WHEREAS, the World Health Organization (WHO) declared the spread of the Covidl9 virus infection as pandemic. This prompted President Rodrigo R. Duterte to issue Presidential Proclamation Nos. 922 and 929 declaring a State of Public Health Emergency and a State of Calamity, respectively; WHEREAS, Section 16 of Republic Act No. 7160 also known as the Local Government Code provides that within their respective territorial jurisdictions, local government units shall ensure and promote health and safety and preserve the comfort and convenience of their inhabitants; WHEREAS, local community quarantine has been established throughout the country to impose stringent policies to mitigate the spread of the CoVID-19 virus in communities; WHEREAS, on August 31, 2020, the national government placed Davao Region under Modified General Community Quarantine (MGCQ) until September 30, 2020; WHEREAS, fishing is a major economic activity in the locality. Fish capture either during close and open season within Davao Gulf requires to entrepreneurial activities to include capture, marketing and selling within or outside the city; WHEREAS, the fish capture of juvenile fishes in the municipal waters needs to be managed not only during the Close Season in Davao Gulf from June until August 31 but the whole year round to give tuna and pelagic fishes such as mackerels, scads and sardines to spawn and let key fishing grounds to recover; WHEREAS, in time of good volume of catch, fisherfolks are given the option to deliver their catch direct to a bigger market in the nearby City of Davao; WHEREAS, the transport of fish catch for trading posts several risks tor health, security and economy especially in this time of national health crisis; WHEREAS, to protect the Samal fisherfolks in their day-to-day activities as well as ensure that the fishery industry is strengthened, it is imperative to provide strategies/mechanisms as the transitions to the new normal take place, still upholding the policies governing the local quarantine protocols for the safety and security of the Samalehos; Now, therefore, I, AL DAVID T. UY, City Mayor, by virtue of the power vested in me by law, do hereby order the following; SECTION t. GENERAL POLICIES. Effective immediately, transport of fish catch excluding juvenile fishes, and selling activities outside Samal Island either by land or through the seas shall only be allowed if the City Fish Landing Center cannot absorb the total volume of production as certified by the City Agriculture Office - CFARMD. 1.1Registration. All Fishermen and his Crews must be registered in the City' s Fishery Registry. Fishing shall only be allowed for Samal Island registered Fishing Boats/Fisherfolks. 1.2Minimum Health Standards. All Fishermen and his crews shall always observe the appropriate minimum health standards set forth by the City to prevent the spread of Covid-19 and ensure health and safety. 1.3No QR Code ID, No Activity policy shall be strictly implemented. All fishermen engagedin catching and selling of fish catch must have a valid QR Code ID and validIdentification Card to be presented upon entry to the City of Davao and vice versa.

1.4Issuance of Transport Permit. Prior to fish transport, appropriate permits shall be secured

at the City Fish Landing Center located in Pehaplata Wharf, Island Garden City of Samal.

1.4.1The payment of the auxiliary/porting fee as required under the existing CityOrdinance No. 2018-292 shall be made only to the authorized personnel of theCity Treasurer's Office.

1.4.2A porting/auxiliary transport permit shall be issued to a fisher folk / fish vendor whodelivers fishery products for local or export markets.

1.5Delivery. In the delivery of fish catch outside Samal Island, a maximum of three (3)persons to include the boat operator (sea) or the driver (land) transport shall be allowed.

1.6Designated destination points in Davao City. Pag-asa of Bankerohan and the Sta. Anawharf both in Davao City are the only designated trading areas of registered vendors.Delivery of fishery products other than the identified areas is prohibited;

SECTION 2. FISH TRADING ACTIVITY AT THE FISHING GROUND IS STRICTLY PROHIBITED. All Fishtraders (compradors) are not allowed to conduct his/her fish trading activity at the fishingground. All trading activities shall be done only at the designated City Fish Landing Center, FishPort or the Public Market.

SECTION 3: ANCHORING. Dropping of anchors anywhere other than the designated area isstrictly prohibited. To hold fast or secure a vessel in place either by using an anchor or by tyingon to a ny part of the reef is strictly prohibited. All fishing vessels shall utilize the mooring buoysand shall dock in the identified and installed barangay fish landing/docking area.

SECTION 4. UNREGISTERED SEA TRANSPORT. Any unregistered boat (of any type) shall not beallowed to ply anywhere in Samal Island to conduct fishing or any other activities. All personsand entities that would violate this provision may be subjected to criminal and/or administrativeprosecution, including impoundment of the boat and confiscation of fish catch, as may beapplicable under existing laws.

SECTION 5. IMPLEMENTATION. The City Agriculture Office-Fisheries Division in coordination with theTask Force Samal (TF-Samal), Philippine National Police (PNP), Philippine Coast Guard (PCG),LGU Fishery Law Enforcers (CAGRO-Fishery Division), Civilian Volunteer's Organization (CVO) andBarangay Officials are mandated to strictly implement the provisions of this Executive Order.

SECTION 6. SANCTIONS. Persons and entities found violating this Executive Order shall besubjected to issuance of citation ticket, imposition of administrative fines, confiscation of thetotal catch, and such other applicable penalties under the City Ordinance No. 2018-292 andother existing laws.

SECTION 7. SEPARABILITY CLAUSE. If any provision of this Executive Order is declared invalid orunconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

SECTION 8. REPEALING CLAUSE. All orders or issuances which are inconsistent with the provisionsof this Executive Order are hereby repealed or modified accordingly.

SECTION 9. EFFECTIVITY. This Executive Order shall take effect immediately and shall remain in fullforce and effect unless modified or earlier withdrawn for some valid grounds.
