Welcome to our new series of Interiors sales which offer an affordable and stylish mixture of decorativeobjects, pictures and works of art for your home, reflecting the current zeitgeist for the eclectic and the individual!

Our wonderful Georgian saleroom has been given a facelift and will be beautifully arranged and easy to browsearound. The undoubted highlight of the sale is a lovely collection from an apartment at Culzean Castle(page 20) however also worth mentioning is an interesting collection from Scottish institution Inhouse (page 45)as well as over 100 paintings ranging from George Henry to John Bellany.

The sale will be on view for two days preceding the auction, including an evening view on Thursday 24th, so comealong and have look at what we have on offer. We are happy to answer any questions you may have includingadvice about restoration, and guide you through the auction process. Although Sylvia Wishart, who has died aged 72,was one of Scotland's leading contemporarylandscape painters, the work of this very privateand self-effacing artist is little known outside asmall circle of friends, admirers and fellowartists. Highlights from the Sale

Potschappel jardinière

This item, from our Culzean Castle apartment collection, really appeals to me asan antique piece with a modern look. It certainly has a contemporary 'vintage'feel with its pretty floral design, but in fact it was made by a well known Germanporcelain factory during the early 20th century and I really appreciate its shapeand hand painted quality. I think it would be lovely with some fresh flowers in it -or you could use it as a very smart waste paper bin!

East meets West

In keeping with my Scottish roots, I have alsochosen a painting by Glasgow Boy GeorgeHenry. This picture, entitled 'A JapaneseTheatre', is particularly interesting as it wascreated during a period when Henry travelledin Asia. The images that he created at thistime had a far reaching influence in his workand many other Glasgow artists.Unfortunately many of the pictures which datefrom this time abroad were destroyed onboard the ship on the return journey, meaningthis painting is a rare survivor of thisimportant period in the artist’s career.

Taxidermy trio

Part of my job at Lyon & Turnbull is working with natural history and taxidermy, so I've developed a realinterest and fondness for such pieces.

This trio of African buffalo is a really fantastic group just waiting to transform a big open space andcreate a bit of character in a room. Despite being traditional antique taxidermy, the in-swept heads ofthe companion buffalo create a bold and impressive display without being too formal or austere.

Sylvia WishartSylvia Wishart, one of Scotland'sleading contemporary landscapepainters, is little known outside asmall circle of friends, admirers andfellow artists. After several years ofteaching in Aberdeenshire, Lewisand Orkney, she returned to Gray'sSchool of Art in Aberdeen in 1969 asa lecturer. She made her home inHowe of Tarty, and it was there, inthe landscape of the Ythan estuary,that her true voice began to emerge.

She had a studio initially on the pierat Stromness, which became thePier Art Centre to house thecollection of her great friendMargaret Gardiner when therefurbished gallery opened in July2007, it was with an exhibition ofSylvia Wishart drawings.

In 2005 Wishart was voted a fullmember of the Royal ScottishAcademy. Her works are also in thecollections of the Arts Council ofGreat Britain, the Contemporary ArtsSociety, Aberdeen Art Gallery,Aberdeen Royal Infirmary, the PierArts Centre and Orkney Museumsand Heritage, and also her workhangs in many homes on Orkney.

Situated on the banks of the River Tweed,near Berwick-upon-Tweed, Paxton Housewas designed by John and James Adam in1758. It is perhaps the finest example of aneighteenth-century Palladian country housein Britain and contains a pre-eminentcollection of Chippendale furniture.

The house boasts the single largestpurpose-built picture gallery in any Scottishcountry house, and today this galleryfocuses on British art from 1760 to 1840,taken from the National Galleries ofScotland’s collection and containing worksby Raeburn, Wilkie and Lawrence, amongothers.

As well as art, antiques and architecture,the house also features eighty acres ofaccessible gardens, woodland andparkland.

A Collection from a PrivateApartment at Culzean CastleIntroductionThere has been a tower house at Culzean since the 1400s,however the recorded history of Culzean properly starts in1569 when Sir Thomas Kennedy was given the Culzeanestates by his brother, the 4th Earl of Cassillis. CulzeanCastle as we know it today was constructed as an L-plancastle by order of the 10th Earl. He instructed the architectRobert Adam to rebuild a previous, but more basic,structure into a fine country house to be the seat of hisearldom. The castle was built in stages between 1777 and1792. It incorporates a large drum tower with a circularsaloon inside (which overlooks the sea), a grand ovalstaircase and a suite of well-appointed apartments.

In 1945, the Kennedy family gave the castle and its groundsto the National Trust for Scotland (thus avoiding inheritancetax). In doing so, they stipulated that the apartment at thetop of the castle be given to General of the Army Dwight D.Eisenhower in recognition of his role as SupremeCommander of the Allied Forces in Europe during theSecond World War. The collection featured in this salecomes from one of these beautiful apartments in the castle,overlooking the rugged coastline of Ayrshire.

Cassillis HouseThe Kennedy family family also had a residence at nearbyCassillis House, a well-preserved and considerablymodernised mansion comprising a 14th-15th century towerremodelled in the 17th century. The house and its contentswere sold in 2009 and there are a number of lots from thatsale in the present collection. Significant lots include thescale model of the R.Y.S. Cayman, with the paintedbackdrop of Culzean Castle, as well as an impressivemahogany four poster bed.

The Dining RoomThe dining room, with its wonderful sea views to the Isle ofArran, contains some of the most handsome pieces offurniture within the collection. Highlights include themahogany dining table in the Gillows style; a largemahogany cellarette and two George III mahoganysideboards, all essential to the 18th century dining room.As quality antique pieces with good condition and colour,they are ready to use in your own dining room.

9. THIRD PARTY LIABILITY

All members of the public on ourpremises are there at their own riskand must note the lay-out of theaccommodation and securityarrangements. Accordingly neitherthe auctioneer nor our employees oragents shall incur liability for death orpersonal injury (except as required bylaw by reason of our negligence) orsimilarly for the safety of the propertyof persons visiting prior to or at a sale.

10. COMMISSION BIDS

While prospective buyers are stronglyadvised to attend the auction and arealways responsible for any decision tobid for a particular lot and shall beassumed to have carefully inspectedand satisfied themselves as to itscondition we shall if so instructedclearly and in writing execute bids ontheir behalf. Neither the auctioneer orour employees or agents shall beresponsible for any failure to do so.Where two or more commission bids atthe same level are recorded we reservethe right in our absolute discretion toprefer the first bid so made.

11. WARRANTY OF TITLE ANDAVAILABILITY

The seller warrants to the auctioneerand to you that the seller is the trueowner of the property consigned or isproperly authorised by the true ownerto consign it for sale and is able totransfer good and marketable title tothe property free from any third partyclaims.

12. AGENCY

The auctioneer normally acts as agentonly and disclaims any responsibilityfor default by sellers or buyers.

13. TERMS OF SALE

The seller acknowledges that lots aresold subject to the stipulations of theseConditions in their entirety and on theTerms of Consignment as notified tothe consignor at the time of the entryof the lot.

14. STANDARD VENDOR FEESAND CHARGES(Subject to VAT)

(1) Commission: 15% of the first £3000and 10% thereafter is charged on theselling price of each lot (subject to aminimum charge of £30). Loss anddamage warranty: 1.5% on value of lotssold. Photography: max £40 mono perlot, max £250 colour. InternetMarketing Service: £10 per lot.

(2) If a vendor wishes to withdraw a lotorganized for sale, a withdrawal fee willapply;

(a) If withdrawn over 28 working daysprior to the sale, this will be charged at10% of the mid estimate along with anyancilliary incurred (such asphotography), all subject to VAT at thecurrent rate.

(b) If withdrawn within 28 working daysof the sale, this will be charged at 20%of the mid estimate along with anyancilliary incurred (such asphotography), all subject to VAT at thecurrent rate.

15. DESCRIPTIONS ANDCONDITION

(1) While we seek to describe lotsaccurately, it may be impractical for usto carry out exhaustive due diligence oneach lot. Prospective buyers are givenample opportunities to view andinspect before any sale and they (andany independent experts on theirbehalf) must satisfy themselves as tothe accuracy of any description appliedto a lot. Prospective buyers also bid onthe understanding that, inevitably,representations or statements by us asto authorship, genuineness, origin,date, age, provenance, condition or

estimated selling price involve mattersof opinion. We undertake that any suchopinion shall be honestly andreasonably held and accept liability foropinions given negligently orfraudulently. Subject to the foregoingneither we the auctioneer or ouremployees or agents or the selleraccept liability for the correctness ofsuch opinions and all conditions andwarranties, whether relating todescription, condition or quality of lots,express, implied or statutory, arehereby excluded. This Condition issubject to the next following Conditionconcerning deliberate forgeries andapplies save as provided for inparagraph 6 “information to buyers”.

(2) Private treaty sales made underthese Conditions are deemed to besales by auction for purposes ofconsumer legislation.

16. FORGERIES

Notwithstanding the precedingCondition, any Lot which proves to be adeliberate forgery (as defined) may bereturned to us by you within 21 days ofthe auction provided it is in the samecondition as when bought, and isaccompanied by particulars identifyingit from the relevant cataloguedescription and a written statement ofdefects. If we are satisfied from theevidence presented that the lot is adeliberate forgery we shall refund themoney paid by you for the lot includingany buyer’s premium provided that (1) ifthe catalogue description reflected theaccepted view of scholars and expertsas at the date of sale or (2) youpersonally are not able to transfer agood and marketable title to us, youshall have no rights under thiscondition.

The right of return provided by thisCondition is additional to any right orremedy provided by law or by theseConditions of Sale.

GENERAL

17. We shall have the right at ourdiscretion, to refuse admission to ourpremises or attendance at our auctionsby any person.

18 (1) Any right to compensation forlosses liabilities and expenses incurredin respect of and as a result of anybreach of these Conditions and anyexclusions provided by them shall beavailable to the seller and/or theauctioneer as appropriate.

(2). Such rights and exclusions shallextend to and be deemed to be for thebenefit of employees and agents of theseller and/or the auctioneer who maythemselves enforce them.

19. Any notice to any buyer, seller,bidder or viewer may be given by firstclass mail in which case it shall bedeemed to have been received by theaddressee 48 hours after posting.

20. Special terms may be used incatalogue descriptions of particularclasses of items (Books, Jewellery,paintings, guns, firearms etc) in whichcase the descriptions must beinterpreted in accordance with anyglossary or guidance notes appearingin the catalogue. These notices andterms will also form part of our termsand conditions of sales.

21. Any indulgence extended to biddersbuyers or sellers by us notwithstandingthe strict terms of these Conditions orof the Terms of Consignment shallaffect the position at the relevant timeonly and in respect of that particularconcession only; in all other respectsthese Conditions shall be construed ashaving full force and effect.

22. Scottish law applies to theinterpretation of these Conditions.

Lyon & Turnbull carries on businesswith bidders, buyers and all thosepresent in the auction room prior to, orin connection, with a sale on thefollowing General Conditions and onsuch other terms, conditions andnotices as may be referred to herein.

1. DEFINITIONS

In these Conditions:

(a) “Auctioneer” means the firm ofLyon & Turnbull or its authorisedauctioneer, as appropriate;

(b) “deliberate forgery” means animitation made with the intention ofdeceiving as to authorship, origin, date,age, period, culture or source butwhich is unequivocally described in thecatalogue as being the work of aparticular creator and which, at thedate of the sale, had a value materiallyless than it would have had if it hadbeen in accordance with thedescription;

(c) “hammer price” means the level ofbidding reached (at or above anyreserve) when the auctioneer bringsdown the hammer;

(d) “terms of consignment” means thestipulated terms and rates ofcommission on which Lyon & Turnbullaccepts instructions from sellers ortheir agents;

(e) “total amount due” means thehammer price in respect of the lot soldtogether with any premium, ValueAdded Tax chargeable and anyadditional charges payable by adefaulting buyer under theseConditions;

(f) “sale proceeds” means the netamount due to the seller, being thehammer price of the lot sold lesscommission at the stated rate, ValueAdded Tax chargeable and any otheramounts due to us by the seller inwhatever capacity and however arising;

(g) “You”, “Your”, etc. refer to the buyeras identified in Condition 2.

(h) The singular includes the pluraland vice versa as appropriate.

2. BIDDING PROCEDURES ANDTHE BUYER

(a) Bidders are required to registertheir particulars before bidding and tosatisfy any security arrangementsbefore entering the auction room toview or bid;

(b) the maker of the highest bidaccepted by the auctioneer conductingthe sale shall be the buyer at thehammer price and any dispute about abid, which must be raised before thenext lot is offered, shall be settled atthe auctioneer’s absolute discretion.

(c) Bidders shall be deemed to act asprincipals.

(d) Once made, no bid may bewithdrawn.

(e) Our right to bid on behalf of theseller is expressly reserved up to theamount of any reserve and the right torefuse any bid is also reserved.

3. INCREMENTS

Bidding increments shall be at theauctioneer’s sole discretion.

4. THE PURCHASE PRICE

The buyer shall pay the hammer pricetogether with a premium thereon.

25% up to £25,000 / 20% thereafter.

VAT will be charged on the premium atthe rate imposed by law.

5. VALUE ADDED TAX

Value Added Tax on the hammer priceis imposed by law on all items affixedwith an asterisk (*) or dagger (†).Value Added Tax is charged at theappropriate rate prevailing by law atthe date of sale and is payable bybuyers of relevant lots.

6. PAYMENT

(1) Immediately a lot is sold you will:

(a) pay to us the total amount due incash or in such other way as is agreedby us. We accept cash, bank transfer(details on request), Switch or DebitCards and Visa or MasterCard (pleasenote there is a surcharge of 2% (VATincluded) when using credit cards). Wedo not accept American Express.

(2) any payments by you to us may beapplied by us towards any sums owingfrom you to us on any accountwhatever without regard to anydirections of you or your agent,whether express or implied.

7. TITLE AND COLLECTION OFPURCHASES

(1) The ownership of any lotspurchased shall not pass to you untilyou have made payment in full to us ofthe total amount due.

(2) You shall at your own risk andexpense take away any lots that youhave purchased and paid for not laterthan four working days following theday of the auction or upon theclearance of any cheque used forpayment after which you shall beresponsible for any removal, storageand other associated charges.

(3) No purchase can be claimed orremoved until it has been paid for.

(4) It is the buyer’s responsibility toascertain collection procedures,particularly if the sale is not being heldat our main saleroom and the potentialstorage charges for lots not collectedby the appropriate time.

8. REMEDIES FOR NON-PAYMENT OR FAILURE TOCOLLECT PURCHASES

(1) If any lot is not paid for in full andtaken away in accordance with theseConditions or if there is any otherbreach of these Conditions, we, asagent for the seller and on their behalf,shall at our absolute discretion andwithout prejudice to any other rights wemay have, be entitled to exercise one ormore of the following rights andremedies:

(a) to proceed against you for damagesfor breach of contract;

(b) to rescind the sale of that lotand/or any other lots sold by us to you;

(c) to resell the lot (by auction orprivate treaty) in which case you shallbe responsible for any resultingdeficiency in the total amount due(after crediting any part payment andadding any resale costs). Any surplusso arising shall belong to the seller;

(d) to remove, store and insure the lotat your expense and, in the case ofstorage, either at our premises orelsewhere;

(e) to charge interest at a rate of 1.5%per month above the current base rateon the total amount due, to the extent itremains unpaid for more than fourworking days after the sale;

(f) to retain that or any other lot sold toyou until you pay the total amount due;

(g) to reject or ignore bids from you oryour agent at future auctions or toimpose conditions before any such bidsshall be accepted;

(h) to apply any proceeds of sale ofother lots due or in future becomingdue to you towards the settlement ofthe total amount due and to exercise alien (that is a right to retain possessionof) any of your property in ourpossession for any purpose until thedebt due is satisfied.

(2) We shall, as agent for the sellerand on their behalf pursue these rightsand remedies only as far as isreasonable to make appropriaterecovery in respect of breach of theseConditions
