Please refer to the information below for further instructions related to your particular hearing: If this is a hearing to consider an appeal from an automatic fine, the Filing Officer has imposed a fine on you for your failure to file a campaign treasurer’s report on the designated due date and, by filing an appeal, you have asked the Commission to consider either (1) that the report was in fact timely filed; or (2) that there were unusual circumstances that excused the failure to file the report timely. You are required to prove your case. If the Commission finds that the report was filed timely or that there were unusual circumstances that excused the failure, it may waive the fine, in whole or in part. The Commission may reduce a fine after considering the factors in Section 106.265, Florida Statutes. If the Commission finds that the report was not timely filed and there were no unusual circumstances, the fine will be upheld.

If this is a hearing to consider a consent order before a determination of probable cause has been made, the Commission will decide whether to accept or reject the consent order. If the Commission accepts the consent order, the case will be closed and become public. If the Commission rejects the consent order or does not make a decision to accept or deny the consent order, the case will remain confidential, unless confidentiality has been waived. If this is a hearing to consider a consent order after a determination of probable cause has been made, the Commission will decide whether to accept or reject the consent order. Respondent should be prepared to explain how the staff in its recommendation incorrectly applied the law to the facts of the case. Respondent may not testify, call others to testify, or introduce any documentary or other evidence at the probable cause hearing. The Commission will only decide whether Respondent should be charged with a violation and, before the Commission determines whether a violation has occurred or a fine should be imposed, Respondent will have an opportunity for another hearing at which evidence may be introduced. If this is an informal hearing, it will be conducted pursuant Sections 120.569 and 120.57(2), Florida Statutes; Chapter 28 and Commission Rule 2B-1.004, Florida Administrative Code. At the hearing, the Commission will decide whether the Respondent committed the violation(s) charged in the Order of Probable Cause. The Respondent will be permitted to testify. However the Respondent may not call witnesses to testify. Respondent may argue why the established facts in the Staff Recommendation do not support the violations charged in the Order of Probable Cause. regularly scheduled meeting on February 18, 2016, in Tallahassee, Florida

Based on the Complaint, Report of Investigation, Staff's Recommendation, and oral

statements (if any) made at the prnbable cause hearing, the Commission finds that theie is probable

STAFF RECOMMENDATION FOLLOWING INVESTIGATION

Pursuant to Section 10625(4)(c), Florida Statutes, undersigned counsel files this written recommendation for disposition of the refonal in this case recommending that there is probable cause to chaige Respondent with violating Sections 106.07(2)(b)l., 106.19(1)(b), 106.19(1)(c), and 106.19(1)( d),Florida Statutes Based upon a thorough review of the Report of Investigation submitted on October 22, 2015, the following facts and law support this staff recommendation:

1 On March 9, 2015, the Florida Elections Commission ("Commission") received a referral from the Division of Elections ("Division") alleging that C Edward McGee ("Respondent") violated Chapter 106, Florida Statutes

2 Respondent was the treasurer for Julie Shapiro Hairis, a candidate for the 17th

Judicial Circuit Court, Group 17, in the 2014 primary election Ms Hanis' Appointment of Campaign Treasurer and Designation of Campaign Depository for Candidates form ("DS-DE 9") was filed with the Division on April 17, 2013, appointing Respondent as her campaign treasurer (ROI Exhibit 2)1

3 By letter dated July 10, 2015, the Executive Director notified Respondent that Commission staff would investigate the following statutory provisions:

Section 106 .. 07(2)(b)L, Florida Statutes: Respondent, treasurer for Julie Shapiro, a 2014 candidate for Circuit Court Judge, 17th

Circuit, Gwup 17, failed to timely make necessary amendments to the campaign's 2011 termination report, as alleged in the complaint

Section 106,.19(l)(b), Florida Statutes Respondent, treasurer for Julie Shapiro, a 2014 candidate for Circuit Court Judge, 17th

Circuit, Group 17, failed to report one or more contributions required to be reported by Chapter 106, Florida Statutes, as alleged in the complaint

Section 106 . .19(1)( c), Florida Statutes: As alleged in the complaint, Respondent, treasurer for Julie Shapiro, a 2014 candidate for Circuit CoUit Judge, 17th Circuit, Group 17, falsely reported or deliberately failed to include information required by Chapter 106, Florida Statutes

Section 106.19(1)(d), Florida Statutes: As alleged in the complaint, Respondent, treasurer for Julie Shapiro, a 2014 candidate for Circuit CoUit Judge, 17th Circuit, Group 17, made or authorized one or more expenditures prohibited by Chapter 106, Florida Statutes ..

4. By letter dated April 18, 2013, Kristi Reid Bronson, Division of Elections, Chief, BUieau of Election Records, notified Ms Hanis that her DS-DE 9 and Candidate Oath had been received and her name had been placed on the 2014 active candidate list A secUiity envelope containing Respondent's confidential PIN number to access the Division's electronic filing system was also enclosed in the letter (ROI Exhibit 3, page 1)

In an October 6, 2015 Affidavit of Background Infotmation, Respondent stated that he has been a campaign treasuret on two fo1mer occasions for judicial candidates, he has 1ead Chapter 106, Floiida Statutes, many times, he has a Handbook, and he has read the updated Handbook each time he se1ved as a treasmet Respondent added that he eventually gave the campaign treasmer duties to William Langston, Esq , including filing repo1ts.. (ROI Exhibit 8, pages 1-3)6

20 In Respondent's October 6, 2015 affidavit, Investigator Smith also asked Respondent about the repotting mistakes he made Respondent stated that he did not have the checkbook or records and that he prepared checks as requested, when needed, 01 when invoices were submitted to him. (ROI Exhibit 8, pages 3-6)

21. "Probable Cause" is defined as reasonable grounds of suspicion suppo1ted by circumstances sufficiently strong to wan ant a cautious person in the belief that the person has committed the offense charged Schmitt v State, 590 So 2d 404, 409 (Fla. 1991) Probable cause exists where the facts and circumstances, of which an [investigatot] has reasonably trnstwo1thy info1mation, are sufficient in themselves for a reasonable man to reach the conclusion that an offense has been committed Department of Highway Safety and Moto1 Vehicles v Favino, 667 So.2d 305, 309 (Fla .. 1st DCA 1995).

22. The facts set forth above show that Respondent was the t1easwe1 for Julie Shapito Hanis, a candidate for the 17th Judicial Circuit Cowt, G10up 17, in the 2014 primaiy election Ms. Harris' IR was filed on Novembet 26, 2014.. However, the 1epo1t was incomplete On January 13, 2015, Febrnaty 5, 2015, and Febrnary 18, 2015, the Division sent Respondent notification that Ms. HaIIis' 2015 IR was incomplete The Division included an Enor Repmt and a "Contributions vs Expenditures Repo1t" with each letter. As of Januaiy 11, 2016, Respondent has failed to file Ms. Hairis' amended 2015 IR

23 The facts set forth above also show that Ms. Hair is' I ermination Report reflected a $628 deficit based on the total cont1ibutions and total expenditures that were repmted on all of he1 campaign ieports filed with the Division Respondent failed to repo1t a contribution to Ms. Hanis's campaign that was required to be repotted, falsely reported or deliberntely failed to include info1mation required to be 1eported by Chapter 106, Flo1ida Statutes, and made 01 authorized p10hibited expenditures in violation of Chapte1 106, Florida Statutes

Based upon these facts and circumstances, I 1ecommend that the Commission find p10bable cause to chaige the Respondent with the following violations:

Pursuant to Section 106 25, Florida Statutes, on March 9, 2015, the Flo1ida Elections Commission received info1mation from the Division of Elections that Respondent violated Chapte1 106, F101ida Statutes The Division's refenal was mandated pmsuant to Section 106 .07(8)(d), Floiida Statutes Commission staff~ the1efore, investigated whether Respondent violated the following statutes:

Section 106 .. 07(2)(b)l, Flodda Statutes, failure of the tieasme1 of a candidate to file an addendum to an incomplete 1epo1t afte1 1eceiving notice from the filing office1;

Section 106 19(l)(b), Florida Statutes, failme of a pe1son or organization to 1eport a cont1ibution 1equi1ed to be repo1ted by Chapter 106, Florida Statutes;

Section 106 19(1 )( c ), Florida Statutes, prohibiting a pe1son 01 organization flom falsely repo1ting or deliberately failing to repo1t information required by Chapte1 106, Floiida Statutes; and

Section 106 19(1 )( d), Florida Statutes, prnhibiting a person 01 organization flom making or autho1izing any expenditure prohibited by Chapter 106, Florida Statutes

I. Preliminary Information:

1 Respondent, C. Edwaid McGee, Jr , was the campaign tieasurer fo1 Julie Shapiro Hanis, a candidate for Circuit Comt Judge fo1 the 17th Judicial Circuit, Group 17. The candidate, Ms.. Hair is, was defeated in the prima1y election held on August 26, 2014 Respondent is an attorney and a pa1tne1 with the law firm, McGee and Huskey, P A

2.. Complainant is the Division of Elections (Division).

3 Respondent's filing officer is Kristi Reid-Bronson, Chief, Bureau of Election Reco1ds

4 Complainant provided with their refe1ral a document entitled "Sum of Cont1ibutions vs Expenditures" for the Julie Shapirn Harris campaign and stated in their 1eferral, "A 1eview of Ms Haiiis' campaign treasmer's repo1ts reflect a negative balance in violation of

Section 106 19(1 )(b ),( c) or ( d), Florida Statutes, or all of the aforementioned " According to the "Sum of Contributions vs Expenditures," the campaign had a negative balance of $628 .. 00 after the filing of the termination report These allegations will be addressed in the paiagraphs that follow. II. Alleged Vi.olation of Section 106.07(2)(b )1, Florida Statutes:

5. I investigated whether Respondent violated this section of the election laws by not timely filing an addendum to the 2014 IR after receiving notice that the report was incomplete

6 On April 17, 2013, an "APPOINTMENT OF CAMPAIGN TREASURER AND DESIGNATION OF CAMPAIGN DEPOSITORY FOR CANDIDATES" form (DS-DE 9) was filed with the Division. Respondent was appointed to serve as the campaign treasurer for Julie Shapiro Hair is .. Io review the DS-DE 9 form, refer to Exhibit 2.

7. On April 18, 2013, Ms .. Bronson sent the candidate, Julie Shapiro Hairis, a letter acknowledging that her name had been placed on the active candidate list; Respondent was provided with a printed copy of the letter.. The letter advised the candidate and Respondent that all candidates filing reports with the Division aie required to use the electronic filing system (EFS).

8 The letter also advised the candidate and Respondent that all of the Division's publications and reporting forms are available on their website, including Chapter 106, Florida Statutes, the Candidate and Campaign Treasurer Handbook, and the Calendar of Reporting Dates The letter further advised the candidate and Respondent of the responsibility to read, understand, and follow the requirements of Florida's election laws Io review a copy of the acknowledgement letter, refer to Exhibit 3

9. On January 13, 2015, the Division sent Respondent a letter informing him that the 2014 IR report was incomplete. An error report was included with the letter as an attachment as well as the document, "Sum of Contributions vs Expenditures" (Exhibit 1). The letter was mailed to Respondent at the address provided on the candidate's DS-DE 9 form Io review the January 13, 2015 letter and the error report, refer to Exhibit 4.

10 On February 5, 2015, the Division sent Respondent a letter marked "Second Notice" The letter stated, "On January 13, 2015, you were advised that one or more of your campaign treasurer's reports were incomplete " An enor report (part of the January 13, 2015 letter) was included with the letter as an attachment; the error report references the report at issue The letter was mailed to Respondent at the address provided on the candidate's DS-DE 9 form Io review the February 5, 2015 letter, refer to Exhibit 5.

11. On February 18, 2015, the Division sent Respondent a letter marked "Final Notice" informing him that the 2014 IR was incomplete .. An error report was included with the final notice as an attachment The final notice was delivered to Respondent at the address provided on the DS-DE 9 fmm. Io review the Final Notice and a copy of the delivery confirmation, refer to Exhibit 6

12.. In an e-mail dated October 16, 2015, Ms .. Bronson stated that no addendum has been filed for the 2014 IR Io review a copy of Ms .. Bronson's e-mail, refer to Exhibit 7..

13 In an affidavit, Respondent was asked whether he, as the appointed campaign treasurer, was responsible for preparing the campaign reports for the campaign. Respondent attested, "Initially, my Paralegal was preparing the drafts I would review, finalize & file them She moved to a different job. I turned the treasurer duties over to William Laystrom, Esq .. " Additionally, Respondent was asked why someone other than him prepared the campaign reports since he was appointed as the campaign treasurer Respondent stated, "When my Paralegal left my employ giving only 6 days notice, I could no longer meet my duties .. Also, I had some health issues which prevented my further service "

14 Respondent explained that his Paralegal would prepare bank deposits and he would review, approve and make deposits He added that the Paralegal would log information in the computer and "when due, I would review on computer & approve, then file "

15.. Respondent attested in his questionnaire-affidavit that he did not review each campaign report He explained that when Mr.. Laystrom "took over," he (Laystrom) e-filed the campaign reports Respondent stated, "I never got copied to review" Io review Respondent's questionnaire-affidavit, refor to Exhibit 8.

16 Review of the candidate's "Campaign Documents" on file with the Division are void of any record indicating that William Laystrom was ever appointed to serve as the campaign treasurer or deputy treasmer for the Julie Shapiro Hanis campaign.

17 No record was found to indicate that Respondent has previously violated this section of the election laws.

III. Alleged Violation of Section 106.19(1)(b), Florida Statutes:

18 I investigated whether Respondent violated this section of the election laws by failing to report contributions

19 I subpoenaed the campaign account records from the designated campaign depository, Landmark Bank, and compared the account records to the campaign tieasurer's reports on file with the Division ..

20 Review of the campaign account recmds disclose that the campaign did not report a contribution during the 2014 M4 reporting period; the reporting period covered April l to April 30, 2014 Bank records disclose a $50 contribution check from "Grace Canington" The check was dated as April 4, 2014 and was deposited in to the campaign account on April 9, 2014 Io review the itemized-contiibutions page from the 2014 M4 and a copy of the check from Grace Carrington and the bank statement showing the deposit, refor to Exhibit 9

21. In an affidavit, when asked about the contribution and why it was not reported, Respondent attested, "!don't have the check book or records Mr Laystrom does." Respondent added that he (Respondent) prepared checks as requested or as needed and based on invoices submitted to him Io review Respondent's questionnaire-affidavit, refor to Exhibit 8

Received call from a man saying he was Ms Harris' husband. He was calling to verify that we did need an updated address since the campaign was already over and they received a call this morning saying we needed an updated address

I verified that someone from our office had called regarding a returned mail and we would need an updated address

He asked what the returned mail was and I informed him it was a fine letter for a late termination report He got very upset and raised his tone (not yelling) about how he was going to fight it because it was due too close to a holiday He asked who it was sent to and then got more upset that it wasn't sent to a certain person, but I infomred him we only mail the letters to the officers on the account and that person was not listed as an officer He started to argue that he should have been on the account and didn't know why he wasn't I explained we can only add people to the account that are listed on the DSOE9 that is sent in by the candidate He then went on to argue that we didn't properly notifiy them because there was no way the treasrer wouldn't have told him there was a late fee I explained the returned mail was our attempt to properly notify them I also explained they can appeal the fine with the Florida Elections Commissions l offered to show him where to find the PDF of the letter online but he said he wasn't near a computer

Received a phone call from a gentleman assisting the treasurer asking how to amend the M5 report He said he also needed assistance filing an amendment for the P1 and starting the P2

I guided him through the M5 amendment - it now is filed with complete detailed records

I guided him through filing a waiver for the P1

I guided him through opening the P2 and showed him how to enter in a contribution He said he would call back if he had any other questions

I called and spoke with Ms Julie Shapiro Harris about her OS-DE 9 being incomplete I explaiend that her signature was a copy but the treasurer's signature was an original. I express that in order ofr our office to process her application, we would need another OS-DE 9 submitted with originals signatures for the candidate and treasurer She said that she would send a replacement asap
