1) INTRODUCTION

Petroleum Exploration (Pvt.) Limited (PEL), a Pakistani Exploration and Production Company in private sector (hereinafter referred to as “the Company”), invites Sealed Bids from well-reputed Civil Construction Companies for the Civil Works described in the Schedule of Requirement (Bill of Quantities) as Annexure “B” enclosed. PEL requests that the following instructions are to be strictly adhered in submission of the Bid documents:

2) INSTRUCTIONS TO BIDDERS:

2.1 Only the Bids of bonafide recipients of the Tender Document will be entertained. Upon receipt of this invitation to tender, please confirm the receipt thereof immediately by fax, e-mail or courier to PEL at the following addresses:

In the event a potential bidder decides not to quote, please send us your decline via facsimile or e-mail.

2.2 PEL reserves the right to amend or revise the tender documents prior to the date set for the closing of the tender. All bidders will be informed of any such change through an Addendum to the tender.

2.3 Your quotation must reach on or before 1600 Hrs on October 07, 2013 in Sealed Envelopes which will bear words “Confidential” and Tender Enquiry No. PEL/BADIN-S/036/13 & PEL/BADAR-2/035/13.

2.4 PEL reserves the right to increase or decrease the quantities/scope of work or reject any or all bids and may not necessarily accept the lowest bidder without assigning any reasons what so ever.

2.5 For ease of comparison, prices are to be quoted item-wise, as described in the Schedule of Requirement (Bill of Quantities), (Annexure “B” & Annexure “C”).

2.6 PEL shall be free from any obligation of opening bids in the presence of bidders. PEL shall not be responsible for any costs / expenses incurred by the bidders in connection with the preparation / delivery of bid.

2.7 Bidder shall maintain high safety standards and comply with PEL’s HSE procedures.

2.8 PEL does not encourage advance payment. However, Mobilization/Fixed charges can be invoiced by the Contractor immediately on completion of mobilization of crew and equipments at the job site. The balance final amount of the bill will be paid

within 45-60 days of receipt of duly verified invoice by PEL’s after completion of work and final acceptance of the work performed by the Contractor.

2.9 Closing date of the Tender is October 07, 2013.

2.10 All quotations without exception shall firm and irrevocable for PEL acceptance for a minimum period of 90 days from the tender closing date.

2.11 CVs of all personnel up to the supervisor level to be deployed at site and indicated in the firm’s organ gram shall be supplied with the bid documents.

2.12 Contractor is to provide its profile, project schedule at the time of bidding.

2.13 Details of similar projects completed in the past five years shall be provided.

2.14 Complete list of current projects being executed by the bidder, with project cost, shall be provided with the bid.

2.15 Detailed list of manpower to be deployed for the project shall be provided.

2.16 The company (PEL) reserves the right to appoint one or more contractors dividing the job suitably for early completion if required.

ANNEXURE “A”

3. TERMS & CONDITIONS

The Bidders are expected to examine all instructions, forms, terms & conditions and specifications attached/included in these tender documents. Failure to furnish all information required by the tender documents or submission of a Bid not substantially responsive to the tender documents will be at the Bidder’s risk and may result in the rejection of their Bid.

1. BID PRICES:

Prices must be quoted on lump sum basis inclusive of all taxes and duties, indicating unit price and total Bid prices at the end.

2. ISSUANCE OF INTENT AND SERVICE CONTRACT

The Company shall inform the successful Bidder of its intent. The arrangements between PEL and the successful bidder shall be governed solely by a subsequent written Service Order or a Contract.

3. PAYMENT:

Payment will be made within 45-60 days after submission of Invoice/ Bill duly verified and supported by the authorized PEL representative.

Payment to the Contractor will be subjected to the deduction of withholding tax, as per prevailing Income Tax Laws of Pakistan (where applicable), Bidders claiming exemption must submit copy of Valid Tax Exemption Certificate.

4. COMPLETION PERIOD:

As mentioned in the Schedule of Requirement. However, the Bidder may quote the best possible completion period convenient to him. Earlier completion, if quoted, will be preferred.

1. TAXES AND DUTIES

A Contractor (foreign or a local) shall be entirely responsible for payment of all taxes, duties, levies, license fees, etc. incurred until completion of the contracted Services to the Company.

5. INSPECTION AND TEST

Please note that all civil construction materials are to be of very good quality and from reliable sources. PEL reserves the rights to inspect all materials, equipments tools and implements at Contractor’s works to ensure that the Contractor has the required capability, skill and workmanship to carry out the assigned Services.

6. HEALTH, SAFETY & ENVIRONMENT

Contractor(s) shall at all times comply with and shall cause its employees to abide by, all safety, security, health and environment rules and regulations in force at the site of the work or

otherwise prescribed by the laws of Pakistan. PEL shall not be responsible for any injury, death or any other accident suffered by the Contractor(s) during operation/execution of the Civil Works.

7. APPLICABLE LAW

The Contract shall be interpreted in accordance with the laws of the Pakistan.

4. SCOPE OF WORK-CIVIL WORKS-GENERAL

The Civil Scope of work includes, but is not limited to, furnishing of all equipments/Tools, skilled / unskilled labour, supervision & supply of all construction material /consumables which are required to perform all the operations in connection with the completion of the construction of well location in accordance with the attached Bill of Quantities , Annexure “B”

5. SPECIAL TERMS & CONDITIONS

Bidder is responsible to analyze and use appropriate equipment required to complete the work in time and meeting the specifications and standards.

The quantities given in the BOQ are estimated, payment will be made on the basis of actual physical quantities measured at the site.

PEL reserves the right to change/modify Location design drawing and quantities before or during construction phase to meet requirement of rig finally selected to drill PEL well location.

The financial proposal shall be in the form of BOQ, Annexure “B”.

6. EQUIPMENT

All equipments shall be inspected and approved by PEL’s representative before mobilization to site.

Please provide a complete list of equipment to be deployed for the project. Contractor’s equipment and materials stored at the plant site must meet plant

safety regulation and all kind of preventive measures shall be taken against fire, theft, and all other workplace hazards.

PEL reserves the right to inspect and verify the Contractor’s work being done at any stage and may stop the work if not according to specifications, standard & grades.

7. TIMELY COMPLETION OF THE PROJECT

If the Contractor feels delay in progress of the work, he shall work overtime and use all such additional equipment and/or personnel as may be necessary in timely completion of the work within the dates specified in the Contract at no additional cost to the Company (PEL).

8. PENALITY CLAUSE

In case the work has been delayed except Force Majeure a penalty equivalent to 5% per week of the total value of the Contract will be imposed on the Contract and will be deducted from the final invoice(s).
