Welcome to the International Property Collection, Gibraltar Edition, Autumn 2013

We welcome you to the Autumn Edition of our Gibraltar property magazine.

Gibraltar has not only withstood the economic plight of the last few years, but has continued its economic growth seemingly unabated. The low tax base in a well regulated EU jurisdiction ensures that Gibraltar is an attractive proposition at any time of an economic cycle. With corporation tax at 10%, income tax peaking at an effective rate of 25% (much lower for qualifying high net worth individuals), and no wealth, capital gains or inheritance tax, Gibraltar is appealing to both individuals and companies willing to relocate to save costs.

It is this firm fiscal foundation that is creating the current supply and demand imbalance at both ends of the residential property price range and in both the sales and lettings markets.

In response to the increase in the number of high net worth individuals seeking to relocate to Gibraltar, two property developments aimed at the higher end buyer are currently under construction. Phase one of Buena Vista Mews is a collection of six villas and nine townhouses in the south district. Phase one of the development has sold out with the first completions by Easter 2014. We are now taking client registrations for the second phase, six bespoke villas, built to client’s specifications.

The true measure of Gibraltar’s increasing attraction to the higher net worth client is the recent launch of the Sanctuary, five huge and exquisitely designed exclusive villas adjacent to Gibraltar’s Nature Reserve affording panoramic views across the Strait of Gibraltar to Africa. At the end of 2012, Spain introduced stringent disclosure requirements on its tax residents relating to non-Spanish assets, the impact of which has been a migration of cross border workers returning to or moving into Gibraltar for the first time. As a result, the supply of rental apartments has significantly reduced and any apartment below £2,000 per calendar month is now in short supply. Indeed, we are usually able to place these with waiting applicants prior to marketing. This short supply of affordable rental properties, has led to would-be tenants becoming property buyers, resulting in a significant tightening of the sales market and property prices up to circa £600,000. This trend is set to continue up the property value curve.

Quality office accommodation is also in short supply. Personal Income TaxIndividuals can opt to be taxed under one of two systems, whichever is most advantageous.

(i) High Net Worth Individuals (Category 2)Persons with net wealth of £2M+ can apply to pay tax only on their first £80,000 of taxable income, equivalent to tax of approximately £29,000, but subject to a minimum of £22,000.

(ii) High Executive Possessing Specialist Skills status (“HEPSS”)Relocating executives with relevant skills pay tax only on the first £120,000 of their assessable income (maximum tax approximately £30,000). A minimum salary of £100,000 is required.

QROPSIt is possible to transfer a UK pension to Gibraltar under QROPS rules. A tax free lump sum of 30% is available and with income drawdowns subject to income tax at a flat rate of 2.5%.
