only a few individuals (real estate agent,
homeowner, potential home buyer, family member, or those performing
repairs or maintenance) to privately view the home.
8. During Parade hours, anyone entering the home must have a ticket.
9. Builders and hosts should prepare contingencies to address disabled
visitors needs where necessary. However, no physical changes to the
structure of the home or outside entrance are demanded by the
Association.
10. Anyone holding a valid ticket will be permitted into all Parade homes
regardless of physical disability. You should designate
handicapped/senior parking areas in front of home (cones, signage, etc.)
11. It is at the Builder’s discretion to request visitors to Parade home to wear
booties before entering the home. If Builder chooses this option, he/she
agrees they will be responsible for purchasing any booties or floor
protection. Booties can be purchased locally at most medical shops. Extra
Large size works best.

12. People’s Choice Award: Each builder will have one locked ballot box. It
is ok to remind people to vote for one home in each category. Do not
advise them what homes to vote for. Remind them to not vote until they
visit their last house, as builders do not have keys to retrieve tickets once
inserted into the ballot box.
XII. Parade Home Hosting Policy
1. Parade Builder is responsible for locating volunteers to host your parade
home and that the home is open on time.
2. Hosts must remain at the front door of your home during the hours
set by the Association for the Parade. The home must be open to the
public at all times during these hours each day, as specified.
3. Hosts should be reminded that their actions will reflect on the Parade of
Homes, the Builder, and the Association.
4. Hosts will be asked to wear an HBA Parade of Homes Host lanyard while
on duty. These will help separate them from the public and will help in
identifying the Parade of Homes hosts if someone has questions.
a. Lanyards will remain at the designated Parade of Homes house and
will only be used for the hosts during their shift(s).
b. Lanyards are not tickets to go see the other homes in the Parade.
5. Hosts and Builders are responsible for checking tickets, scanning tickets,
and selling tickets to persons needing to purchase them. Each Parade
home will be given a packet from the Association containing $50.00
change, 50 tickets, and host lanyards. All of these items need to be
returned to the Association following the last day of the Parade. Any
money or items not be returned are the responsibility of the Host and
Builder. Builders are strongly encouraged to use hosts who are of an age
able to be respectful but firm in enforcing ticket and admittance policies.
Inconsistency in requiring tickets to enter Parade homes subjects the
Association to liability issues and may result in the Builder being
penalized.
a. Builders can purchase discount tickets through the HBA office
at $7.50 (Limit of 10 tickets per home entered in Parade).
These can ONLY be purchased at the HBA office, NOT
through your house tickets.
b. Tickets are $15.00 each – No discounts for seniors or children.
6. Realtors or brokers if used as hosts may not hand out flyers or promote
any projects or real estate that the Builder is not directly involved with,
including developments, subdivisions, MLS listings, etc. They may only
promote the Builder and his work.
7. Realtor Day tickets are good only on the days of the Realtor Tour
(Oct. 3rd & 4th) unless otherwise noted by the Association.
8. All traffic will be required to enter at the front door and exit through the
garage to maintain ticket control.

XIII. Advertising:
1. Following the opening of the Parade, a Parade Builder may use the Parade
of Homes reference in conjunction with the Parade home, for advertising
purposes only.
2. Listing in MLS is permitted, however no mention of participation the
Parade of homes in MLS or other listings is permitted prior to opening
day.
3. Newspaper, radio, TV, flyers, and other advertising is allowed, however
no mention of the Parade of Homes, identifying street name or address is
permitted prior to opening day in any media or public source except as
authorized by the HBA. It is important for the Builder to inform all
parties associated with the home (realtors, homeowner, etc.) of these rules,
as the Builder is responsible for any inadvertent or intentional action.
4. The HBA of Western Colorado is under contract with our event
advertisers (The Grand Junction Daily Sentinel, KREX-TV/Fox 4, and
MBC Grand Broadcasting (The Vault, Moose, Magic, KSTR, The Team,
The Planet, the Monkey, and KNZZ). Our partners usually offer
discounted deals on advertising to our Parade builders, in addition to what
the HBA provides (such as live remotes from your Parade home, ads in the
official program, etc.) Please contact Traci at the HBA for contact
information.
XV. Open Houses
1. No open houses from September 1st through the end of the Parade.

It is up to the builder whether they choose to participate. If a builder is unable to attend the tour but wishes for their home to be open, please make arrangements with the HBA prior to the tour.

Event takes place from 5-8 pm. Awards ceremony begins at 6:00

Monday, October 14: Signs, reconciled tickets/money, stamps, tablets, cords and all other HBA property is to be returned to HBA. Builder is responsible for any missing or damaged items.

If during this inspection the home is still in violation it will be posted as “Closed” for the Realtor Tour and the Parade of Homes until it is completed and re-inspected. of an original design and he/she is the sole owner of such design and has exclusive rights,
including copyright, in and to the design as represented in the structure, plans,

pledged, assigned or encumbered his/her rights to the design and that such design does
not violate any copyright, property or common law rights of others. Builder hereby
indemnifies and holds harmless the Association from any and all claims of third parties,
including, but not limited to, copyright infringement or conversion, which may be
asserted as a result of the inclusion of the house in the Parade of Homes or the inclusion
