    This months Officer Safety Item is a spring-assistedtitanium screwdriver. While it appears to be a penwhen carried in a pocket, it has a button thatreleases and locks the shaft in place. Whenengaged, this item could quickly become adangerous stabbing weapon.

    The overall length is 6-inches with a 3.312-inch

    shaft. Law Enforcement and Security Professionalsshould be mindful of concealed weapons such asthese. We are entering the season where bulkyclothing will likely be worn by suspects. Alwaysmaintain positive control of a suspects hands duringa search or security inspection.

    Airport and transportation security screeners shouldalso be mindful of items that appear to be pens orother common items.

    TSA completed a strategic plan to guide research, development, anddeployment of passenger checkpoint screening technologies;

    however, the plan is not risk-based. According to TSA officials, thestrategic plan and its underlying strategy for the Passenger ScreeningProgram were developed using risk information, such as threatinformation. However, the strategic plan and its underlying strategy donot reflect some of the key risk management principles set forth inDHSs National Infrastructure Protection Plan (NIPP), such asconducting a risk assessment based on the three elements of riskthreat, vulnerability, and consequenceand developing a cost-benefitanalysis and performance measures.

    TSA officials stated that, as of September 2009, a draft risk assessment for all of commercial aviation, theAviation Domain Risk Assessment, was being reviewed internally. However, completion of this risk assessmenthas been repeatedly delayed, and TSA could not identify the extent to which it will address all three elements of

    risk. TSA officials also stated that they expect to develop a cost-benefit analysis and establish performancemeasures, but officials could not provide timeframes for their completion. Without adhering to all key riskmanagement principles as required in the NIPP, TSA lacks assurance that its investments in screeningtechnologies address the highest priority security needs at airport passenger checkpoints.

    Since TSAs creation, 10 passenger screening technologies have been in various phases of research,development, test and evaluation, procurement, and deployment, but TSA has not deployed any of thesetechnologies to airports nationwide. The ETP, the first new technology deployment initiated by TSA, was haltedin June 2006 because of performance problems and high installation costs. Deployment has been initiated forfour technologiesthe ETP in January 2006, and the advanced technology systems, a cast and prosthesisscanner, and a bottled liquids scanner in 2008. TSAs acquisition guidance and leading commercial firmsrecommend testing the operational effectiveness and suitability of technologies or products prior to deployingthem. However, in the case of the ETP, although TSA tested earlier models, the models ultimately chosen werenot operationally tested before they were deployed to ensure they demonstrated effective performance in an

    operational environment. Without operationally testing technologies prior to deployment, TSA does not havereasonable assurance that technologies will perform as intended.

    DHS coordinated with stakeholders to research, develop, and deploy checkpoint screening technologies, butcoordination challenges remain. Through several mechanisms, DHS is taking steps to strengthen coordinationwithin the department and with airport operators and technology vendors.

    Theres a new iPhone application on the market that allows a person to enter any othernumber they wish and have it display as their Caller ID. In addition, this allows aperson to record phone calls or disguise their voice.

    There are plenty of potential issues for law enforcement with this device. In fact themarketing company admits that. Yet, they place the responsibility on the person using it.

    Each of the capabilities of SpoofCard is legal in the US. However, certain uses may beillegal depending on which state you are calling from or to. For example, a handful ofstates have passed laws that make it illegal to spoof caller ID for certain purposes, suchas "to mislead, defraud or deceive the recipient of a telephone call." Before using the

    spoofing capability of SpoofCard, you should determine whether the use you willmake of the service is legal in the state where you are calling from and the statewhere the party you are calling is located.

    While the phone application is free. The company makes their money by sellingminutes. Since this device is available via iTunes.com, Law Enforcement may need toinclude a look at Phone applications and iTunes transfers when investigating casesassociated with phone calls in the future.

    FOR IMMEDIATE RELEASE

    A Maryland scientist who once worked in varying capacities for the Department of Energy, the Department of Defense andthe National Aeronautics and Space Administration has been arrested for attempted espionage, David Kris, AssistanAttorney General for National Security, Channing D. Phillips, Acting U.S. Attorney for the District of Columbia, and JosephPersichini, Jr., Assistant Director for the FBIs Washington Field Office, announced today.

    A criminal complaint unsealed today in the District of Columbia charges Stewart David Nozette, 52, of Chevy ChaseMaryland, with attempted espionage for knowingly and willfully attempting to communicate, deliver, and transmit classifiedinformation relating to the national defense of the United States to an individual that Nozette believed to be an Israelintelligence officer. The complaint does not allege that the government of Israel or anyone acting on its behalf committedany offense under U.S. laws in this case.

    Nozette was arrested earlier today by FBI agents and is expected to make his initial appearance tomorrow in U.S. DistricCourt for the District of Columbia. If convicted, he faces a maximum sentence of life in prison. "The conduct alleged in this

    complaint is serious and should serve as a warning to anyone who would consider compromising our nations secrets foprofit," said David Kris, Assistant Attorney General for National Security.

    "Those who would put our nations defense secrets up for sale can expect to be vigorously prosecuted," said Channing DPhillips, Acting U.S. Attorney for the District of Columbia. "This case reflects our firm resolve to hold accountable anyindividual who betrays the public trust by compromising our national security for his or her own personal gain."

    "The FBI is committed to protecting the nations classified information and pursuing those who attempt to profit from itsrelease or sale," said Joseph Persichini, Jr., Assistant Director for the FBIs Washington Field Office.

    According to an affidavit in support of the criminal complaint, Nozette received a Ph.D. in Planetary Sciences from MIT in1983, and worked at the White House on the National Space Council, Executive Office of the President, in 1989 and1990. He developed the Clementine bi-static radar experiment that purportedly discovered water on the south pole of themoon. Nozette also worked at the Department of Energy's Lawrence Livermore National Laboratory from approximately1990 to 1999 where he designed highly advanced technology. At the Department of Energy, Nozette held a specialsecurity clearance equivalent to the Defense Department Top Secret and Critical Nuclear Weapon Design Informationclearances. Department of Energy clearances apply to access to information specifically relating to atomic or nuclearrelated materials.

    Nozette was also the President, Treasurer and Director of the Alliance for Competitive Technology (ACT), a non-proficorporation that he organized in March 1990. Between January 2000 and February 2006, Nozette, through his companyACT, entered into several agreements to develop advanced technology for the U.S. government. Nozette performed someof this research and development at the U.S. Naval Research Laboratory in Washington, D.C., the Defense AdvancedResearch Projects Agency in Arlington, Virginia, and the National Aeronautics and Space Administration Goddard SpaceFlight Center in Greenbelt, Maryland. From 1989 through 2006, Nozette held security clearances as high as Top Secreand had regular, frequent access to classified information and documents related to the U.S. national defense.

    According to the affidavit, on Sept. 3, 2009, Nozette was contacted via telephone by an individual purporting to be anIsraeli intelligence officer, but who was in fact an undercover employee of the FBI (UCE). During that call, Nozette agreedto meet with the UCE later that day at a hotel in Washington D.C. According to the affidavit, Nozette met with the UCE thaday and discussed his willingness to work for Israeli intelligence.

    Nozette allegedly informed the UCE that he had, in the past, held top security clearances and had access to U.S. satelliteinformation. Nozette also allegedly said that he would be willing to answer questions about this information in exchangefor money. The UCE explained to Nozette that the Israeli intelligence agency, or "Mossad," would arrange for acommunication system so that Nozette could pass information to the Mossad in a post office box. Nozette agreed toprovide regular, continuing information to the UCE and asked for an Israeli passport

    According to the affidavit, Nozette and the UCE met again on Sept. 4, 2009, in the same hotel. During the meetingNozette allegedly informed the UCE that, although he no longer had legal access to any classified information at a U.S.government facility, he could, nonetheless, recall the classified information to which he had been granted access,indicating that it was all still in his head. In the meeting, Nozette allegedly asked when he could expect to receive his firspayment, specifying that he preferred to receive cash amounts "under ten thousand" so he didnt have to report it. At theconclusion of this meeting, Nozette allegedly informed the UCE, "Well I should tell you my first need is that they shouldfigure out how to pay me . . . they don't expect me to do this for free."

    On or about Sept. 10, 2009, undercover FBI agents left a letter in the designated post office box for Nozette. In the letter

    the FBI asked Nozette to answer a list of questions concerning U.S. satellite information. The undercover agents alsoprovided a $2,000 cash payment for Nozette. The serial numbers of the bills were recorded. Nozette retrieved thequestions and the money from the post office the same day.

    On or about Sept. 16, 2009, Nozette was captured on videotape leaving a manila envelope in the designated post officebox in the District of Columbia. The next day, FBI agents retrieved the sealed manila envelope that Nozette had droppedoff and found, among other things, a one-page document containing answers to the questions posed by the undercoveagents and an encrypted computer thumb drive. One of answers provided by Nozette contained information classified asSecret, which concerned capabilities of a prototype overhead collection system. In addition, Nozette allegedly offered toreveal additional classified information that directly concerned nuclear weaponry, military spacecraft or satellites, andother major weapons systems.

    Also on or about Sept. 17, 2009, undercover FBI agents left a second letter in the post office box for Nozette. In the letter

    the FBI asked Nozette to answer another list of questions concerning U.S. satellite information. The FBI also left a cashpayment of $9,000 in the post office box. Nozette allegedly retrieved the questions and the money from the post office boxlater that same day.

    On or about October 1, 2009, Nozette was filmed on videotape leaving a manila envelope in the post office box. Later thaday, FBI agents retrieved the manila envelope left by Nozette and found a second set of answers from him. The answerscontained information classified as both Top Secret and Secret that concerned U.S. satellites, early warning systems,means of defense or retaliation against large-scale attack, communications intelligence information, and major elementsof defense strategy.

    This investigation was conducted by the FBIs Washington Field Office with assistance from the Naval CriminaInvestigative Service and the Air Force Office of Special Investigations.

    The prosecution is being handled by Trial Attorneys Deborah A. Curtis and Heather M. Schmidt, from the

    Counterespionage Section of the Justice Departments National Security Division, and Assistant U.S. Attorney AnthonyAsuncion, from the U.S. Attorneys Office for the District of Columbia.

    The public is reminded that a criminal complaint contains mere allegations and that every defendant is presumed innocentunless and until proven guilty.

    As a nation, we have adversaries outside our borders on constant watch for opportunities. When we have those that havesworn to protect and defend this country working to dismantle our nation from the inside because of selfish greed, thats aserious problem. Their actions are aimed at every citizen, from the child to the elderly. It is not just the military and lawenforcement that swear an oath. For those that have received a security clearance, they too are required to swear theiallegiance to our nation. When that oath is broken, nothing the individual says or does can ever be trusted again.

    There may be times when we become aware of questionable issues pertaining to national security. It is vital that theseissues are reported. Even if it turns out to be nothing, its best to have those empowered to investigate make thadecision. Great work on the part of those bringing the case to this point.

    On October 29, 2009, a US Coast Guard C-130 aircraft and a US MarineCorps AH-1 Helicopter suffered a mid-air collision off the coast of SanClemente Island. The C-130 had a crew of seven; the AH-1 Super Cobra

    Helicopter, a crew of two.

    The Coast Guard aircraft homebased out of Sacramento, CA departed on asearch and rescue patrol after a 12-foot skiff was reported missing from AvalonBay, near Catalina Island.

    The USMC aircraft from Camp Pendelton near San Diego was flying information with another AH-1 and two CH-53E Super Stallion Helicopters. After the collision, the USMC helicoptersdeparted the scene and returned to San Diego.

    While the investigation will certainly look at all details of this tragic incident, one thing that will need an aswers is, Why didthe three remaining USMC helicopters depart the scene? Instead of having vessels conduct long searches of the areawhy didnt at least one of the helicopters stay on scene looking for survivors. If all the aircraft absolutely had to depart thescene for fuel reasons, even though only 25-miles offshore, did one of the aircraft drop a flare, a data-marker buoy or atleast record the geocoordinates of the incident?

    After speaking with USCG Public Affairs personnel about this issue, they couldnt explain the actions of the remainingUSMC aircraft. They recommended speaking with someone from the Marine Corps. After numerous attempts to get anunderstanding of this incident, no one would answer any of the questions posed above. At the time of this writing, there isnothing posted on the USMC.mil website mentioning the loss of two personnel or aircraft. My final question to the PublicAffairs person addressed this issue. The answer I received was, I work for the US Marine Corps Airstation and cananswer that.

    Im not pointing fingers...just asking natural questions.

    All crewmembers from both aircraft are presumed dead after multiple searches. No survivors or bodies were found.

GERMANY.Assassination of HerrhausenTerrorists of the Red Army Faction (RAF) assassinated Alfred Herrhausen, the head of Deutche Bank AG, and the most influentialbusinessman in Germany, on November 30, 1989 in a Frankfurt suburb as Herrhausen was being driven to work. A verysophisticated light-activated bomb was detonated as Herrhausen's car drove by. The killing shook Germany.
