This contract modification increases the total contract amount of the intersection improvement project from $305,000 to $345,000. The project is funded with both Federal and State funds and requires a 10 percent local share. The original local match for the project was $30,500.00. The increase in the City of Bangor's local share resulting from this Modification is $4,000.00 for a total city share of $34,500.00.

Modification 2 amends an Agreement between MaineDOT and the City of Bangor that was executed on June 5, 2017, in order to meet the current cost estimate for the project referenced above, as follows:

Increased Project Cost. The estimated Project Cost shall be increased by $40,000.00 – from $305,000.00 to $345,000.00.

Increased Payable Amount. The maximum payable to the Municipality at the rate of 90 percent of federally participating costs shall be increased by $36,000.00 – from $274,500.00 to $310,500.00.

Increased Local Share. The Municipality’s 10 percent share of federally participating costs shall be increased by $4,000.00 – from $30,500.00 to $34,500.00.

All other terms and conditions of the original Agreement shall remain in effect with no gap. MaineDOT and the City of Bangor, by their duly authorized representatives, have executed this modification on the date last signed below.

RE: Mid-Year Compliance Update (Consent Decree, Civil Action No. 1:15-cv-00350-NT)

Dear Mr. Alex Rosenberg:

The City of Bangor is pleased to submit this mid-year compliance update pursuant to the requirements of the United States and State of Maine v. City of Bangor Consent Decree, Civil Action No. 1:15-cv-0035-NT, entered on November 12, 2015, for work that has taken place from January 1 through May 31, 2020.

I. Measures Taken to Reduce CSO and SSO Volumes

A. Capital Improvement Projects

Railroad Street Regulator The Railroad Street regulator structure was bid in the winter of 2019 with construction starting in March 2019. The project was substantially completed in January of 2020 with the installation of the gate valve actuators. The Railroad Street regulator structure was designed to improve hydraulics at the regulator and upsize the dry weather connection from 30" and 21" to 42". This project also replaces several sections of the Davis Brook stone outfall sewer with box culvert to reduce inflow/infiltration and overall structure integrity of the pipe sections. A few cosmetic punch list items (loam, seeding and roadway paving) remain. These will be completed following private construction work on the adjacent concert venue. The anticipated completion date has been delayed due to the Covid-19 pandemic.

Davis Brook Storage Tank Construction of the Davis Brook Storage Tank (DBST) began in late February of 2020. When complete, the DBST will have a 3.8 MG storage capacity, in addition to the 1.2MG capacity of the existing Davis Brook Storage Conduit, for a combined capacity of 5.0MG. The fall of 2021 expected completion date was revised to July 30, 2022 to adjust for quoted lead times during the bid process.

Main Street Separation This project in the Barkersville and Hildreth-Perry subsections consisted of sewer and storm drain replacement with two separated catch basins. The City’s work consisted of sewer replacement and storm drain separation. Approximately 1100 linear feet of brick sewer were replaced with PVC. Four new separated catch basins, 42 feet of storm drain and 780 feet of separated underdrain were installed. The project was substantially complete by the end of November 2019. Some remaining minor punch list items (loam, seeding, manhole cover adjustments) remain and will be completed this June. The MaineDOT paving project is scheduled for July of this year.

Parker Street This project consists of replacing 900 feet of sewer pipe and six manholes in the Davis Brook subsection. The project will replace a failing brick line running through back yards and redirect flow to new line in the street. Some segments of existing VC pipe will also be replaced. This project, which will reduce inflow and infiltration (I/I) and improve sewer accessibility in the subsection. The project is currently under construction and the City anticipates its completion by the end of June 2020.

Griffin-Bolling This project in the Airport subsection consists of repairs recommended in the LTCP as a result of the Phase II SSES. The project includes the replacement of 1,900 linear feet of 8” PVC sanitary sewer main, approximately 400 linear feet of 12” HDPE storm drain, and approximately 270 linear feet of 18” HDPE storm drain and associated sewer manholes and catch basins along portions of Griffin, Bolling, and Randolph Streets. The project is currently under construction with a contract completion date of August 28, 2020.

First Street This project consists of constructing new sewer lines on First Street to replace a brick sewer constructed in 1871 at one end and a private sewer constructed about the same time at the other end. All buildings will be reconnected to the new lines. This project is in the Davis Brook subsection. The project is currently under construction and includes approximately 590 linear feet of 15” PVC sanitary sewer main, approximately 85 linear feet of 12” HDPE storm drain, and associated sewer manholes and catch basins along portions of First Street. The Contract completion date for this project is August 28, 2020.

Wing Park This project will re-route a sewer line with four 90° angles running through private property that has experienced sanitary sewer overflows (SSOs) in past years. The new line will be constructed in the City right-of-way in the Carr Brook subsection. Adjacent failing sewer segments will also be replaced. The project is in the final stages of design and the City is expecting to advertise the project for construction in early July of 2020. The project start date has been move to fall of 2020 as it is now being developed with the Bangor Water District to allow for watermain upgrades within the project area.

II. Collection System Assessments and Maintenance

CCTV Assessments – The City has inspected 55,000 linear feet (7.8%) of sewer main January 1 through May 31, 2020. This includes CCTV inspections that were part of the SSES work done in Davis Brook subsection, further described in the Section IV below. A map showing the locations of inspected pipes is attached as Exhibit A.

Manhole Assessments – The City has completed 518 (15.5%) manhole inspections January 1 through May 31, 2020. This includes inspections in the Davis Brook subsection described in Section IV below. A map showing the locations of inspected manholes is attached as Exhibit B.

Cleaning – The City has flushed 33,000 linear feet (4.6%) of sewer main January 1 through May 31, 2020. The attached Exhibit C shows the location of the flushed pipes.

Recently, the City has also cut back approximately 40 protruding sewer services within City sewer mains to allow for camera inspection and improve flow conditions within the sewer mains.

The City has continued its program to review grease trap maintenance records before issuing licenses to victualers. The City Clerk’s office forwards license renewals and grease trap logs to the Code Enforcement Office and Engineering for review. Engineering reviews records and CCTV footage to determine if grease has been found in the sewer main downstream of the facility. If so, the Code Enforcement Office works with the food service establishment to educate staff on proper grease disposal and grease trap maintenance. Some licenses have been renewed contingent on increased grease trap maintenance.

III. Sanitary Sewer Overflow (SSO) Update

The following is a summary of SSOs that occurred between January 1 and May 31, 2020:

On January 26, 2020, the sewer crew was flushing the sewer main on Fairways. A resident at 21 Fairways reported that a small amount of clear water spilled from their toilet. The resident

had cleaned the water with a towel. The sewer crew reduced the pressure of the jet to prevent recurrence.

On March 2, 2020, water was observed to be leaking through the pavement at the intersection of Broadway and State St. Bangor Water District suspected the water to be sewer based on the odor of the sample they had collected. Sewer crew members inspected nearby manholes and found the sewer lines flowing freely. On March 3rd, an emergency dig in the general vicinity of the observed leakage revealed that a private sewer line had been damaged, likely as a result of a nearby sewer-stormwater separation project conducted in October of 2018. The damaged line was repaired and a new manhole installed. After an investigation, including dye testing and CCTV work, the City was unable to determine the number and/or source of connections to the private line. The City attempted to attempt to quantify the amount of the release, however, without the ability to confirm the source of flow (sanitary, groundwater, basement sumps, etc.) and lacking upstream access to judge time/velocity of flow, staff were unable to visually calculate gpm for current flow. Further, the City was unable to account for seasonal flow changes, considering the duration can be assumed to have been as long as 17 months.

On April 3, 2020, the Davis Brook Storage Conduit (DBSC) filled during a 1.3” rain event. The DBSC had recently been exposed due to excavation at the Davis Brook Storage Tank (DBST) project site. At 07:00, WWTP staff observed the DBSC leaking from several seams and discharging to the excavation area. Operations were immediately adjusted at the WWTP, the water was pumped back into the collection system and a grade stake was monitored every 30 minutes to determine level of water at the excavation site. The leaking ceased at 14:54. The total volume was calculated as 181,525 gallons. Repairs to the DBSC were made from April 6-8, 2020.

On April 13, 2020, a 1.5” rain event, preceded by an 8” snow storm, overwhelmed the collection system. Several small leaks were observed at the DBSC. The water was diverted to sumps installed at the DBST excavation site and pumped back into the collection system. The volume was estimated to be <32,400 gallons. The sewer crew began walking cross-country lines to inspect for evidence of SSOs. These inspections were completed on April 16, 2020. The following manholes showed evidence of surcharge in the immediate vicinity of the manholes:

• Kenduskeag Interceptor between Pushaw Rd. and Griffin Rd. manhole KI078, KI086,KI088, KI089 and KI091.

• Penobscot Interceptor, manhole EP029 behind Eastern Maine Medical Center, ManholeHK200 near Hancock St., and the sewer line to the Harbor Master Building located at64 Front St.

The sewer crew cleaned debris and applied lime in the surcharged areas. The Parks and Recreation Department was required to install a back-flow preventer on the sewer line to the Harbor Master building. On April 22, 2020, the DBSC repairs were extended north and south of the original repairs. Repairs were completed on April 23, 2020.

All SSOs were reported to Maine DEP, as required.

IV. Sewer System Evaluation Survey (SSES) Update

The crews have been conducting CCTV pipe inspections and manhole inspections in the Davis Brook, Barkersville, and Kenduskeag West subsections during high groundwater. The CCTV footage and manhole reports are reviewed for quality and completeness. Investigations are approximately 90% for the Davis Brook subsection, 80% for the Barkersville subsection, and approximately 60% complete for the Kenduskeag West subsection.

V. Long Term Control Plan (LTCP) Update

At this time there are no LTCP updates to report other than the projects listed above.
