CHHA Board and Committee Meeting Times Newsletter suggestions and ideas, articles and pictures of your event are encouraged. Advertising ques-tions and other information may be directed to the Editor, at P.O. Box 710238, Oak Hill, VA, 20171.

T h e C o m m u n i t y Activities Committee meets as events are scheduled, and chairpersons vary throughout the year. If you are interested in leading an event or have ideas for commu-nity activities, please contact any current Board member.

T h e C o m m u n i t y Facilities Committee meets the first Wednesday of each month at 7:30 PM at the CHHA Community Center. Issues pertain-

ing to our swimming pool, tennis courts, the playground, Community Center and its grounds are managed by the Community Facilities Com-mittee. If you would like to become involved in this committee, contact Jeff Boehlert at 703-435-2836. The next meeting for Community Facili-ties is Mar 2nd.

The Land Management Committee handles all issues that involve the common areas of our community… mainly, lawn care and snow removal. Meetings are held as required. You may contact Wendy Osborn at 703-834-7978 with concerns or if you are interested in helping on the Land Management Committee.

The Board of Directors meets during the year on the first Thursday of each month at 7:30 PM at the Community Center. Meetings are open, and all residents are welcome. Please contact the Board President prior to the meeting for an issue to be placed on the agenda. The next Board meeting is Mar 4th at 7:30 P.M.

The Architectural Control Committee (ACC) meets each month at the Community Center. Contact any ACC member or appropriate Board member as listed on page 2 if you have ACC questions or concerns.

The Chantilly Highlander newsletter team welcomes articles and pictures of interest to the community.

Whether you run, walk or roll, all are welcome to participate. Last year we had close to 30 people partici-pate and we all had a great time. This year’s 5K will be held on Saturday, May 22nd. Start time is at 8AM. No registration is required. Like last year, this is an informal event. This means that you will need to bring your own water and watch. We will mark the course and take the pictures.

We have been thinking about making this event bigger. Some have suggested that it may be a great way to raise awareness for a cause like treatments for autism, or elementary education enrichment programs. The Board is supportive of this and is willing to help in any number of ways, but we need a team to take on the organization. Let Dan Feer ([email protected] or 571-203-9558) know if you want to be on this team.

Come on out on the 22nd of May for a bit of exercise, maybe meet a running partner or make some new friends.

Chris Tacinelli , and Jerry Thatcher Home Owner Attendees: Four resi-dents. The meeting was called to order at 7:30 p.m. by Dan Feer. Election of Officers: The first item of business was the Election of Officers. Dan Feer asked if anyone was inter-ested in an officer position. Jim Ceh volunteered to be Treasurer, Will Gregory stepped up to Vice President, Mary Kerr volunteered as Secretary and Dan Feer stated he was willing to continue as President. With no other directors stepping forward a vote was taken and counted with a unanimous vote to accept the individuals who vol-unteered for such said position. Meeting Minutes: The Minutes of the January meeting were not available, but will be approved at the March meeting. Treasurer’s Report: The annual homeowners’ dues notice was re-viewed by the board and will be mailed next week. Dues are $205 per home and are due no later than March 31, 2004. Community Facilities: Jeff Boehlert volunteered to continue as Community Facilities Board Liaison. A contract has been signed to repair the pool fence. Awaiting call from Contractor with start date.

Crystal Aquatics contract expires March 31, 2004. Splash Aquatics will be the pool service this season. Before the pool season begins, the pool house will be re-keyed. The board of directors will be cleaning out the club house attic and office in the near future. A suggestion was to store only HOA equipment/supplies at the club house. Bids are being received to fill in the cracks on the tennis courts and to seal and re-stripe the parking lot. Funds for these repairs are covered in this year’s budget. Resurfacing of the parking lot is planned for 2007. A concern by a homeowner was raised about the delay in receiving return phone calls made to the HOA. The board will be looking at its procedures. Land Management: Wendy Osborn is continuing as the board liaison for this committee. Two tetherball poles were abandoned on common ground off of Lady Bank Lane and removed this week. There are concerns about the gas line grassy area between Mother Well and Glen Taylor is turning into mud due to children playing in the area. This is common ground and is the responsibil-ity of the HOA. The board is aware that this is an area where many of the neighborhood children play. So as to not prohibit from playing in a safe en-vironment, Land Management will be looking into seeding the area. Con-cerns are that the children do not play in the area while the seeding is laid. Suggestions were made to seed part of the area in the Spring and rope off,

allowing the children to play in the other section when in the Fall, that area would be seeded. Bridget Rivas of Rivas Design is providing a landscape design for both of the Centerville entrances and the Stone Heather entrance. Bids for planting will be accepted once the design is approved. Entrance lights were also a topic of discussion. One is not working due to being hit by a fallen tree in the hurricane. Jeff Boehlert will handle the repair of this light. Community Events: This position is in need of a board liaison. This position is responsible for oversee-ing the community events through-out the year, keeping them within their budget, and recruiting chair-persons. Events include the Spring Egg Hunt, 5K Run, Golf Tourna-ment, Community Day, Halloween Festival and the Holiday Party. The thought is that if volunteers do not step forward to help organize these events, then the events will not take place. A few individuals and organizations have stepped forward to help with a few of the events. Jerry Thatcher is consider-ing being the board liaison and will confirm by the March board meet-ing. Long Range Planning/Neighborhood Watch: Will Greg-ory volunteered to continue to be the board liaison for this commit-tee. The Long Range Planning Com-mittee’s goal is prepare for repairs and future expenses so that the

The Oak Hill Elementary School PTA has a Book Exchange every June for the students to exchange gently used books for “new” books to read over the summer and throughout the year. But we need your help too!

Bob: What is the swim team?

Answerman: The Chantilly Highland’s Dolphin Swim Team is a combination of ad-vanced swim lessons and an introduction to competitive swimming. It is open to boys and girls from 5-18 years of age. Last year we had 150 children, from be-ginners to some of the fastest swimmers in the metro area. Our season runs from the beginning of June to the end of July. Your children will make great progress in their swimming skills, working on all four competitive swim strokes and com-peting in meets against kids from neighboring communities. Sign-up will be in April at the community center. Watch the April Chantilly Highlander for the date and time and for our new web site listing.

Karen: How good a swimmer does my child have to be to join the swim team?

Answerman: Your child must be able to swim one length of the pool on his belly and one on his back. New 8 and under swimmers will need to show their skills to the coach at the GMU indoor pool in May. We want to make sure your child is water safe.

Sue: Why are you such a big fan of the community swim team and why should my child join?

Answerman: One of the reasons that my family enjoys the team has nothing to do with swimming. The swim team has en-abled my family to belong to a commu-nity within a community. Before we joined the Dolphins, we knew only our immediate neighbors. Now we know dozens of great people from Chantilly Highlands. The swim team involves 150 children from 85 different families.

money is allocated appropriately in the budget. No news to report at this time. Neighborhood Watch will be taking on a new look here shortly via the CHHA website. Since it is difficult to obtain volunteers to walk the beat to protect our subdivision, there are plans in the works to allow home-owners the ability to enter any suspi-cious or actual crimes directly into the website so that the other 909 homeowners are informed in a timely manner. However, any crimes should still be reported to the local Fairfax County Police Depart-ment. Architectural Control: Mark Hassinger, a new member to the board and a homeowner here in CHHA for over 20 years, has stepped up to the position of Archi-tectural Control board liaison. Mark will be leading a committee that re-views and enforces the current ar-chitectural control rules, regulations and procedures. This committee is appointed by the Board. Covenants and By-Laws Progress: The Covenants and By-Laws are still being reviewed by the review committee. A committee will be meeting again soon to finalize the documents and present to the HOA legal counsel for evaluation of legal sufficiency. Once sufficiency has been determined, all documents will be presented to the homeowners for review and then approval. Seventy-five percent (75%) of all members must approve for the changes to take effect. Old Business: None at this time. New Business: It was brought to the board’s attention that a rental

home in the community has many cars associated with it and cars are parking illegally. The board made the recommendation to the con-cerned homeowner to contact the County Zoning Department and Po-lice Department regarding this is-sue. A copy of the CHHA Cove-nants and Bylaws will be delivered to the home to confirm that they have a copy. The Chantilly Highlander editor contract is once again up for re-newal. A posting has been placed in The Chantilly Highlander re-questing bids. Chris Tacinelli will be the board liaison to this position. A concern was raised about the ad-vertising within The Chantilly Highlander. It was suggested that this publication contain more infor-mation and details of what is hap-pening within the community. In order for this to transpire, the com-munity needs to be willing to pro-vide information to the editor for inclusion. The Board of Directors will hold an executive board 12-month calendar planning meeting on Thursday, Feb-ruary 19th at 7:30 p.m. Jeff Boehlert made a motion to ad-journ the meeting and Mary Kerr seconded. Meeting adjourned at 9:15 p.m.

Feb 9, 2004 Re: Cox Communications From: The Blalocks – Kinross Circle

In May 2002 some crews showed up in Chan-tilly Highlands from Atlanta that were subcon-tractors for Cox Communications. They were supposed to upgrade the existing cable system to fiber optic cable and bring broadband inter-net service to the community. I was happy to hear the news. That was the last time I was happy with Cox.

Cox Communications, behind schedule and being fined by the county for failing to meet the upgrade deadline, needed to hurry the in-stallation process. Along the way they com-pletely ignored our property rights. The sub-contractors proceeded to invade the neighbor-hood, placing large equipment on our lawns and digging large trenches to place their fiber optic cable.

The process left our community with yards destroyed, driveways cracked and sidewalks damaged. Cox did little to nothing to fix the damage until an increasing amount of calls forced them to make an effort to do the mini-mum amount required by their franchise agreement. My family’s odyssey came to a head last week when it became apparent that Cox Communi-cations was completely devoid of any integrity and I would have to seek reparations through the court system.

A synopsis of my family’s ordeal; • Cox destroyed my front lawn. • Cox endangered my children and other

neighbors with large open pits. • Cox killed a tree (which it utilized as lev-

erage) • Cox knocked out the power by hitting the

lines. • Cox hit the gas line. • Cox cracked the driveway (twice) • Cox cracked the driveway apron (three

times). • Cox poured concrete in subfreezing tem-

peratures and a rainstorm. • Cox poured the driveway apron with my

vehicles in the driveway • Cox left large patches of the yard with no

restoration at all.

Cox Communications in the past 2 years has never done anything to remedy the problems that they were not forced to do. They did re-spond by.

First, denying it was them even after being shown over 50 photos and videotape. Claimed to have a valid easement but never could produce one.

A Cox GM [named] presented bogus docu-ments that he stated were valid easements. One he claimed was a “builder’s easement” dated 4 years after my home was built and one from a person who was never the homeowner. After threatening litigation, Cox sent a contrac-tor out to replace the driveway 8 months after the damage. The contractor poured the driveway in sub freezing temperatures the night before the massive snowstorm in January 2003 telling me “it will be fine”. The driveway, now one year old, has multiple cracks some as long as 15 feet. The driveway apron was replaced once in the pouring rain leading to half the concrete flow-ing down the street. After promising to fix it correctly and notify me when they would be out to do the replace-ment by a VP of Cox [named], another sub-contractor showed up and ripped out the apron and poured the new one with my vehi-cles in the driveway. I had to drive through the yard and over the curb to get out.

Some interesting facts that you may want to know if Cox placed cable lines in your yard:

- They were supposed to install the lines only on the right of way which is the small strip of grass between the sidewalk and the street. - They were not supposed to be in your yard at all unless it was for the drop cable to connect your home. - If they placed a line through your property, that is considered an encroachment and Cox must obtain an easement from the property owner before they place the line. - Each property owner can negotiate what would be fair and reasonable compensation for the utilization of their property with Cox. Cox has now utilized your property to make a profit for almost 2 years! - Cox took the act now; ask questions later strategy, betting most homeowners would not be aware that Cox illegally installed their lines on their property without fair and reasonable compensation. - Not exactly the business practice of a com-pany that wished to be rated on ethics - To compound the problem, not only did they fail to restore many lawns to their previous conditions as required by the franchisee agree-ment, they denied they were the company that caused the problem.

After 2 years of relentlessly pursuing Cox to hold them accountable, I have learned the fol-lowing.

The franchisee agreement signed by the Board of Supervisors and Cox Communications al-lows the Fairfax Cable and Consumer Protec-tion Division to fine Cox for not following the agreement.

What is the maximum fine that can be levied against the $9 billion company? $200 dollars.

[A Cox representative] was outright dismis-sive of the Cable and Consumer Protection Division He viewed them as a mere incon-venience.

As far as the damage to my property, the representative [named] stated quote, "You should be thanking me for raising the value of your home by bringing modern access to your community”

Negotiations with Cox broke down because they insisted on two provisions that I was not willing to stipulate.

#1 Cox wanted a confidentiality agreement that I would not tell any other Chantilly Highland Homeowner that Cox was en-croaching on their property so they could avoid paying for easements.

#2 They wanted to record the easement at the Fairfax County courthouse as being granted for the sum of one dollar which was another way to avoid anyone finding out how much they had to pay.

In this time of corporate greed and general lack of integrity and ethics, you would think that large corporations would learn their lesson. Cox obviously has not as they em-ploy a stable of corporate attorneys whose purpose is to thwart any attempt to hold Cox accountable for their actions. One great example is the e-mail I sent to a CEO [named] of Cox who did not respond but did block me from sending him any more e-mails.

If you are unhappy with the conditions Cox left the neighborhood such as lawn damage, sidewalk damage, driveway damage I suggest you hold Cox accountable. They will never change their business practices unless they are made to, by court order or community outrage.

Fairfax County Canine Ordinance others. Dogs must be restrained by a dependable leash and controlled by a responsible person when off the prop-erty of the owner. (County Code Sec-tion 41-2-4) Vicious and Dangerous Animals

Owners of vicious animals must keep them confined and not permit them to be a danger to people or other animals. It is against the law to keep wild or exotic animals as pets. (County Code Section 41-2-7 and 41-7-1) Cruelty to Animals

It is against the law to maliciously kill, disfigure or poison animals. All pets must be humanely treated with proper food, water, shelter and exer-cise. It is also against the law to over-load, torture or cruelly beat any animal. (State Code 3.1-796.122)

Animals Creating Nuisance / Animal Waste (Scooping)

It is against the law to allow animals to trespass on, destroy or damage another person's property. Animals must not fre-quently and habitually make loud and objectionable noises or be kept in such a manner as to cause unsanitary conditions. County Code concerning dog [excrement] pet waste:

The owner or custodian of any dog shall be responsible for the removal of excreta deposited by such dog on the property of another, including public areas ("pooper scooper" regulation).

Joining the team will not only im-prove your children’s swimming, but you can’t help but meet a few kindred spirits to befriend. If you are new to the community, it is the fastest way to find out all the cool things to do in the area. If you de-sire to get your child involved in the most obscure extra-curricular activ-ity, you can be sure to find at least one swim team parent who knows where to sign up. I am continually amazed at the level of expertise to be found among our families. If you plan to travel almost anywhere in the world, a Dolphin parent has been there, done that, and can show you pictures.

Another reason that my children like the team is that swimming is both an individual, as well as a team sport. They continually try to improve their personal best times but in a team en-vironment. My children swim year round and play softball, soccer and basketball as well.. Summer swim-ming is the only opportunity they have to participate in a Chantilly Highland’s community team that is not only multi-age, but also involves both boys and girls. In what other sport would you see a bunch of 14 year- old boys cheering for 10 year- old girls? In summer swimming you can see this every Saturday morning.

Our family has been involved with the team for 10 years and will hopefully be there for at least an-other 5. Our best community memories have been watching our neighbors’ children grow from summer to summer, going from chocolate-covered kids who can’t swim a lick, to self composed young people who glide through the water and enjoy sharing what they’ve learned with a new bunch of little chocolate-covered kids.

Chantilly Invitational Jazz Festival

Chantilly High School Band Department will host the 24th An-nual Chantilly Invitational Jazz Festival on Friday and Saturday, March 19th and 20th. The festival ends on Saturday night with the three highest-scoring big bands from the day’s competition returning for a true “Battle of the bands.” Defending champion of both the small combo and Big Band categories is Walt Whitman High School.

Admission to all events is free. Scholarships are awarded by The Big Band Society—Ed Walker Chapter and Contemporary Music Center of Chantilly.
