Recent statutory and regulatory changes have forced employers to re-analyze the way they approach employee disability and leave issues. The Americans with Disabilities Act Amendments Act and the new EEOC implementing regulations that recently went into effect are game changers. The junctions where the ADAAA and various leave laws intersect are becoming increasingly more time-consuming and difficult to navigate. Through a combination of discussions, case studies, hypotheticals, and real-life situations, Wayland and Sudbury, will tackle the essential points raised by these legal entanglements from a banking industry perspective. Newsome devotes the majority of his practice to noncompetition and trade secret litigation, drafting noncompetition agreements and assisting clients in taking proactive measures to protect their trade secrets and proprietary business information. He has litigated trade secret and noncompetition disputes in numerous industries.

Newsome regularly conducts training sessions for managers and supervisors with a focus on teaching strong management fundamentals in order to build employee morale, accomplish management objectives, and ensure legal compliance. He has significant experience training foreign nationals on compli-ance with labor and employment laws in the United States and the cultural workplace differences executives, managers, and supervisors new to the United States may encounter.

Before attending law school, Newsome worked for four years as a supervisor for UPS and Roadway Package System. Kara E. Shea is a member of Miller & Mar-tin, PLLC, Nashville. She provides practical advice on employment issues and compliance to national, regional, and local employers of all sizes, ranging from Fortune 500 companies to small businesses and across a variety of industries. Shea also represents employers

before administrative agencies such as the EEOC and in litigation, including discrimination, retaliatory discharge, whistleblower, and wage and hour cases, including class actions.

She has briefed cases presented to both the Tennessee and the US Supreme Court. Her court admissions include the US Court of Appeals, Sixth, Seventh, Tenth, and Eleventh Circuits and the US Supreme Court.

Stacie Caraway, member, Miller & Martin, PLLC, is a national employment law advisor, litigator, and trainer. She advises national, regional, and local employers concerning general employment and labor law issues; develops, reviews, and updates human re-source policies and supporting agreements;

and represents employers in local, state, and federal legal proceedings including EEOC and state human rights com-mission investigations, mediations, and lawsuits throughout the United States.

Caraway is a frequent speaker at national, state, and local employment law symposiums and provides in-house training and counsel on employment law issues relating to hiring, disci-pline, accommodations, and terminations. C. Eric Stevens, shareholder with Littler Mendelson, PC, has nearly 30 years of ex-perience representing clients—focusing on healthcare and financial institutions—in labor relations and employment litigation. He repre-sents both union and nonunion employers in class-action claims under anti-discrimination

laws, litigation involving federal and state wage and hour laws, and contract negotiations, arbitration, successful union-free election campaigns, Office of Federal Contract Compliance Programs audits. In addition, he assists clients with compliance and litigation avoidance by conducting in-house training for supervisory and management-level employees, providing guidance in the development of af-firmative action plans, and preparing and implementing a full range of employment policies.

Josh Sudbury is an attorney in the litigation section of King & Ballow. Before joining King & Ballow, he served as a judicial law clerk for the Honorable Diane K. Vescovo, United States Magistrate Judge for the Western Dis-trict of Tennessee at Memphis.

Sudbury received his law degree from the Cecil C. Humphreys School of Law at the University of Memphis, where he was a member of the Moot Court Board and president of the Student Bar Association. He was a two-time member of the Robert F. Wagner National Labor and Employment Law Moot Court Competition team and champion of the Memphis Law Moot Court Competition.

He received his bachelor’s degree, with honors, from Pres-byterian College in Clinton, SC, where he majored in history and double-minored in economics and political science.

Sudbury is admitted to practice law in Tennessee as well as the United States District Court for the Eastern, Middle, and Western District of Tennessee.

Brian Townley, CFMP, is senior vice presi-dent of The National Banks of Central Texas where he serves as their director of market-ing and director of human resources and employee development. He is also president of Motivational Management Group, which is owned by The National Banks of Central

Texas. Townley has been in the banking industry since 1987 and has a rare blend of bank operations and bank marketing knowledge.

In July of 2011, Townley released his first book, Inspir-ing Leadership – Unleashing Motivation in the Workplace,

which shares his trademark leadership tactics that have played a major role in his personal achievements as well as the success of The National Banks of Central Texas.

He is a graduate of Texas Bankers Associations Operations School, Texas A&M University’s Bank Operations Institute, ABA’s Bank Marketing and Management School ,and Uni-versity of Wisconsin’s Graduate School of Banking ‐ Human Resources School. He is also a certified financial marketing professional, CFMP, and serves on many industry boards and committees.

Townley has spoken at state and national banking conferences and schools and has created many successful motivational programs that have been incorporated within employee incentive plans, talent management solutions, em-ployee sales campaigns, and marketing plans, just to name a few. His expertise is based on his real–world experience where he has implemented strategies that create results, build morale, and insist on accountability.

R. Eddie Wayland is a partner in King & Ballow and supervises the firm’s litigation section. He has successfully argued before the United States Supreme Court and has liti-gated hundreds of cases to conclusion before judges, juries,

arbitrators, and administrative agencies in over 33 states throughout the country.

Wayland concentrates his national practice in the representation of management in all areas of employment and labor law and re-lated litigation. He is a frequent speaker on employment law issues and provides in-house training in these areas.

For 20 consecutive years, Wayland has been listed in the book The Best Lawyers in America. He has also been listed in every edition of Chambers USA America’s Leading Business Lawyers and has been recognized as one of the top lawyers in Tennessee by both Business Tennessee magazine, and also by SuperLawyers magazine.

Wayland has been awarded the Martindale-Hubbell peer review rating of “AV Preeminent,” which is the highest possible rating in both legal ability and ethical standards. He twice has been selected chairman of the Labor and Em-ployment Section of the Tennessee Bar Association. He was founder of the TBA Labor Letter. Among his other publica-tions, Wayland was co-author for the text Americans with Disabilities Act Compliance Guidebook and was a contribut-ing author for the text The Developing Labor Law.

Wayland received his law degree from the University of Tennessee College of Law, graduating Order of the Coif, with high honors, and served as articles editor for the Ten-nessee Law Review.

Hotel InformationThe conference will be held again this year at the Embassy Suites Hotel & Conference Center, located at 1200 Confer-ence Center Boulevard in Murfreesboro, TN. Perfectly situated adjacent to Avenue Murfreesboro lifestyle center, the hotel is convenient to the area’s best restaurants and shops. All rooms are suites, and guest rates include a com-plimentary cooked-to-order breakfast every morning and nightly manager’s reception. The hotel is connected to the conference center, where all general sessions and concurrent workshops will be held.

The TBA has arranged for a limited number of rooms at a special group rate of $139 single/double. The reservation deadline for the special rate is midnight on February 27. General InformationAttire: Business casual attire is appropriate for all TBA pro-grams. Because of temperature variations in meeting rooms, please bring a sweater or jacket for your comfort.

Program Availability: Due to hotel guarantees and material production, reservations received less than 5 days before the program will be subject to space and material availability.

Special Needs: If you have a disability that may affect your participation in this program, please send TBA a statement regarding any special needs at least 10 days before the pro-gram. We will contact you to discuss accommodations.

Cancellation Policy: Cancellations received in the TBA office 5 business days prior to the scheduled program will be refunded in full. Due to commitments with hotels, cancellations received less than 5 business days prior to the scheduled program are not refundable. Substitutions are welcome. Registrants who do not attend the program or send a substitute will be responsible for the entire registration fee.

Inclement Weather Policy: Cancellations due to inclement weather are refundable, minus a late cancellation fee of $50 for a one-day program and $75 for a two-day program. If you have questions concerning the status of a TBA pro-gram due to inclement weather, please call the TBA office at 615/244-4871 or 800/964-5525, x150. The TBA num-ber will provide information concerning program status, cancellation fee, and refund requests.
