The Privacy and Civil Liberties Oversight Board is in receipt of your appeal dated January 27, 2017. You have appealed the decision dated January 27, 2017. In your initial request, dated January 17, 2017, you requested "a copy of the PCLOB Intranet (employee-only website) home page" and "a copy of each page linked to the PCLOB Intranet home page by one click (i.e., one level down)." The decision informed you that your request could not be processed as a proper request under the Freedom oflnformation Act (FOIA) because the subject matter on your request is not a "record" under the FOIA.
Your appeal letter challenges the initial finding as erroneous, and asks that the request be processed in good faith. I have conducted a review of the FOTA Officer's assessment and determination, and considered the documentation provided in your appeal. I conclude that there was a reasonable basis for the FOIA Officer's determination; however; I have decided to exercise my discretion as the PCLOB's FOIA Appeals Authority and grant your request. Accordingly, I am releasing 11 pages to you, which are enclosed.
As noted in the PCLOB's Semi-Annual Report, the agency is upgrading its intranet. The upgrade is currently in progress. The first page produced is the homepage used by staff to access the intranet at intranet.pclob.gov. The remainder of the pages produced are the links one click down from the homepage. Additionally, the older version of our intranet on SharePoint is linked to the homepage at intranet.pclob.gov.

What is the Privacy and Civil Liberties Oversight Board?
The Board is an independent, bipartisan agency within the executive branch established by the Implementing Recommendations of the 9/11 Commission Act, Pub. L. 110--53, signed into law in August 2007. Comprised of four part-time members and a full-time chairman, the Board is vested with two fundamental authorities: (1} To review and analyze actions the executive branch takes to protect the Nation from terrorism, ensuring the need for such actions is balanced with the need to protect privacy and civil liberties and (2) To ensure that liberty concerns are appropriately considered in the development and implementation of laws, regulations, and policies related to efforts to protect the Nation against terrorism.
