Subject: Non-Implementation of Alternative Medicines & Health Products (Enlistment) Rules 2014, S.R.O 412 has opened a massive door for Corruption.

Dear Sirs,

Transparency International Pakistan has received complaint that the Non-Implementation of Alternative Medicines & Health Products (Enlistment) Rules 2014, S.R.O 412 has opened a massive door for Corruption in Pakistan.

The complainant has made following allegations;

That;

1. Alternative Medicines are being marketed in Pakistan since 194 7 without any regulations & standards. This sector includes the Homeopathic, Unani, Ayurvedic, Chinese, Herbal Medicinal Products, Neutraceutical, Cosmeceuticals, Probiotics, Disinfectants, Nutritional Products, Baby Food and Baby Milk Products. Therefore, to regulate alternate medicines also, the Drug Regulatory Authority of Pakistan ( DRAP) Act 2012 was empowered to regulate alternate medicines, and to notify Rules with prior approval of Federal Government.

2. Alternative Medicines & Health Products (Enlistment) Rules 2014 were framed & notified with the approval of the competent authority on 2ih May, 2014 as an S.R.O 412(!)/2014.

3. Only 350 applicants were qualified out ofthousands of applicants by DRAP and only about 350 manufacturers and importers are allowed to continue their business under the new rules. Annex-A.

4. This is to point out that there is no difference between registered and non-registered importers and manufacturers and the purpose of Alternative Medicines & Health Products (Enlistment) Rules 2014 is not achieved.

5. Non-implementation of enforcement has put the life of millions of people in Pakistan at risk. Attached report has been sent to DRAP Authorities from Punjab Government pointing out the sad incidence of death of Body Builders in Lahore, Gujranwala & Sialkot who were using Nutritional Supplements containing steroids and other prohibited substances;

6. It is further pointed out that NAB Prevention Committee of Health & Enlistment also directed DRAP Authorities that initial action may be initiated against the non-filers and umegistered importers and manufacturers ofNeutraceutical Products. (Ref: DRAP letter# F. 10-5/2014-DDC (Health & OTC)(PT) dated 141

7. A letter in this regard was also was sent by Health & OTC department (Ref: No.F.4-772/2016-DDC (Health & OTC) to Collector Custom Karachi with the request not to clear umegistered products (Alternative Medicines). Annex-C.

8. Directorate of Health & OTC is working hard to implement the rules, but the controlling mechanism of sales of spurious and unregistered products is the domain of Provincial Governments, and this is the direct responsibility of Provincial Health Secretaries, through provincial drug inspectors.

9. The Provincial Health Authorities have not taking any legal action against the powerful and corrupt Maafia Involved in sales of unregistered and spurious products and playing with innocent human lives.

The Chief Ministers are requested to taken up this serious matter as the annual sale of Alternative Medicines & Health Products is over Rs. 1000, billion, and unregistered manufacturer have made it a business to fleece public by selling sub standard drugs. The Health Secretaries of the provinces may be directed for implementation of Rules & Regulations issued under S.R.O 412(I)/2014with true letter & spirit. An immediate crackdown may also be started against thousands of unregistered manufacturers and importers.

Transparency International Pakistan is striving for across the board application of Rule of Law, which is the only way to stop corruption.

ternative Medicine & Health Product (Enlistment) Rules, 2014. Relevant Pharmacopeias of

omeopathy, Ayurvedic, Siddha, Unani, Biochemic, Chinese and other herbal medicines have been

prescribed in the DRAP Act, 2012 and rules framed there under.
