eComment: These asset Mangement companies were a blight to our community for 13 years now buying up land after the housing crash and writing off the loss in their taxes, they they are building expensive rental units with “market rate” which is just asset companies buying up all desirable housing and jacking up pricing, we need more housing that people can buy not over priced units.

Good morning,  I am writing to you in support of "The Hill" development. It is proposed for Red Hill Avenue and San Juan Street. I have lived in Tustin for over 20 years and live a few blocks away from the proposed project. We have raised our three sons here and they all have attended or attend schools in the Tustin Unified School District.  I think this project will help revitalize the area. In traveling up and down Red Hill avenue from the freeway I have always felt it has needed some improvements and this project  will bring some opportunities to our neighborhood and city.  Thank you,  Kate Kersten

Hello, I am reaching out to you in support of the “The Hill” development on Red Hill and San Juan St. I have lived in Orange County for the last 10 years. I moved to Tustin 2.5 years ago from Orange and absolutely love it here. I live very close to the proposed development and use Red Hill Ave. on a daily basis. My husband and I have always commented while driving towards the 5 freeway that we wished they bring new life and modernize the area. It just seems a bit run down and neglected. It is a great location and is not being used to it best potential. I believe this project will do just that. In reviewing the plans, I believe they did a good job in not putting too much housing to cause parking issues in the surrounding neighborhood and have scaled it correctly. I love the idea of having some new businesses because I am always looking to support locally. This project is a positive addition to our neighborhood! Thank you, Lindsay

Good Morning Mr. Mail,  City Staff is in receipt of your additional email and it will be added to the public record.   Regards,   Erica H. Demkowicz, AICP Senior Planner Community Development Department 300 Centennial Way Tustin, CA  92780 (714) 573‐3127  [email protected]     From: Neil Mail <[email protected]>  Sent: Thursday, July 22, 2021 12:33 AM To: Demkowicz, Erica <[email protected]> Subject: Re: Re; Public Hearing Notification ‐ 13751 & 13841 Red Hill Avenue DR 2021‐0002; DA 2021‐0001; VTTM 17822  Thank you for the information Erica.   I do have some additional questions and concerns. For this property, what rent level qualifies the units as very low income housing, and does the developer’s plan meet that level for all units so designated?  Secondly, how long does the developer have to keep those rent levels to continue to qualify the units as very low income units?  It would be a shame if the developer was able to get the designation and within a short time give up the designation and raise the rents.    Another concern I have with the reduction in parking spaces per unit is that it will result in many residents of the development having to park on the streets during street sweeping days.  Both regular and low income individuals will be subject to the vigilance of the parking enforcement police, and they do an excellent job.  All will be ticketed.  It wouldn’t fair to help low income families with rent subsidies on one hand, then penalize them with parking tickets because their facility doesn’t have enough parking spaces.   I don’t know enough about low income housing law to know how the city resolves that issue.  Another concern is that the property abuts Tustin High School.  The reduction of the City required parking spaces per unit, and the number of additional cars on the streets around the school from the added 23 units, would result is a significant amount of on‐street parking and more auto traffic in a very congested area around the school.  This creates a increased safety concerns for students going to and from school.  From your reply to my previous email, doesn’t this real safety concern warrant consideration for a significant reduction in the 23 additional units requested by the applicant?

 If the rents for the 6 very low income units truly qualify, and developer commits to maintaining those units as very low income units for the required number of years, maybe the student safety concerns and ticketing on sweeper days could allow the city to work with the developer to reduce the number of additional units.    At a minimum, I believe the Planning Commission and City council, should be made aware of both the ticketing of low income families, and the student safety issues, if the developers proposed plan meets the letter of the law.  Aside from the above, I have yet to receive the developers presentation planned for the Planning Commission meeting from Ms. Wallace.   Again, thank you for your response. Neil Sherman   Sent from my iPad

The applicant is proposing at least 5% of the overall project with very‐low income (i.e. affordable) housing units which entitles the applicant to a 20% density bonus and use of special parking ratios that apply to California’s Density Bonus Law.   The Density Bonus Law is a state mandate and through the provision of affordable housing, the applicant can utilize a different parking ratio than that which is required under the Red Hill Avenue Specific Plan.     The applicant is also entitled to one (1) concession or waiver through State Law and the applicant is requesting a waiver for the required amounts of private and common open space for the project.  According to State Law, the City is required to grant the concession or waiver proposed unless it finds that the proposed concession or incentive does not result in identifiable or actual cost reductions, would cause a public health or safety concern, would cause an environmental problem, would harm historical property, or would be contrary to law.      As a result of the project not resulting in any of the waiver or concession  conditions stated, the waiver for the required amounts of private and open space must be granted by the City.    https://www.tustinca.org/1080/Current‐Projects ‐ link to current projects page   Let me know if you have any additional questions.    Regards,   Erica H. Demkowicz, AICP Senior Planner Community Development Department 300 Centennial Way Tustin, CA  92780 (714) 573‐3127  [email protected]          From: Neil Mail <[email protected]>  Sent: Thursday, July 15, 2021 5:34 PM To: Demkowicz, Erica <[email protected]> Subject: Re: Re; Public Hearing Notification ‐ 13751 & 13841 Red Hill Avenue DR 2021‐0002; DA 2021‐0001; VTTM 17822   Erica, Hoping you and your family stayed healthy this past year.  It has been trying at times.   Thank you for letting me know about the hearing on July 27.  From the numbers in the description, the proposed project is a big improvement from the previous plan.  But it still falls significantly short of the parking space requirement set forth in the city’s requirement.  If I remember right the original requirement was 2.25 parking spaces per unit.  The current plan is 1.66 spaces/unit if the developer is allowed to build 237 units, and 1.74 spaces/unit with their base 114 units.   I’m sure you also made the same calculations.  If my calculations are correct, and you follow the same guidance you used on the previous proposed plan, I’m looking forward to your recommendations at, or subsequent to, this meeting.   Interestingly, a representative from the developer, Jill Wallace, talked with me today about the upcoming meeting.  She had my Association’s Property Manager contact me about her request to talk.  In Ms. Wallace’s response to my question about any requests for variances in their proposal, she

Hi Planning Commission,  Comment about The Project at 13751 & 13841 Red Hill Ave for the July 27th meeting:  Thank you for having retail and public common areas designed into the project.    My suggestions: 

(1) I know you want the High School next to the project to be safe.  At other meetings I have previously encouraged that there be no ability for direct harm (like sniper fire) to the High School from an open parking lot on the side facing the High School.  Thank you if this is already addressed—I am unable to locate the actual plans on the website.  

 (2) I know you want the high school students walking to school to remain safe.  And that 

you encourage high quality transit, such as walking and biking in this HQTA (High Quality Transit Area).  I suggest the sidewalk for the pedestrians stay as far from the street as it is now and with hedges lining the sidewalk on the street side to give the pedestrians some cushion between them and the cars speeding to the high school and freeway.  I understand due to the drought, landscaping has watering limits—can this landscaping be pedestrian protecting?  Better yet, can solid car‐blocking barriers be placed within whatever landscaping is allowed to protect the pedestrians further?  

(3) What are plans for any bike trails on Red Hill?  Currently, none exist and the bike trail on Newport is used by pedestrians who have to ignore the city’s prohibitions and are then able to walk and push strollers safely away from the speeding cars.  The narrow sidewalk is right on the curb beside the cars. Again, Newport illustrates that pedestrians prefer a cushion between them and the cars.  

(4) Is there any room for a bus/shuttle stop planned?  I understand residents in HQTAs are to be able to walk within ½ mile to a public transit.
