Railway employees throughout the Indian Railways in largest number who were associated with the 65-Point Charter of Demands expressed their opinion through over 4000 polling booths spread over I.R., overwhelming in favour of Strike. The counting of ballots was witnessed by indepen- dent persons and concluded on January 22, 2014. As per the figures made available to NFIR’s Secretariat at New Delhi over 97% (97.36) of Railway employ- ees voted in favour of “INDEFINITE STRIKE”. The Federation is still hopeful that wisdom would dawn on the Government for ensuring negotiated settlement on issues in order to avert strike in the Railways. The major demands are like merger of DA with pay & grant of interim relief, guaranteed pension in lieu of new pension scheme, implementation of Railway Ministry’s proposals for improved Grades Pay of Techni- cians, Station Masters, Supervisors, Running Staff, Stenographers etc., on which Strike ballot was held. The Strike Ballot Results – Overwhelming Response for Strike remaining demands in the NFIR’s Charter need to be settled through dialogue in order to avert strike in Railways. While NFIR is keen to avoid dislocation to the Nation at this juncture, the Government should also realize its responsibility for taking decisions on major issues. NFIR conveyed its gratitude to the employees for the success of polling and urged them to be in readiness for a call in the event of failure of negotiations. The Unions of NationalFederation of Indian Railwaymen(NFIR) have successfully conductedStrike Ballot on 17th & 18th January,2014 on 17 Zonal Railways and 6Productions Units throughout theCountry. At the outset Shri M. Raghavaiahhas expressed his gratitude to theRailway Minister Shri MallikarjunKharge, for giving pro-workersdecisions during the last sixmonths as mentioned below:-

Merger of Senior P. WaySupervisor as J.E./P. Way withspread effect for promotion asSSE/P. Way w.e.f. 3rd July 2013(However, NFIR’s demand forallotment of pay scale of Rs.5000-8000 w.e.f. 01/11/2003 isstill pending in the PNM fora),

Abolition of Written rest forappointment of wards of SafetyCategory employees underLARSGESS.

Grant of 2nd chance for Aptitudetest to the wards of SafetyCategory staff under LARSGESS.

Cadre restructuring andupgradation w.e.f. 1st November2013, benefitting large number ofrailway employees of variouscategories.

Payment of PL Bonus at 78 dayswages (notional calculation @Rs. 3500/- p.m.) for Railwayemployees as a result of Hon’bleMR’s insistence in the UnionCabinet meeting held on 3rd

While thanking the Hon’ble MRfor the above decisions which havepositive impact on mass of Railwayemployees, Shri M. Raghavaiah, hasbrought out the following points forpositive response at the level ofRailway Ministry:-

(a) Upgradation of Apex levelGroup ‘C’ posts to Group `B’

General Managers’ Conference held at RailBhawan, New Delhi – 21st & 22nd Jan., 2014

Gazetted raised by NFIR in thePNM Meeting under item No. 36/98 and continued to discuss indifferent fora. He brought to thenotice of Hon’ble MR that theRailway Ministry’s proposal forupgradation of 3335 Group `C’posts to Group `B’ Gazetted ispending with the Ministry ofFinance for quite some time. Herequested Hon’ble MR to intervenefor getting clearance of FinanceMinistry soon as this issue is beingdealt since the last 1- ½ decade.

(b) LARSGESS :Shri M. Raghavaiah pointed out

to the Hon’ble MR that the staffbelonging to TRD, Bridge Deptt,Train Lighting, P.Way Khalasiswhose duties are directly connectedwith the Safety and safe Trainoperations are not covered. Thesecategories should also be broughtunder LARSGESS.

(c) Grade Pay – StationMaster Category :

Thirty Six thousand (36,000)Station Masters have been agitatedas their entry Grade Pay has notbeen revised from Rs. 2800/- to Rs.4200/- (PB-2), although RailwayMinistry had agreed three yearsback. There is no financial implica-tion as only minimal percentage ofposts in Grade Pay Rs. 2800/- existand at any given time 8% vacanciescontinued to remain. He said thatabolition of GP Rs.2800/- will notcause any disturbance to workingsystem.

(d) General Secretary/NFIRM.Raghavaiah has brought to thenotice of Hon’ble MR, the issueslisted below where RailwayMinistry had approved and theseproposals are pending with theFinance Ministry:-

Merger of Technicians II withTechnician I Grade Pay ofRs.2800/-.

Replacement of Grade Pay of

Rs.4600/- with GP Rs.4800/-(PB-2).

Revision of Grade Pay of LocoPilots (Mail/Exp) as Rs.4600/-(PB-2).

Allotment of entry Grade PayRs.5400/- to Group ‘B’ Gazetted.

Placement of JA Grade officers ofRailways in PB-4.

Additional Allowance toRunning Staff.

SAFETY :(a) While sharing with the

concern expressed by the Hon’bleMR on Safety front, Shri M.Raghavaiah, invited the attention ofthe Chairman, Members of RailwayBoard and the General Managers tothe minutes of the meeting held on12th June 2012 with CMEs/Dy.CMEs of Zonal Railways, at RailBhavan, New Delhi, and desired toknow the real implementationprogress of the minutes.

(b) Safety Seminars/Work-shops / Conferences: GeneralSecretary/NFIR has brought to thenotice of Railway Minister, theefforts being made by NFIR Unionstowards conducting SafetySeminars, Workshops and SafetyConferences pursuant to thecommunication issued by theMember Staff (Shri A.K. Goyal, videdated 25th August 2009). He howeverexpressed un-happiness that theexpected co-operation and assis-tance is not forthcoming from theRailway Administration. He alsoexpressed that granting SpecialCasual Leave and Pass facility to thestaff for attending these Seminars/Workshops/Conferences is beingrestricted although NFIR isconducting these activities forupgrading the skills, efficiency leveland safety standards among staff ofSafety Categories. He urged uponthe Railway Minister to see that theRailway Administration extends allforms of assistance to the NFIR

Unions on all 17 Zones and 6Production Units for organizingthese programmes in the overallinterest of Railway efficiency. Hespecially requested GMs to see thatAdministration also associates inthese events for enhancing the safetyconsciousness level among staff.

(c) Training : Touching theaspect of training to the staff, theGeneral Secretary/NFIR said thatthe staff recruited are required to beupgraded in their job throughmandatory training periodicallythereby their performance will bequalitatively superior andquantitatively larger.

(d) Non-filling of vacancies :He specially appealed to theRailway Ministry to see that novacancy should be allowed to existat any given time in the criticalcategories like Loco Pilots, AssttLoco Pilots, Station Masters andGuards categories. For the saidpurpose, he suggested that theGeneral Managers should beallowed to take decision for fillingup vacancies from serving staff asthese vacancies cannot be allowedto be continued in the interest ofSafety and efficiency.

(e) Work Charged posts : Mr.Raghavaiah pointed out that onZonal Railways, work chargedposts are created and continued forcarrying out regular activities butthese are not forming part of regularcadre strength resulting into denialof promotion under cadre restruc-turing.

(f) Service/working conditionsof Safety category staff : He alsobrought to the notice of Hon’ble MRthe miserable service/workingconditions of Track Maintainers(Safety Category) and reminded thatas a result of NFIR’s request in theGeneral Managers’ Conference heldon 11th January 2010, then Hon’bleMR had appointed a JointCommittee. The Joint Committeehad submitted its unanimous reportbut unfortunately its report forupgrading the Track Maintainerposts has not been implemented infull. Even the decision taken on 27th

Sept 2013 in a separate meeting heldbetween the Railway Board and the

Federations for placement of posts at6:12:22:60 ratio in Grade Pay Rs.2800, 2400, 1900 & 1800 respec-tively is yet to be implemented. Hespecifically requested the Hon’bleMR to accord approval.

Industrial Relations :(a) General Secretary/NFIR, M.

Raghavaiah has conveyed to theHon’ble MR the disappointedfeelings among the Railwayemployees over non-implementationof decisions some of which havebeen placed above and non-respon-sive attitude of the Government ongenuine issues. He apprised theHon’ble MR that a Special meetingchaired by the Railway BoardChairman was held on 23rd August2013 and in the Special meeting over34 issues were discussed, minutesof which were circulated on 2nd Sept2013 but unfortunately there hasbeen no appreciable progress.

(b) He further said that the normsissued by the Railway Ministry forcreation of posts have never beenimplemented although new assetshave been created and new serviceshave been introduced from time totime in the Railways in the last 5years. He said that the averageworker is heavily over-burdenedand frustrated. He, however, saidthat having no other alternative thanto proceed with agitation, NFIR hasconducted Strike Ballot on 17th and18th January 2014 and reports havebeen received that over-whelming

majority of railway employees prefer“Strike Action” on 65 point ofCharter of Demands of NFIR.

(c) General Secretary/NFIR atthe same time clarified to theHon’ble MR that NFIR’s track recordhas been to strengthen the IndianRailways and ensure that Railwaysprosper and serve the need of thecustomers. While strike is a lastresort to NFIR, Federation iscompelled to take this extremecourse of action having felt that noother alternative is left out. Hespecially appealed to the Hon’bleMR to take initiative in discussingwith Hon’ble Finance Minister onthe proposals sent by RailwayMinistry and followed by ShriPawan Kumar Bansal, former MR,for obtaining clearance in order toavoid untoward situation on IndianRailways.

Welfare :NFIR General Secretary, M.

Raghavaiah invited the Hon’bleMR’s attention to his discussionswith him on the welfare of employ-ees and also his communicationrelating to shortage of RailwayDoctors to the tune of 38% ofsanctioned strength and requestedthe MR to take initiative forobtaining Union Cabinet’s approvalfor enhancing the age ofsuperannuation of Railway Doctorsto 62 years. He also requested thatContract Medical Practitionersshould be allowed to work upto 10

years and equally para-medicalstaff’s continuance should beensured till vacancies are filled byregular candidates in order to seethat adequate care of railwayemployees, their families andRELHS beneficiaries is ensured.

He expressed hope that theHon’ble MR would issue suitableinstructions to the Railway Board toresolve the pending demands listedby NFIR through serious dialoguewithin the prescribed time frame.

22nd January 2014 On the 2nd day of the General

Managers’ Conference i.e. on 22/01/2014, the General Secretary/NFIR M.Raghaviah has broughtout/discussed following pointswith the Chairman, Members of theRailway Board and the GeneralManagers:-

(a) Inter-Railway transferapplications : He explained thatthe Zonal Railways are notforwarding the request applicationsinspite of clear instructions from theBoard, consequently, staff aresuffering a lot. Zonal Railways areunable to find and make availableeven the replacements as indents arenot properly placed on RRCs/RRBs.He specially urged the GMs toimplement Board’s orders byprocessing and forwarding theapplications and to get relieved thestaff duly finding replacements.

(b) Act Apprentices : Herequested the CRB, MM & MS toissue suitable instructions forengaging Course Completed ActApprentices in technical and othersafety categories as their skills are ofgreat advantage to the system. Hespecifically pointed out that Courtcases were not properly handled onNorth Western Railway andSouthern Railway. So far as NorthWestern Railway is concerned, hepointed out that the GM/SCRailway wanted to accept ActApprentices of NW Railway butthere has been no response fromNW Railway. He requested GM/NW Railway to send list of ActApprentices to SC Railway and alsoto all other Zones for inducting theminto service wherever needed.

(c) Rail Coach Factory,Raibareli: He expressed disa-ppointment that the optees have notbeen relieved to the RCF particularlyfrom S.W. Railway, SouthernRailway etc. while from other zonesstaff have since joined. This negativeapproach is causing disappoint-ment among staff who are eager to gonearer to their places by joining neworganization (Production Unit). Herequested CRB and MM to addressthis problem immediately.

(d) Harnaut Workshop/EastCentral Railway : GeneralSecretary invited the attention of theCRB/MM as well as GM to NFIR’sletters relating to the difficultiesbeing faced by the Workshop Staff atHarnaut more particularly theircadre formation, promotion, hospi-tal facilities, residential accommo-dation etc. He specially requestedthe General Manager, EC Railwayto take special initiative for removingthe hardships faced by the staff.

(e) Absorption of Quasi-Administrative Staff/WestCentral Railway : GeneralSecretary/NFIR expressed his agonyover non-implementation ofRailway Board’s decision by WestCentral Railway in regard toscreening and absorption of Quasi-Administrative staff on the Zone.He cited Railway Board’s letterdated 3rd May 2006 giving clearinstructions to GMs to absorb thosestaff who were on rolls on 10th June1997. He also said that although theBoard have issued letter in the formof reply to WCR to take decision atZonal Railway level, but WCRailway is not willing to implementBoard’s decision. He appealed theGeneral Manager, WC RailwayBoard to do the needful forabsorption of Quasi-Administrativestaff without further delay.

(f) LARSGESS : M.Raghavaiah, General Secretary/NFIR explained to the CRB and MSthe unwanted / un-called forclarification recently issued by theRailway Board stating that Safetystaff should have put in 20 yearsservice in the Safety posts only. Inthis connection, Mr Raghavaiah has

invited Railway Board’s attention toits letter dated 2nd January 2004 and11th Sept 2010 and expressed hisdisappointment over illogicalclarification issued by the RailwayBoard that too after long years. Heurged upon the Railway Board toscrap the clarification that may infuseconfidence amongst safety staff.

(g) Loco Inspectors : GeneralSecretary/NFIR brought to thenotice of Railway Board (CRB,Member Staff etc.) that the LocoPilots inducted prior to 01/01/2006were subjected to grave injustice astheir emoluments were depressedheavily in comparison with theirjuniors. He said that on representa-tion of the Federation (NFIR), theAdditional Members’ Committeehas deliberated and recommendedfor stepping up of pay butunfortunately, the Railway Boardhave not given decision.

In this connection, GeneralSecretary also explained to theRailway Board that on 10 ZonalRailways stepping up of pay wasalready granted by the GMs, one ofwhich is South East CentralRailway. The present CRB, whowas the GM/SEC Railway hadapproved the stepping up of pay.He expressed disappointment overthe negative attitude of the RailwayBoard by filing SLP before theHon’ble Supreme Court with anintention to deny the benefit to theSenior Loco Inspectors. Thisattitude of Board is giving wrongmessage among the running staff ingeneral and Loco Inspectors inparticular, he said. He speciallyrequested the CRB and MS to lookinto the aspect for withdrawing theSLP to facilitate implementation ofstepping up of pay on the remainingsix zones on Indian Railways.

(h) Catering Policy – 2010The General Secretary/NFIR has

brought to the notice of CRB that inthe wake of implementation of newCatering Policy – 2010, a jointmeeting was held. Consequentlydecision was taken that thedepartmental catering staff absorbedin IRCTC will be taken back toRailways in the Departmental

Creation of additional posts of Ticket Checking Staff was discussed in the Railway Board’s PNM Meeting withNFIR under item No. 13/2011 besides separate discussion held by GS/NFIR with the Member Traffic on 25th October,2013.

As per the norms fixed by the Railway Board over 9800 additional posts were required to be created. NFIRhad suggested that in the first phase 50% of 9800 posts may be created immediately. However, Ministry of Railways(Railway Board) have issued sanction for creation of 2500 posts of Ticket Checking Staff on the Railways as perthe details given below:

Ministry of Railways (Railway Board) have revised the constitution of Working Group constituted vide Board’sletters No. 2012/Sig/SEM/WG dated 14.11.2012 & 09/10.5.2013 to review the IRSEM Part-I & II and inclusionof Chapters on Installation and Maintenance of Electronic Interlocking in IRSEM Part-II respectively. The revisedcomposition of the Working Group (WG) is as under:-

Shri S. Lakshminarayana, HAG/S.W. Railway - Convener, (ii) Shri R.K. Jain, SAG/W.C. Railway - Member,(iii) Shri G.K. Sarkar, SAG/Eastern Railway - Member, (iv) Shri S.C. Mishra, SAG/Western Railway - Member,(v) Shri Mukesh Mehrotra, SAG/RDSO - Member.

The Terms of reference of the Working Group are as under:(i) Collect all the Instructions, Directives, Correction Slips and Guidelines issued from 1988 onwards by Railway

Board and RDSO and identify items to be included in IRSEM; (ii) Interact with Zonal Railways, RDSO and IRISETto expedite submission of Draft Chapters as list attached; (iii) Study and incorporate best International practices asapplicable on IR; and (iv) Submit updated IRSEM Part-I & Part-II, based on above, for consideration of Rly. Board.

Railway Board also decided that different chapters are assigned to individual Railways as indicated at Annexure-I. Zonal Railways may submit the allotted chapters to the Working Group for examination in the attached formatlatest by 28th February, 2014.

The Working Group should submit recommendations to Rly. Board within extended tenure i.e. 31st March, 2014.

General Secretary, NFIR, M.Raghavaiah visited Mumbai andaddressed a mammoth meeting ofworkers organized by WesternRailway Mazdoor Sangh (WRMS).Addressing to the huge gathering heexplained as to why NFIR decidedto take Strike Ballot on IndianRailways on 17th & 18th January,2014. Speaking at length he threwlight on the various demands ofRailway employees pending since along time though the RailwayMinistry had agreed to the Issues.He roared that this strike ballot is acompulsion than choice becauseeven agreed demands, referred toFinance Ministry/(DOP&T) are notbeing conceded by the Government.Most of these demands are related toanomalies of 6th Central PayCommission he said. Raghavaiahhighlighted that main demand ofmerger of 50% D.A. with pay hasnot been considered though theletter dated 14.10.2013 addressed toPrime Minister by NFIR in thisregard was forwarded by PMO tothe Finance Ministry. It is a matterof great concern that DearnessAllowance presently paid @ 90% ofpay will soon reach above 100%, hesaid. Since the 7th Central PayCommission is going to be

constituted, the merger of DA isabsolutely necessary to protect theemployees from uncontrolledinflation, Raghavaiah said.

The “Gender SensitizationWorkshop” organized by ITF atChennai from 9-12-2013 to 11-12-2013 was attended by Shri A.Srinivasa Rao, SCRES ViceChairman of Tirupati Branch-I andSmt. R. Vishnu Vandana of SCRESfrom Secunderabad.

With opening remarks by ShriMahendra Sharma, RegionalSecretary, ITF Asia Pacific Region,C.A. Rajasridhar, ITF ExecutiveBoard Member and G.M.Krishnamurthy, General Secretary,Madras Port Trust EmployeesUnion, the Workshop session wascommenced. 35 representatives fromTransport Sector in India, affiliatedto ITF participated in the Workshop.

The concept of Gender, Sex,Impact of Gender on Men andWomen, Gender Stereotypes andPatriarchy were explained by Ms.B.N. Usha in Group discussion. TheGroups also discussed on theViolence against women – under-standing why violence happensagainst women, Inter linkagesbetween women’s vulnerability,gender discrimination etc. Thefollowing vital points were alsoexplained by Ms. B.N. Usha.

Biologically men are strongerthan women.

By nature female gender aresober whereas masculine genderis tough.

Women are good at attendingtheir children than Men.

Women are their own worstenemies.

Violence against women ismostly observed in backwardand uneducated families.

Women with inappropriateculture themselves inviteassault, and violence.

Disturbances in domestic frontshould be dealt optimistically.

On 10th December, 2013, GeethaMenon explained her viewsfocusing on institutions that impacton women and also encouraged theparticipants to give their views onvarious issues relating to Family,Health, Police, judiciary, Religion,Culture, and governance. Ms.Geetha Menon drew the attention ofthe groups divided amongst partici-pants on the following topics.

Gender inequality.

Dalit women who are the mostoppressed facing in equality incaste, culture in society.

Personal law.

Mangalore case: Women widowsare allowed to become priests.

Sha-Bhanu case: Claimedmaintenance from her husbandafter many years ofabandonment.

Society: Adivasi Society.

Adi Dravida: First man, periodof equality.

Tribal women: Made to work likescavengers.Communal violence.Family: Tribal, joint family,urbanization of family, nucleusfamily, live in relationships(Acceptance/Non-acceptance).A Film show on gender, work

place situation, informal economy,sexual harassment and itschallenges was presented by Ms.Nishi Kapahi, ITF Coordinator, AsiaPacific Region.

On 11th December, 2013, the roleof trade unions in addressing theissues relating gender equality werediscussed by the participants.

Three days workshop on“Gender Sensitization” wasevaluated and concluded by Ms.Nishi Kapahi and Ms. GeethaMenon.

The International TransportWorkers’ Federation (ITF) conducteda workshop on ImprovingCommunication in Unions on 06th& 07th January 2014 at Mumbai. Theworkshop was attended by membersof various unions from IndianRailways, Road Transport, Airlinesand Port Trust. The ITF workshopwas conducted by:

Smt. Nishi Kapahi, S/Shri SangamTripathi, Smt Geeta, ITF, ArvindKoshal, Rashid Ali, CommunicationExpert, New Delhi, Manoranjan Pegu,Resource Person, PSI.

The introductory message wasgiven by Shri Sangam Tripathi on06th January 2014 emphasizing theneed of Communications and itsimportance in propagating informa-tion. Shri Rashid Ali explained theimportance and history ofCommunication. A group exercisewas conducted by dividing theparticipants into 6 groups. Eachgroup leader was asked to explainthe discussions and the outcome ofthe Group discussions. All themembers along with Smt Rawat(visiting professor) gave expertcomments on the group discussions.

Shri Manoranjan Pegu explainedthe importance and role of emergingtechnologies and Social Media inImproving Communications. ShriArvind Koshal explained theimportance of Skype and Viber andtheir use in day to day activities inUnions. Shri Rashid Ali explainedthe use of Whatsapp. Shri K.Vishnu, Incharge, NFIR MediaCenter, explained the Communica-tion network in NFIR affiliates alongwith the NFIR website and itsfunctioning.

26 participants including (6representatives from NFIR) belong-ing to 15 unions affiliated to ITFparticipated in the workshop. Onthe whole the outcome of theworkshop is the present mind setupshould be changed and the tradeunion leaders must be trained in

invited attention of CRB to formaldiscussions held by NFIR since last15 years in the PNM fora andpointed out that although normsissued, the implementation has notseen the light of the day. He reques-ted quick action by the RailwayBoard. Similarly, he mentionedabout the urgent requirement ofadditional posts for TRD.

NFIR General Secretary hasbrought to the notice of the RailwayBoard and General Managers thatcadre restructuring implementationis resulting in surrender of posts inthe name of matching money value.As number of staff were alreadyupgraded under MACP Schemethus no financial implication areinvolved. He at the same timerequested the CRB and MS thatthere is no scope for matching andhence surrender of posts should notbe insisted upon. He speciallyrequested the GMs that the workcharge posts operated on Open linecontinuously for over three yearsshould be converted into regularpost. The conversion of these postsinto permanent is permissible interms of extant instructions of Rly.Board. Such an action would givesome benefit of promotion underrestructuring to the staff who areanxiously waiting for promotionand whose promotions are delayeddue to continued operation of workcharge posts against revenue works.

Central Office Bearers meeting ofWest Central Railway MazdoorSangh was held at Kota on 28th

December, 2013/WCRMS President,R.P. Bhatnagar presided over themeeting. WCRMS General Secretary,Ashok Sharma, Zonal Office Bearersand Central Office Bearers ofJabalpur, Bhopal and Kota Divi-sions were present. On arrival of thePresident Shri R.P. Bhatnagar fromMumbai was warmly welcomed atKota Railway Station from where arally was organized which reachedto the venue of the meeting. Theorganizational matters performedduring the year 2013 and the actionplan for 2014 to strengthen theorganization as also the develop-ment of Railway employees werediscussed.

At Kota Railway Station thewheel chair programme wasinaugurated by WCRMS President,R.P. Bhatnagar and DivisionalRailway Manager, Smt. ArchnaJoshi. WCRMS donated four wheelchairs on the occasion. Smt. ArchnaJoshi, DRM appreciated this welfareprogramme organized by WCRMS.

WCRMS President, R.P.Bhatnagar in his address said thatsignificant achievements have beenmade during the year 2013 andhoped that year 2014 would fetchmore benefits to the Railwayemployees. He also wished to theRailway employees and theirfamilies for prosperity in 2014 andthanked them on his re-election asWorking President of NFIR in theNational Convention at Visakha-patnam. WCRMS General Secretary,Ashok Sharma also addressed themeeting.

The duty Roster of 12 hrs.should be changed to 8 hrs. forRailway employees.

Permission process for takinghigher education be made easyand all facilities be provided.

Pass and Medical facilitiesshould be provided to depen-dent parents of employees.

Hostel facilities be provided tonewly appointed employees tillthe alternative residentialaccommodation is made bythem.

Uniforms or Dress Allowanceshould be given to employees.

“5 years condition” forchanging the department shouldbe removed.

More facilities be provided in theRailway Institutes.

The alertness and the timelyaction of the track maintainer Y.Chandru Naidu and Sr. SupervisorM. Sambasiva Rao has averted apossible train mishap was apprecia-ted and they were felicitated byNFIR General Secretary in theSCRES General Council Meeting atSecunderabad on 30.12.2013.

Shri Y. Chandru Naidu, TrackMaintainer while patrolling trackbetween Tsunduru and Tenalistations noticed a flash butt weldfailure having a gap of 8 mm whichled to a level difference of 60 mmbetween the separated rails. Heimmediately alerted the DivisionalControl office at Vijayawada andpromptly relayed the informationabout this weld failure to seniorofficials. The Train No. 12621Chennai – New Delhi TamilnaduExpress already left TsunduruStation towards Tenali waspromptly stopped short of the spotin time by Chandru Naidu byflashing a red lamp signal.

M. Sambasiva Rao immediatelyrushed to the spot with additionalstaff within 30 minutes and bylifting the track physically broughtboth the rails to an even level, fishplated and clamped them quickly.After carefully ensuring the safety,they allowed the train to pass witha restricted speed of 20 kmph. Theentire action was completed withinan hour and the train was allowedto proceed further.

In appreciation of their safetyconsciousness, alertness in thecourse of their duty and theircommendable action in response tosuch a situation, Shri P.K.Srivastava, General Manager, SouthCentral Railway has alreadyawarded them with a cash award atRail Nilayam on 18th December,2013.

SECRMC Meeting withMOSR Adhir RanjanChoudhary

South East Central RailwayMazdoor Congress (SECRMC)warmly welcomed and felicitatedShri Adhir Ranjan Choudhary, StateMinister for Railways at Bilaspur on31st December, 2013. All the CentralOffice Bearers, Branch Secretariesand other office bearers includingcadre of SECRMC from all the threeDivisions participated.

As part of his visit to South EastCentral Railway (SECR)Headquarters, The MOSR met SouthEast Central Railway MazdoorCongress (SECRMC) representativesapart from his other meetings linedup as part of his visit. SECRMCdelegation led by its GeneralSecretary, K.S. Murty and PresidentTapan Chatterjee met RailwayMinister and handed over aMemorandum highlighting theproblems of SECR and Railwayemployees.

During his discussion withMinister, SECRMC GeneralSecretary, K.S. Murty urged MOSRfor redressal of pending demands.Elaborating about their demands,General Secretary informed thatlarge number of works are pendingwith Railway Board for sanctionresulting difficulties. He said that inSECR, being the highest freight

loading and earning zone overIndian Railways, every year, there isa growth of traffic to the extent of 7-10 per cent. In the absence of fundsfor development of works related tosafety and traffic, facilities has led todeterioration in the efficiency of thesystem, Mr. Murty narrated. Hefurther said that with the inceptionof SECR, the sanctioned work forcewas about 50 thousand whereas thepresent staff strength is 43thousand. This has over burdenedthe existing staff, he mentioned. Thestaff amenities such as constructionof new staff quarters, renovation andrepair of the existing quarters,streets, and drainage system hasalso been very poor due to shortageof funds.

K.S. Murty also said that besidesno staff being sanctioned againstnew assets, the amenities for publicare also not able to satisfy for wantof fund. He said that the proposal ofRailway Medical College in Bilaspuris yet to come up which wouldfelicitate the children of local peopleand also of the Railway employeesin particular. SECRMC demandedimmediate scrapping of NewPension Scheme (NPS) which cameinto existence from January 01, 2004.

He also discussed with theMinister on large number of staffmatters represented by NationalFederation of Indian Railwaymen(NFIR) at the Railway Board’s levelwhich have not been finalized. The

non-finalization of the issues hasgenerated serious discontentmentamong the Railway employees andfurther delay may ultimately lead tostaff agitation, he explained toMOSR.

NFIR References to Railway MinistryLetters to Secretary Rly. Board

Restructuring of certainGroup ‘C’ – reg.

Ref: (i) Railway Board’s letterNo.PC-III/2013/CRC/4 dated 08/10/2013, (ii) NFIR’s letter No.I/8/CRC/09/Vol.9 dated 09/10/2013.

Pursuant to the instructions videletter dated 08/10/2013 forrestructuring of certain Group ‘C’cadres, NFIR vide its letter dated 09/10/2013 had invited attention of theRailway Board on the followingitems in accordance with the agree-ments reached with the Federationsduring various CRC meetings:-

(i) Agreed percentage of TechnicalSupervisors 70:30 in GP Rs.4600& GP 4200 has been alteredarbitrarily to 67:33, Agreedpercentages of S&T, CMT andMinisterial Staff have not beenimplemented in toto.

(ii) Federations had never agreedand accepted for providingmatching savings, consequentsurrender of posts for implemen-tation of cadre restructuring,conditions imposed under paras12.1 & 12.2 of Board letter dated08/10/2013 needs to be deleted.

Federation is yet to receive aresponse.

Besides above, NFIR has noticedthat the Railway Board in the letterdated 08/10/2013 have addedfollowing additional conditionsgiving negative impact to theprocess of implementation ofrestructuring in the cadres where itis to be implemented.

Federation highlights below thesuperfluous conditions which werenot at all warranted have beenarbitrarily prescribed in theinstructions issued by RailwayBoard vide letter dated 08/10/2013:-

(i) Portion of para 2 added inBoard’s letter dated 08/10/2013

“Only those temporary postswhich are in operation for atleastthree years may also be taken intoaccount for the purpose of applying

revised percentages. This will besubject to clarification that theseposts are meant for regularactivities which will continue andnot for any sporadic require-ments”.

(ii) Portion of para 10 added inBoard’s letter dated 08/10/2013

“However, in those caseswhere due to pin-pointing of postsstaff is required to join duties inthe upgraded posts at a differentstation, such staff may be allowedthe benefit of upgradation/promotion on” as is where isbasis” for the time being andallowed to join the pin-pointedpost at the new station within sixmonths time from the date of issueof promotion order, subject to thesatisfaction of HOD on merit ineach case.

In this connection, NFIR wishesto invite attention of Railway Boardis invited to the earlier instructionsissued on restructuring of Group‘C’ & ‘D’ cadres under letter No.PC-III/2003/CRC/6 dated 09/10/2003 wherein applicability tovarious cadres has been done in thefollowing manner

“These orders will beapplicable on the regular cadres(excluding surplus & super-numerary posts) of the Open Lineestablishments including Work-shops and Production Units. Theseorders will, however, not beapplicable to staff of RDSO forwhich separate orders will beissued.

These orders will not beapplicable to ex-cadre & work-charged posts which will continueto be based on worth of charge.

These instructions will also notbe applicable to construction Unitsand Projects, where posts aregenerally created on worth ofchare basis, though those shouldbroadly be conforming to thesepercentage distributions.”

NFIR further wishes to inviteattention of Railway Board to para

16 of Board’s letter dated 09/10/2003 where following provision hasbeen made for pin-pointing of posts:-

“The Administration should takesteps to pin-point the additionalposts arising out of this restructuringas per administrative requirements.

Perusal of position as brought outby NFIR in para 2&3 above wouldreveal as to how Railway Board havetried to make the cadre restructuringcomplicated, dis-advantageous to thestaff besides hard to implement. Asa matter of fact, the conditionsmentioned in the previousinstructions dated 09/10/2003 (para2&16) mentioned in para 3 abovecould have served the purpose. Theadditions now made in para 2&10 inletter dated 08/10/2013 which aregiving negative effect has generateddeep sense of anguish and frustrationamong railway employees on theZonal Railways and ProductionUnits. On Zonal Railways, newposts were sanctioned formaintaining newly created assetsand manning newly introducedservices during the years 2010, 2011,2012 and 2013. The Board’sinstruction dated 08/10/2013prohibit treating those posts as partof cadre for the purpose of cadrerestructuring. Federation stronglyprotests against these anti-workerrestrictions.

NFIR, therefore, requests RailwayBoard to modify the instructionsissued vide letter dated 08/10/2013on the lines brought out by theFederation. On cadre restructuringand issue amendment early beforeeffective implementation of theinstructions.

The issue of career growth ofChemical and MetallurgicalAssistants Gr I&II has since beenraised by NFIR in the PNM fora atRailway Board’s level under ItemNo. 1/2011 for over two years forgetting justice imparted to CMAs.There has virtually been no progresson the issue despite writing threeletters by the Federation quotedunder reference. The issue has alsobeen discussed by GS/NFIR withED/E PC-II more than once butwithout positive results and thePNM item continues to be pendingfor over two years.

NFIR, therefore, once againrequests the Railway Board tokindly see that suitable instructionsare issued to redress the grievanceof CMT staff. Federation may beadvised of the action taken.

ECoRSC an affiliate of NFIR hasreported to the Federation that theseinstructions are not being adheredto on East Coast Railway.Federation further wishes to statethat the ECoRSC had raised theissue in the Zonal PNM for paymentof Consolidated TravellingAllowance to Ticket Checking Staffunfortunately General Manager didnot agree.

Placement of erstwhile Group‘D’ staff in PB-1+GP Rs.1800/ -reg.

There have been cases of Railwayemployees who were non-matriculates and while working inerstwhile Group ‘D’ categoriesduring the period from 05/09/2008to the date of completion ofappropriate training, have eitherretired/died in harness beforecompleting the formality of trainingfor placing them in GP Rs.1800/-(PB-1). These former employees havenot been extended the benefit of PB-1 with GP Rs.1800/- with the resultthey have been deprived ofpensionary benefits.

South Central Railway inparticular has instead of extendingbenefit to these former Group ‘D’employees pursuant to RailwayBoard’s instructions vide RBENo.162/10 and letter No.PC-VI/2008/I/3/1 dated 08/11/2010 hasmade a reference to Railway Boardvide letter No.P[R]/531/1 dated 08/03/2013 (Copy enclosed), seekingclarification, the same is stillpending for over six months and theformer employees have been madeto suffer.

NFIR, therefore, requests theRailway Board to issue suitableclarificatory instructions forgranting Grade Pay of Rs.1800/-(PB-1) in the above situations.Suitable clarification be sent to GM/S.C.Railway in reply to his referenceduly endorsing copy to thisFederation.

Injustice done to the staffretired/retiring on 30th June ofevery year w.e.f. 01/01/2006pursuant to implementation ofthe recommendations of 6thCPC-reg.

NFIR has been receivinggrievances from number of railwayemployees who have retired fromrailway service on attaining the agef super-annuation on 30th June of2007, 2008, 2009, 2010, 2011, 2012,2013 as they have been denied thebenefit of annual increment at thetime of retirement even though theyhad put in 12 months continuousservice on 30th June.

In this connection, Federationinvites attention of Railway Board toRule 10 of G.S.R 643 (E) circulatedunder RBE No. 103/2008 relevantextract of which is reproducedbelow:-

“Date of next increment in therevised pay structure-There will bea uniform date of annual incrementviz 1st July of every year. Employeescompleting 6 months and above inthe revised paystructure as on 1st

July will be eligible to be grantedthe increment.”

Above-mentioned provisionclearly states that for earningannual increment, the employeeshave to complete only 6 months inthe revised pay structure of 6th CPC,whereas those retired on 30th June of2007 to 2013 have completed morethan six months and have rathercompleted 12 months on 30th June.As matter of fact, these employeesare eligible for one increment whichshould be added in the pay (in PayBand + GP) at the time of retirementand calculating settlement dues tothese staff to save from financialhardships.

NFIR, therefore, requests theRailway Board to issue suitableclarificatory instructions to redressthe grievances of these staff. A copyof the instruction issued may beendorsed to NFIR.

On perusal of the proposedchannel of promotion for the post ofJE(P.Way), consequent upon themerger of Sr.P.Way Supervisors withJE(P.Way), NFIR conveys that in theheading “Mode of Induction” (Col.No.5), though a quota of 20% ofvacancies has been earmarked to befilled by promotion but the proposaldoes not indicate as to which staffwould be eligible for promotion.

Keeping in view above point,NFIR suggests formulating newchannel of promotion as mentionedbelow:-

: 25% (Promotion)

While vacancies falling under25% LDCE quota may be filled, ashas been indicated in the Board’sproposal, the promotion quotavacancies (25%) may be allowed tobe filled up as follows:-

During the course of NFIR’s PNMmeeting held on 20/21.02.2013while discussing item No.27/2012,Federation was advised that replyfrom Zonal Railway is awaited.Federation, however, insisted thatregularisation of Teachers of WestCentral Railway should be

considered by the Railway Board onthe similar pattern as has been donefor regularisation of SubstituteTeachers of other Zonal Railways.

In this connection, NFIR wishesto convey to the Railway Board thatdetailed reply has since been sent byW.C.Railway to Railway Boardunder letter No.WCR/P-HQ/Wel/Substitute Teacher dated 01/11/2013 seeking Board’s decision, thesame may be connected.

NFIR, therefore, once againrequests the Railway Board toconsider and communicate approvalfor regularisation of four substituteteachers on West Central Railway. Acopy of communication thus sentmay be endorsed to the Federation.

Request Transfers ofEmployees from one departmentto other departments in GradePay of Rs.1800/- (PB-1)

NFIR desires to state that theminimum entry qualification to thelowest Grade Pay post of Rs.1800/- (PB-1) on Railways is Matricula-tion or its equivalent. With this newpolicy decision of the RailwayMinistry pursuant to implementa-tion of recommendations of the VICPC, no candidate is eligible to beinducated in the Grade Pay ofRs.1800/- unless he fulfills thequalification condition i.e. Matri-culation or ITI as the case may be.

Representations are beingreceived from the erstwhile Group-D staff who are in Grade Pay ofRs.1800/- demanding that theirrequests for transfer on bottomseniority to other departments in thesame Grade Pay should be allowed.The present IREM provisions arenot providing greater clarity foradministration to consider suchrequests. Due to the reluctance onthe part of the competent authoritiesin conceding the request transferapplications of erstwhile Group-Dstaff from department to other,disappointment is growing amongthe staff who possess the requiredqualification.

Need has therefore arisen toreview the IREM provisions to

facilitate the staff to go on requesttransfer to other departments in theentry Grade Pay of Rs.1800/- onbottom seniority. In this context,NFIR also wants the Railway Boardto appreciate that Inter ZonalTransfers/Inter Divisional Transfersin the recruitment Grade Pay areallowed subject to fulfillment ofEducational Qualification prescri-bed for direct recruitment.

There are Track Maintainers whopossess Matriculation or aboveseeking transfers on bottom seniorityto the Technical Departments likeS&T, Electrical etc., Although, theseTrack Maintainers have fulfilled theentry qualification condition, theAdministration on many Zones isnot processing such requests eventhough vacancies exist. Similarly, theerstwhile Group-D Staff of TechnicalDepartments when they seek transferon bottom seniority to otherdepartment due to their domesticproblems, such cases are also notbeing considered favourably thoughthey possess the qualificationrequired for holding the post towhich they sought transfer.

Time has come to remove theconfusion as above in order to createsatisfaction among the staff whodesire to pursue their career byseeking transfer to other depart-ments.

NFIR, therefore, urges upon theRailway Board to consider theabove points and issue suitableamendment to the IREM Provisionsfacilitating erstwhile Group-D staffin Grade Pay of Rs.1800/- to seektransfer on bottom seniority to thesame Grade Pay Post in othercadres/departments.

NFIR has received complaintsfrom retired railway officers aboutarbitrary reduction in theentitlement for 2 berths in 2nd AC/4 berths in 3rd AC of RajdhaniExpress trains consequent to issue ofinstructions by the Railway Boardvide letter dated 03/02/2011.Federation is disappointed to notethat the railway officers who retiredfrom railway service during 01/01/2006 to 03/02/2011 were earlierentitled to avail 2 berths in 2nd AC/4 Berths in 3AC against compli-mentary pass when Railway Boardissued circular dated 06 January2011.

In this connection, Federationwishes to point out further that theRailway Board in circular dated 03/02/2011 has imposed two uncalledfor restriction mentioned below

Officers in GP Rs 6600/- anddrawing pay of Rs 26,600/- andabove and

excluding Grade Pay

& resulting deprival of the retiredrailway officers of the privilegewhich they were availingpreviously. Federation wishes tostate that the restrictions imposed byRailway Board are therefore, grosslyunjustified, and are against theinterests of retired officers.

Time and again, NFIR has beenreminding the Railway Board aboutthe necessity for extending thecurrency of instructions dated 03/09/2009 on the subject at least upto31/12/2015 pending discussionswith the Federations. Railway there isheavy shortage of AC Maintenanceand Escorting Staff due to noncreation of posts as per the yardstickalthough additional AC Coacheshave been introduced on number oftrains. In view of this situation,matching savings for implemen-tation of cadre restructuring for ACstaff is not possible.

Under the circumstances explai-ned above, suitable instructions arerequired to be issued to S.W.Railway to find matching savings onother departments. If such exercisehas also not yielded result, exemp-tion from “matching savings” beconsidered as a special case.

Simplification ofRules/Procedure onwithdrawal from PF

“Regarding conditions forfinal withdrawal for marriageexpenses from ProvidentFund, it is advised that finalwithdrawal for marriageexpenses from Provident Fundare subject to the condi-tionslaid down under Rule 922 andRule 925 read with sub-rule (3)of Indian Railway Establi-shment Code Vol. I.

In terms of sub-rule (e) ofRule 925(3), the subscribershall furnish a certificate to thesanctioning authority withinthe period of one month fromthe date of the marriage, or ifhe is on leave on the date of themarriage, within one monthon return from leave, that themoney withdrawn hasactually been utilized for thepurpose for which it wasintended. If the subscriber failsto furnish the requisitecertificate, or if the amountwithdrawn is utilized for apurpose other than that forwhich sanction was given theentire amount shall berecovered forthwith from himin one lump-sum together withinterest thereon at the rateprovided for in rule 920 (1)from the month of the with-drawal, for being credited tohis account in the ProvidentFund.”

Accordingly, it has been decidedthat all erstwhile Group ‘D’ cate-gories in G.P. Rs. 1800, since upgra-ded as Group ‘C’, will continue tobe eligible for selection to Group ‘C’posts as per the AVC alreadyprovided, if they possess therequired eligibility criteria i.e.prescribed educational qualificationand residency period etc. They willalso be eligible for being consideredfor promotion to the posts ofStenographers (G.P. Rs. 2400), if theypossess the required eligibilitycriteria.

Few Zonal Railways had soughtclarification regarding the eligibilityconditions for seeking the benefit ofLARSGESS and also the level ofAssessment Committee in respect ofspecified safety categories inGP1900. This issue has also beenraised by the Employees’Federations.

The matter has been consideredby the Board. In partial modificationof the instruction contained in para4 of Board’s above referred letter inthas been decided that the wards ofemployees in specified safetycategories in GP 1900 (other thanDrivers) may be adjudged by anAssessment Committee consisting of3 JAG Officers at Divisional levelinstead of an Assessment Committee

of 3 SAG Officers at Zonal level.

These instructions are applicablefor retirement/recruitment cyclefrom January – June 2014 onwardsonly. The past cycles will begoverned by the earlier instructions.

The other terms and conditionsof the Scheme will remain the same.

G.S.R. 662(E) - In exercise of thepowers conferred by sub-section (1)of Section 37 of the Apprentices Act,1961 (52 of 1961), the CentralGovernment, after consulting theCentral Apprenticeship Council,hereby makes the following rulesfurther to amend the ApprenticeshipRules, 1992, namely :-

(1) These rules may be called theApprentiship (Second Amendment)Rules, 2013.

(2) They shall come into force onthe date of their publication in theOfficial Gazette.

In the Apprenticeship Rules,1992, in sub-rule (1) of Rule 11, forclauses (a), (b), (c) and (d) and theentries relating thereto, thefollowing shall be substituted,namely:-

"(a) During the first year oftraining - ` 2100 per month

(b) During the Second year oftraining - ` 2400 per month

(c) During the third year oftraining - ` 2800 per month

Determination of date ofincrement after expiry ofduration of penalties ofwithholding of increments/reduction to lower stageimposed for less than a yearregarding

Ministry of Railway havereceived a few references regardingcertain penalties of rule 6 of RailwayServants (Discipline And Appeal)Rules, 1968 which are having payelement imposed for less than a year.In one case, the penalty ofwithholding of increments wasimposed on 24-3-2008 for a periodof six months with cumulative effectand in the other case the penalty ofreduction to lower stage wasimposed on 9-2-2009 for a period ofsix months with non-cumulativeeffect.

The question of date of release ofincrement in the above cases onexpiry of the penalty, in the contextof fixing of Ist July as the date ofincrement uniformally for allGovernment servants following VIthCPC, has been examined inconsultation with the Department ofPersonnel & Training. It is advisedthat fixing of Ist July as the date ofincrement for all Governmentservants under the Revised PayRules following the acceptance ofthe recommendation of the VIthCPC, is relevant only in respect ofAnnual increment. This provision isnot applicable where the incrementis withheld as a measure of penalty.In cases where the increment iswithheld as a penalty for a specifiedperiod restoration of the withheldincrement would be at the end of thecurrency of the penalty and notpostponed to the next Ist July. Theperson concerned may even beentitled to the next increment on theIst July following the expiry of thecurrency of the penalty,(notwithstanding the fact that thepenalty imposed on him was having

postponing effect on his futureincrements), if he has net qualifyingservice of six months prior to therelevants Ist July.

The test is given to thecandidates to judge their power ofreasoning spread in verbal and nonverbal areas. Revenue Earnings upby 13.27 per cent duringApril - November, 2013

The total approximate earningsof Indian Railways on originatingbasis during 1 April - 30 November,2013 were Rs.89,339.64 crorecompared to Rs.78,871.47 croreduring the same period last year,registering an increase of 13.27 percent. The total goods earnings havegone up from Rs.54,482.80 croreduring 1 April – 30 November, 2012to Rs.60,150.41 crore during 1April– 30 November, 2013, registering anincrease of 10.40 per cent.

The Total passenger revenueearnings during 1 April-30 Novem-ber 2013 were Rs.24,523.69 crorecompared to Rs.20,423.28 croreduring the same period last year,registering an increase of 20.08percent. The approximate revenueearnings from other coachingamounted to Rs.2515.81 croreduring April-November 2013compared to Rs.2061.53 croreduring the same period last year, anincrease of 22.04 per cent.

The total approximate numbers

of passengers booked during 1 April– 30 November, 2013 were 5662.38million compared to 5695.10 millionduring the same period last year,showing a decrease of 0.57 per cent.In the suburban and non-suburbansectors, the numbers of passengersbooked during April-November,2013 were 3027.88 million and2634.50 million compared to 2958.80million and 2736.30 million duringthe same period last year, showingan increase of 2.33 per cent and adecrease of 3.72 percent respectively.
