“ “According to the Foreign Investment Agency (FIA), Viet Nam has attracted US $18.47 billion worth of FDI capital in the first 6 months of 2019, or 90.8% of last year’s figure.

As of 20th June 2019, a total of 1,723 new foreign-invested projects, worth US $7.41 billion, were granted licenses, while 628 projects registered to increase their capital by a total of US $2.94 billion. Viet Nam also posted nearly US $8.12 billion worth of capital contribution and share purchases, up 98.1% compared to the corresponding period last year.

Manufacturing remains the most attractive sector for foreign investors, having at-tracted US $13.15 billion, accounting for 71.2% of the total registered FDI capital, fol-lowed by real estate with a total registered capital of US $1.32 billion, while wholesale and retail came in third with a total registered capital of US $1.05 billion. Of the 95 countries and territories supplying FDI to Viet Nam, Hong Kong has become the largest source of foreign investment, registering to invest US $5.3 billion, making up 28.7% of the total FDI. The Republic of South Korea came second, pumping in US $2.73 billion or 14.8% of the total FDI, followed by China with US $2.29 billion (12.4%).

As of October 20th, the country had a cumulative number of 28,954 foreign-invested projects with total registered capital of $351.66 billion, and over half of the FDI capital had been disbursed.

The EU-Vietnam Free Trade Agreement (EVFTA) and the EU-Vietnam Investment Promotion Agreement (EVIPA) were officially signed today in Hanoi, with expectations of giving a big push for trade and investment.

Vietnam’s credit growth in the first half of 2019 was estimated at 6.22%, higher than the 6.1% growth rate recorded during the same the period of last year.

The investors selected to develop the North-South Expressway will have to have successfully developed at least one similar project in an overseas market.

The total import-export turnover in the first six months of 2019 was estimated at US$245.48 billion, the highest ever level among the six-month figures, announced the General Statistics Office of Vietnam (GSO) on June 28th.

Most localities in Central Vietnam have borders with Laos or Cambodia, which is a great opportunity for the region to approach trade with the vast ASEAN community.

The Da Nang authorities have invited bids for building a bridge spanning the Co Co River in Ngu Hanh Son District’s Hoa Hai Ward.

The Da Nang authorities are planning to develop a project on promoting community-based tourism at the Tho Quang - Man Thai beach in Son Tra District.

Since its operation in 2007, the Khanh Son landfill site in Hoa Khanh Nam Ward, Lien Chieu District, Da Nang, has been an urban solid waste treatment facility with sanitary landfill technology.

01DECREE NO. 48/2019/ND-CP OF THE GOVERNMENT DATED JUNE 5TH 2010 PROMULGATING THE MANAGEMENT OF OPERATION OF VEHICLES USED FOR WATER RECREATION.On 05/6/2019, the Government issued Decision No. 48/2019/ND-CP promulgating the management of operation of vehicles used for water recreation.

The Decree consists of 05 chapters and 31 articles, which stipulate specific provisions on managing recreational water activities, active zones, vehicles registration and responsibilities of related units and organizations.The appendix of this Decree includes 12 forms for proposal and certification of operation eligibility used for managing recreational water vehicles.Pursuant to Clause 1, Article 5, active zones for recreational water activities consists of 2 zones:a) Zone 1: bodies of water on the inland waterways, seaport waters or maritime zones;b) Zone 2: bodies of water other than zone 1, marked and located by buoys or pennants with noticeable colors.Accordingly, time of day suitable for recreational water activities differs from zone 1 to zone 2 depending on actual decision made by the prescribed competent authorities regarding permission to organize recreational water activities in zone 1 and agreement and announcement of active zones in zone 2.

The Decree shall take effect from August 15th, 2019.

03DECISION NO. 20/2019/QĐ-TTG DATED JUNE 12TH, 2019 OF THE PRIME MINISTER DEFINING FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE BANKING SUPERVISION AGENCY UNDER THE STATE BANK OF VIETNAM.The decision includes 06 articles, specifying the position and functions, tasks and powers, organizational structure, leadership of the Inspection Agency, banking supervision, transitional terms, validity and responsibility. implementation of the Banking Supervision Agency under the State Bank of Vietnam.Accordingly, its organizational structure is as follows:- Department of Administrative Inspection (Department I);- Department of Policy for Safe Banking Operations (Department II);- Administrative Office;- Department of Banking Supervision I (Agency I);- Department of Banking Supervision II (Agency II);- Department of Banking Supervision III (Agency III);- Department of Supervision of Credit Institution System Safety (Agency IV);- Department of Anti-Money Laundering (Agency V).The Governor of the State Bank stipulates functions, tasks, powers and organizational structure of subordinate units under the Banking Supervision Agency.This Decision takes effect from August 1st, 2019.

On June 11th, 2019, the Ministry of Finance issued Circular No. 34/2019/TT-BTC on amending and supplementing a number of articles of Circular No. 40/2018/TT-BTC providing guidelines on initial offering of shares and management and use of proceeds from equitization of state-owned enterprises and single-member limited liability companies with 100% charter capital invested by state-owned enterprises, including:- Supplementing Article 9a stipulating principles for revising the charter capital structure;- Supplementing Clause 3 in Article 16 on handling Business Arrangement Support Fund as of December 31st, 2017;- Supplementing Article 20a stipulating the Responsibilities of the Members’ Council and Chairmen of state-owned enterprises.

This Circular takes effect from July 29th, 2019.

On June 12th, 2019, the Ministry of Finance issued Circular No. 35/2019/TT-BTC amending and supplementing a number of articles of Circular No. 115/2017/TT-BTC providing guidelines on the supervision of securities transactions in securities market, details as follows:- Amending Clause 11 of Article 4;- Amending and supplementing Clause 1 of Article 13;- Issuing Appendix I - Form No. 02 of Weekly Report to replace Form No. 02 - Appendix I of guidelines for supervision of securities transactions in the securities market;- Amending and supplementing Article 21 on Periodic monitoring reports.Circular No. 35/2019/TT-BTC also amended and supplemented the Circular No. 116/2016/TT-BTC dated October 25th, 2017 providing guidelines for the compliance supervision of the State Securities Commission on securities activities of the Stock Exchange and the Vietnam Securities Depository, as specified in Article 10 on Reporting of the State Securities Commission.

This Circular takes effect from August 1st, 2019.

On June 19th, 2019, the Government issued Decree No. 54/2019/ND-CP regulating the operation of karaoke services and nightclubs.The Decree consists of 04 chapters, 21 articles and an appendix containing 05 forms, stipulating business conditions and responsibilities of enterprises and business households; authority to issue, revise and revoke licenses for business eligibility; implementation responsibilities of agencies and units related to karaoke and nightclub services.Accordingly, Article 9 clearly specifies the authority to issue, revise and revoke licenses for operation of karaoke and nightclub services:- Culture authorities of provincial People’s Committees (licensing authorities) have the authority to issue, adjust and revoke the Operating License.

On June 24th, 2019, the Government issued Decree No. 55/2019/ND-CP on legal support for small and medium enterprises.

Accordingly, Chapter II of this Decree is divided into 2 sections, clearly defining legal support activities for small and medium enterprises.Section 1. Database development, management, maintenance, update, exploitation and use:+ Regarding legal documents (Article 5);+ Regarding legal problems, cases (Article 6);+ Regarding court verdicts and decisions; commercial arbitration awards; decision on competition cases; decisions on enterprises’ administrative violations (Article 7);+ Regarding the state agency’s written replies on legal problems of small and medium enterprises (Article 8);+ Regarding written legal advice provided by the network of legal counsellors and procedures for applying legal consultancy costs support (Article 9).Section 2. Developing and implementing legal support programs for small and medium enterprises:+ Development grounds and activities (Article 10);+ Timeline (Article 11);+ Planning and approval (Article 12);+ Implementation (Article 13);

This Decree takes effect from August 16th, 2019.

- The licensing authority may authorize the district-level culture authorities to issue, revise and revoke the Operating License in compliance with regulations and law on local governmental organization.

This Decree takes effect from September 1st, 2019.

07DECREE NO. 57/2019/ND-CP DATED JUNE 26TH, 2019 OF THE GOVERNMENT STIPULATING PREFERENTIAL EXPORT AND IMPORT TARIFF SCHEDULES FOR THE IMPLEMENTATION OF THE COMPREHENSIVE AND PROGRESSIVE TRANS-PACIFIC PARTNERSHIP AGREEMENT IN THE 2019 - 2022 PERIOD.On June 26th, 2019, the Government issued Decree No. 57/2019/ND-CP promulgating the preferential export tariff schedule and special preferential import tariff schedule implemented under the Comprehensive and Progressive Trans-Pacific Partnership Agreement for 2019 - 2022.

Accordingly, there are 2 appendices issued along with the Decree:- Appendix I - Preferential export tariff schedule under the CPTPP Agreement in the 2019 – 2022 period;- Appendix II - Special preferential import tariff schedule under the CPTPP Agreement in the 2019 – 2022 period. List of goods and special preferential import duty rates for used cars applying tariff-rate quotas under the CPTPP Agreement.

This Decree takes effect from June 26th, 2019.

On June 27th, 2019, the Prime Minister issued Decision No. 23/2019/QD-TTg promulgating the List of imported goods for which customs procedures at import border gates is compulsory.For imported goods included in this List, the person who does customs declaration may opt to perform this procedure at the Customs Sub-Departments at the border gate or at customs clearance points outside the border gate if it falls into the cases prescribed in Article 5.The List of imported goods subject to compulsory customs procedures at the border gate is developed based on the List of Import and Export Goods of Vietnam, which consists of 14 key commodities as follows:- Cigarettes, cigars and tobacco products used for smoking, inhaling, chewing, smelling, sucking;- Alcohol;- Beer made from malt;- Passenger cars of under 16 seats;- Aircrafts, yachts;- All types of petrol;
