Subject maui highlands well heads

We did a sanitary survey of the Maui Highlands (new water system under construction) and noted that the wells, Keokea #1 (4425-01) and Keokea #2 (4425-01) did not have the 12 inch stand off from ground elevation to the top of the well head. See attachments (photo 3100 is well #1 and 3099 is well #2).

The well head cap is not bolted down to the well head and no gasket is installed. We will pursue the lack of gasket and bolting of the well head cap.

Should we pursue the lack of 12 inch standoff? Please advise.

We are pleased to inform you that the Pump Installation work permitted for the Keokea Highlands Well #1 (Well No. 4425-01) is complete and acceptable. This certificate of pump installation completion allows you to commence pumping your well for reasonable & beneficial water use.

To protect Hawaii's natural ground water resources for the benefit of all, the following requirements apply to the use of your well:

I. If the well is not in use it must be properly capped.

2. If the well is to be abandoned then the landowner must cause a licensed contractor to apply for a well abandonment permit in accordance with §13-168-12(f) prior to any well sealing or plugging work.

3. In the event that the well operator and/or landowner changes, the Commission shall be notified of the change prior to the change, and all forms shall be transferred to the new owner.

4. In the event the benchmark in the concrete base of the well is altered in any way, an updated elevation survey (page 5 of the Well Completion Report Part I) shall be submitted to the Commission. The Well Completion Report Part I can be obtained by contacting staff or at www.hawaii.gov/dlnr/cwrmlforms.htm.

5. Your approved pump has a capacity of 260 gpm at a head of 610 ft. In the future, pump replacements of equal or lesser capacity will not require an additional permit from the Commission, but will require the submission of a Well Completion Report Part II by the licensed pump installer. If the pump replacement is greater than the existing pump, you will need to apply for a new pump installation permit.

6. The landowner shall cause the well oPerato~o maintain the installed meter or other appropriate means for measuring and repo g withdrawals and water levels, and appropriate devices or means for measuring hlorides and temperature. These data shall be measured monthly and reported to thF Commission on an annual basis, on forms provided by the Chairperson (attached), lin accordance with § 13-168-7, HAR.

7. The proposed use shall not adversely affect e~iSting or future legal uses of water in the area, including any surface water or est$lished instream flow standards. The authorization to drill a well and/or install a puinp shall not constitute a determination of correlative water rights. The landowner ~d well operator are notified that the quantity of water taken from the well and/or the pump capacity could be reduced by the Commission in the future. I

8. In the event that your installed pump is les~ than 70 gallons per minute, and no elevation survey has been completed, you may be required to do one in the future.

Because groundwater in Hawaii is a public trustJ, and adverse effects at one well may affect other water resources, any violation of the above cQnditions, or any other provision of the Hawaii Administrative Rules, may be subject to fines of up to $5,000/day. The Commission needs your help and asks that you to do your part in utilizing this shared resource. We prefer to work with you in meeting the goal of protecting our ground water resources together.

Enclosed are two (2) originals of your approved Pump Installation Permit for the captioned well(s) that authorize permanent pump installation work for your well(s). As part of the Chairperson's approval, the following special conditions were added and are part of your permit under Permit Condition 11:

Special Conditions

1. If the elevation benchmark needs to be altered, the permittee, well operator, and/or well owner shall ensure that the benchmark Is transferred (or the well resurveyed) and documentation of the new benchmark shall be submitted to the Commission within sixty (60) days after the pump Is Installed.

The permittee, well operator, and/or well owner are responsible for all conditions of the permit. This includes ensuring that the pump installation contractor submits a completed Part II of the Well Completion Report form (enclosed) within sixty (60) days after the pump installation work is completed. Be advised that you may be subject to fines of up to $5000 per day for any violations of your permit conditions starting from the permit approval date.

Please sign and have the contractor sign both permit originals and retum one for our files. A copy of the Well Completion Report (Part II) and a copy of your water use report form are enclosed for your use.

IMPORTANT • Pump installation shall not commence until a fully signed permit is returned to the Commission. Except for the monthly water use report form, please provide copies of all the information In this packet to your pump installation contractor.

In accordance with Department of Land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled 'Water Use, Wells, and Stream Diversion Works", this document permits the pump installation for Keokea Highlands Well (Well No. 4425-01) at Keokea near 600' el., Makawao, Maui, TMK 2-2-2:54, subject to the Hawaii Well Construction & Pump Installation Standards (February 2004) which include but are not limited to the following conditions:

1. The Chairperson to the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, at least two (2) weeks before any work covered by this permit commences and staff shall be allowed to inspect installation activities in accordance with §13-168-15, Hawaii Administrative Rules.

2. The pump Installation permit shall be for installation of a 260 gpm rated capacity at 650 ft. of head, or less, pump in the well.

3. The permittee, well operator, and/or well owner shall provide and maintain an approved meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on a monthly basis, on forms provided by the Chairperson (attached).

4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from a well shall not constitute a determination of correlative water rights. The permittee, well operator, and/or well owner are notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is not a commitment that the. pump capacity permitted here or even some lesser amount is guaranteed in the future.

5. The permittee, well operator, and/or well owner shall complete and submit as-built drawings and Part II - (Permanent) Pump Installation Report of the Well Completion Report (attached) to the Chairperson within sixty (60) days after completion of work.

6. The permittee, well operator, and/or well owner shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this permit.

7. The pump installation permit application and any related staff submittal approved by the Commission are incorporated into this permit by reference. This permit is also subject to the Hawaii Well Construction & Pump Installation Standards (February 18, 2004). If the HWCPIS are not followed and as a consequence water is wasted or contaminated, a lien on the property may result.

8. The permit may be revoked if work is not started within six (6) months after the date of approval or if work is suspended or abandoned for six (6) months, unless otherwise specified. The work proposed in the pump installation permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than three (3) months prior to the date the permit expires. If the commencement date Is not met, the Commission may revoke the permit after giving the permittee, well operator, and/or well owner notice of the proposed action and an opportunity to be heard.

9. If the well is not to be used it must be property capped. If the well is to be abandoned then the permittee, well operator, and/or well owner must apply for a well abandonment permit in accordance with §13-168-12(f) prior to any well sealing or plugging work.

10. The permittee, its successors, and assigns shall Indemnify, defend, and hold the State of Hawaii harmless from and against any loss, liability, claim, or demand for property damage, personal injury, or death arising out of any act or omission of the applicant, assigns, officers, employees, contractors, and agents under this permit or relating to or connected with the granting of this permit.

11. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

Customer is asking for administrative approval to leave test pump in the well to be used after pennanent pump approval for the permanent pump. No water would be pumped after pump test and well will be disabled and without power until final pump approval.

The pump is capable of producing 300 gpm which should give adequate drawdown curve for your modeling c:alc:ulatiODS.

In the event the water is brackish, they will use the well for irrigation purposes or possibly install a reverse osmosis system.

Also another reason to leave the test pump in the well is, due to the unknown condition of the water table of the area, more test pumping may be required after initial test.

Customer would also like to save the cost of2 pump installations.

Enclosed are two (2) copies of your approved Well Construction Permit for the captioned well(s) that authorize well construction activities but excludes installation work for your permanent pump. As part of the Chairperson's approval, the following special conditions were added and are part of your permit under Permit Condition 13:

Special Conditions

1. Attached for your Information Is a copy of the Department of Health's (DOH) review comments. Please note DOH's requirements related to discharge of effluent from well drilling and testing activities.

2. The landowner shall forward any archaeological study materials to the Division of Historic Preservation (HP) for their review. HP's comments are attached to apprise all who do work on this property that there may be historic sites that may incur delays In development.

3. Maul County Department of Planning points out that a well Inside the Pukalanl­Makawao-Kula Community Plan area (above the 600 foot elevation contour) is subject to a Community Plan provision restricting use to within the plan district (comments attached).

This permit does not authorize work for your permanent pump installation. Approval and issuance of your pump installation permit is contingent upon completed application and information provided to and accepted by Commission staff as required in the Well Construction & Pump Installation Standards (1/23/97) and any special conditions performed under this permit. However, a permanent pump may be installed prior to the permanent pump installation permit issuance in accordance with the Commission's April 15, 1998 Declaratory Ruling No. DEC-ADM98-G5, which states that:

"Permanent pump installation for capacities between 0-70 gpm and where the proposed use is for private individual needs in non-ground-water management areas may be allowed prior to the ·final pump installation permit issuance. When required as a condition of the well construction permit. subsequent pumping tests shall validate the acceptability of the permanent pump. The permanent pump installed prior to final pump installation permit issuance is subject to removal if the testing shows that a smaller pump Is required to reduce the potential of affecting neighboring wells and localized upconlng at the applicant's well. "

If you qualify and wish to take advantage of this ruling, please include a written request to install the permanent pump prior to final pump installation permit issuance when you return to us your signed well construction permit.

Please sign and have the contractor sign both permit originals and return one for our files. Also, copies of the aquifer pump test worksheet and the well completion report form are enclosed for your use.

IMPORTANT - Drilling work shall not commence until a fully signed permit Is returned to the Commission. Please provide all the information in this packet to your well drilling contractor. The permittee, well operator, and/or well owner are responsible for all conditions of the permit. This Includes ensuring that the well construction contractor, or other party who constructs the well(s), submits a completed Part I of the Well Completion Report form (enclosed) within sixty (60) days after the well construction work is completed. Be advised that you may be subject to fines of up to $1000 per day for any violations of your permit conditions starting from the permit approval date.

The Chairperson of the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, at least two (2) weeks before any work authorized by this permit commences and staff shall be allowed to inspect installation activities in accordance with §13-168-15, Hawaii Administrative Rules.

The well construction pennlt shall be for construction and testing of the well only. A minimum 1114-inch diameter monitor tube shall be pennanently installed In a manner a(:C8ptabie to the Chairperson, to accurately recOrd water levels. The ~Ittee, well ~rator, and/or well owner shaD coordinate with the Chairperson and conduct a pumping test In accordance with the Standards (a pump testing worksheet is attached). The' PEHTTllttee; well operator, and/or well owner shall submit to the Chairperson the test resultS as a basis fcir supporting an appllcatlOO to Install a permanent pump and withdraw water for use. No permanent pump may be installed until a pump Installation permit is approved and issued by the Chairperson.

In basal ground water, the depth of the 'Nell may not exceed one-fourth (1/4) of the theoretical thickness (41 times initial head) of the basal ground water unless otherwise authorized by the Chairperson.

The permittee, well operator, and/or well owner shall incorporate mitigation measures to prevent construction debris from entering the aquatic environment, to schedule work to avoid periods of high rainfaU, and to revegetate any cieared areas as soon as possible.

In the event that subsurface cultural remains such as artifacts, burials or concentrations of shells or charcoal. are encountered during construction, the pennlttee, 'Nell operator, and/or well owner shall stop work and contact the Departmenfs Historic Preservation immediately.

The ~ well construction shall not adversely affect existing or future ieaal uses of water in the area, Including any surface water or estat>llsfied Instream flow standards. This permit or the authorizatiOn to construcfthe well shall not constitute a determinalion of correlative water rights.

The following shall be submitted to the Chairperson within sixty (50) days after completion of work: a. . Well completion report, (attached - Part I, Well Construction Report). b. Elevation (referenced to mean sea level, msl) survey by a Hawaii-llcensed surveyor. c. As-bullt sectional drawing of the well. d. Plot plan and map showing the exact location of the well. e. Complete pumping test records, including time, pumping rate, drawdown. chloride content, and other data.

The Pfl(ITIltteejhwell OPerator, and/or well owner shaD comply with all applicable laws, rules, and ordinances; non-compliance may be grounds for revocation of 1 lis permit.

The 'Nell construction permit application is Inc;orp()rated into this permit by reference and is subject to the Hawaii Well Construction & Pump Installation Standards (Jan48ry23, 1997; HWCPIS). If the HWCPIS are not followed and as a consequence water Is wasted or contaminated, a lien on the property may result.

The permit may be revoked by the Commission if work is not started within six (6) months after the date of aPP.f0V8I or if work is suspended or abandoned for six (6) monthS, unless otherwise specified. The work proposed fn the well construction permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than three (3) months prki' to the date the permit eXpIres. If the commencement date Is not met, the Commission may revoke the permit after giving the permittee, well operator, and/or well owner notice of the proposed action and an opportunity to be heard.

If the well is not to be used It must be ~ cappecI. If the well is to be abandoned then the ~Ittee, 'Nell operator, and/or well owner must apply for a 'Nell abandonment pennit In a ance with §13-168-12(f) prior to any well sealing or plugging work.

The permlttee,.its successors, and assigns shall Indemnify, defend, and hold the State of Hawaii harmless from and against any loss, liability. ciaim, or demand for property damage, personal injury, or death arising out of any act or omission of the applicant, assigns, officers, employees, contractors, and agents under this permit or relating to or connected with the granting of this permit.

Thank you for the opportunity to review and comment on the Well ConstructionJPump Installation Permit Application for the proposed Keokea Highlands Well, which was received by our staff September 9, 2003. Our review is based on reports, maps, and aerial photographs maintained at the State Historic Preservation Division; no field inspection was conducted of the subject property.

A portion of the subject parcel has previously undergone an archaeological inventory survey, conducted for the proposed expansion of the Maui Research and Technology Park (Chaffee et al. 1997. An Archaeological Inventory Survey of a Portion of the Proposed Expansion of the Maui Research and Technology Park, Kihei, Maui Island, Hawafi. TMK: 2-2-2:54). The survey located three traditional agricultural sites which were sufficiently documented through the survey action; no further work. including preservation. was recommended, Our office found the report (;---acceptable in 1997.

Based on the submitted application, we understand the proposed undertaking consists of the construction of a well/pump installation. Unfortunately, we note that the map included with permit application does not indicate where the well is to be located on the subject property nor is there any indication of past or present land use or alteration. If the applicant could supply better maps, photographs of the project area (including any access road that may need to ~<--be constructed), a plan map of the proposed construction activities, and a description of the condition of the project . area, these data would greatly assist us in making a recommendation on this permit. ~., ~r: f,4oS~

Thank you for the opportunity to comment on this application for well construction and pump installation permit.

Zoning Compliance

According to the State, County and Community Plan Designation, this parcel is located in agriculturally zoned area wherein well development is an allowable use.

Aquifer and Proposed Amount of Withdrawal

The aquifer selVing the project is the Kamaole aquifer which has a sustainable yield of 11 MGD. The applicant proposes to withdraw 1 MGD for domestic use. This is a sizeable amount and will place a large demand on the aquifer. While the proposed well does have immediate effect on existing DWS wells, there are private wells that are in the zone of influence which does point to potential conflict in use. This conflict depends on pumpage, drawdown and aquifer status. Attached is a map showing the location of private wells In the zone of influence.

8ysIem Infrastructura

The applicant should be required to provide adequate fire protection, water selVice, and domestic source in accordance to system standards and that a contingency or back up source be identified. The applicant should be made aware that systems with more than 25 people over 60 days of the year are considered public water systems and are subject to all the rules and regulations of the State Drinking Water Act.

DWS has concems about the proliferation of private systems within the DWS service area. In general, the department discourages the development of individual private wells within the department service area. In the past, such wells have at times been poorly sited or system inadequateiy designed versus standards. We would encourage the applicant to discuss possible contribution to offslte improvements in lieu of private source development with our Engineering Division.

We suggest that the applicant be l1tqulred to report monthly pumpage to DWS as well as the Commission on Water Resource Management (CWRM). :.

Groundwater Protection

In Older to protect groundwater resources, we encourage the appliCant to adopt Best Management Practices (BMPs) designed to minimize infiltration and runoff from dally adivitles. Sample BMPs are as enumerated below.

1) Inspect exposed parts of the well periodically for problems such as: cracked or corroded well casing, broken or missing well cap, damage to protective casing, settling and cracking of surface seals.

2) Slope the area around the well so that surface runoff drains away from the well. 3) Provide a well cap or sanitary seal to prevent unauthorized use of or entry into the well. 4) Provide for sediment removal or well cleaning as necessary. 5) Have the well tested once a year for fecal coliform or other constituents that may be of concem. 8) Keep accurate records of any well maintenance, such as disinfection or sediment removal, that

might require use of chemicals in the well. 7) Avoid mixing or using pesticides, fertilizers, herbicides, degreasers, fuels, or other

pollutants near the well. 8) 00 not locate any type of potentially polluting adivjty up slope from the well.

We encourage the applicant to consider the following water conservation measures in and around the property: utilize Low-FIow Fixtures and Devices: Maui County Code Subsection 16.20A.680 requires the use of low­

ftow water fixtures and devices in faucets, showerheads, urinals, water closets and hose bibs. Water conserving washing machines, ice makers, and other units are also available.

Maintain Fixtures to Prevent Leaks: A simple, regular program of repair and maintenance can prevent the loss of hundredS or even thousands of gallons a day. Refer to the attached handout, "The Costly Drip.-

Use Climate-adapted Plants: This project site is located in the -Maui County Planting Plan- - Plant Zone 3. Please refer to the attached documents -SaVing Water in the Yarde. Native plants adapted to the area, conserve water and further protect the watershed from degradation due to invasive alien species.

We have:reviewed the above referenced permit and have the following comments:

1. The specific project location for the well is unclear. For the general area, the State, County and Community Plan Designation is Agriculture. Well development is an allowable use in this district.

2. If the specific project location is above the 600 ft. elevation contour line the project area is within the boundaries of the Pukalani­Makawao-Kula Community Plan Area and outside the boundaries of the Kihei-Makena Community Plan District. The Pukalani-Makawao­Kula Community Plan clearly states, "Restrict the use of any water developed Vllithin the Upcountry region to the consumption within the Upountry Region with exception provided for agricultural use." The applicant needs to specify well site location and where domestic service area is. If project location is above the 600 ft. contour the applicant will be limited to the Upcountry District for well use.

3. The Department recommends that the State Historic Preservation Division (SHPD) be contacted prior to initiation of construction for comments and mitigative measures.

4. It is of additional concern that lower level wells not be affected by withdrawal. As this well will place a large demand on the aquifer it may increase already high salinity levels and recharge capacity with

1. For Well-Drilling Adivities

Any discharge to State waters of treated process wastewater effluent associated with well drilling activities is regulated by Hawaii Administrative Rules, Title 11, Chapter 55, Appendbc I, effective September 22, 1997. Treated process wastewater effluent covered by this general pennit includes well driling slulTie$, lubricating fluids wastewaters, and well purge wastewaters. This general· permit does nat cover well pump testing. The applicable Notice of Intent Forms and fiting fee shall be submitted at least thirty (30) days before the &tart of discharge to the'Department of HeaRh, Clean Water Branch at 919 Ala Moana Boulevard, Room 301, Honol~lu, Hawaii 96814-4920 or P.O, Box 3378, Honolulu, Hawaii 96801-3378. Inquiries may be directed to the Clean Water Branch at (808) 586-4309 or by fax at (808) 586-4352.

2. For Well Pump Testing

The discharger shaH take all measures necesHry to prevent the discharge of pollutant& from entering Stllte waters. Such measures shall include, if necessary, containment of the initial discharge until the diaCl'large is essentiallY free of pollutants. If the discharge is entering a stream or river bed, best management practices shall be Imptemented to prevent the discharge from disturbing the clarity of the receiving water. If the discharge Is entering a storm drain, the dis~2Irger must obtain written permission from the owner of that storm drain prior to discharge. Furthermore, best management practices shall be implemented to prevent the discharge from collecting sediments and ather pollutants prior to entering the -toR!' drain •
