  • In the 70s, 80s and early 90s, Old Ikoyi was mainly a Government Reserved Area, dominated by sin-gle unit bungalows and one sto-rey buildings on large plots of land (3,000sqm and above). But all that has changed; influenced by the massive sale of Federal Government landed properties in the area over the last two decades. Also, the rising prices of plots and procedures need-ed to perfect land title documents in Old Ikoyi has led to a situation where developers have to go as high as they can or add more units to their devel-opments on these large plots of land in other to get reasonable returns from their investments.

    The recently released approval or-der for buildings in Ikoyi by the Lagos State Government has made it possi-ble for developers to go as high as 30 floors and also build up to 15 apart-ment units on a 1,000sqm of land. The developers have been respond-ing effectively to the gesture and the skylines and face of Old Ikoyi over the last two decades have changed enormously. A recent check on some of the newly completed and ongoing projects in the area got me really fas-cinated by the ingenuity of modern day Ikoyi developers. There is a com-petition that is translating into excel-lence amongst the developers.

    For example, Hotels of interna-tional standard are currently being developed in the area. One of them is the Transcorp Hilton Hotel on Glov-er Road, opposite Lagos Prep School. The new Transcorp Hilton, Ikoyi is to come with a minimum of 300 rooms and is jointly owned by Transcorp Ho-tels Plc. and Heirs Holdings. Other ho-tel developments include the one by Chelsea Hotel, Abuja on the Osborne Road and Alfred Rewane Road junc-tion and that of Chief Sunny Odogwu at the exit point from Inner Crescent to Gerrard Road whose construction is presently stalled. When eventually completed, the impact of these mas-sive developments on the character of Old Ikoyi can be predicted. Already, hotels like Southern Sun and Wheat Baker have continued to significantly impact on the traffic situation of their immediate environment when host-ing events.

    In-between Modupe Alakija Cres-cent (formerly Ikoyi Crescent) and Inner Crescent are several other ongoing mammoth developments in Old Ikoyi. Dayspring Properties Limited owned by Mrs. Folorunsho Modupe Alakija now revered as the richest black woman on earth has an ongoing gigantic development on Modupe Alakija Crescent, while Chartwell Africa Limited and Project

    Scope Limited also have massive res-idential developments going on in the area.

    The number of completed and ongoing commercial and mixed use high-rise developments have also increased in Old Ikoyi. There are cur-rently about ten new developments on and off Alfred Rewane Road (for-merly Kingsway Road); they include: Heritage Mall on 15 floors, Kingsway Towers on 16 floors, Alliance Place on 12 floors, Temple Place on 15 floors, Glover Towers on 12 floors and the BAT Rising Sun Towers on 12 floors. Apart from helping to change the skylines of Old Ikoyi, these develop-ments are expected to put extreme pressure on public utilities in the area.

    On the high-streets of Gerrard and Bourdillon are several ongoing mammoth residential developments. At the junction of Gerrard Road and Oloto Road is the ongoing re-con-struction of a ten storey building by Cobblestone Properties and Estates Limited, while the projects on Bour-dillon Road include: a ten storey lux-ury residential apartment by Eltees Properties Limited, a residential de-velopment known as Gordon Wilson Court by Cadwell by McDonald Road and the 25 storey No. 4 Bourdillon by Kaizen Properties Limited and El-Alan Group; expected to be the tallest tower in Ikoyi when completed.

    Cooper Road is also expected to have a total change of face with sev-eral ongoing and newly completed developments. They include: Oak-wood Place on Plot 23 Cooper Road

    by Heroes Properties Limited with construction work by HFP Engineer-ing, a 6floor residential development by Kaiser Properties Limited, a resi-dential development by Jubilee Gar-den Limited and another 6 floor resi-dential development being marketed by Cortts Real Estate Limited. The trend is unending and with more of these kinds of developments expect-ed to continue springing up as the term Old Ikoyi may soon change to New Ikoyi.     Looking For Low-Budget Properties?here are the best locations to put your money in Lagos!

    Predictions made so far on the Lagos prop-erty market in 2017 may have not been too good. However, in contrast to these pessi-mistic views, a number of real estate pundits are of the opinion that investors should keep an eye on some outskirt locations of Lagos because of the possibilities of their land prices rising sub-stantially before the end of the year. Here are the locations and factors identified for the promising investment outlooks.

    BADAGRYSince the start of the Lagos-Badagry Expressway expansion project from a dual carriage way to ten lanes with bus rapid and mono rail tracks, the de-mand for land in the ancient city bordering Nigeria with many of the other West African nations have increased significantly. Also, the announcement by the Lagos State Government towards the end of 2015 that the first phase of the project (Eric Moore in Surulere to Mile 2) has been completed also went a long way in clearing the doubts from the minds of investors who were skeptical about the visibility of the project. Now that the pace of work on the road has increased as a result of better cooperation between the APC led Federal Government and the Lagos State Government, there are high hopes that the entire project would be completed in a good time. While a plot of land in the easily accessible parts of Badagry like Oko-Afo, Mowo, Aradagun, Ibereko and Ajara currently sell for between N500, 000 and N1million, plots in the not too accessible areas like Ilado, Imeke, Iworo-Ajido and Epe sell for between N200, 000 and N400, 000. With trav-el time from Badagry to the main parts of Lagos expected to reduce from the current two to three hours to less than forty-five minutes, demand for plots in the area are expected to continue to rise and the assumption is that current land prices will also react accordingly. Beyond the expansion of the expressway, the plan by the Lagos State Gov-ernment to build a world class Tourism Center and a Deep Sea Port in Badagry is also expected to pos-itively impact on land prices in the area.

    IBEJU-LEKKIFrom a Free Trade Zone to a Deep Sea Port, Refin-ery and International Airport, many of the ongo-ing/upcoming landmark developmental projects earmarked for the Lekki axis by the Lagos State

    Government are located in the Ibeju-Lekki axis. As real estate developers start to position them-selves in the area to take a reasonable share of the real estate market that will be created for the area when these projects are completed; land prices in the opinion of pundits will naturally start to rise in anticipation of these developments. Apart from these projects, a lot of would-be Lekki real estate investors that have been priced out the main Lekki property market where land prices currently stands at between N50million and N200million will likely be moving in large numbers to Ibeju-Lekki where average land prices currently stands at between N1million and N7million. The recent announce-ment by Governor Akinwunmi Ambode that a fly-over bridge will be constructed at Ajah junction to ease the traffic bottle-neck experienced by com-muters transiting from the main parts of Lekki to the Ibeju-Lekki and Ajah axis have also been tipped by pundits to have positive effects on the demand for land in the area and by extension prices in the area in 2016.

    IKORODUThere is no gain saying that Ikorodu is today the most densely populated outskirt location of Lagos. Rising from less than N500, 000 to between N2mil-lion and N4million over the last decade, real estate pundits are of the opinion that average land prices in Ikorodu will continue to rise in 2016 as a result of improved transport facilities. Recently, Governor Akinwunmi Ambode commissioned the expand-ed Mile 12-Ikorodu Road with over 400 Bus Rapid Transit (BRT) fully air conditioned buses. Another project that will increase the demand for land in Ikorodu according to real estate pundits is the pro-posed 4th Mainland Bridge to link Igbogbo-Baiye-ku in Ikorodu to Badore-Ajah, in Lekki. Expected to bring Ikorodu and Lekki closer to each other in terms of travel time, a start of the project this year is expected to push up the investment prospects of Ikorodu. There is the wide belief amongst sav-vy real estate investors, that at completion, the 4th Mainland Bridge will not only bridge the travel time but also the prices of properties between Le-

    kki and Ikorodu.

    LAGOS-IBADAN EXPRESSWAYIn what is now known as the Lagos-Ogun Property Market, locations along the Lagos-Ibadan express-way are the most active. Over the last decade, the demand for landed properties in areas like Isheri, Arepo, Magboro, Ibafo, Mowe-Ofada-Papalanto and Shimawa all along the Lagos-Ibadan express-way has been phenomenal. One of the reasons ad-duced for the high demand, is their proximity to prime real estate locations in Lagos like Magodo GRA and Ikeja. The demand for plots in these are-as are however expected to increase significantly this year as expansion work on portions of the La-gos-Ibadan expressway linking them to the main parts of Lagos get completed. The assumption is that with improved travel time, the Lagos-Ibadan expressway property market would become more attractive to potential investors. The average price of land in the area currently stands at between N500, 000 and N7million.

    ALAGBOLE-AKUTEAlthough by geographical delineation, the Alag-bole-Akute property market is located in Ogun State, the realities on ground shows that 90% of person residing in the area work and have their eco-nomic life directly connected to Lagos. On a traffic free day, travel time from the Alagbole-Akute axis to a place like Ojodu-Berger Bus Stop is less than fifteen minutes; a major reason given by pundits for the high demand for landed properties in the area by savvy real estate investors and first time home owners. However, during peak periods, trav-el time from the area to the same Ojodu-Berger Bus Stop in most cases gets to between one and two hours. That may soon end as the Ogun State Government has commenced the construction of a dual carriage way and bridge to connect the area to the Ojodu-Berger axis. The assumption is that, when the road project is eventually completed at the latter part of the year, land prices which cur-rently stands at between N2million and N5million could double in response to increased demand.

    Prime property prices in central London rise quarter on quarter for first time since 2014

    Optimism and activity is im-proving in the prime central London property market with prices up 0.7% quarter on quarter in the first three months of the year but still down 0.5% year on year.

    The 0.7% uplift in prices was the first quarterly rise since the third quarter of 2014 and marks a turning point for the market, according to the latest residential report from real es-tate firm JLL.

    The research also shows that the sub 2 million market has been the most robust throughout the past two years with the stamp duty reforms less impactful at lower price points. This continued during the first quar-ter of 2017 with prices up by 1.8% in this sector of the market.

    In the 2 million to 5 million sector prices increased by 0.8% and were up by 0.1% between 5 million and 10 million. Properties above 10 million, however, continued to fall, with prices down a further 1.3% in the first quarter.

    However, whilst prices have ris-en, sales have fallen, down by 17% quarter on quarter, and 44% year on year. The dramatic year on year falls can partly be attributed to the stamp duty changes that added 3% onto additional homes brought in during April 2016 which created a higher volume of sales in the first quarter of 2016, the report points out.

    We are encouraged by the activi-ty we have witnessed throughout the first quarter. Transactional volumes remain relatively subdued, though, particularly at the top end of the mar-ket, said Richard Barber, director of JLL sales.

    However, sentiment is certainly improving. Provided the after effects of Article 50 are not too dramatic, we expect to see a steadily improving outlook over 2017, especially once the general election is over, he add-ed.

    In the lettings market rents have fallen 1.5% quarter on quarter and are down by 8.5% year on year but sale were up by 5% year on year and one and two bedroom apartments remained the most sought after property types with demand par-ticularly strong for these units within new developments.

    The data also shows that demand at the upper end of the market, above 3,000 per week, has been strong for the past year and increased further in the first quarter. The report suggest that many of these renters are using the lettings market as a temporary stop while waiting to buy their ideal property in the sales market.

    It adds that higher levels of stamp duty have accelerated this trend with

    purchasers no longer happy to make multiple moves in the sales market, preferring to bide their time in the lettings market.

    Given the ongoing uncertainty, particularly around Brexit and the triggering of Article 50, it is encour-aging that transaction levels have improved in early 2017. This boost to the market has helped to put many investors minds at rest for the time being at least, said Lucy Morton, JLL head of residential agency.

    It is undeniable, however, that Brexit continues to have a detrimen-tal effect on the prime central Lon-don lettings market. Tenants now firmly hold the upper hand despite the availability of properties dimin-ishing, she explained.

    The two and three bedroom flat markets presently have the greatest oversupply of available properties but we expect the escalating pref-erence for corporates to house sen-ior executives in pied--terre apart-ments, rather than to relocate whole families into larger flats and houses, will help to rebalance this segment of the market during the course of 2017, she added.

    The start of the year has certainly been encouraging, but further rea-lignment between supply and de-mand is needed before the market returns to a firmer footing, she con-cluded.

    Have You Been Priced Out Of Top Lagos Mainland Estates?here are suitable and cheaper alternatives!

    IKEJA GRAAs one of the oldest Government initiated estates in Lagos, land prices in Ikeja GRA are currently the exclusive preserve of the high and mighty in the society. A plot of land in Ikeja currently sell for between N170, 000 and N200, 000 per sqm (N170million-N200million for 1,000sqm land). However, for prospective land owners who have been priced out of the Ikeja GRA land market but want something not away with a very slim budget, a suitable al-ternative location is Mende in Maryland. Located on the stretch of land from the entry point of the Maryland Bridge/ Tunnel when coming from Anthony Village to its exit point at the Odo-Iya Alaro Canal en-route Ojota, Mende in terms of proximity to Ikeja GRA is less than five minutes drive through Mobolaji Bank Anthony Way during traffic free periods. A plot of land in Arowjobe Estate which is the most popular estate in Mende is between N30, 000-N35, 000 per sqm (N30million-N35million for 1,000sqm land), while in the less developed parts of Mende a plot of land could still sell for between N10million and N15million. It is however important to note that many parts of Mende is waterlogged and landowners must be ready to commit some amount of money for sandfilling before being able to build on them. Infra-structure within Mende like road network and water supply is also at an av-erage level.

    OGUDU GRAOgudu GRA like most of the schemes created by the Lagos State Government in the central parts of the Mainland has over the years grown to become the choice location for the affluent in the society. This is evident in the price of land in the estate which currently sell for between N120, 000 and N150, 000 per sqm (N120million-N150million for 1,000sqm land). However, for persons looking for cheaper plots of land in locations not far away from Ogudu GRA, several options abound in some the estates within the Gbagada axis. Some of the estates include Sholuyi, Yetunde Brown, Medina and Oke Alo. In these estates a plot of land currently sell for between N35,000 and N40, 000 per sqm for already sand-filled plots (N35million-N40million for 1,000sqm land); N15,000 and N20,000 per sqm for waterlogged plots (N15million-N20million for 1,000sqm). Unlike Ogudu GRA which has fantastic road network, layout and security arrange-ment, the cheaper estates in Gbagada are still struggling to fix their infrastructure challenges.

    OMOLE PHASE 1Omole Phase 1 is the location of Square Ville the mansion home of pop-ular Nigerian hip-hop acts P-square. The estate is also the location of the homes of several other Nigerian celebrities; amongst them Otunba Wasiu Alabi Pasuma. Apart from the guys in the show-biz world, many influential Nigerians reside in Omole Phase 1. A plot of land in the estate currently sell for between N90, 000 and N100, 000 per sqm (N90million-N100million for 1,000sqm land). The nearby locations to Omole Phase 1 where cheap-er plots can be bought are in the Ojodu-Abiodun area down to parts of Berger Bus Stop. In estates like Budland, Yetunde Morgan, Goodland and River Valley, a plot of land still sell for between N10, 000 and N25, 000 per sqm (N10million and N25million for N1,000sqm land). While infrastructure in Omole Phase 1 like road, water supply, drainage channels and security arrangement in Omole Phase 1 are top-notch, those of the cheaper estates in Ojodu-Abiodun and Berger are on the average level. Plots in some parts of this estates are also waterlogged and will require sandfilling before houses can be constructed on them.

    MAGODO GRA SHANGISHA Magodo GRA Shangisha along the Lagos-Ibadan expressway just after 7up Bus Stop almost overlooking the Lagos State Secretariat in Alausa is one of the top and extremely expensive estates on the Mainland. Recent findings show that plots of land measuring 1, 000sqm in the estate are now being advertised for as high as N140million (N140, 000 per sqm). While a few real estate pundits have called it unrealistic and unsustainable, the facts on ground show that Magodo GRA is still one of the top choice locations for prominent Nigerians and Lagos Big Boys. The rising price of land in the estate have also been attributed to shortage in supply of virgin plots amidst increasing demand. However, ten minutes drive further down the Lagos-Ibadan expressway are locations where would-be land owners who have been priced out of Magodo GRA will be spoilt for choice. In Isheri North which has a Lagos State and Ogun State side, a plot of land still sells for between N7, 000 and N15, 000 (N7million-N15million for 1,000sqm land). Close to Isheri North is Arepo which strangely has land prices sell-ing at higher prices to those of Isheri North considering both locations proximity to Lagos. The reason for that is however not farfetched, Arepo because of its construction-friendly topography is today more developed than Isheri North and has a higher number of privately developed residen-tial estates.

    Owning a plot of land in some of the top estates in Lagos Mainland has become as herculean task. With average land prices in some of these estates going for as high as N200milion per plot, would-be land owners may now have no choice but settle for alternative nearby locations to their dream estates. Presented in this article is a com-plete review of land prices in the most expensive estates on the Mainland as well as those of the relatively afforda-ble locations around them.

    Understanding Nigerias Law On How You Can Legally Own Land!

    Since 1978, the major legisla-tion regulating land acquisi-tion within the country has been the Land Use Act of 1978 which states that all land in a State is to be held in trust by the State Gover-nor for the benefit of all Nigerians. By law, foreigners may also acquire land wherever it is located in the country from either the State governments or from other holders.

    Since the Land Use Act confers all land to the respective State govern-ment, a prospective buyer can apply to the Governor of the State for a Cer-tificate of Occupancy which is for a period of 99 years. However, The Fed-eral Government of Nigeria also has power to grant Certificate of Occu-pancy in respect of lands comprised in the Federal Capital Territory (i.e., Abuja and its designated environs), or vested in the Federal Government but located in States territories.

    Local Governments may also grant customary Certificate of Occu-pancy where the land in question is not in an urban area. All you have to do is apply formally to the particu-lar Government, or any appropriate agency, for the issuance of a right of occupancy which is called the Certifi-cate of Occupancy

    LAND HOLDING INTERESTS UN-DER THE LAND USE ACT

    Two classes of people are recog-nized by law as rightful owners of land. The first class are people who have been granted rights of occu-pancy by the State, Local or Federal Government. The second class con-sists of those who held interests in land in Nigeria before the Act came into force. According to the Act, a person in this category continues to hold those interests in the land as if a right of occupancy had actually been granted to him by the Government. Hence, a prospective investor can ac-quire land from any of these classes of holders, but each case presents its own peculiarities. If you are acquiring

    land from someone who was grant-ed a Certificate of Occupancy, an in-vestigation of the previous holders title to the land would usually be conducted for verification.

    If however the owner of the land falls into the second category of peo-ple who had their land before the Land Use Act was enforced, the in-terest of that holder will be based on one or more of the different systems of land tenure which existed and op-erated in Nigeria prior to the Land Use Act. Where the land was held under customary law, for instance, proof of title would not normally be by the production of a document. Even where the received English ten-ure system applied, the production of documents alone would not suffice as the relevant land registries would require to be searched, amongst oth-er things hence the need to get assis-tance from a legal source

    If you as the one who wants to acquire the land is satisfied with the current holders title, the next step would be the preparation of an ap-propriate legal document transfer-ring the title to you or granting you a lease over the property. However, it is important to note that you need the consent of the State Govern-ment before the transaction can be valid. Finally, the document would be stamped and registered and the transfer of interest has effect from the date of registration. Having said this, worthy of note is the fact that by virtue of the Public acquisition of land Law, the State government may acquire land compulsorily for public purpose from individual land owners subject to the payment of compen-sation to such landowners.

    Hence, the notice of land ac-quisition by the government must be served to the land owner as the courts have consistently held that non service of the Notice of Acqui-sition would render the acquisition invalid. It must also be noted that

    the acquisition of private individuals interest in land can only be done by the government for public purpose as any acquisition not done for pub-lic purpose will be declared invalid by the courts on being challenged. Furthermore, as the Notice of acqui-

    sition of land represents a construc-tive notice to the whole world, there is need for members of the public desirous of purchasing land to con-firm through a solicitor, whether the land/property they are purchasing is under government acquisition.

    The Hanging Gardens of...Birmingham?

    British firm Archi-tects of Inven-tion has drawn inspiration from the Hanging Gardens of Babylon, one of the Seven Wonders of the Ancient World, for its lat-est project. Envisioned for Birmingham, UK, the Garden Hill proposal consists of two wooden residential towers with an interesting stepped design and some sus-tainable features.

    The Garden Hill pro-posals two connected towers would rise to 25 stories, with a total floorspace of 38,500 sq m (414,410 sq ft). They would include around 500 residences, 60 per-cent configured as one bedroom units, and 40 percent with two bed-rooms.

    The units would measure 40 - 75 sq m (430 - 807 sq ft), but Architects of Invention would try to mitigate any lack of space by providing multiple shared and pri-vate garden terraces at every level, plus a spacious rooftop garden. In addition, novel shared facilities include music recording studios and small rental units for startups. The brief also calls for between 120 - 200 car parking spaces and retail spaces on street-level.

    The building would be constructed from cross-laminated timber (CLT), like some previous wooden towers weve reported on. Both elec-tricity and hot water would be supplied by roof-based solar panels and the architects make mention of excellent insulation and the use of pas-sive ventilation.

    If it actually went ahead, the project would reference Birming-hams multiculturalism nicely and also fit in well with the citys exist-ing high-profile architecture, such as Mecanoos Library of Birmingham and Future Systems award-winning Selfridges Building (captured here by New Atlas photography expert Simon Crisp).

    That said, while there have been talks between Architects of Inven-tion and a Chinese private equity fund, its still a concept with no imme-diate plans to build. Its probably also worth pointing out that nobody really knows what the Hanging Gardens of Babylon actually looked like (assuming it indeed existed), so dont think of this as a copy of the orig-inal in any way, just inspired by it.

    The proposed budget for Garden Hill is 70 million (roughly US$90 million). Well let you know if anything ever comes of it.

    Bridge Gap in Magodo Land Prices: For over two decades, land prices in Magodo Shangisha (Phase 2) and Mago-do Isheri (Phase 1) have been miles apart. While the former commands price tags of N100million and above, the latter currently have its price tag at a lit-tle over N60million. The fact that Magodo Shangisha used to be better and easily accessible when compared to Magodo Isheri which required travelling through the then horrendous traffic of Ojodu-Berger Bus Stop was always the reason giving for the price gap of the two estates despite their carrying of sim-ilar names and existing as government schemes that are less than five min-utes drive apart when there is no traffic bottleneck. However, with Governor Ambodes regeneration of the Ojodu-Berger Bus Stop, real estate pundits say the price gaps between the two Magodos may soon be a thing of the past. The demand for land prices in Magodo Isheri will soon increase significantly as the fear of the traffic situation in Ojodu-Berger Bus Stop is no longer there. Governor Ambode has also done well to not only open-up Berger Bus Stop, he has gone ahead to improve the access road that goes into Isheri. All of these will soon make Magodo Isheri attractive to investors since it is even currently about half the price of Magodo Shangisha. Also, the fact that there are now fewer virgin plots in Magodo Shangisha will help to push up demand in Ma-godo Isheri where there are still relatively available virgin plots Segun Olani-yonu an Estate Surveyor and Valuer who resides in Magodo Isheri explained.

    Exodus to Lagos-Ibadan Expressway Axis: It is already good news for those living in areas along the Lagos-Ibadan ex-pressway axis. Areas like Isheri North, Arepo, Magboro, Ibafo, Shimawa, Pa-kuro, Mowe-Ofada down to parts of Papalanto and Shagamu have already had their traffic time to parts of Lagos reduced significantly as the traffic in Ojodu-Berger Bus Stop is no more.     Rise in Akute-Alagbole Axis Property Prices: It is now almost a known fact that about 40% of the people that cluster at Ojodu-Berger Bus Stop during peak traffic periods going to their different places of Business endeavor in other parts of Lagos reside in the Akute-Alagbole axis. A recent check on listings in these areas show that it is now almost impossible to get a standard plot of land in the main parts of Alagbole, Akute and Ajuwon for N5million.

    General Rise in Rents/Property Prices: For all the areas that have been mentioned as possible impact areas for the revamped Ojodu-Berger Bus Stop, every pundit I have spoken to have agreed that rents in these areas would soon be on the rise. People are going to be moving into all these areas in large numbers and in droves too, they all seem to predict. The assumptions are very clear; the laws of economics (demand and supply) will set in. The higher the demand, the higher the price. The prop-erty market of these areas seem to satisfy all classes of demand (high-end, mid-end and low-end). There will be increased activity in these areas and the future definitely looks good for those who can take the bull by the horns.

    5 Impacts Ambodes Ojodu-Berger Reform Will Have On The Property Market!If the last time you visited Lagos was about two years ago, it is possible that you currently may not be able to easily identify the Ojodu-Berger Bus Stop (the first entry point to Lagos). Whether we want to or not, our very nature is woven to rely on relationships and in the course of our lives, one of the relationships we will have is the landlord-tenant one. Un-fortunately, this relationship is one of the most controversial relationships in life. Its filled with issues, conflicts and disputes and are often not ami-cable resolved even where attempts are made to resolve them. The sensi-tization of people to the fact that the law can be used to deal with a lot of the problems characterized in this re-lationship has however turned things around. Especially the mediation ap-proach where a win: win situation is usually the objective.

    Once upon a time, a landlord could wake up one day and decide he wants the tenant out of his house; perhaps out of spite, perhaps because he needs the property urgently, per-haps because he has a better offer. Whatever the reason, it didnt matter. The landlord is the alpha and omega and the tenant at his mercy. Failure of the tenant to comply would often re-sult in a forced eviction. The tenant is forcibly removed from the premises with his or her things thrown out and sometimes, the tenants property is removed from the premises in his or her absence. Call it Jankara or OPC method, some landlords and quack agents have almost perfected this act of illegality. The trend has however been abated with the realization that such actions is frowned at by the law.

    Regardless of the type of occu-pancy, whether informal settlements, lease, rental accommodation, coop-erative housing or emergency hous-ing, or the type of housing or interest of a person in a house, all occupants are entitled to a measure of security of tenure which guarantees equal protection against intimidation, har-assment, threats and forced eviction without due process of law. This means that no landlord, whether in-dividual, a corporate organization or even the government, has the right to take matters into his hands by ejecting a tenant without resorting to the law. The landlord and Tenant re-lationship is guided by Law and both parties have their cover or protection against any untoward behavior of the other party in Law.

    As a tenant, it is your right by law to have adequate notice to quit if your landlord wishes to take posses-sion of his premises. No longer can the landlord come in the morning and ask you to quit by evening if he has not served the appropriate and due notice. Lawfully, the notice to quit is what puts an end to the term created by a tenancy and this is usu-ally stated in the tenancy agreement. Where it is not expressly stated, a

    weekly tenancy is terminated by a weeks notice, a monthly tenancy is terminated by a months notice and a quarterly notice is given to terminate a quarterly tenancy while a yearly tenancy is terminated by six months notice. The nature of a tenancy is de-termined by reference to the time when rent is paid or demanded.

    Some tenancy agreements have shorter or longer notices. Some even state that notices will not be given in the case where the landlord wish-es to eject the tenant. This is why it is important to read the tenancy agreement carefully before signing because the law honours agree-ment between parties, and in the case where you sign a lawful agree-ment that limits your rights, you will be bound by it. Claiming you didnt know holds no water because igno-rance of the law affords no excuse.

    In the case where the landlord takes you to court as a tenant, the court cannot eject you without hear-ing from you. This is because the amended 1999 Constitution of the Federal Republic of Nigeria states

    that all persons in the country have certain undeniable rights which in-clude the Right to Fair hearing. No person (tenant) can be tried in a com-petent court without allowing him to

    be heard. As a tenant, you also have the right to sue your landlord if he does not follow the due process of the law and forcibly throws you out.

    That is the determination of what building a house will cost you. Ordi-narily, it is a very good thing to have this and you will be required to even produce it for verification if you are seeking financing in funding the con-struction of your house. But if you are not required to present it probably because you are funding your struc-ture out of pocket, then this could help(motivate) or hinder(de-motivate) you depending on how your handle challenges.
