Respected President, Dear Office Bearers, State & Central Council Members, Members of the Executive Body and my Dear Members of the Behala Medical Association (Indian Medical Association, Behala Branch) …………….. I consider it a proud privilege to place before you all, the 45th Annual Report 2013-2014 of the Behala Medical Association (Indian Medical Association, Behala Branch) on this Sunday, 13th day of April, 2014 at JMRCH, IMA House, IMA Behala Branch at 6pm. Sir, our branch has completed 45 golden years and we look forward towards the Golden Jubilee Celebration on 2018-19 from now on.

This Report is a brief account of our activities, success and failures during this association year.

OBITUARY: Let me begin my presentation, paying respect to the departed souls whom we lost during the year 2013-2014. We are intact at our branch level. The devastating natural calamities, notorious acts of terrorism and acts of barbarism which took many innocent lives leave us crestfallen. We appeal to appropriate authorities to reinstate peace and extend exemplary punishments to these unsocial and inhuman elements. We deeply mourn their sad demise and express our grief & sorrow. We also pay our homage to the departed souls & convey our sympathy to the members of the bereaved families of our colleagues in different branches of IMA all over the country. May their soul rest in peace…………….

MEMBERSHIP: Friends, hope you will agree with me that in any association, increase in membership strength is always considered to be a good indicator for good organizational activity. In this regard we would like to submit before you the strength of our membership as on 31st March 2014:

In comparison to the previous years, this year we were able to make adequate increase in membership strength and must work hard in this field to increase our membership above 650 this year. There are at present 50 plus doctors practicing in Behala who are not members of our Branch. As the second “LARGE” branch of IMA in Bengal we need to push up our membership strength further. Hope the new committee will push the membership drive further…..

The Present Membership Fees of our Branch is as below:

We have implemented Senior Citizen Discount Scheme since last 6 years and all Senior Citizen Members have been charged only the Headquarter Fund Contribution (HFC) amount as IMA Headquarters has not waived its charges for membership. Kindly Note 50% Discount on Life Membership was implemented by IMA Hqrs for 1 year (1st July 2013 to 30th June 2014) and sequential changes will be applicable on Branch Membership till 30th June 2014.

SOCIETY REGISTRATION, PAN, CONSTITUTION & RELATED ISSUES: The issue of Registration of IMA under Society Registration Act was first raised in All India Medical Conference at Nagpur. The saga after that should not be recorded in black & white. We came to know that IMA’s Society Registration is now invalid and there was no option to re-register as “Indian Medical Association” after Independence because only Government can use “Indian” as prefix, e.g. Indian Army, Indian Navy etc. After seeking legal opinion and with recommendation from 42nd AGM of IMA Behala Branch we moved for individual branch registration with IMA (HQ) permission. Today our Branch is registered under West Bengal Societies Registration Act XXVI of 1961, Registration Number S/1L/81885 of 2011-2012 as BEHALA MEDICAL ASSSOCIATION. We have got our own PAN, number being AABAB 6065E. We have made an affidavit from court of 1st class magistrate that Indian Medical Association, Behala Branch and Behala Medical Association is one and same organization, a branch of Indian Medical Association (HQ). Simultaneously we have reviewed our Constitution which was approved and accepted by the 206th Meeting of Central Working Committee held on 19th November 2011 at Chandigarh and duly ratified in the 72nd Meeting of the Central Council of IMA held on 27th -29th December 2011 at Bengaluru (vide letter IMA/Admin/CC/C-9/03 dated 2nd April 2012). Note: IMA Hqrs. in its 74th meeting of Central Council on 27-29th December 2013 at Rajahmundry, A.P, finally, unanimously approved the decision that individual local & state branches should register themselves with Registrar of Societies in their area and apply for individual PAN: a demand voiced eloquently & repeatedly for last 5 years……..A victory for Behala Medical Association (IMA Behala Branch) - the 1st branch in Bengal to do so.

LAND, BUILDING & RELATED ISSUES: Kolkata Municipal Corporation: All papers regarding IMA Behala Branch building are up-to-date. Our yearly Kolkata Municipal Corporation Tax is Rs. 20,132.00 which is very high for a welfare organization. We had approached the office of the Hon’ble Mayor, KMC, through proper channel, for exemption of the non-residential surcharge, but our plea was ignored. But still we are paying our taxes regularly. Dept. of Land & Land Revenue, Government of West Bengal: The matter regarding long term lease of the land is still pending. We could not do much headway regarding this issue. Kindly Note: Regarding members’ proposals to earn revenue from this building, it must be stressed that at present as per hand-over agreement we are not yet entitled to use the land commercially. Govt. of West Bengal leased the land for the Charitable Clinic and IMA Behala Branch Office. We have till now successfully maintained this building from our own resources; we hope members are satisfied with the way the building is being maintained since last 8 years; let us maintain it from our own resources. Addition/Alteration to building: Two new toilets (Male & Female) were introduced at roof top, a long time demand of elderly members during whole day programmes. Even the 1st floor toilet was restructured for dual use by introducing a commode. Ground floor old Secretary’s Room was restructured and converted into IMA Computer Section with Server Room. The ground floor was re-painted. The two existing 2-tonner air-conditioners were replaced by two new LG 2-tonner air-conditioners. IMA House was renamed as IMA House, Behala and steel letters were fixed. Behala Medical Association was put on outside walls with steel letters in Bengali.

PROPOSAL: Proposal for a new common toilet for outsiders and clinic patients at the south-west corner of the premises along with restructuring of the outside area and underground sanitary connection with KMC sewerage system to be taken up in the next financial year. Beautification of Jogendra Mohan Rakshit Convention Hall (JMRCH) along with interior decoration and painting will also be taken up in the next financial year.

MEETINGS: Nine (9) Executive Body Meetings (including two Emergent meetings), Three (3) General Body Meetings , Meetings of the Wings, Sub-Committee Meetings and Clinical Meetings were held regularly during this year in our branch. We are really grateful for your kind participation and sincere advice. But few members remained absent in most of the meetings. We must mention in this context that as per Rules & Bye-laws of the Association, elected members must inform Branch Secretary, if he/she is unable to attend the meeting with reason (regret). The President has the power to show cause any member failing to attend three consecutive meetings & if necessary can replace him/her mid-term. We request elected committee members to attend meetings without fail.

44rd ANNUAL GENERAL MEETING: The 44rd Annual General Meeting of our Branch was held on Sunday 21st April 2013 for the Association Year 2012-2013. We prepared a Power Point Presentation of all activities throughout the year and members present appreciated the change in Annual Report presentation. The members present in the AGM expressed satisfaction over the performance of the outgoing Executive Body. We prepared & audited our accounts in time, which was placed in the Annual General Body Meeting. Members expressed satisfaction over the Accounts prepared by the Finance Secretary, which were also passed. Many important issues were discussed for implementation. But with only one-fifth attendance at AGM raised many eyebrows as why members throng IMA Conferences, Bijoya Sammilani, Picnic & other Scientific Programmes but stay away from organizational meets? We have to search for the reason. Being a non-election year the same committee continued for another year with renewed vigor. We requested members to attend future AGM in large numbers & give us their valuable opinion so that we could rectify our mistakes and work with much more confidence. The meeting was followed by Presidential Dinner.

ANNUAL SCIENTIFIC CONFERENCE OF OUR BRANCH: BIMACON: The Multidisciplinary 19th Annual Scientific Conference (BIMACON-2013), the annual mega-event of Behala Medical Association (IMA Behala Branch) was held on Sunday 2nd June 2013 at the The Park Hotel, 17 Park Street, Kolkata-16. The Annual Multidisciplinary Mega-event “BIMACON-2013” was inaugurated by our own Dr. Sudarsan Chakraborty, Hon. Editor Elect JIMA (2013-2014). He also released the special issue of “Impulse”. Dr. Debasish Mukherjee, Branch President, Behala Medical Association (IMA Behala Branch) released the ‘Docline-2013’. It was a spectacular show this year with 276 participants (210 Doctor Delegates and 66 accompanying persons). 14 (Fourteen) Scientific Sessions and 16 (Sixteen) Scientific Display Stalls were organized during the show. Delegates were showered with Gifts from different angles during the event from start to finish. The breakfast with black forest cakes, the scrumptious buffet lunch with assorted desserts and all day long tea counter with cookies and not to forget the mouth watering welcome drinks in the morning. A mega lucky draw was organized at the end and those who stayed till the end were lucky winners. The negative side of this success is only 14 doctors contributed to the earnings with first three accounting for 70% of it. Approximately 105 Pharmaceutical Houses, local Diagnostic Centers and Private Hospitals participated but some of their participation was not up to our expectation. If the rest 630 members could bring at least one pharma company/ division / diagnostic centre / private hospital / medical services / medical equipments / medico legal service houses / non-medical houses like car companies, banks, investment houses, car rentals, travel agents, caterers and so on, each with minimum contribution; we could arrange the next conference for two days in Hotel Radisson Fort. 14 Doctors who actively helped to organize the show by bringing sponsorships were felicitated with special gifts as per decision of the organizing committee. We are grateful to all the pharmaceutical and allied houses, hospitals and diagnostic centres that came forward to organize this mega show of Behala Medical Association (IMA Behala Branch). But we strongly believe that more number of Doctors should attend BIMACON in the coming days.

ANNUAL SCIENTIFIC CONFERENCES OF DIFFERENT WINGS OF OUR BRANCH: BIMAAMSCON: The 8th Annual Scientific Conference of IMAAMS Behala Branch Chapter, BIMAAMSCON-2013 was held

on Sunday 4th August 2013 at Behala Medical Association (IMA Behala Branch) along with 21st World Breastfeeding Week. (For details check IMAAMS report)

BIMACGPCON: The 9th Annual Scientific Conference of IMA College of General Practitioners, IMA Behala Branch Sub-Faculty BIMACGPCON-2013 was held on Sunday 29th September 2013 at Behala Medical Association (IMA Behala Branch) along with World Heart Day-2013. (For details check IMACGP report)

BIMAWOMBCON: The 5th Annual Scientific Conference of Woman Doctors’ Wing, BIMAWOMBCON-2013 was held on Sunday 15th December 2013 at IMA Behala Branch (For details check IMA WDW report)

DOCTORS’ DAY: FOCUS ON DOCTORS In consonance with the view expressed in many IMA meetings, that, Doctors’ Day should focus on doctors specially, and not extension of the humanitarian service they are providing for the 364 days of the calendar, Behala Medical Association arranged Screening Camp for members and their spouses for detection of some ailments. Truly, teachers are focused on Teachers’ Day, mothers focused on the Mothers’ Day, children focused on the Children’s Day, but Doctors’ Day never focused on doctors. This change of attitude towards appreciating the round- the- year service by the doctors to the society, needed to be stressed and focused, for attention by all quarters. Doctors should be appreciated and supported so that they can serve the society better. Doctor-patient relationship will then be improved considerably. Earlier Statue of Dr. B.C. Roy was garlanded by Branch President Dr. Debashis Mukherjee and two CME programmes were also held on that day. In continuation of Doctors’ Day felicitation programme, we felicitated 10 senior members above 75 years on that day. The members are Dr. Asit Kumar Khan (11.01.37), Dr. Sushil Chandra Sen (01.03.37), Dr. Subir Kumar Das (16.11.37), Dr. Dipak Chaudhuri (22.05.38), Dr. Sudhangshu Bimal Dasgupta (02.08.38), Dr. Jitendra Lal Banerjee (18.11.38), Dr. Nalini Bhusan Sen Chaudhuri (04.05.39), Dr. Gita Chaudhuri (15.08.39), Dr. Sisir Kumar Halder (02.11.39), Dr. Partha Kumar Bhattacharyya (31.12.39). ‘SAARGAM’- the cultural platform of BMA which was launched on 1st July 2012 observed its Anniversary and performed strikingly on that day. Saargam Dhun organized vocal songs with karaoke, Saargam Taal organized “Monsoon Romance” dance programme and Saargam Abhinoy staged Manoj Mitra’s “Chokhe Angul Dada’. Buffet Lunch and Dinner provided were appreciated by all, who attended the programme.

IMA ACADEMY OF MEDICAL SPECIALITIES, BEHALA BRANCH CHAPTER: The strength of IMAAMS Behala Branch Chapter remained static at 106 (One hundred & six) this year. IMAAMS Behala Branch Chapter just continued its activities through arrangement of 3 (Three) subject-oriented clinical discussions (all were organized on Sunday evenings as per members’ demand) and 1 (One) workshop on PC-PNDT. Regarding paucity of IMAAMS CME programmes we must seek apology to our members. Though our AMS is star-studded yet we failed to arrange a handful of CMEs. It is certainly a failure on our part to communicate & mobilize our members for the same. I really am ashamed to tell you that we approached few SPECIALIST doctors to take the helm of academic affairs of IMAAMS Behala Branch Chapter and organise CME regularly only to hear that they are too busy and not possible for them to do so. Well, we do organise CME at different outside venue fixing up with pharma companies but we do not have time to organise non-sponsored subject-oriented clinical discussions at our branch; needed introspection & motivation. WHO Day 2013 observation was organized by IMAAMS on 7th April 2013 on the theme “HIGH BLOOD PRESSURE”. The WHO slogan for the year was “Under Pressure? Cut your risk of Heart Attack & Stroke-Control your Blood Pressure”. 6 Scientific Sessions with a Panel Discussion were organized. The PC-PNDT workshop was organized on 15th March 2014 by District Family Welfare Bureau, Kolkata under Dept. of Health & Family Welfare, Govt. of WB. The Govt. officials highly praised the arrangements made by the organisers and congratulated the 50 doctors (who participated as per their requirement) for active participation. The IMAAMS team did organize the 8th Annual Scientific Conference “BIMAAMSCON 2013” this year on Sunday 4th August 2013 along with 21st World Breastfeeding Week 2013 with theme “Breastfeeding Support: Close to Mothers”. The programme was inaugurated by Dr. Sudarsan Chakraborty, Editor Elect (2013-14) JIMA. He also released the special edition of “Impulse” prepared on World Breastfeeding Week. Eleven (11) Scientific Sessions including “Ardhendu Sekhar Bhattacharyya Memorial Oration” and “Theme Session of World Breastfeeding Week” were organized. Not the numbers, but the qualities of Scientific Sessions were praised by 152 delegates who were present throughout the day. Thanks to members of “Saargam” for yet another mind-blowing performance at the end of the day.

IMA COLLEGE OF GENERAL PRACTITIONERS, BEHALA BRANCH SUB-FACULTY: IMA College of General Practitioners, Behala Branch Sub-faculty, is the second biggest Sub-faculty in Bengal, remained static with 112 members this year. We apologize to Dr. Santi Ranjan Biswas and Dr. Subhasis Bhandari, the two new members enrolled during last association year as they did not receive their LM certificates from IMACGP (HQ) Chennai till date, inspite of repeated reminders. The new committee has to take up this issue with their Chennai counterpart. We have set our target to become no. 1 in this category and so we have set our target this year to 150+ members. IMACGP Behala Branch Sub-faculty organizes the regular CME programmes at IMA Behala Branch. This year we have conducted 11 (Eleven) CME on different subjects and 1 (One) workshop on “MISSION KISHORE UDAY” with Panel Discussion on Adolescent Care arranged by West Bengal Academy of Paediatrics (IAP,WB). Dr. Swapankumar Ghosh, the Hon’ble Sheriff of Calcutta inaugurated the “BIMACGPCON 2013” as Chief Guest & also released the special edition of “Impulse” on the occasion. Scientifically (14 Scientific Sessions including Laxmi Rani Bhattacharyya Memorial Oration on World Heart Day Theme: Take the Road to Healthy Heart) & financially it was a successful programme with 150 Doctors attending the conference. Like all previous years also it was only headache for a few and enjoyment for all. At the end of the conference, the members of “Saargam” presented an astounding cultural programme only to send the delegates back home with a memorable day’s experience. The all round success of this wing was the result of continuous support and enthusiasm of the various sponsors aided by strong interest shown by the all members of our branch and sincere effort of our office staffs.

IMA WOMAN DOCTORS’ WING, BEHALA BRANCH: The Behala Medical Association, IMA Woman Doctors’ Wing with 149 members is a part of the Women Doctors’ Wing of IMA Bengal State Branch & IMA Headquarters. This year also they organized “BIJOYA SAMMILANI” along with DOCTORS’ SPOUSE FORUM which was highly appreciated by the audience. We congratulate the leaders for their devotion with a mention for need to involve the idle members. This wing which created a history in Bengal by organizing the 1st Woman Doctors’ Conference, BIMAWOMBCON at Local Branch Level on Sunday 13th September 2009 continued their golden run and organized the 5th Woman Doctors’ Conference, “BIMAWOMBCON-2013” on Sunday 15th December 2013 with “The Gender Agenda; Gaining Momentum”, as the theme. Dr. Swapankumar Ghosh, the Hon’ble Sheriff of Calcutta, inaugurated the Conference as Chief Guest and released the special edition of ‘Impulse’. With the active participation of Doctors’ Spouse Forum members the conference registered 161 delegates. 13 Scientific Sessions (including Sikha Bhattacharyya Memorial Oration) were organized. The Hon. State Secretary in his message was compelled to write “The Venture of BIMA WOMBCON is not praiseworthy but also surpasses the set standard of running a local branch”. Thanks again to the members of “Saargam” for a mind-blowing cultural programme at the end of the day. For the 1st time in the history of Behala Medical Association (IMA Behala Branch) the Woman Doctors’ Wing along with Doctor’s Spouse Forum observed “INTERNATIONAL WOMEN’S DAY” with pomp & grandeur on 8th March 2014. The theme of this year “International Women’s Day” was “Inspiring Change”. The home and guest speakers on the theme were Dr. Sonali Mukherjee, Dr. Nandita Chakraborty, Dr. Bharati Moitra, Dr. Sanghamitra Ghosh and Dr. Sukanya Banik. The International Women’s Day also brought inspirational changes to the leadership of both Woman Doctors’ Wing and Doctors’ Spouse Forum. Once again “Saargam” presented flabbergast cultural extravaganza with a round of applause from the audience, members and guests. We must congratulate the officials of the wing for their endeavor and grand success.

IMA SOCIAL SECURITY SCHEMES (NATIONAL & STATE): THE STATE SOCIAL SECURITY SCHEME: In spite of all effort we failed to keep our promise to raise the membership to even 200. Each member should come forward to make this scheme a success - at least for the fraternity’s sake! Each one of you should enroll one new member so that the total number rises which will have a direct implication on the amount payable to the deceased member’s family. While the membership strength of this scheme has decreased in IMA Behala, from 141 to 135 at our Branch level but still we are the highest in Bengal. The benefit of the old scheme may be a very small amount but it may turn out to be handy at times. This year we paid DFC to the families of Dr. Santosh Kumar Mukherjee (Rs. 39,490.00), Dr. Mano Ranjan Das (Rs. 42,790.00) and Dr. Arindam Ghosh (Rs. 42,790.00). Kindly Note: The original SSSS certificates of Dr. Anil Kumar Rakshit and Dr. Sankar Datta are in safe custody of Branch Secretary as Behala Medical Association (IMA Behala Branch) is the beneficiary.

THE NATIONAL SOCIAL SECURITY SCHEME: I am not at all happy the way NATIONAL SOCIAL SECURITY SCHEME has been implemented by the leaders of this wing in our branch this year. We only added 3 (Three) new members to this scheme to take the total number to 65 (Sixty Five). The New Members enrolled are Dr. Pradip Kumar Maiti, Dr. Rekha Maiti & Dr. Debjani Raychaudhuri. We know that we are the biggest contributor to the NSSS from Bengal today, but still we must take initiative to uplift the membership to 101 by end of this year. The All India IMANSSS membership is around 14600+ and the last DFC paid by this scheme is about 10 lakhs. It is really astonishing that many of our members still sometimes express that they are not well intimated about the scheme. I am really at bay to find out ways to communicate further…………………………………….

PROPOSAL: I request this AGM to take a resolution and give special powers to Dr. Sankar Bandyopadhyay, Vice President, to take initiative to propel this scheme forward at our branch level.

CLINICAL ESTABLISHMENT ACT: We still stand firm on our previous stand that none of the individual clinic of private practitioners should register under CEA. Friends here I must caution you regarding one aspect: As in CE rule we are bound to register our personal chamber; IMA have protested; Government is silent; but when any litigation occurs we may be in trouble as we are practicing in unregistered place as per law of the land. We must raise our voice against change of CE rules (exclusion of private chambers); although IMA (HQ) is fighting it out at the centre but the IMA Bengal State Headquarters is conspicuously silent on this issue till date.

LEGAL QUESTION OF THE DAY: Q. Does running of a clinic by a physician at his residence amount to commercial activity? Ans. This question has recently been answered by the Delhi HC in DR. D.V.CHUG versus STATE & ANR., Delhi HC, decided by SURESH KAIT, J., on 2-7-2012 Para of this judgment is reproduced below: “5. The issue arises in the instant petition, whether, running of clinic from the residential premises, would come in commercial activity”. After a detailed discussion of law and decided cases, the court observed as follows: “11. On considering the submissions of ld. counsel appearing for the parties, I am of the considered view that the professional establishment of a doctor cannot come within the definition of commercial activity. Commerce is that activity where a capital is put into; work and risk run of profit or loss. If the activities are undertaken for production or distribution of goods or for rendering material services, then it comes under the definition of commerce. The word ‘profession’ used to be confined to the three learned professions; the Church, Medicine and Law. There is a fundamental distinction between the professional activities and commercial activities”. SUMMARY—Running of a clinic by a physician at his residence amounts to a professional, not a commercial activity.

Needless to mention, Hospital Board of India is with you, for you and forever. IMA Hospital Board of India: Bengal Chapter should visit each and every member’s clinical establishment and make them member of this National organization. Now the Kolkata Municipal Corporation has suddenly imposed a new “Fire License” on all Clinical Establishments (CE) along with renewal of Certificate of Enlistment. Our friends who run small scale CE faced a severe problem as they were being harassed by touts. Huge one time taxation on fire fighting grounds that was implemented on small-scale CEs made few of them approach IMA to intervene. Representatives of IMA met the Director, Fire & Emergency Services and sorted out the matter initially for small scale CE. The Director assured us to look into the matter but with the change at the Government level the saga continues till date. It’s time that all owners, administrators of Hospital & Nursing Homes must unite to fight against KMC, WBF&ES and Dept. of Health & FW. These small-scale CEs were established much before the current law was passed. WBF & ES is one of the most corrupt departments of the Govt. of West Bengal and almost all CE owners/administrators got a taste of it during procuring temporary NOC. Accidents are Accidents – it is bound to occur irrespective of the level of safety measures: Train Accidents, Air Crashes and Nuclear Disaster – do they not occur even after most stringent safety measures? Instead of asking every institution to store water (One lac litre), why the Ganga water hydrants (the heritage of Calcutta) is not made functional? Institution more than 20 years old and less than 20 beds should not come under this rule. The Government should bring out modified recommendation for safety measures for these CE separately and allow these small-scale CEs to function. IMA NATIONAL PROFESSIONAL PROTECTION SCHEME: BY THE DOCTORS FOR THE DOCTORS RULES & BYE LAWS Preamble: The Indian Medical Association was established to safeguard the interest of the Medical Profession and health of the public, by organising the Medical Practitioners in a systematic way, promoting the advancement of Medical and related sciences and maintaining honor, dignity and discipline. Ultimately all the efforts of IMA are to lead the public to get the best from the Medical Practitioners whom they approach, at the apt time and with minimum cost. Unfortunately it is now found that the Medical Practitioners are drawn into litigation on death or other calamities occurring during the treatment for no fault of theirs. Moreover many members have expressed a fear that unless some measures were taken to safeguard their interests in such matters, they have to be selective in treatment, or start treatment only after various types of tests. This will ultimately cause delay in treatment and increase the cost of treatment. To avoid such calamity, in the best interests of the sick public, the IMA has decided to take the responsibility of protecting the doctors in litigations, provided they too financially contribute something for this cause, and for that purpose the National Professional Protection Scheme is established in 2002. Aims & Objectives:

To protect the members and help them in case of harassment, litigation etc. which may arise during the process of their professional practice.

To provide legal aid to the members of the Scheme.

To promote Social Service Activities such as to provide Medical Aid to the poor and needy, to undertake family welfare programmes, to organize blood donation campaigns, to conduct Medical Education and First Aid classes, to organize AIDS Awareness programmes etc.

To involve in all activities including awareness seminars, workshops etc publication of relevant materials or books both for the public and the members of the scheme and IMA so as to decrease the incidence of litigations against doctors.

Eligibility: Only life members of the Indian Medical Association are eligible to become the members of the Scheme. Jurisdiction: Any claim arising within the jurisdiction of Republic of India alone will be entertained by the scheme. Membership: Membership fee for the first year shall be Rs. 3000/-. The membership fee once paid will not be refunded. Any cause of action from the date of realization of the membership fee for one full calendar year will be taken up by the Scheme. Cause of action means the treatment given by the member to the patient which led to the litigation. Continuous membership can be obtained by prior renewal on payment availing a rebate of Rs. 100/- every year upto a period of 6 years/ if no compensation is paid on behalf of the member. Any member can take multiple units by paying membership fee of Rs. 3000/- (Rupees Three Thousand only) per unit, as above. The claim amount shall be proportionate to the number of units.

First Year Membership Fee - Rs.3000/-

Second Year Membership Fee - Rs.2900/- (if no claim)

Third Year Membership Fee - Rs.2800/- (if no claim)

After sixth year fixed payment - Rs.2500/- per year (If no claim) Saving clause: The benefits of this Scheme shall not be denied to anyone on the basis of caste/creed or community. The help extended to the members shall be limited to the cost of litigation and compensation if any. The excess if any in the operation of the Scheme shall not in any way be distributed as dividend or profit among the members of the scheme. Member’s right and duties: The scheme will fight out civil and criminal cases arising out of a member’s medical practice upto the level as decided by the managing Committee. Litigations arising out of other actions of the members including the administration will not be dealt with by the Scheme. The concerned member shall inform the Hon. Secretary and state Representative of the Scheme as soon as the incident occurs. Incident includes notice from the Advocate or from any Legal Forum or from the individual patients or their relatives or intimation whereby the member gets information that a case has been registered with the Police. If the member fails to inform the concerned office bearers of the scheme about such incident, the member will forfeit the right to enjoy the benefits of the Scheme for that particular case. The concerned member shall obey any instruction given by the management of the Scheme regarding the case. The scheme should not be made a party in the case because the Scheme is not Insurance Company. The member will get all the benefits from the Scheme provided he/she follows the instructions given by the management of the Scheme and if the incident has occurred during the period of his membership. Any member who makes the Scheme also a party in his/her case will cease to enjoy the benefits from the Scheme in that particular case. The concerned member shall give the copies of the relevant documents of the case to the Hon. Secretary for the use of the Scheme in English. The statements and documents submitted by the members should be true and correct in all respects. If the member gives any false or misleading information to the Secretary the member shall cease to enjoy the benefits of the Scheme. Should the member be advised by the scheme to file a counter petition or suit against the party concerned for monetary damages and defamation, the member is bound to obey. In such cases, if compensation is ordered, 50% of the amount should be remitted to the scheme after deducting all the expenses A member of the Scheme, if called upon by the police or by the court to give evidence should consult the Hon. Secretary or the State Representative and act as per their direction. Protection & Damages payable by the Scheme: The Scheme is liable to pay to a member, 50% of cash balance of the Scheme at the time of settlement, whichever is less. The legal adviser / advocate will be selected as far as possible in consultation with the member involved in the case. But if the Chairman/Hon. Secretary feels to appoint a different advocate, he will have the right to do so. The scheme will not give protection to the institutions or the management of the Hospital for its lapses even if the institution or the Management is headed by a member of the Scheme. Case against the individual members for their alleged professional lapses alone will be taken up by the Scheme. Appellate Body: If any member is aggrieved by the decision of the chairman or the Managing committee he can prefer an appeal before the appellate body (CWC) within a period of 90 days and it shall be forwarded to the Hon. Secretary General of IMA. The matter shall be discussed and finalized in the subsequent Central Working Committee.

PUBLICATION (IMPULSE): Friends, you will agree with me that the News Bulletin is a must for all organizations to build a good effective communication. This year we failed to publish “Impulse” quarterly and regularly. With our sincere effort we were successful in publishing “four” issues of impulse this year along with BIMACON, BIMAAMSCON, BIMACGPCON & BIMAWOMBCON. E-impulse is a new feather in the cap of Behala Medical Association (IMA Behala Branch) and it is being sent all over India to more than 1500 IMA Branches, State & Central Council Members and State & Central Working Committee members from this year. We are really grateful to Dr. Sushil Kumar Bhattacharyya, Past Branch President & Hon. Secretary who toiled hard for the launch of “E-Impulse” and hope he shall nourish it to great heights. Although we failed to release e-impulse this year due to various problems, we are really sorry for that. BIJOYA SAMMILANI: On Sunday, 27th October 2013 our Branch organized a mega-successful musico-magical “Bijoya Sammilani” this year. About 300+ delegates (Doctors & their families) spent 5hrs of Musical Nite with Banquet at the “IMA House”. A well attended gathering & an active participation on that day showed that this programme is gradually gaining much popularity amongst our members and their families. Introduction of “SAARGAM” has changed the cultural scenario of our branch. Many new faces performed with perfection. We congratulate all the members of the Doctors’ Spouse Forum and Women Doctors’ Wing for helping to organize this programme.

“SARGAAM” organized cultural show during RABINDRA JAYANTI, DOCTOR’S DAY, BIMAAMSCON, BIMACGPCON, BIMAWOMBCON, BIJOYA SAMMILANI AND BIJOY DIWAS All Member Doctors, their Spouses (Members of Doctors’ Spouse Forum) and Children (Gen Next) who want to perform (Karaoke, Vocal, Instrumental, Solo Dance, Recitation, Group Dance, Dance Drama and Drama) on stage under the banner of “Saargam” must attend the meetings of Saargam positively & enroll their activity. Henceforth all cultural activities of Behala Medical Association will be under the banner of “SAARGAM” and will be under direct supervision of either Hon. Secretary or any three of the Joint Secretaries.

INDEPENDENCE DAY & REPUBLIC DAY: We observed & paid homage to our great leaders & freedom fighters of our country in a traditional ceremony at our IMA House both these days. We must congratulate all Office Bearers for their active participation on both these days. This year we had an average attendance of 45 members on both these days. What about our other members!

SOCIAL WELFARE: THE SAYAN BHATTACHARYYA MEMORIAL IMA OUTDOOR CHARITABLE CLINIC & VACCINATION CENTRE: THE PRIDE OF IMA IMA Behala Branch Outdoor Charitable Clinic & Vaccination Centre which was established in 1984 and later christened as The Sayan Bhattacharyya Memorial IMA Outdoor Charitable Clinic & Vaccination Centre swelled with the increasing number of patients this year. Now the clinic runs daily from Monday to Friday from 3.30-6.30 p.m. thereby satisfying the local demand of many years. We are proud to say that we have examined 5805 patients this year (compared to 5774 patients last year) which is 31 more than what we examined last year. No. of patients at Skin OPD was 1664 (1491 last year) and 116 (96 last year) children were given Immunization at our clinic. We are sorry to say that still there are few lacunae to fill e.g. participation of more number of our members in the clinic. We appeal to all the members to spare at least two hours once in a month for a noble cause.

ELECTION OF IMA BEHALA BRANCH: NO POLITICS PLEASE The last Annual General Election was held on Sunday 23rd March 2014 and as the number of contestants and the number of posts in each category being equal, there was no casting of votes and all the candidates were declared elected. The Chairman of the Election Commission will hand over the results to the Branch President shortly and the new office bearers will be installed after Presidential handover. We must congratulate Dr. Anil Kumar Rakshit, the Chairperson, along with Dr. Sibu Choudhury and Dr. Probodh Kumar Banerjee, the Co-chairpersons of the Election Conduction Committee of Behala Medical Association (IMA Behala Branch), for their sincere effort for a smooth & fair election process at our branch.

ASSUALT ON DOCTORS AND PROTEST MARCH: “IMA will not tolerate assault on its members and their establishments”

This year there were no major occasions where we faced trouble. We tried our level best to protect our members and put up a united show on all small occasions & fought the issue with hands together. Few members were very happy with the role of IMA in their issues but few were unhappy & think IMA did nothing for them. But with this we have to go on. I still believe it is high time for all of us to stand side by side on a common platform and that common platform for all of us, regardless of our specialities, is…INDIAN MEDICAL ASSOCIATION. It is time enough for all of us to realize this blatant

truth. The earlier we realize this fact, the better for all of us. We must realize that we are involved in a profession that is least secure on several accounts. We are open to all sorts of assaults, both verbal and physical, and above all mental. And now we are losing many colleagues on non-professional grounds. The administration is always playing safe, following the jungle rule, where the people with muscle power are getting advantage. But the need of the hour is to Strengthen IMA…the need of the hour is to enroll as many members as possible, and our request to all existing members to lend their sincere efforts in this direction. We must congratulate the previous state Govt. of West Bengal for the implementation of The West Bengal Medicare Service Persons and Medicare Service Institution (Prevention of Violence & damage to property) Act 2009 and hope that the present Government will work for its proper implementation.

Still Many Non-Member Doctor’s (Few Members Also!) Say ‘What Is IMA Doing For Us?’ Why Should We Become Members Of IMA? What Shall We Gain By Becoming Members Of IMA? They stay away as they

know that they also will enjoy the same benefits without any expense of their own.

Just a minor accident of a handicapped student’s bike colliding with the open door of standing car of local MLA resulted in power-flexing by the politician and ransacking of Kanpur Medical College & Students’ Hostel with the help of administration / police force; resulted in free for all at Kanpur Medical College; brutal attack on students by police administration; grievous injury of 3 student who were admitted in ICU ; The HOD of Medicine, Kanpur Medical College, who happened to be President of IMA Kanpur Branch also saw the whole episode in front of her eyes and IMA Kanpur swung into action immediately. They immediately approached the topmost administration, thronged the streets in protest, made healthcare standstill and moved to court; Allahabad High court swiftly formed one man enquiry commission, one man special investigation team, ordered transfer of all police administrators and booked the rookie local MLA. The matter is still sub-judice …….……..United we stand, divided we fall - the role IMA Kanpur played with active support from IMA UP State Branch and IMA Headquarters should be an eye opener to IMA leaders in Bengal where we always fall apart on political lines and ultimately the common doctors always suffer.

E-COMMUNICATION & INFORMATION IS POWER: SMS, E-MAIL, WEBSITE & FACEBOOK Power is an abstract quality which exists only in human perception. Procurement and dissemination of information is power in action. One of my frustrations in lifelong service of IMA is the way we handle information. The quantum of work done by the National organization never gets reflected in our reports. The defect lies in the lack of communication of vital information in real time. Lesser known organizations with lesser contribution make it big on health issues in our State and in National level also. Like a mammoth IMA is frozen in time. This partly reflects the nature of the medical profession and the load it carries on behalf of the nation. But we can definitely do much better. Unlike any other organization, IMA’s activities have a direct bearing on Nation’s health. If we have updated information on what is happening, it will be possible to guide and direct these activities to certain goals. With IMA’s reach to each and every district of West Bengal and the country we will become a Public Health giant in no time. For that to happen we have to start giving importance to the internal communication mechanisms amongst our local branches of IMA. We have taken up the challenge and wish all other in Bengal will do the same in near future. We have launched a Website www.imabehala.org 5years back and trying our level best to update it regularly with all information for our members and IMA leaders all over the country to avail in real-time. Our branch has changed to e-communication with its leadership and members at large. We have launched e-impulse (our branch news-letter) and sending it all over the country to all IMA leaders. Is it not time to file classified reports in real time by e-mail and communicate to all members (500+ till date) via [email protected] the faster, cheaper mode of communication? Is it not time to properly document what all we do and communicate with the world in real-time? IMA Behala Branch has made its presence in Face book also and more than 180 members joined till date. Information is power. It can take us to another orbit. Let’s join hands through e-communication and share, update information with all colleagues and take IMA to a new height.

THE MOST ADVANCED HI-TECH IMA OFFICE IN BENGAL The IMA Behala Branch office will stay open between 2.30-7.30pm daily except Sundays & Holidays from next association year. Many drop in during leisure for a chat & a drink. Some stop over while passing by. Many doctors who want to be member of IMA peep-in with enquiry. General masses pour in with their health oriented problems wanting some help. Different organizations contact the office for different health camps and for invitation to some health-oriented functions. Many medical representatives stop over to donate physician samples for the charitable clinic. In short, opening of IMA Behala office has made the common man feel the very presence of IMA, a doctors’ organization in the hearts of Behala.

DR. ANANDIBAI JOSHI MEMORIAL MEDICAL LIBRARY Named after the first Woman Doctor of our country in modern medicine, DR. ANANDIBAI JOSHI, a medical library was inaugurated on 13th September 2009 by our the then Branch President Dr. Sushil Kumar Bhattacharyya. We are grateful to our Finance Secretary Dr. Sneha Ranjan Bhattacharyya who has taken all pains to organize the library and maintain a computerized record of all the books available till date. The total number of books & journals in the library increased from 352 (last year) to 395 till date. We have started issuing books from the library to our members (for maximum of 7 days). We request all members to donate current books for the library.

IMA DOCTORS’ SPOUSE FORUM: 1st IN INDIA This wing was formed by the spouse of the members of our branch and was launched at the BIMACON-2010 at The Park Hotels on 16th May 2010. Behala Medical Association (IMA Behala Branch) has made it all India news as the first branch to make such a move. This forum organized a gala “RABINDRA JAYANTI” on Sunday 12th May 2013 at JMRCH, IMA Behala Branch. The Cultural Programme (Drama, Dance Drama, Dance Numbers, Solo & Duet Songs and Recitation) that was organized with perfection left the audience spell bound. Rabindra Jayanti was attended by 180 Doctors and their families totaling 245 delegates, an all time record. The traditional fun filled and enjoyable family get-together “BIMABONBHOJ” could not be organized by BIMA Doctors’ Spouse Forum this year due to unavoidable circumstances. They also organized “BIJOYA SAMMILANI” and “INTERNATIONAL WOMEN’S DAY” with Woman Doctors’ Wing and participated in BIMAWOMBCON-2013 and “BIJOY DIWAS” en-mass. They also attended in large numbers during Republic and Independence Days observation giving colour to both the days. We wish them all success for all their future activities. Since long it was our desire that the spouses of ours should club together and they have done it. Let’s help them to unite.

GREATEST ACHIEVEMENT- CELEBRATED WITH POMP & GRANDEUR: BIJOY DIWAS-2014 Behala Medical Association (IMA Behala Branch) received the Best IMA Local Branch Rotating Trophy of Gujarat State Branch for the year 2013 during 88th Annual National Conference of IMA held at Rajahmundry, A.P., on 27-29th December 2013. Hon. Secretary himself went to receive the award in person as per recommendation of the executive body. Celebration was on at our branch along with New Year 2014. “BIJOY DIWAS” was organized by IMA Behala Branch along with closing ceremony of 150th Birth Anniversary of Swami Vivekananda on 12th January 2014. “Saargam” once again organized a dazzling show on that day. Flawless Karaoke Songs, Recitation and Dance Drama “Natir Puja” was staged by “Saargam”. Dr. Bhaskar Mitra, our member and a professional singer himself stunned the audience with his melody. Thanks to Chikitsa Medicare Centre (P) Ltd. who extended their support by sending a “Huge Cake” to commemorate the occasion. I must pen down a line that I felt for the first time in IMA Behala Branch from the performers to the audience, all of us, were charged up that day with a feeling of a great achievement “The Best Local Branch in India”.

Dr. Satyabrata Kar was the President of Indian Psychiatric Society, West Bengal Chapter for the year 2012-2013.

PROBLEMS & PENDING ISSUES: Presently we are having problems of various natures. Out of the ocean I would like you to think over the following few matters and help us, guide us to formulate our course of action in relation to: 1. To make the long cherished Behala Medical Association (IMA Behala Branch) “Self Help Group” full functioning. 2. To pursue the Long-term settlement of our leased land & land deed of IMA Behala Branch. 3. To Promote membership of National Social Security Scheme, State Social Security Scheme and to form Group

Insurance at Branch Level. 4. To promote membership of IMACGP, IMAAMS at Branch level. 5. To join the fight for Clinical Establishment Rules and Changes to exclude Individual Doctor’s Chambers from it. 6. To join the fight for removal of word ‘Trade License’ in Certificate of Enlistment of Corporation/Municipalities and

exclusion of Individual Doctor’s Chambers from Certificate of Enlistment.

40.3.3 During IMA Hqrs. and IMA Bengal State Branch Elections, on receipt of the ballot paper by the respective representative of our Branch, the same should be immediately submitted to the Branch Office/Hon. Branch Secretary.

40.3.4 The Branch or its Executive Committee shall decide the Candidates to be voted (vide 40.3.3) and that shall be binding on the respective representative.

40.3.5 In case of non-compliance, the Branch shall have due rights to take action against the said Representative.

ACKNOWLEDGEMENT: Friends, with all your support, guidance and best wishes, we have spent yet another year of activities. In doing these we have received tremendous enthusiasm from different corners, from IMA State & National level leaders, leaders from neighbouring & distant branches of IMA in West Bengal and also some non-member doctors. I am aware that it is not wise to name a few but I must thank our President and our Treasurer for their active support. Further I must thank other Office Bearers, Executive body, State & Central Council members, Chairpersons, Conveners and members of different subcommittees without whose active co-operation it was impossible to do all these activities. Our office staffs have helped me in implementing the decisions taken by you. I must express my gratitude to all of them. I am thankful to our accountant and auditor for taking care of our accounts and auditing. Pharmaceutical Houses & allied groups are coming closer to us with their hands of cooperation extended. I offer my heartfelt thanks to them. And I am thankful to printers for timely release of our Annual Report & Accounts. I know that due to some unavoidable circumstances some of our friends still could not make it convenient to be with us in our glorious moments. But I seriously believe that they will overcome their own problems & will come out with open hearts in the days to come. I have high regards for each and every member of our Branch. I found in all of them beautiful synchronization, dedication and diligence. All of them are cherished treasures of our Branch. Friends, we have tried to work like a family during our journey. We may hurt the sentiments of someone; even sometimes my behavior or speech may have been harsh or hurting. I would like to request you to kindly forget it and forgive us. Please remember whatever we have done, we have done it for the interest of our association. If our activities pleased you the credit is definitely with the members at large. If there is any failure or lacunae I accept all the responsibility. Please excuse me for the lapses. At the end, once again I would like to thank you all for your generous help I received during this GOLDEN RUN of IMA Behala Branch. I hope you will agree with me that I have fulfilled my commitment towards my local branch and today we are proud that IMA Behala Branch is one of the pioneer branches in Bengal. “Neighbours’ Envy Owners’ Pride”. But while doing so I also have made many jealous enemies. Our target was to take IMA Behala Branch to reach the top in state and recognition in HQ ………………… once we have done it …..……….. now we have to sustain it …………………..…..you have to make sure that EXTERNAL FORCES that are trying to break us daily are unable to break our INTERNAL UNITY in future………………………….. I end here today with a caution
