The purpose of the Public Service Commission is the regulation of the adequacy of service, safety of operation, and reasonableness of rates of 8,000 utili ties and transportation companies in Missouri.

It has no jurisdiction over municipally­owned utilities, and its regulation of rural electric cooperatives is limited to the safe­ty of their operations. Cooperatives may voluntarily place themselves under complete i

t'regulation, and two -- Sho-Me Power Corpora­tion of Marshfield and 'Citizens Electric Corporation of Ste. Genevieve -- have elected to do 50.

Consumers benefit from regulation through guarantees of adequate, safe service at rea­sonable rates, while the regulated companies and those who invest in them are assured a reasonable return on their capital.

In setting rates, the commission must main­tain a balance between these two main in­terests. If rates are excessive, consumers SAM L. MANLEY. The PSC was organized in its present form in 1913. Its earliest predecessor was the Board of Railroad Commissioners, which was established by the General Assembly in 1875. The Board was later given authority over grain warehouses and railway express com­panies. When the PSC was created, regula­tion of grain warehouses was not extended to it.

The pubUa information office assists other sections in the prepCU'ation and printing of reports and speeches, and participates in planning and conducting meetings and con­ferences.

By 1913, the regulation of utilities had been attempted by the courts, the legisla-· ture. communities, and local commissions, but none of these approaches was satisfac­tory. Neither the courts nor the General Assembly had time to devote to regulatory matters, while the towns and local commis­sions lacked funds to function adequately.

The Public Service Commission, which was modeled after the New York PSC. was created so that the regulation of utilities and re­lated matters would be administered in a central location, by an office with suffi­cient funds and professional personnel to perform its duties swiftly and economically.

From its offices on the ninth and tenth floors of the Jefferson State Office Build-· ing in Jefferson City, the PSC regulates 12 types of companies, whose numbers at the end of. 1971-72 fiscal ·year were:

The commission's duties include inspection and investigation of various utility opera­tions, response to complaints, promulgation of rules and regulations, and probably most time-consuming, the investigation, hearing and disposition of rate cases.

The size of the commission's task is perhaps best indicated by the fact that the value of property owned by the regulated companies in 1972 was $5,545,000,000 and their reve­

Utility rate cases, as in the past few years, required a major portion of the commission I s attention. The 38 cases before the PSC during the fiscal year was the second high­est in commission history, exceeded only by the 51 cases during the previous fiscal year.

As long as the economy continues to drive utility costs upward, the number of rate cases is expected to continue at or near the level experienced during 1971-72.

Of the rate cases decided during the fiscal year, the commission allowed the amount re­quested in only three. Less than the pro­posed increase was granted in 13 cases and in one case the entire amount requested was denied. Four rate proposals were with­drawn during the fiscal year and 17 were pending as of June 30, 1972.

Utility rate increases filed with the com­mission can be suspended for a maximum period of 10 months to allow time for investiga­tion and hearings. The PSC staff, which represents the people of Missouri in pro­ceedings before the connnission, uses this time, as do the company and intervenors in the case, to prepare and submit evidence, conduct cross-examination and present final arguments.

Missouri railroads were permitted during the fiscal year to raise rates by 2-1/2 percent on intrastate shipments, which corresponded to an increase granted by the Interstate Commerce Commission on interstate traffic. Upon protests from interested parties, the commission suspended that portion of the increase that would apply to carload lots of some farm products and fertilizers.

Earlier in the fiscal year, increases of 18 to 20 percent on those same classes of products had been allowed following suspen­sion in earlier cases. They also matched ICC raises. In allowing the higher rates,

I the commission said the railroads I revenues were increasing, but operating expenses were climbing at a greater pace.

I I

Similar rising costs were being experienced by truck firms in Missouri, who also re­quested higher rates. In February, 1972,

I household movers were allowed a 10 percent increase in rates, half of the amount they had requested. The commission permitted the

I proposed 20 percent increase in packing and other fees to go into effect. General·com­modities carriers were granted an increase by the commission that averaged 8.64 percent and corresponded to' a rate hike approved by the Interstate Commerce Commission.

Dump truck operators, citing rising costs and expenses, filed a request for a 40 per­cent increase that was pending at the end of the year. In November, 1971, an interim dump truck increase of .14.6 percent for construction work and 5 percent for most other hauling was made permanent by the

I PSC.

After the close of the fiscal year, the PSC was certified by the Federal Price Commis­sion to make determinations as to whether

I rate increases meet the criteria of the Economic Stabilization Act of 1970. As a result of the certification, Missouri com­panies no longer have to submit increases to the Price Commission for approval, but the commission must show in each order that

I . price regulations have been adhered to.

The Transportation Division includes the en­forcement, insurance, license and records, operating rights, rates, and audits sections. There were 228 bus companies, 26 railroads, one railway express firm, and ?, 546 truck companies under PSC jurisdiction during the fiscal year.

The examiners al­so perform research for the commissioners, pa:t'ticipate in conferences on the applica­tion of PSC laLJ and W1'i te proposed or revised commission rules as .regulation cha.nges.

A precedent-setting directive was issued by the commission in May, 1972, that estab­lished strict standards of conduct designed to remove the commission and its employes from any contact with the public relations activities of companies under its jurisdic­tion. The directive forbids commission mem­bers and employes from accepting gifts from regulated companies and forbids acceptance of meals ,. gratuities, goods, services, or travel of any kind. Commission members, employes and the regulated companies are required by the directive to file monthly reports of contacts concerning PSC business.

The five commissioners said in issuing the ruling that they and the PSC employes must maintain a completely neutral stance. Their neutrality must be completely apparent to the public so all citizens will realize cases are judged on their merits, and that the primary concern of the PSC is the pub­lic interest.

Members of the pUblic made greater use of the PSC than in the previous year. The num­ber of contacts with the public increased, as did the· participation of citizens in cases before the commission. Phone calls and letters regarding complaints and re­quests for information about utility mat­ters totaled. 13,704, compared with 11,703 in the preceding year.

In four rate cases -- Southwestern Bell Telephone, Union Electric, Capital City Tel­ephone, and Midstate Telephone -- the com­mission held additional hearings at which interested individuals could testify in re­gard to service or other matters involving the utilities. The commission in the South­western Bell and Union Electric cases went to Saint Louis in order that the hearings could more conveniently be attended by the companies f customers. Capital Ci ty and Mid­state customers are located in or near Jef­ferson City.

The commission has always tried to take as much evidence as is practicable and to al ­low as many persons as possible to testify. It has frequently gone to other cities to conduct hearings, but is now increas ing its exposure throughout the state and attempt­ing to obtain a broader view of consumer opinion, particularly in rate cases.

In addition to its work· in Missouri, the commission represents the people of Missouri in cases before federal agencies or before Congress or at conferences on regUlation. The commission intervened in one Interstate Commerce Commission case and two·Federal Power Commission cases during the 1971-72 fiscal year. During that period there were 12 cases pending before the ICC and 16 pend­ing before the FPC in which the Missouri PSC was engaged.

A good indicator of the work of the commis­sion during the year is the time spent in the hearing room, which totaled 1,088 hours and resulted in 34,766 pages of transcript, a sharp increase from 929 hours and 29,170 pages in the 1970-71 fiscal year.

Cases filed with the commission for the fiscal year totaled 2,199, an increase of 434 over the total of 1,765 in the previous year. Hearings were conducted in 911 cases, up from 819, or an increase ot 92. The num­ber of orders issued by the commission was 7,545, or 1,151 greater than during the preceding year.

Nineteen appeals were brought on commission decisions and 12 appeals brought prior to the fiscal year were closed.

actions for declaratory judgments. Five formal opinions were issued by the general counsel in response to specific requests and Icountless informal opinions were offered. Over 1,100 letters were sent by the general counsel's office during the year. I Railroad, truck, and bus tariffs and sched­ules filed with the commission in the period I of this report totaled 7, 045, up from 6,935 in the previous year.

I For failure to comply with. commission re­quirements. the permi ts of 458 carriers were revoked during the year, compared to 238 in I the previous year. Inspectors of the en­forcement section drove 130,000 miles in the performance of their duties, contacting I2,950 motor carriers. The' number of con­tacts was down from 4,107 in the preceding year, but the number of safety inspections Imore than doubled, from 2,215 to 5,479. Of the vehicles inspected, 141 were taken out of service until defects were corrected. I Investigations .of unlawful operations to­tal ed 361, compared with 398 the year before. IInspectors investigated 170 accidents and

\made 172 checks of bus stations for clean­liness and safety. Insurance cancellations accounted for the suspension of 1,688 motor I carriers, compared with 1,663 in the 1970­71 fiscal year. Of those suspended, 1,041 were reinstated upon filing notice of proper I insurance.

The tariffs filed by utility companies to­taled 3,950, down from 5,030 in the previous year, a decline attributable to the fewer number of rate cases. On the other hand, the number of complaints and the time in­

. volved with the complaints increased as the pUblic has become more aware of the commis­sion's role. Complaints concerning utility rates and tariffs numbered 1,239, up from 989 in the previous year.

I There were 495 field investigations of com­plaints, 399 more than in the 1970-71 fis­cal year. The greater number of investi­gations is largely due to an increase in complaints concerning water and sewer com­

I panies that necessitated more than one in­vestigation.

regard to utility complaints, information requests, and tariffs, compared to 5,600 in the earlier year; while telephone calls, conferences, and other contacts dealing with utilities totaled 7,450, up from 6,480 in

I I The Engineering Department conducted 16 in­

vestigations of gas incidents,. one fewer than the year before, and made 85 gas safety inspections, 44 more than in the previous year. Each of the 21 gas distribution com­

I panies was checked several times during the year. Railroad safety field inspections numbered 1,031, an increase of 117 over the previous year.

ROBERT E. SEMB, Chief Accountant, and his staff conduat audits of regu~atedcompanies for use in rate cases and other proceedings before the commission. The Accounting De­partment reviews annua~ reports filed by the companies and aLso perfovrns comp~ia~e au­dits, specia~ investigations, and statis­tica~ studies.

It is anticipated that during the 1972-73 fiscal year, work will be completed on a uniform standard of construction and main­tenance of the supply and communications systems of electric and telephone companies.

The Accounting Department conducted 37 au­dits and examinations, 12 of which were major audits. in the 1971-72 fiscal· period. The department is presently working on 10 audits and examinations that are expected to be completed during the current fiscal year.

The information obtained in these audits and examinations is used by the commission staff to determine the original cost of the property used in public service and the financial condition of the utilities.

Securities wi th a total value of $981,503,817 were issued during the 1971-72 fiscal year by utilities under PSC jurisdiction. An authority fee is paid the commission after it examines and approves utility securities issues. The reason for the issuance of $847,404,400 in securities was the refund­ing of outstanding indebtedness. The to­tal of $134,099,417 in securities remain­ing represented new capital securities. The types and amounts of the securities are shown in Table A on Page 14.

The money from which the Public Service Commission budget is appropriated is ob­tained from the regulated companies, thus making the PSC one of the few self-support­ing government agencies. Revenues from the assessment of utilities goes to the Public Service Commission Fund. while receipts from motor carrier license stickers are depos­ited in the State Highway Department Fund.

The General Assembly appropriates the PSC budget from these two funds. If there is a balance in the PSC Fund, it is carried over to the next year, while any remainder in the Highway Department Fund is absorbed into general highway funds. Authority fees and miscellaneous fees are credited directly to the state general revenue fund.

The utility assessments, which are subject to commission approval, are allocated on the basis of the companies' gross revenues during the prior .year. The assessments for the 1972-73 fiscal year were $1,600,820, compared with $1,350,000 for the previous fiscal year. The assessment by types of utility is shown on Table B on Page 14.
