AN ORDINANCE CREATING TRUNK SEWER SPECIAL ASSESSMENT DIS1'RICT NO. GA-J(COMMONLY KNOWN AS THE OLD GJRDWOOD TRUNK IMPROVEMENT DISTRICT), A/lroDETERMINJNG TO PROCEED WITH THE PROPOSED IMPROVEMENTS THEREIN.

THE ANCHORAGE ASSEMBLY FINDS THAT:

A. The Municipality has been petitioned to create a specialassessment district for the construction of trunk sewer iolprovementsdescribed in paragraph "CO below, within the area described ir.: paragraph"D" below.

B. The petition to create the special assessment district has beensigned by sufficient and proper owners, and has been filed with theMunicipal Clerk.

C. The trunk sewer improvements include all engineerinlJ, design,piping and appurtenances, needed and/or required, to provide trunkfacilities to serve the area described in paragraph "0" below and asshown on the attached map.

D. The trunk sewer improvements described above are necel;sary, andwill benefit the following described property:

E. The total estimated cost af the proposed trunk: sew'~r improve-ment is $692,700.

NOW THEREFORE, THE ANCHORAGE ASSEMBLY ORDAINS:

Section 1. There is established Trunk Sewer Spec:ial .~ssessmentDistrict Number GA-3, consisting of the area described in pari!graph "D"above.

Section 2. The Municipality shall proceed with the prop1)SecJ trunksewer improvements as described.

Section 3. An account shall be kept of all costs clf thl! proposed

improvements.

Section 4. After the improveJl\ents have been completed, and thecost$ of the improvements known, assessments for the total CCISt of thetrunk improvements will be levied 111hen connection to the tt"\;lnk systemby either a Lateral Improvement District (LID), a Levy upon <:onnection(LUC), or a Special Agreement is made.

Section 5. The authorized percentage of the cost, or rate to beassessed against the property in 1~he district, shall be computed inaccordance with the Municipal Code and Wastewater Utillty Tariff, ineffect at the time the assessment roll is approved by the Municipal

Assembly.

Section 6. Payment of the pr-o-r-ata share of the cost to each lotor parcel shall be made in accoJ:clance with the Nunicjpal Codes andAnchorage Wastewat..J: Utility Tariff in effect at the time the MunicipalAssembly approves the appropriate a6sessment roll.

Section 7. It is made a mattj~r of record here that the assess-ments hereinbefore described are iJC1tended to provide the first costs{capital costs} of sanitary trunk and appurtenances within and outsideof the confines of this trunk se~'er district. These costs may besupplemented by lateral sewer charges, downstream bezlefit charges,sewer ser;vice charges and other appl~opriate levies from time to time asmay be J:equired to complete the comprehensive sanitar;y sewer progJ:amnow proposed.

Section 8. This trunk ordinance does not create a lien to proper-ties within, or adjacent to, the boundary described in paral1raph "poabove.

Section 9. The construction of this trunk improvE,ment districthas been partially funded by a direct le9islative approJ~riatLon, aka,Senate Bill Number 183.

SECTION 1. The sanitary se~er improvements authorized in ordinance AD94-119 have been completed and costs for the improvements computed. Sanitarysewer assessments are levied against the property benefited by said irnprovementsas set forth on the attached assessment roll.
