Dear Mr. Norton:

Please accept this letter as a formal complaint against Laffey US Senate. I believe that LXffey US Senate has violated the Federal Election Campaign Act of 197 1, as amended (“Act”)*. Over the course of a campaign, honest mistakes will be made. However, it has become increasingly apparent that Mr. Stephen P. Laffey’ s campaign has systematically violated the rules that ensure that political campaigns compete on a level playing field and are openly and honestly run. I trust that the Federal Election Commission (“Commission”) will do everythng in its power to clear up the many unsettling questions surrounding Mr. Laffey’s hdraising activities. This is a serious matter, and the people of Rhode Island and Mr. Laffey’s contributors deserve answers.

I request that the Federal Elections Commission investigate the following potential violations:

Improper use of corporate resources to create a voter list with the express purpose of aiding a federal candidate (“Laffey”). This is explicitly discussed by Mr. Vincent Indeglia in a letter sent to all of his employees at American Labor Services, Inc on Mr. Laffey’s behalf.

Violation of the Act and Commission’s regulations barring a corporation from making contributions to a federal candidate and distributing materials promoting a federal candidate to a corporation’s salaried and hourly employees.

U n l a w coercion of employees by Mr. Indeglia on Mr. Laffey’s behalf.

Misrepresentation of expenses related to mailings and postage. Filings submitted by the Laffey campaign to the Commission reveal approximately $20,000 in printing and postage related expenses. There is reason to believe that American Labor Services, Inc. made a prohibited corporate expenditure and contribution to Laffey US Senate by distributing a letter to all of its employees that expressly advocates Mr. Laffey’s election in the Rhode Island Republican Senate Primary. /

Federal laws prohibit a corporation from making any expenditures or contributions in connection with a federal ele~tion.~ Corporations are prohibited from distributing partisan registration and voting. materials beyond its executives and shareholders: and from supporting or conducting voter registration and get-out-the-vote drives if they involve materials that advocate the election of a particular federal candidate? The federal law also prohibits a corporation fiom coordinating these types of activities with the federal candidate or his campaign committee.

According to recent newspaper stories, Mr. Indeglia sent a letter to all of his employees on corporate letterhead and signed it in his capacity as president of the corporation. The letter states that he is “helping Mayor Laffey get elected to the United States Senate. . . .” It also directs his employees to gather personal information on Hispanic-Americans and states “[wle need to get those people registered to vote in the Republican Primary Election and then the General Election.” A copy of the Mr. Indeglia’s letter is attached to this letter for your review.

The newspaper articles also disclose that Mr. Indeglia held a campaign fundraiser for the Laffey US Senate campaign on Wednesday; April 26,2006. While the Laffey campaign

and Mr. Indeglia deny that they discussed the letter before it was sent to the corporation’s employees, this event indicates that Mr. Indeglia has a close relationship with the Laffey campaign. The Commission should conduct a M l investigation to determine whether Mr. Indeglia coordinated the letter with the Laffey campaign. If the corporation provided the Laffey campaign with copies of voter registration lists, this action would appear to be a prohibited .in-kind contribution to the campaign.

For the reasons discussed above, there is reason to believe that American Labor Services, Inc. and Mr. Indeglia violated to the Act by distributing the letter advocating Mr. Laffey’s election to all of his employees. There’ is also sufficient cause to investigate whether the corporation coordinated this activity with *e Laffey campaign.

In addition, it appears that the Laffey cainpaign has failed to properly account for mailing and postage related expenses.

In a Providence Journal article, John Dodenhoff, the Laffey US Senate Campaign Manager, stated that the campaign has spent $69,549 on five direct-mail pieces to 11 5,244 potential backers and contributors since October of last year! Mr. DodenhoFs claim, however, is contradicted by the Laffey US Senate’s own filings. Despite raising a reported $328,276 during the past hdraising quarter, the Laffey US Senate disclosed only $8,000 in mailing-related expenses to the Commission. Even more disconcerting is the’fact that since Mr. Laffey entered the race in September of 2005, Laffey US Senate has disclosed a total of less than $20,000 on printing and postage related expenses. It defies logic that the Laffey US Senate would have spent less than $20,000 for printing and postage during the course of the race, given that it purportedly mailed at least five direct mail pieces.

Misrenresentation of Club for Growth Contributions

Laffey US Senate failed to properly account for contributions collected on its behalf by the special interest group, the Club for Growth. Filings that the Laffey campaign has made to the Commission fail to disclose correctly the amount of approximately $300,000 which was raised on the campaign’s behalf by the Club for Growth. While the Club for Growth has apparently complied with the Commission’s requirement by reporting the hundreds of thousands of dollars it has raised‘for Laffey, the candidate’s campaign has failed to follow suit. Donors listed in the Club for Growth’s FEC filings as making earmarked contributions to the Laffey organization are not properly identified in Laffey’s filings. These donors’ contributions are not accompanied by any notation in the memo line of the Laffey US Senate’s report indicating that this money was collected by the Club for Growth. ‘

In their filings, the Laffey campaign failed to abide by campaign finance laws by completing the following necessary steps: Identify the Club for Growth by name and

Letter causes stir in race

A campaign letter for Stephen P. Laffey sent by a businessman to his employees may have run afoul of federal election laws.

PROVIDENCE -- The Chafee campaign yesterday called on Republican primary opponent Stephen P. Laf5ey to cancel a Narragansett fundraiser being hosted for him tonight by the owner of a temporary- employment agency who asked his employees, in writing, to help Laffey recruit ''every person of Hispanic descent that you know.'' r

The Cranston mayor not only refused to cancel the fundraiser, he accused U.S. Sen. Lincoln D. Chafee of flailhg at him "out of desperation" and "embarassment" because "we've outraised the senator the last three quarters."

He also called Chafee "the last guy to be talking about fundraising issues" after accepting a "junket1' to the Mirage resort casino in Las Vegas from the Harness Tracks of America, and $600,000 of his campaign contributions from special-interest political action committees.

"Apples and oranges'' was the response from the Chafee campaign as Rhode Island's U.S. Senate race entered a new and more openly aggressive phase. Today, the Chafee camp is launching its first TV ad, with $49,620 worth of 30-second TV spots that will run through Tuesday and $6,050 worth of minute- long radio ads.

Chafee spokesman Stephen Hourahan said there is no comparison between "a trip to make a speech'' and a potentially 'kerious" federal election law violation.

At issue is a Federal Election Commission prohibition against "express candidate advocacy" by corporate executives to their employees. Drawing attention to another potential violation, the Chafee campaign said: "The use of coiporate resources to create a voter list with the express purpose of aiding a federal candidate raises the specter that this activity constitutes a potential illegal corporate contribution to the Laffey campaign."

The back-and-forth began Monday when Chafee campaign manager Ian Lang made public and called "troubling" a letter that Vincent Indeglia, president of American Labor Services, disseminated among his employees.

At that point, Lang refused M e r public comment on the letter. A day later, however, after the National Republican Senatorial Committee had quietly distributed other copies, and after the Associated Press had published a story about the letter that made no mention about how it had been obtained, the emboldened Chafee camp launched a full-out assault.

*It posed these questions: "How many of Mr. Indeglia's employees believed that they were required to comply with h& directive in his letter? Did American Labor Services make a potentially illegal corporate contribution to Laffey by sharing the letter with. . . [and] giving the new voter list to Laffey's campaign?"

It also urged Laffey to cancel the $300-a-couple hdraiser Indeglia is hosting for him at the Canochet Beach Club, in Narragansett, "until the ethical issues swirling around" the letter are addressed.

But Laffey said he had no such intention.

Of his childhood fiend, he said: "Vinny made an honest mistake," but "hek a private citizen. . . . He said he was sorry" and "we are not canceling a hdraiser."

Of the Chafee campaign's efforts to draw attention to Indeglia's letter, Laffey said: "I know it must be embarassing that we've outraised the senator the last three quarters, each quarter, but you know, we're going to keep doing it."

He also repeated his request to Chafee to debate him on any issue, including immigration. Chafee has so far declined his invitation.

The letter urged support for L ~ e y , while demeaning Chafee, the Republican incumbent, and Democratic candidate Sheldon Whitehouse as out-of-touch aristocrats who have never "held a job other than being ushered into their political office by their parents' money."

"There are some people in this state that are trying very hard to make laws that will result in the deportation of millions of illegal aliens. These same people are'bying to make it more difficult for legal aliens and residents to become citizens. . . . These people are Lincoln Chafee and Sheldon Whitehouse. You can help stop these two aristocractic politicians fiom disrespecting your rights."

In his letter, Indeglia, the lawyer-nephew of Superior Court Judge Gilbert V. Indeglia, said: "I am helping Mayor Laffey to get elected to the U.S. Senate so that he can make sure the right laws get passed on this issue." I

But, "I need your help to do this," he wrote. "We need to get the name, address and telephone number of 'every person of Hispanic descent that you know who is a United States citizen already" so they can be "registered to vote in the Republican primary and then the general election."

When asked, Indeglia said he never consulted with the Laffey campaign about the letter, but wrote it believing Laffey's "position mimics the Bush position, which is that there would be temporary worker status granted to people living in this country as of whatever date the law is passed." An illegal immigrant seeking legitimate status would need a sponsoring employer; murderers, drug-dealers and other criminals would be ineligible.

But spokesmen for both Chafee and Whitehouse said the letter misrepresented their positions in the immigration debate.

citizenship." It would require already here illegally to pay 00 fine and back taxes, . learn English, and spend 1 1 years here as a law-abiding citizen.

' Laffey said the letter does' not reflect his views either: "Overwhelmingly, people do not want amnesty, they want enforcement first."

If the United States secures its border with Mexico, imposes stiffer fines against employers who knowingly hire illegal immigrants, "the economics will help take care of the problem," he said.

He said he had no objection to a guest-worker program, but not one that automatically leads to citizenship. Asked what he would do with the millions of people already here illegally, he said; "First we secure the border, then we start talking about people here."

Indeglia said he did not know about the FEC prohibitions until they were brought to his attention by The Providence Journal earlier this week.

"It was not my intention to cause Mr. Laffey or his campaign any grief over this and I feci verydbad about that. . . . I guess I have to do something, but I don't know what that is."

PROVIDENCE - - Cranston Mayor Stephen Laffey yesterday distanced himself fiom a letter a supporter wrote to his employees asking them to aid Laffey's Senate campaign.

The letter, written on American Labor Services, Inc., letterhead by its president, asks workers to help register Hispanic citizens to vote in the Republican primary. It could violate laws that prohibit corporations fiom telling hourly workers which candidates to support, according to former and current Federal Elections Commission officials.

"We had no idea about this letter," said Nachama Soloveichik, spokeswoman) for Laffey's campaign. "Had he asked us, we would have told him, 'Don't do this. Please don't do this.' We encourage him to take whatever steps needed to fix this."

The letter, written last week by Vincent Indeglia, president of the Providence employment agency, criticizes Laffey's opponents for their positions on immigration and asks employees to turn over names and contact information of every U.S. citizen they know. Indeglia said he left 50 to 100 copies on the desk where as many as 200 workers pick up their paychecks on Fridays.

LafTey is running in the Republican primary against incumbent Sen. Lincoln Chafee.

Federal election law prohibits corporations from expressly advocating a candidate's election or defeat, said FEC spokesman George Smaragdis and Craig Engle, a Republican attorney who worked at the FEC for 10 years.

Indeglia, 42, of Narragansett, said in a phone interview that he is holding a fundraiser for LafTey on Wednesday, but did not consult Laffey or his campaign about the letter. He also said he did not know it could violate the law.

"I'm very sorry if this in any way hurts the guy," he said.

Indeglia's letter said he supports allowing illegal workers to stay in the U.S. Spokespeople for the candidates mentioned in theletter said Indeglia did not accurately express their views on the issue.

The letter said Chafee and Sheldon Whitehouse, a Democratic carididate, want to deport illegal immigrants and mike it harder for legal immigrants to become citizens, while LafYey supports allowing people to become legal residents and citizens if they choose.

However, Chafee and Whitehouse support legislation that would give illegal immigrants a chance at citizenship if they paid a fine and met other conditions. LafTey wants to secure the nation's border with

PROVIDENCE -- In their public appearances, they are statesmanlike in their. efforts to convince voters that they have the temperament and gravitas to serve in the United States Senate.

Behind the scenes -- in their stealth mail campaigns -- they get down and dirty.

Cranston Mayor Stephen P. Laffey derides GOP primary opponent Lincoln D. Chafee as a "tax-and- spend porker."

He calls incumbent Chafee's voting record "embarrassing," and the man himself ')so brazen about his disgust for the Republican Party that he didn't even vote for George W. Bush in 2004."

Using a medium which provides no opportunity for rebuttal, he also describes Chafee as a pawn of "power-hungry special interests," among them: the big drug companies.

And what is Chafee doing to defend himself?

On the surface, he appears to be taking the high road with targeted mailings telling potential primary voters how much federal aid his 'Iseniority and growing clout'' has won for their communities. But these are among the few mailings he is willing to make public.

In mailings his campaign refused to make public, he said th is of Laffey: "His divisive, confiontational approach has led to acrimony and costly lawsuits, but little in real results for the city of Cranston."

And this: "He can't run on his record, so he's going to attack mine."

He also calls Laf5ey "vindictive," 'Wriolic'l and "intemperate" and cites, as an example, Laffey's pledge to refbse "to fight for or accept federal funds."

"Here," says one mailing, "are details on several important projects that Senator Chafee has delivered for Central Falls and your region, projects that his primary challenger Steve Laffey has announced he would have opposed."

most campaigns, before the combat begins. And there is it will be especially " fierce in this high-stakes battle between both Republicans and Democrats -- and wings within the GOP -

- for control of the U.S. Senate. ,

The typical Rhode Island candidate spends tens of thousands of dollars on these under-the-radar attempts to burnish his own image, while tearing down the other guy's. There are more of the same fiom the National Republican Senatorial Committee, which backs Chafee, and the Washington-based Club For Growth, which backs Laf5ey.

Campaigns rarely make such mailings public without prompting. Sometimes, not eventhen. * I

And unlike more expensive TV ads, which go to broad audiences, they can be mico-targeted to specific voters and donors with specific concerns: abortion, guns, health care, tax rates.

The Laffey campaign has spent $69,549 since October to produce and mail five direct-mail pieces to 1 15,244 potential backers and contributors across the country, according to campaign manager John Dodenhoff.

The Laffey campaign made copies of all five mailings public last week after being told The Journal already had copies of most, if not all, in the series. At that point, Laffey said he would be delighted to have the newspaper print them in Ml. ,

Chafee campaign manager Ian Lang not only refused to provide copies of most of Chafee's mailings, he also refhsed to say how much his candidate had already publicly reported spending on them to the Federal Elections Commission. Chafee's most recent FEC report indicates he spent at least $13,172 during the last quarter alone on mailings.

Brown University Prof. Darrell West calls this the good cophad cop routine: "In the public campaign, you are polite and maintain good behavior" while "behind the scenes you act like a maniac criticizing the opposition."

"The hope," he says, "is you can pin negatives on the other person, without appearing to be mean yourself."

West has written extensively about the TV air wars in modem campaigns. But in a relatively low- turnout election, which GOP primaries have traditionally been in Rhode Island, he believes "the ground war may be even more important than the air war because . . . you can really target those you think are going to participate in the primary."

Jennifer Duffl, a Rhode Island native who analyzes Senate races for the Cook Political Report, agrees.

"AS a general rule, you are sending out direct mail to the party faiffil, the activists" to get them "fired up to go out and work and give money . . .,I' she says. "AS a result, it tends to be a little over the top."

"It's about,= dishonest as McDonald's telling you they have the best French fries in the world . . . It's an act of persuasion. The truth is in the eyes of the beholder."

I Lang's explanation for refbsing to make Chafee's mailings public: "It's not secret. We sent it to thousands of pe6ple," but "these are mailings that go out to individuals and that's what it is intended to do."

e a Democratic primary opponents Matt Brown, Sheldon Whitehouse and Carl Sheeler have relied less, it would appear, on direct-mail appeals than the Republicans. But Secretary of State Brown's campaign did not respond, over several weeks, to inquiries about its direct-mail effort. Sheeler could not be reached for comment yesterday.

The Laffey and Chafee mailings fall into several categories that include the tribute letter from someone with whom the candidate would like to be associated and the letters praising their own accomplishments and criticizing their opponent.

Chafee counts among his letter-writing supporters U.S. Sen. Arlen Specter, R-Pa., and former Massachusetts Gov. William Weld, but his campaign even refused to release those letters.

Laffey's boosters include onetime Republican presidential candidate Steve Forbes, the CEO and editor- in-chief of the magazine that bears his family's name.

Forbes, who won just 89 of the 36,03 1 votes cast in the 2000 Rhode Island presidential Republican primary, attached his name to a Laffey fhdraising letter that said, in part:

"I happen to be of the opinion that Steve LafTey winning his primary battle against a tax-and-spend RHINO for this U.S. Senate seat is the best chance of restoring the GOP to the pro-taxpayer party President Reagan championed." (RHINO is insider slang for Republican-in-name-only .)

LafTey says,,the number of votes Forbes got in Rhode Island is "immaterial to me, it's whether people actually send back money" and, by that measure, the Forbes letter "has been successfd."

"I was very honored," LafTey said. "He's a very well-known person; he ran for president of the United ,

States and he speaks out about low taxes and simplifying the tax code and about cutting government waste and those are things I believe in."

With the September primary now less than five months away, the public battle will soon engage.

But Chafee has had the luxury, until now, of freely and without challenge belittling Laffey as the guy who ran up kostly lawsuits" without any "real results'' for the city of Cranston.

He and his backers at the NRSC could also paint Laffey as a flip-flopper who has "come down on both sides" of the abortion divide and who, after raising taxes three times as Cranston mayor, now "talks about wanting to cut taxes at the federal level."

"He says one thing; then another depending on when you ask him."

LafTey just laughs, calls Chafee's comments "unfortunate" and says: "Hek entitled to his opinion, but not his own facts. The city of Cranston has had a massive turnaround."

He says the $100,000 or so his administration spent on legal fees to defend the city against School Committee demands saved $3.2 million in one year; another $80,000 in legal fees saved $500,000 in crossing-guard expenses. r
