NATURALIZATIONApplication for Indonesian citizenship (Naturalization)

Law Number 12 Year 2006

Article 1 para 3 of the Law Number 12 Year 2006 regarding the Indonesian Citizenship: Naturalization is a process of changing the status that should be fulfilled by a foreign resident to become Indonesian citizenship. Therefore, the foreign resident should meet certain requirements specified in the prevailing laws and the regulations of the Republic of Indonesia.

Article 8 to Article 18 of the Law Number 2006:the intention of a foreign resident to be granted with Indonesian citizenship should be done in writing, through a letter/written request in Bahasa Indonesia with a stamp, and addressed to the Minister of Legal Affairs and Human Rights, and as for the accompanying documents, should be addressed to the Head of the Provincial Office of the Department of Legal Affairs and Human Rights

Foreign resident/applicant should meet the following requirements:•Age 18 years old or married;•at the time of the submission of the letter of request, the foreign resident/applicant has resided in Indonesia for 5 (five) years consecutively or 10 (ten) years non-consecutively;•Physical and mentally healthy;•have the ability to speak Bahasa Indonesia and acknowledge Pancasila (the Five Principles) as the national ideology of the Republic of Indonesia as well as the Indonesian Constitution of 1945;•have never been sentenced or committed in criminal crime;•the granting of the Indonesian citizenship does not result in dual-citizenship for the foreign resident;•have a fixed or permanent work/occupation as well as monthly income;•pay a certain amount of money to the state treasury.

Naturalization by means of marriageMinister of Legal Affairs and Human Rights Decree, No. M.02-

HL.05.06 Year 2006, dated 26 September 2006

•Foreign resident who legally married to an Indonesian can obtain Indonesian citizenship if the said foreign resident has resided in Indonesia for 5 years consecutively or 10 years non-consecutively, unless by gaining the Indonesian citizenship has resulted in dual-citizenship to the foreign resident. •In the case of dual-citizenship, the said foreign citizen can be granted with a permanent resident based on the prevailing law and regulation of the Republic of Indonesia.

The granting of the Indonesian citizenship by the State

Foreign resident who is regarded as having a great or significant contribution to the Republic of Indonesia or if the circumstance is deemed necessary, can be granted with Indonesian citizenship by the President of the Republic of Indonesia upon receiving the consideration provided by the People’s Representative of the republic of Indonesia (Parliament), unless the granting of citizenship may result in dual-citizenship to the said foreign resident

IMMIGRATION Visas of the Republic of Indonesia

•May be issued in the form of an official stamp, a sheet of paper inserted into or attached to a passport, an ordinary card, or an electronic card•The type of visa issued shall be based on the visa application•A Diplomatic Visa or a Service Visa shall only be issued to the bearer of a Diplomatic Passport or a Service Passport (diplomatic letters or official letters) A visa application should be submitted to the Embassy or Consular Office of the Republic of Indonesia or other official designated by Government of the

Republic of Indonesia.

Visas shall be used within 90 (ninety) days, calculated from the date of issuance. Any foreign national who fails to use a visa within this designated

period of time must submit a re-application for a new visa.

General Visa Requirements

Visa applications should be submitted to the Visa Officer after filling out the required form. A visa application should be submitted along with the following:

1. a valid passport (a passport is considered valid at least 6 months before its expiration);

2. a round trip or through-ticket to country of destination; 3. 2 (two) photographs, size 4 x 6 cm; 4. proof or written guarantee of possession of sufficient

funds for living expenses during entire stay in Indonesia; 5. payment of the visa fee.

Please note: Other nationals without residence permit in Thailand must apply for a visa at Indonesian Embassies or Consulates in their home country.
