Florida law says associations can buy condo units and lease or sell them

Q. The owners are suspi-cious of a former board mishandling funds and

possibly embezzling funds from our association’s accounts. We have heard that once the former board was out for over a year that the new board or any owner cannot file any charges against the former board mem-bers. Is this true?

A. There is a legal term called the statute of limitations that limits

the right of a harmed party, such as the association, from bringing suit against the party who caused the harm, such as the former board members who allegedly embezzled money from the association’s

accounts. Depending on the amount embezzled, a claim against a board member (or former board member) must be brought against such a person within four or five years for such alleged embezzlement. Otherwise, the association’s claim may be forever barred even with the strongest evi-dence.

Q. We have an owner that always sends in records requests asking for nu-

merous documents to be cop-ied that takes an extraordinary amount of time to prepare. may the association charge for this time?

A. The association may charge time for person-nel to gather and copy

documents at a rate not to exceed $20 per hour. However, the association may not charge if the time takes less than 30 minutes or if the number of pages to copy is 25 pages or less. The association may also charge 25 cents per page after the first 25 pages.

Q. Our association recently purchased one of the units in our condo asso-

ciation. Shortly thereafter, the board decided to lease out the unit. Is this legal?

A. Yes, unless the govern-ing documents of the association prohibit

it. Under Florida law, unless the governing documents say otherwise, the association has the power to purchase units in the association and to lease or sell such units. This usually occurs when the association forecloses on a unit owner who fails to pay their monthly or quarterly assessments and ends up taking title after the foreclosure is over.

What separates you from other Realtors? Passion, Pres-ence, Knowledge, The Law, Serious Negotiating Skills. I’m 45. If I were 15 years younger, there might be a spot for me on “million Dollar Listing”. congrats to Samantha, chad and chris for bring-ing the show to miami. 

Which neighborhoods/ar-eas are your specialty? Not so much an area but a price point. I rou-tinely represent properties exclusively above One million Dollars. I now have an office at 1700 E. Las Olas blvd., so I will be aggressively pursuing market share on the East side.

Describe your working style? casual but intense. I’m not wearing flip-flops but I’m not really a suit and tie guy either. I ALWAYS answer my phone and my clients know I am available 24/7. I don’t stop.

What advice do you have for buyers? Indecision is your enemy. You don’t need to make hasty decisions but if you like something, act!

What advice do you have for sellers? Hire the best and brightest to list your home for sale. Interview more than one agent. Good agents don’t fear competition. Their cli-ents and track record do all the talking.

how does what you’ve learned about real estate help your clients?

Tremendously! It allows them to be themselves. They can be calm, cool, collected or complete basket-cases. It doesn’t matter because they have mE. I’ve negotiated hundreds of successful transactions. I am tactfully aggressive, with a no-nonsense approach. They un-derstand that I am in complete control of their real estate affairs. It’s all good.

What’s the hottest listing you have right now? Loaded question as the properties I represent have all the bells and whistles that buyers want.

Following a very untraditional, unique and long-winding path into real estate (attorney and institutional trader), ultimately providing me serious edge, street cred and a fantastic career helping buyers and sellers in the luxury market.

Are you involved in any charitable organizations?

For years I have devoted time and money to relay For Life, Wounded War-rior Project, Fisher House Foundation, Humane Society of broward county and a host of animal charities/shelters as my family and I are passionate about dogs and horses.  

What’s one thing people would be surprised to know about you?

For as hardcore as I am in the field or at the office when I am working, I really like to read, write, relax and spend time with my family.  I am as engaging as any of the guys you see on mDL in an agent capacity.  but at home, I’m just dad (LOL), hanging with my wife and kids, attending my daughter’s equestrian practices and competitions, or playing fetch with 1 of my 3 dogs.
