(1) "Act" rneans the Bon1bay Prohibition Act, 1949;
(2) "bonded warehouse" means a place appointed by the ~:,t:'ite Government as a bonded wa.rehouse for the storage in bond

(6) "exporting place" means any place of India outside the State of Gujarat fron:1 which foreign liquor is to be brought into the State of

6. Procedure to be foUowed by the importer at the exporting pfa.ee.-As soon as the consigrnnent of foreign liquor to be imported is ready for despatch. frmn the exporting place, the importer, or his agerit shall obtain fron1 the excise officer at the exporting place a certificate in Fonn "Certificate-I" annexed to Part I! of the pass.

· Procedure for the Im.port
10, Importer to apply for import pass.-Any person who a licence or permit under the Act for the sale or possession of u,.,_,w,n made foreign liquor and who desires to import (hereinafter chapter refr:n-ed to as "lrnporter") any Indian -n1adc foreign liquor

· 11, Issue of pass.-(1) On receipt of the application made under rule 10, the competent excise authority shall make such inquiries as he may deem necessary and if he sees no objection he rnay-
(a) where the foreign liquor is to be imported is bond, require the importer to execute a bond, in Form C, with two sureties. for the payment of the ainount of duty leviable on the foreign liquor to be imported or a general bond, in Forn1 D which would rernaln in force for a period of three years. a!ongwith two sureties for the payment of a sum sufficient to cover the an10unt of duty leviable on the total quantity of frlreign liquor which rnay be imported by hixn fron1 time to tirne during the period of three years, and on the execution of the bond grant an in1port-in·bond pass in F'orm

Procedure to be followed at the exporting place. --As soon as the consignrncnt of foreign liquor to be in1ported is ready for despatch from the exporting place, the importer, or his agent shall obtain form the Excise Officer at the exporting place a certif\cate in the Form "Certificatc--2" annexed to Part IV of the pass.
13, Procedure in transit. -Pait IV of the pass and the certificate shall be sent a!ongwith the consignment while in transit and shall be produced for inspection on demand made by any Prohibition and Excise Ofllccr or Police Offker, not below the rank of a Sub-Inspector, or any Revenue Officer not below the rank of an Aval Karkun.

22. Application for export pass. -On receipt of such pennit, the exporter shall apply in Fonn G for an export pass, to the eoxnpetent excise authority alongwi1h the said permit.
23. Issue of export pass.-(1) On receipt of the application under Rule 22, the Co1npetent Excise Authority shall make such inquiries as he may deem necessary and if he sees no objection, require the applicant. if the Indian rnacle foreign liquor is to be exported in bond, to execute a bond. in Form H with two sureties f<x the payment of the duty and fees leviablc on the que.ntity of foreign liquor to be exported, and on the execution of such bond, grant him an export in bond pass in Forni I:

24, Issue of 1:ndian-mad~ foreign liquor for purposes of export.The exporter or his agent shall present Part IV of the export pass to the Officer--in--charge of the distillery, brewery or bonded warehouse from which liquor is to be exported. Such Officer shall, after comparing Pait IV with Pa1t III and the permit forwarded to hi1n under sub-rule (2) of rule 23, and if he sees no objection, issue the foreign liquor from the distillery, brewery or bonded warehouse. He shall seal with his official sea! eaeh receptacle or package containing foreign liquor to be exported which shaII also bear, for the purpose of identlfication the nurnber of the export pass, the serial number, of the reeeptacle or package the kind, quantity and the strength of the foreign Liquor contained therein, the narne of the importing place and the narne of

Procedure fc· the Export of Duty Paid Imported Foreign Liquor
26. Exporter to apply for export pass.-(1) .Any person who holds a licence or permit under the i\cl for lhc sale or possession of duty paicl imported foreign liquor or is pennittecl to possess or se11 such foreign liquor under the i\ct and who desires to export: duty paid imported foreign liquor (hereinafter in this chapter refened to as the "export") shall apply in Form G for an export pass to the cornpctent excise authority.
(2) Such application shall be acccn11paniecl by an irnport pass or no objection ccrlilkatc granted by the competent excise authority of the irnporting place.

(2) Nothing in this rule shall affect any fu.rther liability of the exporter to punishment under any of the provisions of the Act for the failure to deliver the full quantity of foreign liquor m.entioned in the export pass or for the breach of any of the rules in this Chapter or any condition of the export pass.
